The Municipality of San Rafael de Heredia, (hereinafter MSRH), In exercise of the powers conferred by Articles 169 and 170 of the Political Constitution; 59 of the General Law of Public Administration; Articles 2, 3, 4, 5, and 6 of the Municipal Code; Articles 6, 12, and 13 of the Organic Environmental Law.

I.-That every person has the right to a healthy and ecologically balanced environment.

II.-That for a better quality of life for present and future generations, we must provide adequate means and environmental education for the well-being of the general population.

III.-That for a healthy enjoyment of available resources and to gain greater knowledge of different current techniques and products in favor of sustainable development, appropriate means and activities must be created in order to obtain the greatest benefit from them.

IV.-That the MSRH promotes, plans, creates, and executes the environmental strategies, instruments, and actions necessary for the conservation, prevention, and protection of natural resources, also being a monitor of human activities that generate a negative environmental impact, all in accordance with current environmental legislation, in such a way as to allow the development of an environmental culture aimed at improving the quality of life of its inhabitants.

On the organization and the nature of the Ecological Fair

CHAPTER II

a)A physical space for the holding of the fair, with the participation of all offerors and interested parties, with the objective of holding a true Ecological Fair in the Canton.
b)Issuing an identification card to persons duly authorized to participate in the offer of products, commerce, and services.
c)Meeting spaces between producers, organizations for the promotion of agro-ecology and environmental protection, organic consumers, and the public in general, interested in knowing and learning the advantages of organic products and the defense of the environment.
d)A space for the dissemination of publications and educational materials related to green culture, organic agriculture, healthy food, and environmental protection.
e)Making a copy of this regulation available to the participant for its application, through the MSRH website.
f)A space to promote the canton's environmental and climate change initiatives that allow for publicizing the efforts made by the different organized groups of the canton.

Obligations of the organizers

CHAPTER III

a)Conduct prior coordination of the products to be offered with the purpose of having the greatest diversity while seeking a balance between supply, demand, and the need for information.
b)Disseminate the Ecological Fair through different means such as the municipality's website, radio, email, brochures, magazines, and television, among others.
c)Ensure compliance with this Regulation.
d)Assign the stands according to the type of participant.
e)Supervise that the products to be offered are of good quality and presentation, being able to remove those that, at the discretion of the Commission, do not meet this requirement.
f)Organize talks, workshops, consultancies, or exchange of g) Coordinate security with the Municipal Police, the public force of the Canton, and the Costa Rican Red Cross.
h)Ensure, jointly with the participants, the order, cleanliness, and security of the place where the Fair will be held.
i)Maintain an updated file of each of the participants of the fair to keep a record of the suppliers or offerors so that they can be taken into account on future occasions.
j)Administer the funds collected during the holding of the Ecological Fair, in accordance with current legislation.
k)Ensure the proper safekeeping of all documentation handled by the commission in the exercise of its functions.

Likewise, they must conform to the environmental policies of the MSRH.

Obligations of the participants

CHAPTER V

a)Complete the Registration Form, indicating the products, quantities, and presentations expected to be sold and/or exhibited at the Fair, no later than April 30th.
b)Sign the commitment contract or participation agreement with the Ecological Fair Commission in charge.
c)Place in a visible location, such as on a blackboard, banner, or poster, the list of products, sales prices, and category, as well as the certifications for organic, eco-friendly, or ecotourism products (for those who possess them) or permits approved by the Ministry of Health.
d)Wear the identification card provided by the MSRH in a visible location every day of the ecological fair.
e)Comply with the indications that the Ecological Fair Commission provides regarding sanitation, prevention and correction measures, and other indications required at the time.
f)Maintain good conduct, excellent personal presentation, adequate hygiene standards, and courteous treatment of the public.
g)Pay the fee for space usage at least two weeks before the start of the Fair.
h)Collaborate with the cleaning of the Ecological Fair, both at their own stand and at a general level.
i)Comply with and enforce this Regulation.
j)Respect and comply with national and local laws and regulations, the Traffic Law, the General Health Law, etc.

On the stands and the presentation

CHAPTER VI

They must ensure order and cleanliness in each designated space, as well as the care of the stand during its use on the days of the fair, and return it according to the requirements of the Ecological Fair Commission.

Education, Culture, and Services

CHAPTER VII

Exhibitions, workshops, talks, or consultancies.

a)Exhibitions on the environmental topics permitted at the Ecological Fair may be held in the park, the Athenaeum, or in places that the Ecological Fair Commission designates for that purpose.
b)The information on what is presented in each workshop, talk, or exhibition must be available to anyone who requires it, and a copy of the material must be left in digital format with the Environmental Management Unit, so that said information is kept at the MSRH.
c)The different workshops on environmental topics shall be held at the place, day, and time that the Ecological Fair Commission designates for that purpose and shall be in charge of the Association for Environmental Management and Collection Center, the Climate Change Commission, or another company, university, or institution that proposes it.
d)Environmental education activities such as talks, workshops, and exhibitions shall be coordinated by the Ecological Fair Commission, and the information on them shall be kept at the Environmental Management Unit of the MSRH and shall be available to the public.
e)Establish the relevant coordination to promote the participation of the canton's educational centers.

On cultural activities.

f)The cultural activities to be presented must have a traditional connotation and/or be focused on ecological environmental topics.

Food Services.

g)Establish a single food and beverage service for the sale of meals during the ecological fair, whose foods must have as their main focus consumer health, preferentially using organic, fresh, and sustainable products.
h)In the case of typical food, it must be prepared at the moment; it may not be displayed without proper protection nor reheated, and it must also follow food hygiene and safety standards.
i)The food service shall be operated by a single organization or group, and the money collected shall be used for what that organization or group agrees upon together with the Ecological Fair Commission, and must be used to promote environmental initiatives in the canton.
j)The sale of food must have the permit from the Ministry of Health, as indicated in the legislation in force for that case.
k)Water from food preparation must be disposed of in appropriate places for that purpose.
l)The sale of carbonated or alcoholic beverages shall not be permitted during the holding of the ecological fair.
m)The municipality shall coordinate the collection of waste produced from this activity.

It shall enter into force upon its publication. Publish for the second time.

La Municipalidad de San Rafael de Heredia, (en adelante MSRH), En ejercicio de las facultades que les confieren los artículos 169, 170 de la Constitución Política; 59 de la Ley General de la Administración Pública; los artículos 2, 3, 4, 5, 6 del Código Municipal; los artículos 6°, 12, 13 de la Ley Orgánica del Ambiente.

I.-Que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado.

II.-Que para una mejor calidad de vida de las presentes y futuras generaciones debemos de brindar los medios y la educación ambiental adecuada en pro del bienestar de la población en general.

III.-Que para un disfrute sano de los recursos disponible y para obtener un mayor conocimiento de las diferentes técnicas y productos actuales en pro de un desarrollo sustentable, se deben crear los medios y actividades adecuadas con el fin de obtener el mayor provecho de las mismas.

IV.-Que la MSRH, impulsa, planifica, crea y ejecuta las estrategias, instrumentos y acciones ambientales necesarias para la conservación, prevención y protección de los recursos naturales siendo además vigilante de las actividades humanas que generen un impacto ambiental negativo, todo acorde con la legislación ambiental vigente, de tal forma que permita desarrollar una cultura ambiental tendiente a mejorar la calidad de vida de sus habitantes.

Disposiciones Generales

Sobre la organización y el carácter de la Feria Ecológica

CAPÍTULO II

a)Un espacio físico para la realización de la feria, con la participación de todos los oferentes e interesados, con el objetivo de hacer una verdadera Feria Ecológica en el Cantón.
b)Otorgar un carnet de identificación a las personas debidamente autorizadas para participar en la oferta de productos, comercio y servicios.
c)Espacios de encuentro entre productores, organizaciones de promoción de la agro ecología y cuidado del medio ambiente, consumidor orgánico y público en general, interesado en conocer y aprender las ventajas de los productos orgánicos y la defensa del medio ambiente.
d)Un espacio para la difusión de publicaciones y materiales educativos relacionados con la cultura verde, la agricultura orgánica, la comida sana, protección del ambiente.
e)Poner a disposición del participante, mediante la página web de la MSRH, una copia del presente reglamento para su aplicación.
f)Un espacio para promocionar las iniciativas ambientales y de cambio climático del cantón que permitan dar a conocer los esfuerzos que realizan los diferentes grupos organizados del cantón.

Obligaciones de los organizadores

CAPÍTULO III

a)Realizar coordinaciones previas de los productos a ofertarse con la finalidad de tener la mayor diversidad y a la vez buscar un equilibrio entre la oferta, la demanda y la necesidad de la información.
b)Difundir la Feria Ecológica a través de diferentes medios como página web de la municipalidad, radio, correo electrónico, folletos, revistas y televisión entre otros.
c)Velar por el cumplimiento del presente Reglamento.
d)Designar los stands de acuerdo al tipo de participante.
e)Supervisar que los productos a ofertarse sean de buena calidad y presentación, pudiendo retirar aquellos, que a criterio de la Comisión, no cumplan con este requisito.
f)Organizar charlas, talleres o consultorías o de intercambio de g) Coordinar la seguridad con la Policía Municipal, la fuerza pública del Cantón y la Cruz Roja Costarricense.
h)Velar, conjuntamente con los participantes por el orden, aseo y seguridad del lugar donde se realizará la Feria.
i)Mantener un archivo actualizado de cada uno de los participantes de la feria para llevar un record de los proveedores u oferentes y que puedan ser tomados en cuenta en próximas ocasiones.
j)Administrar los fondos que se recauden en la realización de la Feria Ecológica, de conformidad con la legislación vigente.
k)Asegurar el debido resguardo de toda la documentación que maneje la comisión en el ejercicio de sus funciones.

Sobre los participantes

Asimismo deben ajustarse a las políticas ambientales de la MSRH.

Obligaciones de los participantes

CAPÍTULO V

a)Llenar el Formulario de Inscripción, indicando los productos, cantidades y presentaciones que espera vender y/o exponer en la Feria a más tardar el 30 de abril.
b)Firmar el contrato de compromiso o convenio de participación con la Comisión de Feria Ecológica a cargo.
c)Colocar en lugar visible como en una pizarra, banner o cartel, la lista de productos, precios de venta y categoría, así como las certificaciones de productos orgánicos, eco amigable, eco turístico (quienes lo posean) o permisos aprobados por parte del Ministerio de Salud.
d)Portar en lugar visible carné de identificación dado por parte de la MSRH, todos los días de la feria ecológica.
e)Acatar en conformidad las indicaciones que la Comisión de Feria Ecológica le indique en relación con sanidad, medidas de prevención y corrección y otras indicaciones requeridas en el momento.
f)Tener buena conducta, excelente presentación personal, normas de higiene adecuadas y trato amable al público.
g)Cancelar la cuota por concepto de uso de espacio mínimo dos semanas antes del inicio de la Feria.
h)Colaborar con la limpieza de la Feria Ecológica, tanto de su stand, como a nivel general.
i)Cumplir y hacer cumplir este Reglamento.
j)Respetar y cumplir las leyes y reglamentos nacionales y locales, Ley de Tránsito, Ley General de Salud, etc.

Sobre los puestos y la presentación

CAPÍTULO VI

Los mismos deberán velar por el orden y el aseo en cada espacio designado, así como el cuidado del puesto durante el uso los días de la feria y devolverlo conforme a los requerimientos de la Comisión de Feria Ecológica.

Educación, Cultura y Servicios

CAPÍTULO VII

consultorías.

a)Las exposiciones sobre los temas ambientales permitidos en la Feria Ecológica podrán llevarse a cabo en el parque, el Ateneo o en lugares que la Comisión de Feria Ecológica designe para ese fin.
b)La información sobre lo expuesto en cada taller, charla o deberá de dejar una copia del material de manera digital a la Unidad de Gestión Ambiental, con el fin de que dicha información se mantenga en la MSRH.
c)Las diferentes talleres en temas ambientales se llevarán a cabo en el lugar, día y hora que la Comisión de Feria Ecológica designe para tal efecto y estarán a cargo de La Asociación de Gestión Ambiental y Centro de Acopio, de la Comisión de Cambio Climático o de otra empresa, universidad o institución que lo proponga.
d)Las actividades de educación ambiental tales como charlas, talleres, las mismas se mantendrá en la Unidad de Gestión Ambiental de la MSRH las cuales estarán disponibles al público.
e)Establecer las coordinaciones pertinentes para promover la participación de los centros educativos del cantón.

De las actividades culturales.

f)Las actividades culturales a presentarse deben tener la connotación tradicional y/o estar avocado a temas ambientales ecológicos.

Servicios de Alimentación.

g)Establecer un único servicio de alimentos y bebidas para la venta comidas durante la feria ecológica, cuyos alimentos deben tener como enfoque principal la salud del consumidor, utilizando preferiblemente productos orgánicos, frescos y sostenibles.
h)En el caso de la comida típica debe ser preparada en el momento, no podrá estar expuesta sin su debida protección ni recalentada y además deberá de seguir las normas de higiene y seguridad alimenticia.
i)El servicio de alimentación deberá ser operado por una sola organización o grupo y el dinero que se recaude se utilizará en lo que dicha organización o grupo acuerden junto con la Comisión de Feria Ecológica debiendo ser utilizado para promover iniciativas ambientales en el cantón.
j)La venta de comidas debe de contar con el permiso del Ministerio de Salud, según se indica en la legislación vigente para ese caso.
k)Las aguas provenientes de la preparación de comidas deben de disponerse en los lugares adecuados para ese fin.
l)No se permitirá la venta de bebidas gaseosas o alcohólicas durante la realización de la feria ecológica.
m)Será la municipalidad quien coordine la recolección de la basura que se produzca de esta actividad.

Artículo 1 — Scope of Application: this regulation shall be mandatory in the Canton of San Rafael de Heredia, in relation to the holding of the Ecological Fair, to be held in the month of June every year; it may also be used as a reference for other ecological fairs with similar purposes.

Artículo 2 — Objectives: The objective of this regulation is to regulate the holding of an ecological fair, where adequate environmental education is guaranteed and there are options for sustainable and environmentally friendly services and products.

Artículo 3 — The Ecological Fair shall be coordinated by a Commission appointed by the Municipal Council and supervised by the Commission of Environmental Affairs of the MSRH.

Artículo 4 — The MSRH, through the Commission of the Ecological Fair, shall invite those interested in participating in the Ecological Fair of the canton of San Rafael de Heredia, to be held on the weekend coinciding with the celebration of Environment Week (Friday, Saturday, Sunday).

Artículo 5 — The Ecological Fair shall include: the sale of ecological products and services, exhibitions, consultancies, workshops and/or talks on environmental education, and a single food and beverage stand.

Artículo 8 — The MSRH, through the Commission of the Ecological Fair of San Rafael, shall promote the following:

Artículo 9 — The obligations that the organizers of the Ecological Fair must comply with are described below:

Artículo 11 — Participants must report the qualities and characteristics of their product, demonstrating compliance with Article 7 of this regulation at the time of obtaining authorization for participation in the fair.

Artículo 12 — Persons participating in this Ecological Fair must sign the Commitment Agreement and comply with the requirements indicated in this Regulation.

Artículo 13 — The obligations that the participants of the Ecological Fair must comply with are described below:

Artículo 15 — The Commission of the Ecological Fair shall distribute and designate the space for holding the different activities in accordance with the characteristics of each one.

Artículo 16 — Each participant may market their products at a stand designated by the organizers.

Artículo 17 — In the case of activities that generate economic resources, the participant must pay a fixed amount established by the Commission of the Ecological Fair.

Artículo 18 — Each sales stand must be duly identified, indicating the name of the corresponding producer or organization, the community of origin of the product, and the price of each product, if required.

Artículo 19 — The interior of the stands may be conditioned by each participant.

Artículo 20 — The activities and services that can be offered during the holding of the Ecological Fair are described below:

Artículo 2 — Objetivos: El presente reglamento tiene como objetivo, normar la realización de una feria ecológica, en donde se garantice una educación ambiental adecuada se tengan opciones de servicios y productos sostenibles y amigables con el ambiente.

Artículo 3 — La Feria Ecológica será coordinada por una Comisión nombrada por el Concejo Municipal y fiscalizada por la Comisión de Asuntos Ambientales de la MSRH.

Artículo 4 — La MSRH a través de la Comisión de Feria Ecológica invitará a los interesados en participar de la Feria Ecológica del cantón de San Rafael de Heredia, a realizarse el fin de semana que coincida con la celebración de la semana del Medio Ambiente (viernes, sábado, domingo).

Artículo 5 — La Feria Ecológica deberá incluir: venta de productos y servicios ecológicos, exposiciones, consultorías, talleres y/o charlas en educación ambiental y un único puesto de comidas.

Artículo 8 — La MSRH mediante la Comisión de la Feria Ecológica de San Rafael propiciará lo siguiente:

Artículo 9 — A continuación se describirán cada una de las obligaciones que deben cumplir los organizadores de la Feria Ecológica:

Artículo 11 — Los participantes deberán informar las calidades y cualidades de su producto, que demuestren el cumplimiento del artículo 7 del presente reglamento en el momento de obtener la autorización para la participación en la feria.

Artículo 12 — Las personas participantes en esta Feria Ecológica deberán firmar el Convenio de Compromiso y cumplir con los requisitos indicados en el presente Reglamento.

Artículo 13 — A continuación se describirán cada una de las obligaciones que deben cumplir los participantes de la Feria Ecológica:

Artículo 15 — La Comisión de Feria Ecológica distribuirá y designará el espacio para la realización de las diferentes actividades de conformidad con las características de cada una.

Artículo 16 — Cada participante podrá comercializar sus productos en un puesto designado por los organizadores.

Artículo 17 — En el caso de las actividades que generen recursos económicos, el participante deberá cancelar un monto fijo establecido por la Comisión de Feria Ecológica.

Artículo 18 — Cada puesto de venta deberá estar debidamente identificado, indicando el nombre de la persona productora u organización correspondiente, comunidad origen del producto y precio de cada producto en caso de requerirlo.

Artículo 19 — La parte interior de los puestos podrá ser acondicionada por cada participante.

Artículo 20 — A continuación se describirán las actividades y servicios que se pueden ofrecer durante la realización de la Feria Ecológica:
