in the entirety of the text - Complete Text of Standard 38053 Increases for the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA), the maximum budgetary expenditure for the year 2014 Complete Text of record: F5E97 No. 38053-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by articles 140, subsections 3) and 18), and 146 of the Political Constitution; articles 25, subsection 1), 27, subsection 1), and 28, subsection 2), subparagraph b) of Law No. 6227, General Law of Public Administration of May 2, 1978, and its amendments; Law No. 8131, Law of Financial Administration of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulations, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law No. 6877, Creation of the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA) of July 18, 1983, and its amendments; Executive Decree No. 32452-H of June 29, 2005, and its amendments; and Executive Decree No. 37595-H of March 18, 2013.

1. 1That by means of Law No. 6877, published in La Gaceta No. 143 of July 29, 1983, and its amendments, the National Groundwater, Irrigation, and Drainage Service (SENARA) was created, whose objectives, among others, are to promote the agricultural development of the country, through the establishment and operation of irrigation, drainage, and flood protection systems, to contribute to preferentially developing those agricultural development projects that are based on a just distribution of land, and to ensure that within the territory benefited by the creation of irrigation and drainage districts, a rational and democratic modification of land ownership is carried out.
2. 2That through official letters GG-OF-775-2013 of October 2, 2013, and GG-OF-846-2013 of October 22, 2013, the General Manager of SENARA requested an increase in the maximum budgetary expenditure for 2014, for a total amount of ¢12,660,821,275.00 (twelve billion six hundred sixty million eight hundred twenty-one thousand two hundred seventy-five colones exactly), for the development of nine projects of the Integrated Water Resources Management Program (PROGIRH) and one project of the Limón Ciudad-Puerto Project. Said request has the endorsement of the Ministry of Agriculture and Livestock granted through official letter DM-675-2013 of October 8, 2013.
3. 3That of the indicated amount, it would be appropriate to increase, by way of Executive Decree, the sum of ¢672,857,320.00 (six hundred seventy-two million eight hundred fifty-seven thousand three hundred twenty colones exactly) in accordance with the provisions of article 5, subsection b.2 of Executive Decree No. 37595-H, published in Digital Supplement No. 54 to La Gaceta No. 57 of March 21, 2013, by virtue of the fact that its financing comes from the specific surplus. However, the sum of ¢63,500,000.00 (sixty-three million five hundred thousand colones exactly) must be deducted from the indicated amount, as they correspond to the resources that must be reserved due to the application of the provisions of article 5 of Presidential Directive No. 40-H.
4. 4That in accordance with what is stated in the preceding whereas clause, what is to be increased via Executive Decree is the remaining amount for the sum of ¢609,357,320.00 (six hundred nine million three hundred fifty-seven thousand three hundred twenty colones exactly) for the acquisition of land for the resettlement plan for families located within the area of influence of the Limón Ciudad Puerto project, payment of compensation to families for resettlement or for the partial affectation of properties located within the design line of the works, and the payment of compensation for rights of way of the Canal del Sur, Section II.
5. 5That through the cited Executive Decree No. 37595-H, the General Budgetary Policy Guidelines for the year 2014 were issued, establishing in article 2º the maximum percentage by which the budgetary expenditure of public entities, ministries, and other bodies could be increased, with respect to that of the preceding year. In correspondence with said provision, the resulting maximum budgetary expenditure amount for the year 2014 for SENARA was established in the sum of ¢11,177,963,955.00 (eleven billion one hundred seventy-seven million nine hundred sixty-three thousand nine hundred fifty-five colones exactly), which was communicated through official letter STAP-2439-2013 of November 12, 2013; a figure that does not include the expenditure previously indicated in this decree.
6. 6That through Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005, and its amendments, the "Guideline for the application of article 6 of Law No. 8131, Law of Financial Administration of the Republic and Public Budgets, and the regulation of the class of Public Sector revenues denominated Financing" is issued.
7. 7That article 9 of the referenced Executive Decree No. 32452-H enables the use of the specific surplus for the payment of expenses defined in the purposes established in the special or legal provisions applicable to such resources.
8. 8That due to the foregoing, it is necessary to increase the maximum budgetary expenditure set for SENARA for the year 2014, increasing it by the sum of ¢609,357,320.00 (six hundred nine million three hundred fifty-seven thousand three hundred twenty colones exactly). Therefore;

1. 1Que mediante la Ley Nº 6877, publicada en La Gaceta Nº 143 de 29 de julio de 1983 y sus reformas, se crea el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), cuyos objetivos, entre otros, son fomentar el desarrollo agropecuario del país, mediante el establecimiento y funcionamiento de sistemas de riego, avenamiento y protección contra inundaciones, contribuir a desarrollar preferentemente aquellos proyectos de desarrollo agropecuario que se sustenten en una justa distribución de la tierra y procurar que en el territorio beneficiado por la creación de distritos de riego y avenamiento, se efectúe una modificación racional y democrática en la propiedad de la tierra.
2. 2Que mediante los oficios GG-OF-775-2013 del 2 de octubre de 2013 y GG-OF-846-2013 de 22 de octubre de 2013, el Gerente General del SENARA, solicitó incrementar el gasto presupuestario máximo del 2014, por un monto total de ¢12.660.821.275,00 (doce mil seiscientos sesenta millones ochocientos veintiún mil doscientos setenta y cinco colones exactos), para el desarrollo de nueve proyectos del programa de Gestión Integral de Recursos Hídricos (PROGIRH) y un proyecto del Proyecto Limón Ciudad-Puerto. Dicha solicitud cuenta con el aval del Ministerio de Agricultura y Ganadería otorgado mediante oficio DM-675-2013 del 08 de octubre del 2013.
3. 3Que del monto señalado, correspondería ampliar por la vía del Decreto Ejecutivo, la suma de ¢672.857.320,00 (seiscientos setenta y dos millones ochocientos cincuenta y siete mil trescientos veinte colones exactos) de conformidad con lo establecido en el artículo 5° inciso b.2 del Decreto Ejecutivo Nº 37595-H, publicado en el Alcance Digital Nº 54 a La Gaceta Nº 57 de 21 de marzo de 2013, en virtud de que su financiamiento proviene del superávit específico. Sin embargo, del monto indicado debe deducirse la suma de ¢63.500.000,00 (sesenta y tres millones quinientos mil colones exactos), ya que corresponden a los recursos que se deben reservar por la aplicación de lo dispuesto en el artículo 5° de la Directriz Presidencial Nº 40-H.
4. 4Que de conformidad con lo señalado en el considerando previo, lo que corresponde ampliar vía Decreto Ejecutivo es el monto restante por la suma de ¢609.357.320,00 (seiscientos nueve millones trescientos cincuenta y siete mil trescientos veinte colones exactos) para la adquisición de terrenos para el plan de reasentamiento de las familias ubicadas en el área de influencia del proyecto Limón Ciudad Puerto, pago de indemnizaciones a familias por reasentamiento o por la afectación parcial a propiedades que se encuentran dentro de la línea de diseño de las obras y el pago de indemnizaciones por derechos de paso del Canal del Sur, Tramo II.
5. 5Que mediante el Decreto Ejecutivo Nº 37595-H citado, se emitieron las Directrices Generales de Política Presupuestaria para el año 2014, estableciéndose en el artículo 2°, el porcentaje máximo en que podría incrementarse el gasto presupuestario de las entidades públicas, ministerios y demás órganos, con respecto al del año precedente. En correspondencia con dicha disposición, el monto de gasto presupuestario máximo para el año 2014 resultante para el SENARA, fue establecido en la suma de ¢11.177.963.955,00 (once mil ciento setenta y siete millones novecientos sesenta y tres mil novecientos cincuenta y cinco colones exactos), el cual fue comunicado mediante el oficio STAP-2439-2013 del 12 de noviembre del 2013; cifra que no contempla el gasto indicado previamente en este decreto.
6. 6Que mediante el Decreto Ejecutivo Nº 32452-H, publicado en La Gaceta Nº 130 de 6 de julio de 2005 y sus reformas, se emite el "Lineamiento para la aplicación del artículo 6 de la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
7. 7Que el artículo 9° del referido Decreto Ejecutivo Nº 32452-H, posibilita la utilización del superávit específico, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.
8. 8Que por lo anterior, resulta necesario ampliar el gasto presupuestario máximo fijado al SENARA para el año 2014, incrementándolo en la suma de ¢609.357.320,00 (seiscientos nueve millones trescientos cincuenta y siete mil trescientos veinte colones exactos). Por tanto;
