en la totalidad del texto - Full Text of Norm 37773 Creates the National Territorial Information System (SNIT) Full Text of act: F06C5 N° 37773-JP-H-MINAE-MICITT THE PRESIDENT OF THE REPUBLIC, AND THE MINISTERS OF FINANCE; OF JUSTICE AND PEACE; OF ENVIRONMENT AND ENERGY, AND OF SCIENCE, TECHNOLOGY AND TELECOMMUNICATIONS Based on articles 9 and 140 subsection 18) of the Political Constitution of Costa Rica; 21, 23, 25, 27 subsection 1) and 28 subsection 2), paragraph b) of Law No. 6227, General Law of Public Administration of May 2, 1978; and article 3 of Law No. 8154 of November 27, 2001, approval of Loan Agreement No. 1284-OC/CR, "Cadastre and Registry Regularization Program," entered into between the Republic of Costa Rica and the Inter-American Development Bank, Executive Decree No. 34434-H-J, of January 25, 2008, Operational Regulations of the Cadastre and Registry Regularization Program.
Considering:
8154 and Executive Decree No. 34434-H-J of January 25, 2008, which is the Operational Regulations of the Cadastre and Registry Regularization Program, published in the Official Gazette La Gaceta No. 68 of April 8, 2008, indicate that the Executing Unit is a deconcentrated body attached to the Ministry of Finance, responsible for the execution and coordination of the Program's activities, whose term shall be equal to the program execution period.
1284/OC-CR for the execution of the so-called "Cadastre and Registry Regularization Program," approved by Law No. 8154 of November 27, 2001.
1284/OC-CR, through which Component 1 of the program is established, its objective is the formation of a cadastre and its compatibilization with the Real Property Registry, currently called the Real Estate Registry, based on Decree No. 35509-J of September 30, 2009, published in La Gaceta No. 198, Tuesday, October 13, 2009, as well as the enactment of the legal and institutional reform required for the long-term sustainability of the cadastral-registry system.
Said Infrastructure, must be common to all government entities, from the municipalities that must be interconnected, to each of the State Institutions that have competences in territorial administration or that require territorial information to carry out their management.
That article 4 of Executive Decree No. 34434-H-J of January 25, 2008, which is the Operational Regulations of the Cadastre and Registry Regularization Program, published in the Official Gazette La Gaceta No. 68 of April 8, 2008, establishes among the powers of the Executing Unit, is the component for the reorganization of the Cadastral System and its compatibilization with the National Registry, which in turn has 4 sub-components:
a. Institutional reorganization of the Cadastral-Registry System and adaptation of the legal and regulatory framework.
b. Formation of the Cadastre and compatibilization with the Registry.
c. Establishment of the National Territorial Information System (SNIT).
d. Administrative Alternative Conflict Resolution (Resolución Alternativa de Conflictos, RAC).

10.-That for the provisional operation of the SNIT it is necessary that its technical operation be under the charge of the Executing Unit of the Cadastre and Registry Regularization Program. Therefore, They Decree:
CREATION OF THE NATIONAL SYSTEM OF TERRITORIAL INFORMATION
a. Publicize in an integrated manner the georeferenceable territorial information existing in public entities and bodies, as well as that generated by private entities that, at the discretion of the National Registry, is of interest to the SNIT.
b. Foster the definition, operationalization, and use of a single geospatial data infrastructure.
c. Strengthen and support the management of territorial information of those public entities or bodies with competence in this matter.
d. Promote the use of territorial information systems with platforms developed under standards that ensure the interoperability of geospatial data.
e. Provide access, whether free or for a fee, to the public territorial information contained in the system to all citizens as well as to public entities and bodies, whether they are providers or not of territorial information for the system, thereby promoting the democratization of the use of territorial information at all levels of society.

In addition to the competences assigned to it by law, the National Registry shall be responsible for:
a. Defining and permanently reviewing the technical standards and measures that enable the interoperability of territorial information.
b. Defining, reviewing, and proposing technical standards and measures to strengthen and promote the territorial information management policy and guarantee access, whether free or for a fee, to public territorial information by public entities and bodies as well as by citizens in general.
c. Defining the technical standards and characteristics (standards) based on which territorial information must be generated to be incorporated into the system.
d. Promoting the establishment of a national geospatial data infrastructure.
The National Registry may agree with autonomous and semi-autonomous institutions, municipalities, and public enterprises on the publication in the SNIT of that georeferenceable territorial information that they administer, manage, and construct.
Said information must comply with the technical standards and standards defined by the National Registry, according to the standards and regulations in force at the international level and that are used for the generation, validation, and management of geospatial information. The participating institutions must be responsible for the maintenance, updating, and reliability of the information provided.

Considerando:
Dicha Infraestructura, deberá ser común a todas las entidades gubernamentales, desde los municipios que deberán estar interconectados, hasta cada una de las Instituciones del Estado, que tengan competencias en la administración del territorio o que requieran información territorial para realizar su gestión.
Que el artículo 4 del Decreto Ejecutivo N° 34434-H-J del 25 de enero del 2008, que es el Reglamento Operativo del Programa de Regularización de Catastro y Registro, publicado en el Diario Oficial La Gaceta N° 68 del 8 de abril del 2008, establece entre las atribuciones de la Unidad Ejecutora, se encuentra el componente de reorganización del Sistema Catastral y su compatibilización con el Registro Nacional, que a su vez tiene 4 subcomponentes:
a. Reorganización institucional del Sistema Catastral-Registral y adecuación del marco legal y normativo.
b. Formación del Catastro y compatibilización con el Registro.
c. Establecimiento del Sistema Nacional de Información Territorial (SNIT).
d. Resolución Alternativa de Conflictos (RAC) administrativo.
10.-Que para el funcionamiento provisional del SNIT es necesario que su operación técnica esté a cargo de la Unidad Ejecutora del Programa de Regularización de Catastro y Registro. Por tanto,
CREACIÓN DEL SISTEMA NACIONAL DE INFORMACIÓN TERRITORIAL
Decretan:
a. Publicitar en forma integrada la información territorial georeferenciable existente en entes y órganos públicos, así como la que generen entes privados y que a criterio del Registro Nacional resulten de interés para el SNIT.
b. Propiciar la definición, operacionalización y uso de una misma infraestructura de datos geoespaciales.
c. Fortalecer y apoyar la gestión de la información sobre el territorio de aquellos entes u órganos públicos con competencia en esa materia.
d. Fomentar el uso de sistemas de información territorial con plataformas desarrolladas bajo estándares que aseguren la interoperabilidad de datos geoespaciales.
e. Dar acceso, sea gratuito u oneroso, a la información territorial pública contenida en el sistema a todos los ciudadanos así como a los entes y órganos públicos, sean estos proveedores o no de información territorial para el sistema, fomentando con ello la democratización en el uso de la información del territorio a todos los niveles de la sociedad.
Además de las competencias que le asigna la ley, corresponderá al Registro Nacional:
a. Definir y examinar en forma permanente las normas técnicas y las medidas que permitan la interoperabilidad de la información territorial.
b. Definir, examinar y proponer normas técnicas y medidas para fortalecer y promover la política de gestión de la información territorial y garantizar el acceso, sea gratuito u oneroso, a la información territorial pública por parte de los entes y órganos públicos así como de la ciudadanía en general.
c. Definir las normas y características técnicas (estándares) a partir de las cuales debe generarse la información territorial para ser incorporada al sistema.
d. Promover el establecimiento de una infraestructura nacional de datos geoespaciales.
El Registro Nacional, podrá convenir con las instituciones autónomas y semiautónomas, las municipalidades y las empresas públicas la publicación en el SNIT de aquella información territorial georeferenciable que administren, gestionen y construyan.
Dicha información debe ser conforme con las normas técnicas y estándares definidos por el Registro Nacional, según los estándares y normativa vigentes a nivel internacional y que son utilizados para la generación, validación y gestión de la información geoespacial. Las instituciones que participen deben ser responsables por el mantenimiento, actualización y confiabilidad de la información suministrada.
