in the entirety of the text - Complete Text of Regulation 37460 Creates the National Onion Commission Complete Text of record: F230F No. 37460- MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by Articles 140, subsections 3), 8), 18), and 20) and 146 of the Political Constitution, Articles 25, 27.1, 28.2b, of Law No. 6227 of May 2, 1978, General Public Administration Law, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock.

1That pursuant to the provisions of Law No. 7064, Law for the Promotion of Agricultural Production, the Minister of Agriculture and Livestock is responsible for the stewardship (Rectoría) of the Agri-Food Sector.
2That the productive essence of an activity is conditioned by the components that guarantee legitimate competitiveness, therefore it is necessary to ensure that the policies, plans, and procedures developed in the country to regulate and develop the onion horticultural activity, within the set of elements that make up the sustainability of management, address in a special and concrete manner the elements that guarantee the resulting competitiveness.
3That it is necessary for the Office of the Vice Minister of Agriculture and Livestock, within the Agri-Food Sector, to have the advisory assistance of a group of experts to achieve timely and effective management that satisfies the country's interests, building a space for reflection and debate that contributes to the development of the competitiveness of the onion horticultural producer, institutionalizing this scope to establish a fruitful dialogue with the references of maximum prestige in the field, with the purpose of presenting and participating in deliberations and debates, enriching them with a multidisciplinary dimension.
4That onion cultivation in recent years has been exposed to and affected by diseases, pests, natural disasters, and above all by low prices that threaten its stability.
5That it is of institutional and national convenience and in accordance with the objectives established in the axes and strategic actions contemplated in the National Development Plan 2010-2014, to establish a body that analyzes and proposes technical actions in the phases of agricultural production and marketing, as well as to design strategies to insert producer organizations into commercial circuits, both national and international. Therefore,

They Decree:

CREATION OF THE NATIONAL ONION COMMISSION

Whereas:

a. Manage and recommend projects before the institutions of the Agri-Food Sector that have an impact on the development of the Onion Agricultural Sector and submit to the Office of the Vice Minister the observations and comments that seek to improve the condition of this Sector.

b. Propose the issuance, amendment, or repeal of regulations, policies, and procedures related to the national onion agricultural activity, addressing national or international circumstances, in accordance with the goal of competitiveness and the sustainable development of the onion sector.

a)The Vice Minister of Agriculture and Livestock, who shall preside over it, as its President.
b)The Director of the Higher Directorate of Regional Operations and Agricultural Extension of the Ministry of Agriculture and Livestock.
c)The Coordinator of National Programs of the Ministry of Agriculture and Livestock.

ch) The Manager of the National Onion Program of the Minister of Agriculture and Livestock.

d)A representative of the National Production Council, appointed by the Institutional Head.
e)A representative of the State Phytosanitary Service, appointed by the Directorate of the State Phytosanitary Service.
f)A representative of the National Seed Office designated by the Board of Directors.
g)A representative of the National Institute of Innovation and Transfer of Agricultural Technology (INTA), appointed by the Board of Directors.
h)A representative of the Agronomic Research Center of the University of Costa Rica, appointed by the Dean of the Faculty of Agri-Food Sciences.
i)Three representatives; one from each Agricultural Services Agency of the Ministry of Agriculture and Livestock in the onion-producing zones, appointed by the Regional Directors of the Central Oriental, Central Occidental, and Central Sur regions.
j)A representative from each of the organized onion producer organizations, corresponding to: the National Horticultural Corporation, the Union of Small and Medium National Producers (Upanacional), the Cantonal Agricultural Center of Santa Ana, the Association of Horticulturists of Irazú of Tierra Blanca de Cartago (ASHORI), the Association and Chamber of Farmers (ASOCAGRI), the Association of Producers of Llano Grande (APLA). Each of these representatives shall be appointed by the respective Board of Directors of the aforementioned organizations.

In all matters not regulated in this Decree, the regulations established for collegiate bodies in the General Public Administration Law shall apply.

Issued at the Presidency of the Republic, on the twenty-eighth day of the month of November of the year two thousand twelve.

en la totalidad del texto - Texto Completo Norma 37460 Crea Comisión Nacional de Cebolla Texto Completo acta: F230F Nº 37460- MAG LA PRESIDENTA DE LA REPÚBLICA Y LA MINISTRA DE AGRICULTURA Y GANADERÍA En uso de las facultades que les confieren los artículos 140 incisos 3), 8), 18) y 20) y 146 de la Constitución Política, los artículos 25, 27.1, 28.2b, de la Ley No. 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, la Ley No. 7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería.

1Que de conformidad con lo dispuesto en la Ley Nº 7064, Ley de Fomento a la Producción Agropecuaria, compete a la Ministra de Agricultura y Ganadería, la Rectoría del Sector Agroalimentario.
2Que la esencia productiva de una actividad está condicionada por los componentes que garanticen la legítima competitividad, siendo en consecuencia necesario garantizar que las políticas, planes y procedimientos desarrollados en el país para regular y desarrollar la actividad hortícola cebollera, en el conjunto de elementos que componen la sostenibilidad de la gestión, atiendan de manera especial y concreta los elementos que garanticen la competitividad resultante.
3Que es necesario para el Despacho de la Viceministra de Agricultura y Ganadería, dentro del Sector Agroalimentario, contar con la asesoría de un grupo de expertos para lograr una gestión oportuna y eficaz que satisfaga los intereses del país, construyendo un espacio de reflexión y debate que coadyuve en el desarrollo de la competitividad del productor hortícola cebollero, institucionalizando este ámbito para entablar un fructifico diálogo con los referentes de máximo prestigio en la materia, con el objeto de exponer y participar de las deliberaciones y debates enriqueciéndolos con una dimensión multidisciplinaria.
4Que el cultivo de la cebolla en los últimos años ha estado expuesto y afectado por enfermedades, plagas, desastres naturales y sobre todo por los bajos precios que atentan contra su estabilidad.
5Que es de conveniencia institucional y nacional y conforme con los objetivos establecidos en los ejes y las acciones estratégicas contempladas en el Plan Nacional de Desarrollo 2010-2014, establecer un órgano que analice y proponga las acciones técnicas en las fases de producción y mercadeo agropecuario, así como diseñar las estrategias para insertar las organizaciones de productores en los circuitos comerciales, tanto nacional como internacional. Por tanto,

CREACIÓN DE LA COMISIÓN NACIONAL DE CEBOLLA

Considerando:

Decretan:

a. Gestionar y recomendar los proyectos ante las instituciones del Sector Agroalimentario que tengan incidencia en el desarrollo del Sector Agrícola Cebollero y presentar al Despacho de la Viceministra las observaciones y comentarios que procuren mejorar la condición de este Sector.

b. Proponer la emisión, modificación o derogatoria de normas, políticas y procedimientos relacionados con la actividad agrícola cebollera nacional, atendiendo las circunstancias nacionales o internacionales, acordes con la meta de competitividad y el desarrollo sostenible del sector cebollero.

a)La Viceministra de Agricultura y Ganadería, quien la presidirá, como Presidenta de la misma.
b)El Director de la Dirección Superior de Operaciones Regionales y Extensión Agropecuaria del Ministerio de Agricultura y Ganadería.
c)El Coordinador de Programas Nacionales del Ministerio de Agricultura y Ganadería.

ch) El Gerente del Programa Nacional de Cebolla del Ministerio de Agricultura y Ganadería.

d)Un representante del Consejo Nacional de Producción, designado por el Jerarca Institucional.
e)Un representante del Servicio Fitosanitario del Estado, designado por la Dirección del Servicio Fitosanitario del Estado.
f)Un representante de la Oficina Nacional de Semillas designado por la Junta Directiva.
g)Un representante del Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA), designado por la Junta Directiva.
h)Un representante del Centro de Investigaciones Agronómicas de la Universidad de Costa Rica designado por el Decano de la Facultad de Ciencias Agroalimentarias.
i)Tres representantes; uno por cada Agencia de Servicios Agropecuarios del Ministerio de Agricultura y Ganadería de las zonas productoras de cebolla, designados por los Directores Regionales de las regiones Central Oriental, Central Occidental y Central Sur.
j)Un representante por cada una de las organizaciones de productores cebolleros organizados, correspondiente a: la Corporación Hortícola Nacional, la Unión de Pequeños y Medianos Productores Nacionales (Upanacional), el Centro Agrícola Cantonal de Santa Ana, la Asociación de Horticultores del Irazú de Tierra Blanca de Cartago (ASHORI), la Asociación y Cámara de Agricultores (ASOCAGRI), la Asociación Productores de Llano Grande (APLA). Cada uno de estos representantes será designado por la Junta Directiva respectiva de las organizaciones mencionadas.

En todo lo que no se regule en este Decreto se aplicará la normativa establecida para los órganos colegiados en la Ley General de la Administración Pública.

Dado en la Presidencia de la República, a los veintiocho días del mes de noviembre del año dos mil doce.

Artículo 4 — —The Commission shall have its headquarters in the Ministry of Agriculture and Livestock and shall be coordinated by the Vice Minister of said Ministry, meeting ordinarily once a month, on the third Thursday of each month, and extraordinarily when convened by the President.

Artículo 5 — —It shall take effect upon its publication.

Artículo 5 — Rige a partir de su publicación.
