Complete Text of Law 9223 Recognition of the Rights of the Inhabitants of the Southern Caribbean Complete Text record: 13E79D N° 9223 (Note from Sinalevi: By resolution of the Constitutional Chamber N° 012745 of July 10, 2019, this regulation was annulled solely with respect to the territories included in the forested zone, in accordance with the provisions of the Procuraduría General de la República in its reports. By virtue of the foregoing, the Sistema Nacional de Áreas de Conservación is ordered to proceed, within a period of twelve months from the full publication of this ruling in the Boletín Judicial, to demarcate the aforementioned area and, jointly with the Procuraduría General de la República, to exercise the corresponding legal actions in defense of the public domain. This declaration of unconstitutionality shall have declaratory and retroactive effect to the date the regulation took effect, all without prejudice to good-faith acquired rights.)

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF COSTA RICA, DECREES:

RECOGNITION OF THE RIGHTS OF THE INHABITANTS OF THE SOUTHERN CARIBBEAN SINGLE ARTICLE.- For the recognition of the legitimate rights of the inhabitants and the coastal towns of the Southern Caribbean, the boundaries of the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo are established within the following boundaries: according to the basic map Sixaola 3644 I, scale 1:50,000 of the Instituto Geográfico Nacional de Costa Rica, with Costa Rica Transverse Mercator projection (CRTM 05), starting from the point where the Rojo River or Willy Creek flows into the Caribbean Sea, under coordinates 647833 and 1065751, follows upstream of said water body to coordinate 647811 and 1065331, follows to point 647635 and 1065220, follows to coordinate 646912 and 1065070 where the Manzanillo drainage channel joins national highway 256, continuing along the right-of-way on the eastern edge of this highway to coordinate 646647 and 1064590, continuing to point 646544 and 1064425, to the point with coordinates 646469 and 1064448 and to the point with coordinate 646571 and 1064574, a place where it continues parallel at a distance of 50 meters from national route 256, starting from the middle of the road and from the south side thereof, to a point located 100 meters west and 50 meters south of the bridge over the Ernesto creek at coordinate 643396 and 1065619. It takes a line parallel to said creek at 100 meters upstream, to its spring (naciente) at coordinate 642602 and 1064611. At its spring (naciente), it takes the 40-meter contour level curve and follows said curve until reaching the intersection between coordinates 645785 and 1062162. From that point, it follows a line of 300 meters, with this strip to subsequently seek another line located 100 meters before the spring (naciente) of the Milla creek, coordinate 646069 and 1062154. From that point, it follows downstream a line parallel to said creek at 100 meters, until reaching a point on the coast 200 meters before the tide line, coordinate 652224 and 1062347. It then continues southeast, parallel to the coast at 200 meters, to a point located 300 meters before the first mouth of the Gandoca lagoon (now closed), coordinate 653351 and 1061036, and takes that line parallel to the Gandoca River upstream at 300 meters, to a point located between coordinate 653794 and 1058150. From that point, it takes a due south course to the Sixaola River, where it then follows downstream along the left bank to its mouth. From that point of the mouth, a line perpendicular to the beach of 2,500 meters is taken and continues bordering the coast heading northeast and parallel to it at a distance of 2,500 meters, to an imaginary line parallel 2,500 meters to a point located 100 meters northeast of the mouth of the Cocles River, from which it returns along the tide line to the initial starting point at the mouth of the Rojo River or Willy Creek in the Caribbean Sea, under coordinates 647833 and 1065751.

Takes effect upon its publication.

Given in the province of Limón, on the twentieth day of the month of March of the year two thousand fourteen.

En virtud de lo anterior, se ordena al Sistema Nacional de Áreas de Conservación que proceda, dentro del plazo de doce meses, contado a partir de la publicación íntegra de este pronunciamiento en el Boletín Judicial, a delimitar el área antes mencionada y, en conjunto con la Procuraduría General de la República, ejercer las acciones legales correspondientes en defensa del patrimonio público. Esta declaratoria de inconstitucionalidad tendrá efecto declarativo y retroactivo a la fecha de vigencia de la norma, todo sin perjuicio de derechos adquiridos de buena fe.)

LA ASAMBLEA LEGISLATIVA DE LA REPÚBLICA DE COSTA RICA, DECRETA:

RECONOCIMIENTO DE LOS DERECHOS DE LOS HABITANTES DEL CARIBE SUR ARTÍCULO ÚNICO.- Para el reconocimiento de los legítimos derechos de los habitantes y de los poblados costeros del Caribe Sur se establecen los límites del Refugio Nacional de Vida Silvestre Gandoca- Manzanillo, dentro de los siguientes linderos: según el mapa básico Sixaola 3644 I, escala 1:50.000 del Instituto Geográfico Nacional de Costa Rica, con proyección Costa Rica Transversal Mercator (CRTM 05), partiendo del punto en que el río Rojo o Willy Creek desemboca en el Mar Caribe, bajo las coordenadas 647833 y 1065751, sigue aguas arriba de dicho cuerpo hídrico hasta la coordenada 647811 y 1065331, sigue hasta el punto 647635 y 1065220, sigue hasta la coordenada 646912 y 1065070 donde se une el canal de drenaje de Manzanillo con la carretera nacional 256, continuando por el derecho de vía en el margen este de esta carretera hasta la coordenada 646647 y 1064590, continuando hasta el punto 646544 y 1064425, al punto con coordenadas 646469 y 1064448 y hasta el punto con coordenada 646571 y 1064574, lugar donde continúa paralelamente a una distancia de 50 metros de la ruta nacional 256, partiendo de la mitad de la calle y del lado sur de esta, hasta un punto situado 100 metros oeste y 50 metros sur del puente sobre la quebrada Ernesto en la coordenada 643396 y 1065619. Toma una línea paralela de 100 metros a dicha quebrada aguas arriba, hasta su nacimiento en la coordenada 642602 y 1064611. En su nacimiento toma la curva del nivel de los 40 metros y se va por dicha curva hasta alcanzar la intersección entre las coordenadas 645785 y 1062162. De ese punto sigue una línea de 300 metros, con este franco para buscar posteriormente otra línea que se ubique 100 metros antes del nacimiento de la quebrada Milla, coordenada 646069 y 1062154. De ese punto sigue aguas abajo una línea paralela de 100 metros a dicha quebrada, hasta llegar a un punto situado en la costa a 200 metros antes de la línea de marea, coordenada 652224 y 1062347. Luego continúa con rumbo sureste paralelo 200 metros a la costa, hasta un punto situado a 300 metros antes de la primera boca de la laguna Gandoca (hoy cerrada), coordenada 653351 y 1061036, y toma esa línea paralela 300 metros al río Gandoca aguas arriba, hasta un punto situado entre la coordenada 653794 y 1058150. De ese punto toma rumbo sur franco hasta el río Sixaola, donde luego toma aguas abajo por la margen izquierda hasta su desembocadura. De ese punto de la desembocadura se toma una línea perpendicular a la playa de 2.500 metros y continúa bordeando la costa con rumbo noreste y en forma paralela a esta a una distancia de 2.500 metros, hasta una línea imaginaria paralela 2.500 metros a un punto situado 100 metros al noreste de la desembocadura del río Cocles, del cual regresa por la línea de marea hasta el punto inicial de partida en la desembocadura del río Rojo o Willy Creek en el Mar Caribe, bajo las coordenadas 647833 y 1065751.
