in the entirety of the text - Complete Text of Norm 008 Establishes the National Technical Commission on Biosafety Complete Text record: F4D49 N° 008-2013-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Based on articles 140 and 146 of the Political Constitution, article 21, 28 subsection 2) of the General Law of Public Administration, Law N° 6227, of May 2, 1978, article 40 of the Phytosanitary Protection Law N° 7664, of April 8, 1997, articles 111, 112 and 114 of the Regulation to the Phytosanitary Protection Law, Executive Decree N° 26921, of March 20, 1998.

1. 1That article 40 of the Phytosanitary Protection Law, Law N° 7664, regulates the creation of the National Technical Commission on Biosafety (Comisión Técnica Nacional de Bioseguridad) as an advisory body to the State Phytosanitary Service (Servicio Fitosanitario del Estado), in Biotechnology, indicating that its composition, powers, and functions will be established in the respective regulation.
2. 2That article 111 of the Regulation to the Phytosanitary Protection Law, Executive Decree N° 26921-MAG, establishes as a function of the National Technical Commission on Biosafety to advise public institutions, the State Phytosanitary Service, and the offices responsible for issuing authorizations for the different processes involving genetically modified organisms.
3. 3That article 112 of the Regulation to the Phytosanitary Protection Law, Executive Decree N° 26921-MAG, which was amended by Executive Decree N° 37588-MAG-MS-MICIT-MINAET, of November 14, 2012, establishes the new composition structure of the National Technical Commission on Biosafety, which will come into effect as of June 25, 2013, including two representatives from the Ministry of Health, establishing that the representatives of the Ministry of Agriculture and Livestock are: one representative from the State Phytosanitary Service and one representative from the National Animal Health Service (Servicio Nacional de Salud Animal), bodies attached to the Ministry of Agriculture and Livestock.
4. 4That the State considers it opportune and convenient to establish, through a single act, the composition of the members of the Commission for the purposes of exercising their functions for the two-year term established in article 114 of the Regulation to the Phytosanitary Protection Law, Executive Decree N° 26921-MAG.
5. 5That the Ministry of Science, Technology and Telecommunications, the National Animal Health Service, the State Phytosanitary Service, the Ministry of Environment and Energy, the Ministry of Health, the National Seed Office (Oficina Nacional de Semillas), the National Academy of Sciences, the Costa Rican Federation for the Conservation of the Environment (Federación Costarricense para la Conservación del Ambiente), and the Biodiversity Coordination Network (Red de Coordinación en Biodiversidad), designated the officials who will compose the National Technical Commission on Biosafety.

en la totalidad del texto - Texto Completo Norma 008 Conforma la Comisión Técnica Nacional de Bioseguridad Texto Completo acta: F4D49 N° 008-2013-MAG LA PRESIDENTA DE LA REPÚBLICA Y LA MINISTRA DE AGRICULTURA Y GANADERÍA Con fundamento en los artículos 140 y 146 de la Constitución Política, artículo 21, 28 inciso 2) de la Ley General de la Administración Pública, Ley N° 6227, del 2 de mayo de 1978, artículo 40 de la Ley de Protección Fitosanitaria N° 7664, del 8 de abril de 1997, artículos 111, 112 y 114 del Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo N° 26921, del 20 de marzo de 1998.

1. 1Que el artículo 40 de la Ley de Protección Fitosanitaria, Ley N° 7664, regula la creación de la Comisión Técnica Nacional de Bioseguridad como órgano asesor del Servicio Fitosanitario del Estado, en Biotecnología, indicando que su integración, atribuciones y funciones serán establecidas en el reglamento respectivo.
2. 2Que el artículo 111 del Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo N° 26921-MAG, establece como función de la Comisión Técnica Nacional de Bioseguridad asesorar a las instituciones públicas, al Servicio Fitosanitario del Estado y a las oficinas encargadas de emitir las autorizaciones para los diferentes procesos con organismos modificados genéticamente.
3. 3Que el artículo 112 del Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo N° 26921-MAG, el cual fue modificado mediante el Decreto Ejecutivo N° 37588-MAG-MS-MICIT-MINAET, del 14 de noviembre del 2012, establece la nueva estructura de integración de la Comisión Técnica Nacional de Bioseguridad, la cual entrará a regir a partir del 25 de junio del 2013, realizando la inclusión de dos representantes del Ministerio de Salud, estableciendo que los representantes del Ministerio de Agricultura y Ganadería, son: un representante del Servicio Fitosanitario del Estado y un representante del Servicio Nacional de Salud Animal, órganos adscritos al Ministerio de Agricultura y Ganadería.
4. 4Que el Estado considera oportuno y conveniente establecer mediante un solo acto la integración de los miembros de la Comisión para los efectos del ejercicio de las funciones por el plazo de dos años establecidos en el artículo 114 del Reglamento a la Ley de Protección Fitosanitaria, Decreto Ejecutivo N° 26921-MAG.
5. 5Que el Ministerio de Ciencia, Tecnología y Telecomunicaciones, el Servicio Nacional de Salud Animal, el Servicio Fitosanitario del Estado, el Ministerio del Ambiente y Energía, el Ministerio de Salud, la Oficina Nacional de Semillas, la Academia Nacional de Ciencias, la Federación Costarricense para la Conservación del Ambiente y la Red de Coordinación en Biodiversidad, designaron a los funcionarios que integrarán la Comisión Técnica Nacional de Bioseguridad.
