In the exercise of this competence, it is responsible for the technical and administrative direction of the customs functions that this law and the other provisions of the sector grant to the National Customs Service; the issuance of policies and directives for the activities of customs offices and dependencies under its charge; the exercise of customs powers and the resolution of challenges filed before it by persons subject to its jurisdiction."

6227 of May 2, 1978, establishes that "The activity of public entities must be subject, in its entirety, to the fundamental principles of public service, to ensure its continuity, its efficiency, its adaptation to any change in the legal regime or in the social need it satisfies, and equality in the treatment of recipients, users, or beneficiaries."

25270-H of June 14, 1996, its current reforms and modifications, provides that among the functions of the General Directorate of Customs is that of "Coordinating actions with the Ministries, bodies, and other entities related to the customs process, in order to harmonize customs policies."

"e. Maintain updated information systems and registration of auxiliaries, ensuring their adequate control.

f. Provide technical support to the dependencies of the National Customs Service, public or private entities, and coordinate the corresponding actions in matters of its competence."

It is responsible for the implementation and compliance with international agreements, as well as keeping the tariff schedule updated, facilitating the transmission of knowledge in said areas.", and Article 21 bis of the same assigns it, among other functions, the following:

"e. Analyze decrees that are published, official communications, requests, and others that imply modification of the Integrated Tariff Schedule and carry out the actions and coordination that correspond with the competent dependencies, for their inclusion.

." g. Maintain the integrated tariff schedule updated and define policies, plan, and coordinate the entry of tariff information and technical standards.

h. Coordinate with competent entities the implementation and standardization of technical standards, in matters of its competence."

7346 of January 7, 1993, the "Central American Tariff System" (SAC) is adopted, based on the Nomenclature of the Harmonized Commodity Description and Coding System (Harmonized System S. A.), sponsored by the Customs Cooperation Council, which constitutes the tariff classification of import and export goods at the Central American and national level.

37822-MINAE-MOPT-H, published in La Gaceta No. 197 of October 14, 2013, the Ministry of Environment and Energy (MINAE), the Ministry of Public Works and Transport, and the Ministry of Finance, approved in Article 1 the modification of Article 4 of Executive Decree No. 33096-H-MINAE-MOPT, published in La Gaceta No. 96 of May 19, 2006, so that it reads:

"New hybrid-electric vehicles of headings 8703 and 8704 may have a reduction of the rate of twenty percentage points in the Selective Consumption Tax, provided that the importer presents to the Customs Administration a certificate issued by MINAE that they comply with the characteristics established in Article 7 of this decree."

Therefore, Based on the cited factual and legal considerations, powers, and other attributions granted in the Uniform Central American Customs Code, in the General Customs Law No. 7557 of October 20, 1995, its current reforms and modifications, and in the Regulations to the General Customs Law, Executive Decree No. 25270-H of June 14, 1996, its current reforms and modifications.

THE DIRECTOR GENERAL OF CUSTOMS, REPORTS:

1. 1That the modifications to the texts and rate of the Selective Consumption Tax contained in Executive Decree No. 37822-MINAE-MOPT-H, published in La Gaceta No. 197 of October 14, 2013, detailed in the attached Annex, have already been incorporated into the Automated Tariff Schedule of the National Customs Service contained in the TICA computer application and take effect as of October 29, 2013.

2- To Customs Agencies, Customs Agents, and other Auxiliaries of the Public Function that must make the corresponding update in the Tariff Schedule that each one uses.

Let it be communicated and published in the Official Gazette La Gaceta.

En el uso de esta competencia, le corresponde la dirección técnica y administrativa de las funciones aduaneras que esta ley y las demás disposiciones del ramo le conceden al Servicio Nacional de Aduanas; la emisión de políticas y directrices para las actividades de las aduanas y dependencias a su cargo; el ejercicio de las atribuciones aduaneras y la decisión de las impugnaciones interpuestas ante ella por los administrados".

"e. Mantener actualizados los sistemas de información y registro de auxiliares, asegurando su adecuado control.

f. Brindar apoyo técnico a las dependencias del Servicio Nacional de Aduanas, entidades públicas o privadas y coordinar las acciones correspondientes en materia de su competencia".

Le compete la implementación y cumplimiento de convenios internacionales, así como mantener actualizado el arancel, facilitando la transmisión de conocimiento en dichas áreas.", y en el artículo 21 bis, del mismo le encarga entre otras funciones, las siguientes:

"e. Analizar los decretos que se publiquen, oficios, solicitudes y otros que impliquen la modificación del Arancel Integrado y realizar las acciones y coordinaciones que correspondan con las dependencias competentes, para su inclusión.

." g. Mantener actualizado el arancel integrado y definir las políticas, planificar y coordinar el ingreso de la información arancelaria y normas técnicas.

h. Coordinar con las entidades competentes la implementación y estandarización de normas técnicas, en la materia de su competencia".

A.), auspiciado por el Consejo de Cooperación Aduanera, el cual constituye la clasificación arancelaria de las mercancías de importación y exportación a nivel centroamericano y nacional.

"Los vehículos híbridos-eléctricos nuevos de las partidas 8703 y 8704, podrán contar con una reducción de la tarifa de veinte puntos porcentuales en el impuesto Selectivo de Consumo, siempre que el importador presente ante la Administración Aduanera una constancia emitida por el MINAE de que los mismos cumplen con las características establecidas en el artículo 7° de este decreto".

Por tanto, Con fundamento en las consideraciones de hecho y derecho de cita, potestades y demás atribuciones otorgadas en el Código Aduanero Uniforme Centroamericano, en la Ley General de Aduanas N° 7557 de fecha 20 de octubre de 1995, sus reformas y modificaciones vigentes y en el Reglamento a la Ley General de Aduanas Decreto Ejecutivo N° 25270-H de fecha 14 de junio de 1996, sus reformas y modificaciones vigentes.

EL DIRECTOR GENERAL DE ADUANAS, COMUNICA:

1. 1Que las modificaciones de los textos y tarifa del impuesto Selectivo de Consumo contenidos en el Decreto Ejecutivo N° 37822-MINAE-MOPT-H, publicado en La Gaceta N° 197 del 14 de octubre del 2013, detalladas en el Anexo adjunto, ya fueron incorporadas en el Arancel automatizado del Servicio Nacional de Aduanas contenido en la aplicación informática TICA y rigen a partir del 29 de octubre del 2013.

2- A las Agencias y Agentes de Aduanas y demás Auxiliares de la Función Pública que deben realizar la correspondiente actualización en el Arancel que cada uno utilice.
