10176-2011 at eight hours and forty minutes on August 5, 2011, case file No. 09- 011542-0007-CO, the Constitutional Chamber of the Supreme Court of Justice resolved the unconstitutionality action filed by Aros de Costa Rica S. A., in which "The action is partially granted. In consequence, the phrase of Transitional Provision 1 of the agreement of the Belén Council, from ordinary session No. 16-2007, Article 5°, is annulled as unconstitutional, solely insofar as it states: 'for the necessary time.' This ruling has declaratory and retroactive effects to the effective date of the annulled regulation, without prejudice to rights acquired in good faith...."

10176-2011, regarding whether an agreement of the Municipal Council or a Public Hearing in compliance with Article 17 of the Urban Planning Law (LPU) is required to set the term for the transitional article. In response, said Chamber issued Vote No. 16594-2011 at 15:33 hours on November 30, 2011, which states in the pertinent part: "In this sense, defining which procedure must be followed in the specific case, as a result of this judicial decision, is a matter that the municipal authorities themselves must resolve, and not this Chamber."

40-2012 adopted agreement Ref. 4039/2012 to establish the term for transitional article 1 of the current Regulatory Plan and remitted the information to the Constitutional Chamber.

article 6° of ordinary session No. 05-2013 of January 22, 2013, resolved to clarify that the hearing to define the term of the transitional article of the Regulatory Plan of the Canton of Belén, which was originally going to be held on January 25, 2013, was rescheduled for March 22 of the same year, for not complying with the procedural rules regarding the minimum deadline to convene interested parties to participate in the hearing, as required by Law. Likewise, the Municipal Secretary was instructed to proceed with the publication process in La Gaceta.

Likewise, a total of 2 written inquiries were received from those present, and both were addressed orally during the event; namely, the inquiry made by Mr. Juan Manuel González Zamora (inquiry slip No. 004) and that made by Mr. Carlos Rolando Garita Abarca (inquiry slip No. 001).

Juan Manuel González Zamora was received by the Municipal Council via process No. 1684, which was addressed by official letter OAPR-O-036-2013.

This argument was already extensively discussed by the Constitutional Chamber, hence said Chamber partially granted the originally alleged unconstitutionality action, indicating to the Municipality its duty to establish a term, which was justified by the Regulatory Plan Monitoring Committee and endorsed by the Municipal Council in ordinary session No. 40-2012.

Leonel Rosales Maroto, a.i. Director of Urban Planning, National Institute of Housing and Urban Planning (INVU), submitted to the Customer Service Unit, upon reviewing the proposal related to the definition of the term of the transitional article of the regulatory plan, granted its approval.

I.To approve the proposed modification of the term for Transitional Provision 1 of the Regulatory Plan of the canton of Belén.

II.To modify the second agreement adopted by this Municipal Council in article 5° of extraordinary session No. 16-2007, article 5° of March 13, 2007, published in La Gaceta No. 59 of the 23rd of the same month and year, to read as follows: "To include a transitional article in the current Regulatory Plan of the canton of Belén, which suspends immediately, in general, the granting of water availability certificates and construction permits for Residential, Commercial, and Industrial Development Projects, in Condominiums and Urbanizations, until December 31, 2013, a term provided for updating and implementing the new Regulatory Plan for the canton of Belén in light of the new known elements.

III. To communicate this to the National Institute of Housing and Urban Planning (INVU)

IV. To publish in the Official Gazette La Gaceta

Belén, August 22, 2013.-

A., en la cual "Se declara parcialmente con lugar la acción. En consecuencia, se anula por inconstitucional la frase del Transitorio 1 del acuerdo del Concejo de Belén, de la sesión ordinaria N° 16-2007. Artículo 5°, únicamente en cuanto indica: "por el tiempo necesario". Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de la norma anulada, sin perjuicio de los derechos adquiridos de buena fe...."

Ante el cual dicha Sala emite el Voto N° 16594-2011 de las 15:33 horas del 30 de noviembre del 2011 en el cual se indica en lo conducente: "En este sentido, definir cuál es el procedimiento que debe seguir en el caso concreto, producto de esta decisión judicial es un asunto que deben resolver las propias autoridades municipales, y no esta Sala."

Según el artículo 169 de la Constitución Política, y el artículo de 15 Ley de Planificación Urbana.

4039/2012 para establecer el plazo de vigencia del artículo transitorio 1 al Plan Regulador vigente y remite información a la Sala Constitucional.

Asimismo se instruyó a la Secretaria Municipal para que procediera con el trámite de publicación en La Gaceta.

La nueva fecha para la audiencia que se definió fue el 22 de marzo del 2013.

Asimismo, se recibieron un total de 2 consultas escritas realizadas por parte de los presentes, ambas se atendieron a viva voz en el evento; a saber la consulta realizada por el señor Juan Manuel González Zamora (boleta de consulta N° 004) y la realizada por el señor Carlos Rolando Garita Abarca (boleta de consulta N° 001).

Sin embargo a todas se brindaron la respuesta correspondiente.

Este argumento ya fue ampliamente discutido por la Sala Constitucional, de ahí que dicha Sala declara parcialmente con lugar la acción de inconstitucionalidad alegada originalmente, indicando a la Municipalidad su deber de establecer un plazo el cual fue justificado por la Comisión de Seguimiento del Plan Regulador y avalado por el Concejo Municipal en sesión ordinaria N° 40-2012.

Leonel Rosales Maroto, Director de Urbanismo a. í., Instituto de Vivienda y Urbanismo, presentado en la Unidad de Servicio al Cliente, al conocer la propuesta relacionada con la propuesta de la definición del plazo de vigencia del artículo transitorio del plan regulador, otorgó su aprobación.

I. Aprobar la propuesta de modificación del plazo de vigencia del Transitorio 1 del Plan Regulador del cantón de Belén

II.Modificar el acuerdo segundo adoptado por este Concejo Municipal en el artículo 5° la sesión extraordinaria N° 16-2007, artículo 5° del 13 de marzo del 2007, publicado en La Gaceta N° 59 del 23 del mismo mes y año para que se lea así: "Incluir un artículo transitorio en el actual Plan Regulador del cantón de Belén, que suspende inmediatamente, en general, el otorgamiento de disponibilidad de agua y permisos de construcción, a los Proyectos de Desarrollo Habitacional, Comercial e industrial, en Condominios y Urbanizaciones, hasta el 31 de diciembre del 2013, plazo previsto para actualizar y poner en ejecución el nuevo Plan Regulador para el cantón de Belén a la luz de los nuevos elementos conocidos.

III. Comunicar al Instituto de Vivienda y Urbanismo

IV. Publicar en el Diario Oficial La Gaceta
