CHAPTER I General Provisions
The purpose of this regulation is to develop the maintenance service for parks and green zones in the canton of La Cruz, in order to maintain cleanliness and proper upkeep. The purpose of this regulation is to regulate the collection of the corresponding rate, in accordance with Article 74 of Ley 7794 Código Municipal.
For the purposes of this regulation, the following shall be understood as:
Municipality: Municipality of La Cruz.
Maintenance: all technical and artisanal activity, as well as the financial cost incurred by the Municipality, through its various departments, for the upkeep of parks located in the districts of its jurisdiction where the service is provided.
Park or green zone: any public-domain real estate that serves as a recreation and leisure area for citizens and that has or is subject to having public services and urban facilities, such as telephony, potable water, benches, children's playgrounds, among others. These sites are freely accessible to all inhabitants of the country, who, when using them, have the obligation to keep them in the best possible condition. Within these sites, the following shall not be done:

All citizens have the right to the use and enjoyment of parks and public spaces, according to their nature and respecting the purpose for which they have been designated and in accordance with the provisions of this regulation and other applicable regulations.

Any damage to park facilities caused by misuse must be reported to the local authorities so that those responsible pay the costs of repair or replacement.
Whoever causes damage to the parks or green zones of the canton of La Cruz shall be subject to the provisions of Article 1045 of the Código Civil.
The tariff or rate for the park and green zone maintenance service, once approved by the Concejo Municipal, must be published in the Diario Oficial La Gaceta and shall take effect 30 days after its publication.

CAPÍTULO I
Disposiciones generales
El presente reglamento tiene por objeto desarrollar el servicio de mantenimiento de parques y zonas verdes en el cantón de La Cruz, con el fin de mantener el aseo y el mantenimiento adecuado. El presente reglamento tiene como objeto regular el cobro de la tasa correspondiente, de conformidad con el artículo 74 de la Ley N° 7794 Código Municipal.
Para efectos de este reglamento, se entenderá por:
Municipalidad: Municipalidad de La Cruz.
Mantenimiento: toda aquella actividad técnica y artesanal, así como el costo financiero que realiza la Municipalidad, a través de sus distintas dependencias para la atención de los parques ubicados en los distritos de su jurisdicción en donde se preste el servicio.
Parque o zona verde: todo aquel bien inmueble de dominio público que sirva como área de recreo y esparcimiento para la ciudadanía y que cuenta o es sujeto de tener servicios públicos y facilidades urbanísticas, tales como telefonía, agua potable, bancas, juegos infantiles, entre otros. Estos sitios, son de libre acceso a todos los habitantes del país, los que al usarlos tienen la obligación de conservarlos en el mejor estado posible. Dentro de estos sitios no se deberá:

Todos los ciudadanos tienen derecho al uso y disfrute de los parques y espacios públicos, de acuerdo a su naturaleza y respetando el destino para el que se hayan designado y de acuerdo a lo estableció en el presente reglamento y demás normativa aplicable.

Disposiciones finales
Todo daño en las instalaciones de los parques ocasionados por un mal uso, deberá ser denunciado ante las autoridades locales para que los responsables paguen los costos de reparación o sustitución.
A quien produzca daños a los parques o zonas verdes del cantón de La Cruz se le aplicará lo dispuesto en el artículo 1045 del Código Civil.
La tarifa o tasa por el servicio de mantenimiento de parques y zonas verdes, una vez aprobada por el Concejo Municipal, deberá ser publicada en el Diario Oficial La Gaceta y empezará a regir 30 días después de su publicación.
