1. 1That it is the responsibility of the Costa Rican Institute of Fisheries and Aquaculture, in accordance with the provisions of Laws No. 7384 and No. 8436, to regulate and control the sustainable use of fishery resources, as well as the use of the corresponding fishing gear in each fishery, the permitted methods, zones and seasons, as well as the issuance, with technical regulations, of fishing licenses, permits and authorizations.
2. 2That the Costa Rican semi-industrial shrimp fleet carries out fishing activities and operations in the Costa Rican jurisdictional waters of the Pacific Ocean, using bottom trawl nets as fishing gear in coastal shrimp fishing and in deep waters, for which turtle excluder devices have been used in those nets in accordance with the applicable provisions.
3. 3That in a ruling issued by the Constitutional Chamber, in the month of August 2013, it established and declared as unconstitutional the use of trawl nets in the

that were active at the date of the issuance of the constitutionality ruling, under the consideration that the activity be carried out in compliance with the legal framework and that, if scientifically possible, environmentally friendly technologies be adopted under the supervision of INCOPESCA.

1. 4That INCOPESCA has carried out and officially issued, in the month of September 2013, the Technical Report for the Project "Evaluation of the Use of Fish Excluder Devices (FED), in Shrimp Trawl Nets, Pacific, Costa Rica," by which it is concluded that the use of the simple fisheye-type fish excluder device in the trawl nets of the semi-industrial shrimp fishery is reasonable and advisable as an environmentally friendly technology and for the sustainable use of the shrimp resource.
2. 5That the fisheye-type fish excluder device allows juvenile fish to exit the net, by functioning as an escape window, taking advantage of the behavior shown by several species of fish that swim against the current, since this attachment is placed in such a way that it creates a current flow towards the inside of the net and, when the fish react to that flow, they find the exit; the shrimp, for its part, is pushed by this current to the bottom of the bag ensuring its capture. Therefore,

THEY AGREE:

1º-It is established as mandatory the use of the fish excluder device, of the fisheye type, in the conduct of fishing operations by the Costa Rican semi-industrial shrimp fleet, both in coastal fishing and in deep-water fishing. Said device shall be placed, one per trawl net, located in the upper part of the net bag (copo). The fisheye device consists of an elliptical-shaped frame, constructed with a stainless steel or aluminum rod, which keeps open the cut in the net through which the exit of the fish is allowed, reinforced with a triangle of the same material, to fix the working position. The device must comply with the following design and measurements: with a dimension at its escape opening of a length of 320mm (32 centimeters) and a height of 220mm (22 centimeters) and a vertex depth of 440mm (44 centimeters), according to the following design:

2º-The fisheye device must be installed in the net, at the center of the upper part of the capture bag or net bag (copo), measured from the closure of the bag towards the Turtle Excluder Device (TED) with the mesh stretched and is marked, cutting the upper central mesh to make a cut on each of its sides, making a hole in the bag or net bag (copo), adjusted to the diameter of the device ring. The ring is fixed to the edges of the mesh cut placing the vertex of the triangle towards the mouth of the net, the meshes of the cut that remain on the side of the TED are fixed to the lower contour of the ring and those on the other side of the cut (those that remain on the side of the bag or net bag (copo)) are attached to the upper part of the turtle excluder device ring. To compensate for the weight of the attachment, a rigid float is placed alongside the upper edge, on the outer part. The attachment cannot be obstructed by any element of the net; in the case of the lazy line, its fastening elements such as rings or loops must be located at the rear part of the fisheye device.

3º-The mandatory use of the fish excluder device, for the Costa Rican semi-industrial shrimp fleet, shall be effective as of January 1, 2014. The inspection and verification of the mandatory use of the device shall correspond to the exercise of the powers and competencies of the National Coast Guard Service and of INCOPESCA, through the Fisheries Protection Unit or the corresponding body, both at sea and at the unloading of the shrimp boats.

4º-Violation of the provisions herein, regarding the use of the fish excluder device in fishing operations and its installation and use in the trawl nets of semi-industrial shrimp vessels, shall be sanctioned in accordance with the applicable provisions of Law 8436, both through administrative channels and for the purpose of filing the corresponding judicial complaints.

5º-INCOPESCA, through the Technical General Directorate and the Research and Development Department, shall carry out the corresponding studies for the purposes of monitoring and following up on the analysis of the results resulting from the use of the fish excluder device, in order to determine any actions that may be necessary to adjust and improve the functioning of the device in the interest of the sustainable use of hydrobiological resources.

6º-Let it be published.

7º-This agreement is final.

Considering:

1. 1Que corresponde al Instituto Costarricense de Pesca y Acuicultura de conformidad con lo dispuesto en las Leyes Nº7384 y Nº8436, normar y regular el aprovechamiento sostenible de los recursos pesqueros, así como la utilización de las artes de pesca correspondientes en cada pesquería, los métodos permitidos, las zonas y épocas, así como la emisión con las regulaciones técnicas de las licencias de pesca, permisos y autorizaciones.
2. 2Que la flota camaronera semiindustrial costarricense realiza las actividades y faenas de pesca en las aguas jurisdiccionales costarricense del Océano Pacífico, utilizando como artes de pesca las redes de arrastre por el fondo en la pesca camaronera costera y en aguas de profundidad, para lo cual se han utilizado en dichas redes dispositivos excluidores de tortugas de conformidad con las disposiciones aplicables.
3. 3Que en sentencia dictada por la Sala Constitucional, en el mes de agosto del año 2013, la misma estableció y declaró como inconstitucional la utilización de las redes de arrastre en el aprovechamiento del recurso camarón, manteniéndose la vigencia de las licencias de pesca de camarón semiindustrial que se encontraren activas a la fecha del dictado de la sentencia de constitucionalidad, bajo la consideración de que la actividad se ejerza con sujeción al ordenamiento jurídico y que se adopten si fuera científicamente posible, tecnologías amigables con el ambiente bajo la supervisión del INCOPESCA.
4. 4Que el INCOPESCA ha realizado y emitido a oficialmente en el mes de setiembre del año 2013 el Informe Técnico del Proyecto "Evaluación del Uso de Dispositivos Excluidores de Peces (DEP), en Redes de Arrastre de Camarón, Pacífico, Costa Rica", mediante el cual se concluye la razonabilidad y conveniencia como tecnología amigable con el ambiente y el aprovechamiento sostenible del recurso camarón, la utilización del dispositivo excluidor de peces tipo ojo de pescado simple en las redes de arrastre de la pesca camaronera semiindustrial.
5. 5Que el dispositivo excluidor de peces tipo ojo de pescado permite la salida de los peces juveniles de la red, al funcionar como una ventana de escape, aprovechando el comportamiento presentan varias especies de peces de nado contra corriente, ya que este aditamento se coloca de tal manera que origina un flujo de corriente hacia adentro de la red y, los peces al reaccionar ante ese flujo encuentran la salida; por su parte el camarón es empujado por esta corriente al fondo del bolso asegurando su captura. Por tanto,

ACUERDAN:

1º-Se establece como obligatorio el uso del dispositivo excluidor de peces, del tipo ojo de pescado, en la realización de las faenas de pesca por parte de la flota semiindustrial camaronera costarricense, tanto en la pesca costera como en la pesca de profundidad. Dicho dispositivo se deberá colocar uno por cada red de arrastre, ubicándose en la parte superior del copo de la red. El dispositivo ojo de pescado consiste en un marco de forma elíptica, construido con varilla de acero inoxidable o aluminio, que mantiene abierto el corte de la red por el que se permite la salida de los peces, reforzado con un triángulo del mismo material, para fijar la posición de trabajo. El dispositivo deberá cumplir con el siguiente diseño y medidas: con una dimensión en su abertura de escape de un largo de 320mm (32 centímetros) y una altura de 220mm (22 centímetros) y una profundidad del vértice de 440mm (44 centímetros), según el siguiente diseño:

2º-El dispositivo ojo de pescado se deberá instalar en la red, en el centro de la parte superior del bolso de captura o copo, medidos a partir del cierre del bolso hacia el Dispositivo Excluidor de Tortugas (DET) con el paño estirado y se marca, cortando la malla central superior para realizar un corte para cada uno de sus lados, haciendo un orificio en el bolso o copo, ajustado al diámetro del aro del dispositivo. El aro se fija en los bordes del corte del paño ubicando el vértice del triángulo hacia la boca de la red, las mallas del corte que quedan del lado del DET se fijan en el contorno inferior del aro y las del otro lado del corte (las que quedan del lado del bolso o copo) se sujetan a la parte superior del aro del dispositivo excluidor de tortugas marinas. Para compensar el peso del aditamento, junto al borde superior, por la parte externa, se coloca un flotador rígido. El aditamento no puede ser obstruido por ningún elemento de la red, en el caso del cabo de cobro (falso), sus elementos de fijación como argollas o anillos deberán estar en la parte posterior del dispositivo ojo de pescado.

3º-La utilización obligatoria del uso del dispositivo excluidor de peces, para la flota semiindustrial camaronera costarricense, lo será a partir del 1 de enero del año 2014. La inspección y verificación de la utilización obligatoria del dispositivo, corresponderá al ejercicio de las facultades y competencias del Servicio Nacional de Guardacostas y del INCOPESCA, por medio de la Unidad de Protección Pesquera o la instancia correspondiente, tanto en el mar como en la descarga de los barcos camaroneros.

4º-La violación a lo dispuesto en el presente, sobre la utilización del dispositivo excluidor de peces, en las faenas de pesca y su instalación y uso en las redes de arrastre de las embarcaciones semiindustriales camaroneras, será sancionado de conformidad con las disposiciones aplicables de la Ley 8436, tanto en la vía administrativa, como para efecto de la interposición de las denuncias judiciales correspondientes.

5º-El INCOPESCA a través de la Dirección General Técnica y el Departamento de Investigación y Desarrollo realizara los estudios correspondientes a los efectos de dar seguimiento y continuidad al análisis de los resultados que resulten de la utilización del dispositivo excluidor de peces con la finalidad de determinar las acciones que pudieren resultar necesarias para ajustar y mejorar el funcionamiento del dispositivo en aras del aprovechamiento sostenible de los recursos hidrobiológicos.

6º-Publíquese.

7º-Acuerdo firme.
