I.—That by means of Law No. 8710, published in La Gaceta No. 48 of March 10, 2009, article 2° of Law No. 5695, Law for the Creation of the National Registry, and its reforms, is amended, indicating that the National Cadastre becomes part of the Real Estate Registry.
II.—That Executive Decree No. 35509-J of September 30, 2009, Regulation of Organization of the Real Estate Registry published in the Official Gazette La Gaceta No. 198 of October 13, 2009, establishes that the Real Estate Registry is composed of the Subdirectorate of Cadastre and the Subdirectorate of Registry.
III.—That the Real Estate Registry of the National Registry, based on the Law of National Cadastre No. 6545 of March 25, 1981, in its article 13 has the exclusive authority for the execution and maintenance of the Cadastre, a function that may be partially delegated to other state institutions.
IV.—That the Legislative Assembly, on November 27, 2001, approved Law No. 8154, "Loan Agreement No. 1284/OC-CR, Cadastre and Registry Regularization Program", signed between the Government of the Republic and the Inter-American Development Bank (IDB), for the execution of the Cadastre and National Registry Regularization Program, which by provision of the same law, is under the charge of an Executing Unit attached to the Minister of Finance as a deconcentrated body.
V.—That the Cadastre and National Registry Regularization Program has as its task the cadastral survey with the objective of forming the national cadastre and making the cadastral and registry information of real estate compatible, in application of what is provided by Law of Cadastre No. 6545 of March 25, 1981.
VI.—That in accordance with what article 1° Executive Decree No. 30106-J establishes, which "Declares Cadastral Zone the Entirety of the Cantons of the National Territory" published in La Gaceta No. 19 of January 28, 2002, and article 7 of the Regulation to the Law of National Cadastre, Executive Decree No. 34331, which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone.
VII.—That the Regulation to the Law of National Cadastre, Executive Decree No. 34331, which has been in effect since September 27, 2008, establishes the technical requirements for the survey of survey plans.
VIII.—That because the cadastral survey work for Districts 01 San Joaquín, 02 Barrantes, and 03 Llorente of Canton 08 Flores of the Province of Heredia has concluded, and in accordance with what article 19 of the National Cadastre Law and 10 of its regulation establish, the property owners of said Districts were convened by the Real Estate Registry of the National Registry and the Executing Unit of the Cadastre and National Registry Regularization Program to a public exhibition to learn the results of the survey and express their conformity or non-conformity.
IX.—That the call to the public exhibition of the results of the cadastral survey of Districts 01 San Joaquín, 02 Barrantes, and 03 Llorente of Canton 08 Flores of the Province of Heredia was published in the Official Gazette La Gaceta No. 235 of December 03, 2009 (page 48) and in the nationally circulated newspaper La Nación, on November 25 and 26, 2009.
X.—That in a resolution at eight o'clock on January fifteen, two thousand thirteen, the Real Estate Registry of the National Registry declared the cadastral data resulting from the cadastral survey carried out in districts 01 San Joaquín, 02 Barrantes, and 03 Llorente of canton 08 Flores of the province of Heredia to be final.
XI.—That the terms of the deadlines established in article 20 of the Law of National Cadastre have already elapsed and the claims filed by the owners were resolved by the Directorate of the Real Estate Registry of the National Registry. Therefore, they decree:
DISTRICTS 01 SAN JOAQUÍN, 02 BARRANTES, AND 03 LLORENTE OF CANTON 08 FLORES OF PROVINCE 04 HEREDIA ARE DECLARED A CADASTRATED ZONE
Considering:

6545, its Regulation, and its reforms, specifically in article 26 of the Regulation to the Law of National Cadastre, Executive Decree No. 34331 of November 29, 2007, reformed by Executive Decree No. 34763 of September 16, 2008, and effective as of September 27, 2008, regarding methods and accuracies, as well as with the following indications and requirements:
1.1. The following must be stated:
1.1.1. The survey plan outline with the coordinates of all its vertices in the System of the Official Coordinate Network of Executive Decree No. 33797-MJ-MOPT of March 30, 2007 (National Geodetic Reference Network Horizontal CR05 and Transverse Mercator Projection for Costa Rica CRTM05); 1.1.2. The survey method used for the survey thereof and for its connection to the Official Coordinate Network; 1.1.3. The relative accuracy obtained in the survey of the plan, specifying if it is a zone that has mapping at a scale of 1:1000 or 1:5000; 1.1.4. The absolute accuracy of the nominal values of the horizontal coordinates of the vertices of the plan shall be indicated with the number of decimals according to their accuracies; 1.1.5. For the determination of the relative accuracy of surveys of real estate with areas less than one hectare and that are located within the area mapped at a scale of 1:5000, the same accuracy shall be used as in the areas mapped at the scale of 1:1000.
1.1.6. For the previous case 1.1.5, the absolute accuracy to apply shall be the same as that which corresponds to the areas mapped at the scale of 1:5000; 1.1.7. In the case of surveys of real estate that are within the transition areas mapped between the scales of 1:1000 and 1:5000, the surveyor must adjust to the accuracy guidelines established for the area in which the largest surface area of said survey is located.
1.2. The Cadastral Subdirectorate of the Real Estate Registry of the National Registry shall use, for the verification of the geometry of the plans resulting from the liberal practice of surveying, what is applicable from the Manual of processes required to achieve the compatibility of cadastral and registry information, its annexes, as well as its future modifications.

I.-Que mediante Ley Nº 8710, publicada en La Gaceta Nº 48 del 10 de marzo de 2009 se reforma el artículo 2° de la Ley Nº 5695, Ley de Creación del Registro Nacional, y sus reformas, indicando que el Catastro Nacional pasa a formar parte del Registro Inmobiliario.
II.-Que el Decreto Ejecutivo Nº 35509-J de 30 de setiembre de 2009, Reglamento de Organización del Registro Inmobiliario publicado en el Diario Oficial La Gaceta Nº 198 del 13 de octubre de 2009, establece que el Registro Inmobiliario está conformado por la Subdirección de Catastro y la Subdirección Registral.
III.-Que el Registro Inmobiliario del Registro Nacional, con fundamento en la Ley de Catastro Nacional Nº 6545 de 25 de marzo de 1981, en su artículo 13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro, función que puede delegar parcialmente en otras instituciones estatales.
IV.-Que la Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la Ley Nº 8154, "Convenio de Préstamo Nº 1284/OC-CR, Programa de Regularización del Catastro y Registro", suscrito entre el Gobierno de la República y el Banco Interamericano de Desarrollo (BID), para la ejecución del Programa de Regularización del Catastro y Registro Nacional, que por disposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al Ministro de Hacienda como órgano desconcentrado.
V.-Que el Programa de Regularización del Catastro y Registro Nacional, tiene como tarea el levantamiento catastral con el objetivo de formar el catastro nacional y compatibilizar la información catastral y registral de los inmuebles, en aplicación de lo que dispone la Ley de Catastro Nº 6545 de 25 de marzo de 1981.
VI.-Que de conformidad con lo que establece el artículo 1º Decreto Ejecutivo Nº 30106-J donde se "Declara Zona Catastral la Totalidad de los Cantones del Territorio Nacional" publicado en La Gaceta Nº 19 de 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo Nº 34331, el cual rige desde el 27 de setiembre de 2008, la totalidad de los cantones del territorio nacional fueron declarados zona catastral.
VII.-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo Nº 34331 el cual rige desde el 27 de setiembre de 2008, establece los requerimientos técnicos para el levantamiento de planos de agrimensura.
VIII.-Que por haber concluido los trabajos de levantamiento catastral de los Distritos 01 San Joaquín, 02 Barrantes y 03 Llorente del Cantón 08 Flores de la Provincia de Heredia y de conformidad con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su reglamento, fueron convocados por el Registro Inmobiliario del Registro Nacional y la Unidad Ejecutora del Programa de Regularización del Catastro y Registro Nacional, los propietarios de inmuebles de dichos Distritos a una su conformidad o disconformidad.
IX.-Que la convocatoria a la exposición pública de los resultados del levantamiento catastral de los Distritos 01 San Joaquín, 02 Barrantes y 03 Llorente del Cantón 08 Flores de la Provincia de Heredia fue publicada en el Diario Oficial La Gaceta Nº 235 del 03 de diciembre del 2009 (página 48) y en el diario de circulación nacional La Nación, en fechas 25 y 26 de noviembre de 2009.
X.-Que en resolución de las ocho horas del quince de enero del año dos mil trece el Registro Inmobiliario del Registro Nacional declaró firmes los datos catastrales resultantes del levantamiento catastral efectuado en los distritos 01 San Joaquín, 02 Barrantes y 03 Llorente del cantón 08 Flores de la provincia de Heredia.
XI.-Que ya transcurrieron los términos de los plazos establecidos en el artículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la Dirección del Registro Inmobiliario del Registro Nacional, los reclamos presentados por los propietarios. Por tanto,
SE DECLARA ZONA CATASTRADA LOS DISTRITOS 01 SAN JOAQUÍN, 02 BARRANTES Y 03 LLORENTE DEL CANTÓN 08 FLORES DE LA PROVINCIA 04 HEREDIA
Considerando:

En una zona no catastrada, se utilizará el plano catastrado respectivo.
1.1. Deberá consignarse:
1.1.1. El derrotero del plano con las coordenadas de todos sus vértices en el Sistema de la Red Oficial de Coordenadas del Decreto Ejecutivo N° 33797-MJ-MOPT del 30 de marzo de 2007 (Red Geodésica Nacional de Referencia Horizontal CRO5 y Proyección Transversal de Mercator para Costa Rica CRTM05); 1.1.2. El método de agrimensura utilizado para el levantamiento del mismo y para su enlace a la Red Oficial de Coordenadas; 1.1.3. La exactitud relativa obtenida en el levantamiento del plano, especificando si se trata de zona que cuenta con mapeo a escala 1:1000 o 1:5000; 1.1.4. La exactitud absoluta de los valores nominales de las coordenadas horizontales de los vértices del plano, serán indicadas con la cantidad de decimales acorde con sus exactitudes; 1.1.5. Para la determinación de la exactitud relativa de los levantamientos de inmuebles con áreas menores a una hectárea y que se encuentren dentro del área mapeada a escala 1:5000, se utilizará la misma exactitud que en las áreas mapeadas a la escala 1:1000.
1.1.6. Para el caso anterior 1.1.5, la exactitud absoluta a aplicar será la misma que corresponde a las áreas mapeadas a la escala 1:5000; 1.1.7. En el caso de levantamientos de inmuebles, que se encuentren dentro de las áreas de transición mapeadas entre las escalas 1:1000 y 1:5000, el agrimensor deberá ajustarse a los lineamientos de exactitud, establecidos para el área en el que se encuentre la mayor superficie de dicho levantamiento.
1.2. La Subdirección Catastral del Registro Inmobiliario del Registro Nacional, usará para la verificación de la geometría de los planos producto del ejercicio liberal de la agrimensura, lo que corresponda aplicar del Manual de procesos requeridos para lograr la compatibilización de la información catastral y registral, sus anexos, así como sus futuras modificaciones.
Dentro de esta presentación podrá solicitarse un archivo en formato .txt, donde consten los valores nominales de las coordenadas planas nacionales oficiales, correspondientes a los vértices del polígono representado en el plano a registrar.
