in the entirety of the text - Full Text of Norm 285 Creates an opening in the Automated Customs Tariff with Technical Note 81 CITES Full Text of record: F94EE GENERAL CUSTOMS DIRECTORATE RESOLUTION OF GENERAL SCOPE Resolution RES-DGA-285-2013.—General Customs Directorate.—San José, at two o’clock in the afternoon on the fifth of September of two thousand thirteen.

1.—That article 11 of the General Customs Law, its current reforms and amendments, provides that “The General Customs Directorate is the national superior hierarchical body in customs matters. In the exercise of this competence, it is responsible for the technical and administrative direction of the customs functions that this law and the other provisions of the branch grant to the National Customs Service; the issuance of policies and directives for the activities of the customs offices and units under its charge; the exercise of customs powers and the decision on appeals filed before it by those administered.” 2.—That article 4 of the General Public Administration Law No. 6227 of May 2, 1978, establishes that “The activity of public entities shall be subject as a whole to the fundamental principles of public service, to ensure its continuity, its efficiency, its adaptation to any change in the legal regime or in the social need that they satisfy, and equality in the treatment of the recipients, users, or beneficiaries.” 3.—That article 7 of the Regulations to the General Customs Law, Executive Decree No. 25270-H of June 14, 1996, its current reforms and amendments, provides that among the functions of the General Customs Directorate is that of “Coordinating actions with the Ministries, bodies, and other entities related to the customs process, in order to harmonize customs policies.” 4.—That article 18 bis of the Regulations to the General Customs Law, among the functions of the Technical Management Directorate, establishes the following:

“e. Keep the information systems and auxiliaries’ registry updated, ensuring their adequate control.

f. Provide technical support to the units of the National Customs Service, public or private entities, and coordinate the corresponding actions in matters of its competence.” 5.—That according to article 21 of the Regulations to the General Customs Law, supra cited, “The Customs Technical Department is responsible for defining matters related to the issuance of guidelines on tariff classification and origin of goods. It is responsible for the implementation and fulfillment of international agreements, as well as keeping the tariff updated, facilitating the transmission of knowledge in said areas,” and in article 21 bis, it assigns it, among other functions, the following:

“e. Analyze the decrees that are published, official letters, requests, and others that imply modification of the Integrated Tariff and carry out the corresponding actions and coordinations with the competent units, for their inclusion.

g. Keep the integrated tariff updated and define the policies, plan, and coordinate the entry of tariff information and technical standards.

h. Coordinate with the competent entities the implementation and standardization of technical standards, in the matter of its competence.” 6.—That with Law No. 7346 of January 9, 1992, the “Sistema Arancelario Centroamericano” (SAC) is adopted, based on the Nomenclature of the Harmonized System of Designation and Coding of Goods (Harmonized System H.S.), sponsored by the Customs Cooperation Council, which constitutes the tariff classification of import and export goods at the Central American and national level.

7.—That through Executive Decrees Nos. 22593-H-MEIC and 22594-H-MEIC, both dated November 12, 1993, the Sistema Arancelario Centroamericano was put into effect with the corresponding addition of internal import taxes and the column that includes the codes of non-tariff requirements or Technical Notes that identify the type of document and the office responsible for issuing it.

8.—That through official communication SINAC-DE-GMRN-072-2013, dated May 13, 2013, the Sistema Nacional de Áreas de Conservación (SINAC), signed by Mr. José Joaquín Calvo Domingo, CITES Focal Point, of the CITES Management Authority, makes it known to the General Customs Directorate that the “Government of Costa Rica as a Party to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, requested through MINAET official communication, DM-211-2012, to include the Hammerhead Shark, Sphryna Lewini in Appendix III of the Convention, with the objective of strengthening the actions already undertaken by the country in the conservation of said species.” 9.—That through the cited official communication, SINAC requests the application of Technical Note 81 CITES, to the marine species Hammerhead Shark, Sphryna Lewini, located in the tariff subheadings: 0302.81.00.00, 0303.81.00.00, 0304.59.00.10, 0304.99.00.20, and 0305.71.00.00; for which it is necessary to create the specific national openings that comprise the species in question.

10.—That through official communication SINAC-DE-GMRN-073-2013, dated May 13, 2013, the Sistema Nacional de Conservación (SINAC), signed by Mr. José Joaquín Calvo Domingo, CITES Focal Point, of the CITES Management Authority, makes it known to the General Customs Directorate “the decisions adopted by the Conference of the Parties to the Convention on the International Trade in Endangered Species of Wild Fauna and Flora (CITES), at its 16th Meeting, in which the decision is made to include in Appendix II the following species of timber trees, which are found in our territory:

a. Dalbergia retusa (Cocobolo) (Logs, sawn wood, wood veneer sheets, and plywood).

b. Dalbergia granadillo (Logs, sawn wood, wood veneer sheets, and plywood).” 11.—That said official communication indicates that the decisions are of mandatory compliance by the party countries and are related to the commercial activities of wildlife and forestry that are carried out in our country; therefore, they request to include Technical Note 81 corresponding to CITES, to the tree species indicated therein.

12.—That because the goods of the tree species Dalbergia retusa (cocobolo) and Dalbergia granadillo, are classified in the tariff lines: 4403.99.00.10, 4407.99.00.10, 4408.90.00.11, 4408.90.00.91, 4412.32.00.10, and 4412.99.99.10, and that they currently have Technical Note 81; it is only necessary to modify the heading text of the tariff lines of interest.

13.—That the “Import or export permit under the Convention on the International Trade in Endangered Species of Wild Fauna and Flora, granted by the Ministerio de Ambiente y Energía, Superior Directorate of the Sistema de Áreas de Conservación (CITES),” is identified in the Tariff of the National Customs Service as Technical Note with code 81. Therefore, Based on the considerations of fact and law cited, powers, and other powers granted in the Uniform Central American Customs Code, in the General Customs Law No. 7557 of October 20, 1995, its current reforms and amendments, and in the Regulations to the General Customs Law, Executive Decree No. 25270-H of June 14, 1996, its reforms and current amendments.

THE GENERAL DIRECTOR OF CUSTOMS,

1.—To create the specific national openings for the marine species of the Hammerhead Shark in the Automated Tariff of the National Customs Service with Technical Note 81 CITES; tariff lines that are detailed in the annex of this resolution.

2.—To include in the heading of the tariff lines cited below, the new species of timber trees: Dalbergia retusa (cocobolo) and Dalbergia granadillo:

3.—To inform that the changes in the Automated Tariff will begin to take effect 15 business days after the publication of this resolution. Therefore, Customs Agencies and Agents and other Auxiliaries of the Public Function are reminded that they must perform the corresponding update in the Tariff that each one uses.

4.—To be communicated and published in the Official Gazette La Gaceta.

en la totalidad del texto - Texto Completo Norma 285 Crea apertura en el Arancel Automatizado de Aduanas con la Nota Técnica 81 CITES Texto Completo acta: F94EE DIRECCIÓN GENERAL DE ADUANAS RESOLUCIÓN DE ALCANCE GENERAL Resolución RES-DGA-285-2013.-Dirección General de Aduanas.-San José, a las catorce horas del cinco de setiembre del dos mil trece.

1. 1Que el artículo 11 de la Ley General de Aduanas sus reformas y modificaciones vigentes, dispone que "La Dirección General de Aduanas es el órgano superior jerárquico nacional en materia aduanera. En el uso de esta competencia, le corresponde la dirección técnica y administrativa de las funciones aduaneras que esta ley y las demás disposiciones del ramo le conceden al Servicio Nacional de Aduanas; la emisión de políticas y directrices para las actividades de las aduanas y dependencias a su cargo; el ejercicio de las atribuciones aduaneras y la decisión de las impugnaciones interpuestas ante ella por los administrados".
2. 2Que el artículo 4° de la Ley General de la Administración Pública N° 6227 de 2 de mayo de 1978, establece que "La actividad de los entes públicos deberá estar sujeta en su conjunto a los principios fundamentales del servicio público, para asegurar su continuidad, su eficiencia, su adaptación a todo cambio en el régimen legal o en la necesidad social que satisfacen y la igualdad en el trato de los destinatarios, usuarios o beneficiarios".
3. 3Que el artículo 7°, del Reglamento a la Ley General de Aduanas, Decreto N° 25270-H de 14 de junio de 1996, sus reformas y modificaciones vigentes, dispone que entre las funciones de la Dirección General de Aduanas se encuentra la de "Coordinar acciones con los Ministerios, órganos y demás entes relacionados con el proceso aduanero, con el fin de armonizar las políticas aduaneras".
4. 4Que el artículo 18 bis del Reglamento a la Ley General de Aduanas, entre las funciones de la Dirección de Gestión Técnica establece las siguientes:

"e. Mantener actualizados los sistemas de información y registro de auxiliares, asegurando su adecuado control.

f. Brindar apoyo técnico a las dependencias del Servicio Nacional de Aduanas, entidades públicas o privadas y coordinar las acciones correspondientes en materia de su competencia".

1. 5Que según el artículo 21 del Reglamento a la Ley General de Aduanas, supra citado, "Al Departamento de Técnica Aduanera le compete la definición de los asuntos relacionados con la emisión de los lineamientos en materia de clasificación arancelaria y origen de las mercancías. Le compete la implementación y cumplimiento de convenios internacionales, así como mantener actualizado el arancel, facilitando la transmisión de conocimiento en dichas áreas.", y en el artículo 21 bis, le encarga entre otras funciones, las siguientes:

"e. Analizar los decretos que se publiquen, oficios, solicitudes y otros que impliquen la modificación del Arancel Integrado y realizar las acciones y coordinaciones que correspondan con las dependencias competentes, para su inclusión.

g. Mantener actualizado el arancel integrado y definir las políticas, planificar y coordinar el ingreso de la información arancelaria y normas técnicas.

h. Coordinar con las entidades competentes la implementación y estandarización de normas técnicas, en la materia de su competencia."

1. 6Que con la Ley N° 7346 de 9 de enero de 1992, se adopta el "Sistema Arancelario Centroamericano" (SAC), basado en la Nomenclatura del Sistema Armonizado de Designación y Codificación de Mercancías (Sistema Armonizado S. A.), auspiciado por el Consejo de Cooperación Aduanera, el cual constituye la clasificación arancelaria de las mercancías de importación y exportación a nivel centroamericano y nacional.
2. 7Que mediante Decretos Ejecutivos Nos. 22593-H-MEIC y 22594-H-MEIC, ambos de fecha 12 de noviembre de 1993, se puso en vigencia el Sistema Arancelario Centroamericano con la correspondiente adición de los impuestos internos a la importación y la columna que incluye los códigos de los requisitos no arancelarios o Notas Técnicas que identifican el tipo de documento y la oficina encargada de emitirlo.
3. 8Que mediante oficio SINAC-DE-GMRN-072-2013, de fecha 13 de mayo del 2013, el Sistema Nacional de Aéreas de Conservación SINAC, suscrito por el señor José Joaquín Calvo Domingo, Punto Focal CITES, de la Autoridad Administrativa CITES, hace del conocimiento de la Dirección General de Aduanas que el "Gobierno de Costa Rica como Parte de la Convención sobre Comercio Internacional de Especies Amenazadas de Fauna y Flora Silvestre, solicitó mediante oficio del MINAET, DM-211-2012, incluir al Tiburón Martillo, Sphryna Lewini en el Apéndice III de la Convención, con el objetivo de fortalecer las acciones ya emprendidas por el país en la conservación de dicha especie".
4. 9Que mediante el oficio de cita, el SINAC, solicita la aplicación de la Nota Técnica 81 CITES, a la especie marina de Tiburón Martillo, Sphryna Lewini, ubicada en las fracciones arancelarias: 0302.81.00.00, 0303.81.00.00, 0304.59.00.10, 0304.99.00.20 y 0305.71.00.00; para lo cual es necesario crear las aperturas nacionales específicas que comprendan la especie en mención.

10.-Que mediante oficio SINAC-DE-GMRN-073-2013, de fecha 13 de mayo del 2013, el Sistema Nacional de Conservación SINAC, suscrito por el señor José Joaquín Calvo Domingo, Punto Focal CITES, de la Autoridad Administrativa CITES, hace del conocimiento de la Dirección General de Aduanas "las decisiones adoptadas por la Conferencia de las Partes de la Convención sobre el Comercio Internacional de Especies Amenazadas de Fauna y Flora Silvestre (CITES), en su 16ª Reunión, en la cual se toma la decisión de incluir en el Apéndice II las siguientes especies de árboles maderables, que se encuentran en nuestro territorio:

a. Dalbergia retusa (Cocobolo) (Trozas, madera aserrada, láminas de chapa de madera y madera contrachapada).

b. Dalbergia granadillo (Trozas, madera aserrada, láminas de chapa de madera y madera contrachapada)." 11.-Que dicho oficio indica que las decisiones son de acatamiento obligatorio por los países parte y tienen relación con las actividades comerciales de vida silvestre y forestal que se desarrollan en nuestro país; por lo tanto, solicitan incluir la Nota Técnica 81 correspondiente a CITES, a las especies de árboles indicados en el mismo.

12.-Que en razón de que las mercancías de la especie de árbol Dalbergia retusa (cocobolo) y Dalbergia granadillo, clasifican en los incisos arancelarios: 4403.99.00.10, 4407.99.00.10, 4408.90.00.11, 4408.90.00.91, 4412.32.00.10 y 4412.99.99.10, y que en la actualidad cuentan con la Nota Técnica 81; solamente se requiere modificar el texto de epígrafe a los incisos arancelarios de interés.

13.-Que el "Permiso importación o exportación de la Convención sobre el Comercio Internacional de Especies amenazadas de Fauna y Flora silvestre, otorgado por el Ministerio de Ambiente y Energía, Dirección Superior Sistema de Áreas de Conservación (CITES)", se encuentra identificado en el Arancel del Servicio Nacional de Aduanas como Nota Técnica con el código 81. Por tanto, Con fundamento en las consideraciones de hecho y derecho de cita, potestades y demás atribuciones otorgadas en el Código Aduanero Uniforme Centroamericano, en la Ley General de Aduanas N° 7557 de fecha 20 de octubre de 1995, sus reformas y modificaciones vigentes y en el Reglamento a la Ley General de Aduanas Decreto Ejecutivo N° 25270-H de fecha 14 de junio de 1996, sus reformas y modificaciones vigentes.

EL DIRECTOR GENERAL DE ADUANAS,

1º-Crear las aperturas nacionales específicas para la especie marina del Tiburón Martillo en el Arancel Automatizado del Servicio Nacional de Aduanas con la Nota Técnica 81 CITES; incisos arancelarios que se detallan en el anexo de esta resolución.

2º-Incluir en el epígrafe de los incisos arancelarios citados a continuación, las nuevas especies de árboles maderables: Dalbergia retusa (cocobolo) y Dalbergia granadillo:

3º-Informar que los cambios en el Arancel Automatizado, empezarán a regir 15 días hábiles después de la publicación de la presente resolución. Por lo que se les recuerda a las Agencias y Agentes de Aduana y demás Auxiliares de la Función Pública que deben realizar la correspondiente actualización en el Arancel que cada uno utilice.

4º-Comuníquese y publíquese en el Diario Oficial La Gaceta.-
