DECLARE OF PUBLIC AND NATIONAL INTEREST THE ACTIVITY CALLED "THE WHALE FESTIVAL" Full text of Norm 37913 Declares of public and national interest the activity called "The Whale Festival" Full Text of act: F2B90 Nº 37913-MEIC-TUR THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ECONOMY, INDUSTRY AND COMMERCE, AND THE MINISTER OF TOURISM In use of the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 27, subsection l), and 28, subsection 2), paragraph b) of the General Public Administration Law, Law N° 6227 of May 2, 1978; the Organic Law of the Ministry of Economy, Industry and Commerce, Law N° 6054 of June 14, 1977; the Law for the Strengthening of Small and Medium Enterprises, Law Nº 8262 of May 2, 2002; and the Organic Law of the Costa Rican Tourism Institute, Law Nº 1917 of July 30, 1955.

I.- That it is of great importance for the Government of the Republic of Costa Rica to contribute to the country's economic and social development process through employment generation and the development of SMEs (PYME) in the Brunca Region.

II.- That by Executive Decree N° 37027-MEIC-PLAN, the Competitiveness Council of the Brunca Region (Consejo de Competitividad de la Región Brunca, CCRB) was created as a multisectoral (public, private, municipal, academic, organized groups) and participatory body responsible for strengthening the business climate and the competitiveness of enterprises in the Brunca Region through multisectoral analysis and the generation of consensus-based proposals with an impact on improving competitive capacities.

III.- That the creation of the Competitiveness Council of the Brunca Region and the definition of the actions implemented by this body are based on the Modelo and the Agenda de Competitividad regional, the result of the process developed within the framework of the Joint Programme "Development of competitiveness for the Brunca Region in the tourism and agro-industry sectors, with emphasis on the creation of green and decent jobs for poverty reduction." IV.- That in the Modelo de Competitividad of the Brunca Region, the strategic activities included those oriented toward tourism development, promoting the development of micro, small, and medium enterprises that allow for enhancing employment opportunities and economic growth.

V.- That the activity called "Festival de las Ballenas," which has been taking place during the first and second weekend of September of each year, constitutes an event that adds value to tourism activity and business development based on the natural wealth of the Brunca Region of Costa Rica. Therefore, They decree:

Considering:

en la totalidad del texto - Texto Completo Norma 37913 Declara de interés público y nacional la actividad denominada "El Festival de las Ballenas" Texto Completo acta: F2B90 Nº 37913-MEIC-TUR LA PRESIDENTA DE LA REPÚBLICA, LA MINISTRA DE ECONOMÍA INDUSTRIA Y COMERCIO, Y EL MINISTRO DE TURISMO En uso de las facultades que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 27 inciso l) y 28 inciso 2), acápite b) de la Ley General de la Administración Pública, Ley N° 6227 del 2 de mayo de 1978; Ley Orgánica del Ministerio de Economía, Industria y Comercio, Ley N° 6054 del 14 de junio de 1977; la Ley de Fortalecimiento de las Pequeñas y Medianas Empresas, Ley Nº 8262 del 2 de mayo de 2002; y, Ley Orgánica del Instituto Costarricense de Turismo, Ley Nº 1917 del 30 de julio de 1955.

I.-Que es de gran importancia para el Gobierno de la República de Costa Rica, contribuir con el proceso de desarrollo económico y social del país, mediante la generación de empleo y el desarrollo de las PYME en la Región Brunca.

II.-Que mediante Decreto Ejecutivo N° 37027-MEIC-PLAN, se creó el Consejo de Competitividad de la Región Brunca(CCRB), como instancia multisectorial (público, privado, municipal, académico, grupos organizados) y participativa, encargada del fortalecimiento del clima de negocios y la competitividad de las empresas de la Región Brunca, mediante el análisis multisectorial y la generación de propuestas consensuadas con impacto en la mejora de las capacidades competitivas.

III.-Que la creación del Consejo de Competitividad de la Región Brunca y la definición de las acciones que por esta instancia son implementadas tienen su fundamento en el Modelo y la Agenda de Competitividad regional, resultado del proceso elaborado en el marco del Programa Conjunto "Desarrollo de la competitividad para la Región Brunca en los sectores de turismo y agroindustria, con énfasis en la creación de empleos verdes y dignos para la reducción de la pobreza".

IV.-Que en el Modelo de Competitividad de la RegiónBrunca se definió entre las actividades estratégicas las orientadas al desarrollo turístico, fomentando el desarrollo de micro, pequeñas y medianas empresas que permitan potenciar las oportunidades de empleo y crecimiento económico.

V.-Que la actividad denominada "Festival de las Ballenas", que se ha venido llevando a cabo, durante el primero y segundo fin de semana del mes de setiembre de cada año, constituye un acontecimiento que da valor agregado a la actividad del turismo y al desarrollo empresarial a partir de la riqueza natural con que cuenta la Región Brunca de Costa Rica. Por tanto,

DECLARAR DE INTERÉS PÚBLICO Y NACIONAL LA ACTIVIDAD DENOMINADA "EL FESTIVAL DE LAS BALLENAS", QUE SE LLEVA A CABO EL PRIMERO Y SEGUNDO FIN DE SEMANA DEL MES DE SETIEMBRE DE CADA AÑO EN LA REGIÓN BRUNCA
