in the entirety of the text - Full Text of Norm 9 New Zoning Map of the Playa Carrillo Regulatory Plan Full Text of record: F72AB MUNICIPALITY OF HOJANCHA ADJUSTMENTS TO THE LAND USE MAP OF THE REGULATORY PLAN PARTIAL PLAYA CARRILLO The Municipality of Hojancha informs this canton and the residents of the Playa Carrillo sector, and the general public, of the adoption and entry into force of the new land use map of the Partial Regulatory Plan of Playa Carrillo, canton of Hojancha, Guanacaste province, comprising the sector between landmarks 19 to 34 of the I.G.N. This map was approved by the Instituto Costarricense de Turismo via official letter MPD-P-295-2013, of November 19, 2013, by the Instituto Nacional de Vivienda y Urbanismo via official letter C-PU-D-6-2014, of January 10, 2014, and by the Municipal Council of Hojancha through agreement No. 9 of ordinary session No. 197-014, held on February 4, 2014.
1. Justification for the adjustments. The Municipality of Hojancha, jointly with the Instituto Costarricense de Turismo, has been managing the formulation of the Comprehensive Regulatory Plan for the Sámara-Carrillo Development Center, which includes the cantons of Nicoya and Hojancha. However, said plan is still in the process of being prepared and reviewed by SETENA. Therefore, in order to better address management in the maritime-terrestrial zone, safeguarding the interests of the State and the legal certainty of the concessionaires, the readjustment of the Zoning Map of the Playa Carrillo Regulatory Plan is necessary, to include the Natural Heritage of the State classified and certified by MINAET, and the public roads that over time have been formalized in the coastal sector, as well as the landmarks placed by the Instituto Geográfico Nacional, which are not visible on said map.
For this process, the manual for the preparation of coastal regulatory plans was used, prepared by the Instituto Costarricense de Turismo and published in Digital Supplement No. 58 to La Gaceta No. 63 of Tuesday, April 2, 2013, using Level 2. Partial adjustments to the planning map, in which the objectives and purposes of the plan are not modified, nor the originally proposed planning.
The following Level 2 points are incorporated within the adjustments.
13.6.2. The map is adjusted to the new landmarking conducted by the Instituto Geográfico Nacional, regarding the limit of the 150 meters of the restricted zone.
13.6.4. The aspects corresponding to natural heritage of the state determined by MINAET are incorporated into the regulatory plan map.
13.6.5. Land-use changes (cambios de uso de suelo) are made in some uses of the plan in order to adjust the map to the existing reality, taking into account that the planning that had been carried out within the public zone, in which an area for the cooperative zone had been established, is excluded from the map. When excluding the planning of the public zone, it becomes necessary to establish a new cooperative zone within the new map, modifying the areas of other uses.
13.6.6. The existing road network in reality within the zones is included in the new map, respecting the legal widths and setbacks according to the type of road that corresponds. New roads that were not in the previous map, and that are considered public due to their frequent use and relevance for access to the restricted zone, are added to this new map.

en la totalidad del texto - Texto Completo Norma 9 Nueva lámina de Zonificación del Plan Regulador de Playa Carrillo Texto Completo acta: F72AB MUNICIPALIDAD DE HOJANCHA AJUSTES LÁMINA DE USOS DEL PLAN REGULADOR PARCIAL PLAYA CARRILLO La Municipalidad de Hojancha informa a este cantón y a los vecinos del sector de Playa Carrillo, y al público en general, sobre la adopción y puesta en vigencia de la nueva lámina de usos del Plan Regulador Parcial de Playa Carrillo, cantón de Hojancha, provincia Guanacaste, que comprende el sector entre los mojones 19 al 34 del I.G.N. Esta lámina fue aprobada por Instituto Costarricense de Turismo Oficio MPD-P-295-2013, del 19 de noviembre del 2013, por el Instituto Nacional de Vivienda y Urbanismo Oficio C-PU-D-6-2014, del 10 de enero del 2014 y por el Concejo Municipal de Hojancha mediante acuerdo Nº 9 de la sesión ordinaria Nº 197- 014, celebrada el día 4 de febrero del 2014.

Dentro de los ajustes se incorporan los siguientes puntos del Nivel 2.
13.6.2. Se ajusta la lámina a los nuevos amojonamientos realizados por el Instituto Geográfico Nacional, sobre el límite de los 150 metros de la zona restringida.
13.6.4. Se incorpora dentro de la lámina de plan regulador lo correspondiente a patrimonio natural del estado determinado por el MINAET.
13.6.5. Se realizan cambios de uso de suelo en algunos usos del plan con la finalidad de ajustar la lámina a la realidad existente, tomando en cuenta que se excluye de la lámina la planificación que se había realizado dentro de la zona pública en la cual se había establecido un área para la zona cooperativa. Al excluir la planificación de la zona pública se hace necesario establecer una nueva zona cooperativa dentro de la nueva lámina, modificando las áreas de otros usos.
13.6.6. Se incluye dentro de la nueva lámina la vialidad existente en la realidad dentro de las zonas respetando los anchos y retiros de ley según el tipo de vía que corresponde. Se agrega a esta nueva lámina caminos nuevos que no se encontraban dentro de la lámina anterior y que son considerados como públicos por el uso frecuente y la relevancia que tienen dentro del acceso a la zona restringida.
