of the entire text - Full Text of Standard 0 Partial reform and technical rectification of the zoning and road network map of the Playa Ocotal Coastal Regulatory Plan Full Text of record: F7D60 MUNICIPALITY OF CARRILLO MARITIME TERRESTRIAL ZONE DEPARTMENT Partial adjustment and technical rectification of the map of zoning and road network of the Coastal Regulatory Plan of Playa Ocotal In accordance with the "Manual for the Preparation of Coastal Regulatory Plans in the Maritime Terrestrial Zone," specifically in section 13. Rectifications, Adjustments and Modifications to Existing Regulatory Plans published in Supplement No. 37 of the Official Gazette La Gaceta of February 22, 2013, the publication of the "Partial Adjustment and Technical Rectification of the Map of zoning and Road Network of the Playa Ocotal Coastal Regulatory Plan" is carried out, duly approved by the Costa Rican Tourism Institute according to Board of Directors Agreement SJD-474-2013, official communication from the Urbanism Directorate of the National Institute of Housing and Urbanism C-PU-D-885-2013, and Agreement No. 4, subsection 1, of Ordinary Session No. 33-2013 of the Municipal Council of Carrillo, which is transcribed below:
The Municipal Council of Carrillo, sheltered by the "Manual for the Preparation of Coastal Regulatory Plans in the Maritime Terrestrial Zone," specifically in section 13. Rectifications, Adjustments and Modifications to Existing Regulatory Plans published in Supplement No. 37 of the Official Gazette La Gaceta of February 22, 2013, requests the Partial Adjustment and Technical Rectification of the Map of zoning and Road Network of the Playa Ocotal Coastal Regulatory Plan, as detailed below:
- Carry out the partial adjustment to include the areas declared as natural heritage of the State through certifications No. ACT-OR-DR-1735 of December 9, 2011, and No. ACT-OR-DR-612-12 of May 14, 2012, from the Santa Cruz-Carrillo-Minaet Regional Office in accordance with point 13.6.4 of the Manual for the Preparation of Coastal Regulatory Plans.
- Carry out the technical rectification to include the current demarcation of the public zone carried out by the National Geographic Institute and made official through publication in the official gazette La Gaceta No. 103 of May 30, 1994, in accordance with point 13.5.3 of the Manual for the Preparation of Coastal Regulatory Plans.
- Carry out the technical rectification to adjust the precision and accuracy of the road network layout of the original map in accordance with point 13.5.1 of the Manual for the Preparation of Coastal Regulatory Plans.
- Carry out the partial adjustment in the boundaries and areas that demarcate the different uses resulting from the technical rectifications in the road network in accordance with point 13.6.1 of the Manual for the Preparation of Coastal Regulatory Plans.
Justification:
The graphic adjustment must be carried out because there is a contradiction with the actual situation on the ground, and it is performed while always maintaining the objectives and purposes of the plan originally proposed, conforming to what is indicated in points 13.5 and 13.6 of the Manual for the Preparation of Coastal Regulatory Plans.
For the Municipality, it is indispensable to carry out the "Partial Adjustment and the Technical Rectification of the map of Zoning and Road Network of Playa Ocotal," because the zoning and road network map of the current Playa Ocotal Regulatory Plan is inexact, imprecise, and omissive regarding the current delimitation of the public zone and the areas of natural heritage of the State administered by MINAET.
In accordance with the pronouncement of the Attorney General's Office of the Republic C-011-1999, which, in reference to changes in planning, indicates that:
If these occur, it is because new circumstances exist whose importance makes the modifications indispensable, which must be clearly proven, so as not to harm existing public and private interests, derived from the original planning.
In the case of the Playa Ocotal Regulatory Plan, conditions of private rights (concessions) and public interests (protection of heritage, protection of the public zone, and protection of public roads) exist, and therefore it contains existing rights derived from the original planning, so that in order not to harm these interests, both public and private, it is necessary to carry out these adjustments for the general convenience, fulfilling the following objectives:
. Guarantee the protection of public areas, both the beach areas and the public roads.
. Preserve under MINAET administration the areas declared as Natural Heritage of the State.
. Guarantee the legal certainty of the concession holders (concesionarios) who currently must process an extension of the concession rights granted in this coastal sector.
It is clarified that under this procedure of Partial Adjustment and Technical Rectification of the Zoning and Road Network Map of Playa Ocotal, the roads and the established right-of-way are maintained, excluding from the rectification the roads located between boundary markers 99 and 19. The modification of the green zone between the 14-meter road and the public zone between boundary markers 95 and 96 is due to the adjustment of the area granted in concession in accordance with the cadastral map G-0919787-2004. All aspects defined in the regulations of the Regulatory Plan remain unchanged. Furthermore, due to the level of technical adjustment required and the percentage of areas of Natural Heritage of the State that are incorporated, it is considered unnecessary to carry out any type of adjustment to the Implementation Regulations of the Regulatory Plan.
Therefore, the Maritime Terrestrial Zone Department is instructed to, in coordination with the Administration, submit the request for Rectification and Adjustment of the Playa Ocotal Regulatory Plan before the Costa Rican Tourism Institute and the National Institute of Housing and Urbanism, in accordance with what is indicated by the ICT in official communication MPD-P-128-2013, and the Costa Rican Tourism Institute and the National Institute of Housing and Urbanism are requested, once all the requirements of the Manual for the Preparation of Coastal Regulatory Plans in the Maritime Terrestrial Zone are fulfilled, to authorize the Municipality of Carrillo to carry out the publication of the map of "Partial Adjustment and the Technical Rectification of the map of Zoning and Road Network of Playa Ocotal."

El Concejo Municipal de Carrillo amparado al "Manual Para la Elaboración de Planes Reguladores Costeros en la Zona Marítimo Terrestre" específicamente en el apartado 13. Rectificaciones, Ajustes y Modificaciones en Planes Reguladores Vigentes publicado en el Alcance N° 37 del Diario Oficial La Gaceta del 22 de febrero de 2013, solicita el Ajuste Parcial y Rectificación Técnica de la Lámina de zonificación y Vialidad del Plan Regulador Costero de Playa Ocotal, en lo que se detalla a continuación:
- Realizar el ajuste parcial para incluir las áreas declaradas como patrimonio natural del Estado mediante certificaciones Nº ACT-OR-DR-1735 del 9 de diciembre de 2011 y N° ACT-OR-DR-612-12 del 14 de mayo de 2012 de la Oficina Regional Santa Cruz-Carrillo-Minaet de conformidad con el punto 13.6.4 del Manual para Elaboración de Planes Reguladores Costeros.
- Realizar la rectificación técnica para incluir la demarcación vigente de la zona pública realizada por el Instituto Geográfico Nacional y oficializada mediante publicación en el diario oficial La Gaceta N° 103 del 30 de mayo de 1994 de conformidad con el punto 13.5.3 del Manual para Elaboración de Planes Reguladores Costeros.
- Realizar la rectificación técnica para ajustar la precisión y exactitud del trazo de la vialidad de la lámina original de conformidad con el punto 13.5.1 del Manual para Elaboración De Planes Reguladores Costeros.
- Realizar el ajuste parcial en los límites y las áreas que demarcan los diferentes usos producto de las rectificaciones técnicas en la vialidad de conformidad con el punto 13.6.1 del Manual para Elaboración de Planes Reguladores Costeros.
Justificación:
Se debe realizar el ajuste gráfico debido a que existe una contraposición de la situación real en campo y se realiza manteniendo siempre los objetivos y propósitos del plan originalmente propuestos ajustándose a lo indicado en los puntos 13.5 y 13.6 del Manual para Elaboración de Planes Reguladores Costeros.
Para la Municipalidad es indispensable realizar el "Ajuste Parcial y la Rectificación Técnica de la lámina de Zonificación y Vialidad de Playa Ocotal", debido a que la lámina de zonificación y vialidad del Plan Regulador vigente de Playa Ocotal es inexacta e imprecisa y omisa en cuanto a la delimitación vigente de la zona pública y las áreas de patrimonio natural del Estado administradas por MINAET.
De conformidad con el pronunciamiento de la Procuraduría General de la República C-011-1999, que en referencia a los cambios en la planificación indica que:
Si éstos se dan, es porque existen nuevas circunstancias cuya importancia hacen indispensable las modificaciones, lo que deberá quedar claramente probado, a fin de no lesionar intereses públicos y particulares, existentes y derivados, de la planificación original.
En el caso del Plan Regulador de Playa Ocotal, existen condiciones de derechos particulares (concesiones) y de intereses públicos (protección del patrimonio, protección de la zona pública y protección de las vías públicas) por lo que contiene derechos existentes y derivados de la planificación original, por lo que con el fin de no lesionar estos intereses tanto públicos como particulares es menester realizar estos ajustes para la conveniencia general, cumpliendo con los siguientes objetivos:
. Garantizar la protección de las áreas públicas tanto de las áreas de playa como las calles públicas.
. Preservar bajo administración del MINAET las áreas declaradas como Patrimonio Natural del Estado.
. Garantizar la seguridad jurídica de los concesionarios que actualmente deben tramitar una prórroga de los derechos de concesión otorgados en este sector costero.
Se aclara que bajo este procedimiento de Ajuste Parcial y la Rectificación Técnica de la lámina de Zonificación y Vialidad de Playa Ocotal, se mantienen las vías y el derecho de vía establecido actualmente, excluyéndose de la rectificación las calles que se encuentran entre los mojones 99 y 19. La modificación de la zona verde entre la calle de 14 metros y la zona pública entre los mojones 95 y 96 obedece al ajuste del área otorgada en concesión de conformidad con el plano catastrado G-0919787-2004. Todos los aspectos definidos en el reglamento del Plan Regulador se mantienen inalterados. Además por nivel de ajuste técnico requerido y el porcentaje de áreas de Patrimonio Natural del Estado que se incorporan se considera innecesario realizar ningún tipo de ajuste en el Reglamento de Implementación del Plan Regulador.
Por tanto, se instruye al Departamento de Zona Marítimo Terrestre para que en coordinación con la Administración presente la solicitud de Rectificación y Ajuste del Plan Regulador de Playa Ocotal, ante el Instituto Costarricense de Turismo y el Instituto Nacional de Vivienda y urbanismo, de conformidad con lo indicado por el ICT en el oficio MPD-P-128-2013 y se le solicita al Instituto Costarricense de Turismo y al Instituto Nacional de Vivienda y Urbanismo, que una vez cumpliendo con todos los requisitos del Manual para Elaboración de Planes Reguladores Costeros de la zona Marítimo Terrestre se autorice a la Municipalidad de Carrillo a realizar la publicación de la lámina de "Ajuste Parcial y la Rectificación Técnica de la lámina de Zonificación y Vialidad de Playa Ocotal
