in the entirety of the text - Complete Text of Decree 37849 Creates Río General National Wildlife Refuge, private category Complete Text of file: F50E2 No. 37849-MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by Article 140, subsections 3), 8), 18) and 146) of the Political Constitution and based on the provisions of Articles 82 subsection c) and 87 of the Wildlife Conservation Law No. 7317 of December 7, 1992; Articles 32, 34, 35, 36 and 37 of the Organic Environmental Law No. 7554 of November 13, 1995; Articles 58 and 60 of the Biodiversity Law No. 7788 of May 27, 1998; Article 6, subsection a) of the Forest Law No. 7575; Articles 171 and 172 of the Regulations to the Wildlife Conservation Law, Executive Decree No. 32633-MINAE published in La Gaceta No. 180 of September 20, 2005; Articles 70 subsection e), 71 and 72 of the Regulations to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008 and Articles 6, 9, 11 and 27 of the General Public Administration Law No. 6227 of May 2, 1978.

I.-That it is in the interest of the Costa Rican State to strengthen the administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of said resources.

II.-That the corporation named Corporación de Desarrollo Agrícola del Monte Sociedad Anónima (PINDECO-DEL MONTE), legal identification number three-one hundred one-ten thousand eight hundred eighty-two, represented by Mr. Rodrigo Alberto Jiménez Rímolo, of legal age, married once, civil engineer, resident of San José, holder of identity card number one- five hundred four-four hundred eighty- five, who is Second Vice President with powers of general unlimited attorney-in-fact of the aforementioned corporation, whose legal capacity is current and registered in the Mercantile Section of the Public Registry at volume: sixty- two, folio: three hundred twenty, entry: two hundred thirty, requested from the La Amistad Pacífico Conservation Area, Buenos Aires Subregional Office the voluntary submission to the Private Wildlife Refuge Regime, of portions of four properties owned by it registered in the Real Property Registry on the real folios described below: All of the Partido of Puntarenas, of Canton 3 which is Buenos Aires, of District 2 which is Volcán, real folio numbers: 1. 6-158380-000, with a total area of 124 ha 2982.13 dm², whose area to be submitted would be 66 ha 8682.00 dm2 with cadastral plan P-1205426-2007. 2. 6-155078-000, with a total area of 602 ha 6635.84 dm2, whose area to be submitted would be 334 ha 3458.00 dm² with cadastral plan P-1205427-2007. 3. 6-102318-000, with a total area of 453 ha 8120.26 dm2, whose area to be submitted would be 141 ha 4194.00 dm2 with cadastral plan P-665650-1987. 4. 6-20295-000, with a total area of 46 ha 6813.33 dm2, whose area to be submitted would be 11 ha 6909.00 dm2 with cadastral plan P-1204790-2007. For a total submitted to the refuge area, of the four properties, corresponding to 554 ha 3243.00 dm2.

III.-That the areas to be submitted correspond to different sectors within the pineapple plantations, where said agricultural activity was not implemented because they are remaining forest fragments (fragmentos remanentes de bosque), which include protection areas of the General and Sonador Rivers and the Cacao, Vueltas, and Segundo Streams, in addition to sectors with slopes that do not favor fruit cultivation, sectors of secondary forest and/or riparian forest, however, there are several parts that can be considered with vegetative structures that vary between scrubland and young fallow land, which meet the parameters established to be included within the definition of forest indicated by Forest Law No. 7575.

IV.-The corporation Corporación de Desarrollo Agrícola del Monte Sociedad Anónima, through the representative of the Corporation, expressly accepted to voluntarily submit to the National Wildlife Refuge regime, private category, the aforementioned properties for a period of ten years, as established in Article 171 subsection f) of Executive Decree No. 32633-MINAE, automatically renewable for equal periods unless it or the administration expresses otherwise beforehand.

V.-That within the area subject to the application there is a large number of faunal resources (insects, mammals, amphibians, birds and reptiles) as well as floral resources that deserve to be conserved rationally and sustainably, to guarantee their permanence within the ecosystems where they currently are found. The properties submitted to the Refuge, were dedicated to agricultural activities in the recent past, and by the will of their owner, they will be dedicated exclusively to conservation henceforth, thus representing an important recovery area for natural habitats and for the regeneration of degraded zones that will serve for the development of the flora and fauna present in the area.

VI.-That in accordance with Article 87 of the Wildlife Conservation Law, the main environmental effect generated by the declaration of a property under this legal regime is that, for the purposes of the conservation of natural resources, the general administration of the refuge corresponds to the owners of the properties, which will be supervised by the La Amistad Pacífico Conservation Area, Buenos Aires Subregional Office.

VII.-That through resolution number ACLA-P-D-039 at one o'clock in the afternoon on January twenty-third of the year two thousand twelve, the Acting Director of the La Amistad Pacífico Conservation Area, Licentiate Luis Sánchez Arguedas, accepted the request for voluntary submission made by the Second Vice President of the corporation Corporación de Desarrollo Agrícola del Monte Sociedad Anónima (PINDECO-DEL MONTE), under the category of National Wildlife Refuge, private category.

VIII.-That with the protection of the ecosystems immersed within the protected wild area to be declared, the protection and conservation of wildlife species of great biological, socioeconomic importance and in danger of extinction will be achieved.

IX.-That the administration of wildlife and the recommendation of measures that ensure the perpetuity of the species is a function of the General Directorate of Wildlife of the Ministry of Environment and Energy.

X.-That Wildlife Conservation Law No. 7317 in its Article 82 provides that national wildlife refuges are those that the Executive Branch declares or has declared as such, for the protection and research of wild flora and fauna, especially those that are endangered. For classification purposes, there are three classes of national wildlife refuges: State-owned Refuges, Mixed-ownership Refuges and Private-ownership Refuges.

XI.-That upon analyzing the documentation presented by Corporación de Desarrollo Agrícola del Monte Sociedad Anónima, it was determined that it complied with the provisions of Article 171 of Executive Decree No. 32633-MINAE named Regulations to the Wildlife Conservation Law.

XII.-That by agreement No. 12 of ordinary session No. 10-2012 of the National Council of Conservation Areas (CONAC), the creation of the Río General National Wildlife Refuge, private category, was approved in accordance with Article 25 subsection 6) of the Biodiversity Law No. 7788. Agreement ratified in ordinary session No. 11-2012 of November 26, 2012. Therefore,

"THE RÍO GENERAL NATIONAL WILDLIFE REFUGE IS HEREBY CREATED, PRIVATE CATEGORY"

en la totalidad del texto - Texto Completo Norma 37849 Crea Refugio Nacional de Vida Silvestre Río General, categoría privada Texto Completo acta: F50E2 Nº 37849-MINAET LA EL PRESIDENTA DE LA REPÚBLICA Y EL MINISTRO DE AMBIENTE Y ENERGÍA En el ejercicio de las facultades conferidas por el artículo 140, incisos 3), 8), 18) y 146) de la Constitución Política y con fundamento en lo dispuesto en los artículos 82 inciso c) y 87 de la Ley de Conservación de la Vida Silvestre N° 7317 de 7 de diciembre de 1992; los artículos 32, 34, 35, 36 y 37 de la Ley Orgánica del Ambiente N° 7554 del 13 de noviembre de 1995; los artículos 58 y 60 de la Ley de Biodiversidad N° 7788 del 27 de mayo de 1998; el artículo 6, inciso a) de la Ley Forestal N° 7575; los artículos 171 y 172 del Reglamento a la Ley de Conservación de la Vida Silvestre, Decreto Ejecutivo N° 32633-MINAE publicado en La Gaceta N° 180 del 20 de setiembre del 2005; los artículos 70 inciso e), 71 y 72 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N° 34433-MINAE del 11 de marzo del 2008 y los artículos 6, 9, 11 y 27 de la Ley General de la Administración Pública N° 6227 del 2 de mayo de 1978.

I.-Que es interés del Estado costarricense fortalecer las estructuras administrativas en el campo de los recursos naturales, a fin de contar con políticas definidas que garanticen el uso racional de dichos recursos.

II.-Que la sociedad denominada Corporación de Desarrollo Agrícola del Monte Sociedad Anónima (PINDECO-DEL MONTE), cédula jurídica número tres-ciento uno-diez mil ochocientos ochenta y dos, representada por el señor Rodrigo Alberto Jiménez Rímolo, mayor de edad, casado una vez, ingeniero civil, vecino de San José, portador de la cédula de identidad número uno- quinientos cuatro-ciento ochenta y cinco, quien es Segundo Vicepresidente con facultades de apoderado generalísimo sin límite de suma de la citada sociedad, cuya personería está vigente e inscrita en la Sección Mercantil del Registro Público al tomo: sesenta y dos, folio: trescientos veinte, asiento: doscientos treinta, solicitó al Área de Conservación La Amistad Pacífico, Oficina Subregional de Buenos Aires el sometimiento voluntario al Régimen de Refugios Privados de Vida Silvestre, parte de cuatro inmuebles de su propiedad inscritos en el Registro de la Propiedad Inmueble a los folios reales que se describen a continuación: Todos del Partido de Puntarenas, del Cantón 3 que es Buenos Aires, del Distrito 2 que es Volcán, folios reales número: 1. 6-158380-000, con una medida total de 124 ha 2982,13 dm², cuya área a someter sería de 66 ha 8682,00 dm2 con plano catastrado P-1205426-2007. 2. 6-155078-000, con una medida total de 602 ha 6635,84 dm2, cuya área a someter sería de 334 ha 3458,00 dm² con plano catastrado P-1205427- 2007. 3. 6-102318-000, con una medida total de 453 ha 8120, 26 dm2, cuya área a someter sería de 141 ha 4194,00 dm2 con plano catastrado P-665650-1987. 4. 6-20295-000, con una medida total de 46 ha 6813,33 dm2, cuya área a someter, sería de 11 ha 6909,00 dm2 con plano catastrado P-1204790-2007. Para una medida total someter a refugio, de los cuatro inmuebles, correspondiente a 554 ha 3243,00 dm2.

III.-Que las áreas a someter corresponden a diferentes sectores dentro de las plantaciones de pina, donde no se implemento dicha actividad agrícola por ser fragmentos remanentes de bosque, dentro de los cuales se incluyen áreas de protección de los Ríos General, Sonador y las Quebradas Cacao, Vueltas, Segundo, además de sectores con pendientes que no favorecen al cultivo de la fruta, sectores de bosque secundario y/o bosque ripario, sin embargo, hay varias partes que se pueden considerar con estructuras vegetales que varían entre charrales y tacotales jóvenes, que cumplen con los parámetros establecidos para incluirse dentro de la definición de bosque que indica la Ley Forestal N° 7575.

IV.-La sociedad Corporación de Desarrollo Agrícola del Monte Sociedad Anónima, a través del representante de la Sociedad aceptó expresamente, someter voluntariamente al régimen de Refugio Nacional de Vida Silvestre, categoría privada, los inmuebles dichos por un periodo de diez años, según lo establece el artículo 171 inciso f) del Decreto Ejecutivo N° 32633-MINAE, prorrogables en forma automática salvo su previa manifestación o de la administración que exprese lo contrario.

V.-Que dentro del área objeto de la solicitud existe un gran número de recursos faunísticos (insectos, mamíferos, anfibios, aves y reptiles) así como recursos florísticos que merecen ser conservados racional y sosteniblemente, para garantizar su permanencia dentro de los ecosistemas en que actualmente se encuentran. Los inmuebles sometidos al Refugio, fueron dedicados a actividades agrícolas en un pasado reciente, y por voluntad de su propietario, serán dedicados exclusivamente a la conservación en adelante, por lo que representa una importante área de recuperación de los hábitat naturales y para la regeneración de zonas degradadas que servirán para el desarrollo de la flora y fauna presente en la zona.

VI.-Que de conformidad con el artículo 87 de la Ley de Conservación de la Vida Silvestre, el principal efecto ambiental que genera la declaratoria de un inmueble bajo este régimen jurídico lo es, que para los efectos de la conservación de los recursos naturales la administración general del refugio corresponde a los propietarios de los inmuebles, la cual será supervisada por el Área de Conservación La Amistad Pacífico, Oficina Subregional de Buenos Aires.

VII.-Que por medio de la resolución número ACLA-P-D-039 de las trece horas del día veintitrés de enero del año dos mil doce, el Director a. i., del Área de Conservación La Amistad Pacífico, Licenciado Luis Sánchez Arguedas, aceptó la solicitud de sometimiento voluntario que realizó el Segundo Vicepresidente de la sociedad Corporación de Desarrollo Agrícola del Monte Sociedad Anónima (PINDECO-DEL MONTE), bajo la categoría de Refugio Nacional de Vida Silvestre, categoría privada.

VIII.-Que con la protección de los ecosistemas inmersos dentro del área silvestre protegida a declarar, se logrará la protección y conservación de especies de vida silvestre de gran importancia biológica, socioeconómica y en peligro de extinción.

IX.-Que la administración de la vida silvestre y la recomendación de medidas que aseguren la perpetuidad de las especies es función de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía.

X.-Que la Ley de Conservación de la Vida Silvestre N° 7317 en su artículo 82 dispone que son refugios nacionales de fauna y vida silvestre, los que el Poder Ejecutivo declare o haya declarado como tales, para la protección e investigación de la flora y la fauna silvestres, en especial de las que se encuentren en vías de extinción. Para efecto de clasificarlos, existen tres clases de refugios nacionales de vida silvestre: Refugios de propiedad estatal, Refugios de propiedad mixta y Refugios de propiedad privada.

XI.-Que analizada la documentación presentada por Corporación de Desarrollo Agrícola del Monte Sociedad Anónima se determinó que cumplió con lo establecido en el artículo 171 del Decreto Ejecutivo N° 32633-MINAE denominado Reglamento a la Ley de Conservación de la Vida Silvestre.

XII.-Que mediante acuerdo N° 12 de la sesión ordinaria N° 10-2012 del Consejo Nacional de Áreas de Conservación (CONAC) aprobó la creación del Refugio Nacional de Vida Silvestre Río General, categoría privada, de conformidad al artículo 25 inciso 6) de la Ley de Biodiversidad N° 7788. Acuerdo ratificado en sesión ordinaria N° 11-2012 del 26 de noviembre del 2012. Por tanto,
