in the entirety of the text - Complete Text of Norm 37713 Approval of Technical Regulation RTCR 460:2011 "Requirements for Sanitary Varnishes Used in Canned Fishery Products" Complete Text of Act: EF8D9 No. 37713-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK By virtue of the powers conferred upon them by articles 140, subsections 3) and 18), and article 146 of the Political Constitution; articles 27, subsection 1), and 28, subsection 2, heading b) of the General Public Administration Law, Law No. 6227 of May 2, 1978; the Law Mandating the Use of the International System of Units of Measure "SI" (Decimal Metric System), Law No. 5292 of August 9, 1973; the General Law of the National Animal Health Service (SENASA), Law No. 8495 of April 6, 2006; the Law of the National System for Quality, Law No. 8279 of May 2, 2002; and the Law Approving the Final Act Incorporating the Results of the Uruguay Round of Multilateral Trade Negotiations, Law No. 7475 of December 20, 1994.

Considering:

8495 of April 6, 2006, the Law of the National Animal Health Service (SENASA), establishes that its competence is ".To administer, plan, direct, and take the pertinent veterinary or sanitary measures for the control of the safety and innocuity of products and by-products of animal origin, in the stages of capture, production, industrialization, and commercialization, considering food additives, residues of veterinary drugs, pesticides, and other chemical, biological, or biotechnological contaminants." It is necessary to prepare this Technical Regulation to guarantee the innocuity of canned fishery products.

Therefore, They Decree:

RTCR 460: 2011" Requirements for Sanitary Varnishes Used in Canned Fishery Products"

(Sinalevi Note: Because Technical Regulation RTCR 460:2011 "Requirements for sanitary varnishes used in canned fishery products" has its own articles, it must be consulted in the system independently)

The cost of the verification of this Regulation must be covered by the State in accordance with the General Law of the National Animal Health Service, Law No. 8495 of April 6, 2006. The costs incurred by request or due to the non-compliance of the regulated party shall be charged directly to them.

Non-compliance with the provisions established in this Regulation will give rise to the application of the sanctions indicated in the General Law of the National Animal Health Service, Law No. 8495 of April 6, 2006; as the case may be. The criminal liability derived from the non-compliance of this Regulation will be within the cognizance of the respective Courts of Justice; for such purposes, the provisions and sanctions established in the current criminal legislation will be applied.

Single Transitory Provision.—The National Animal Health Service (SENASA) of the Ministry of Agriculture and Livestock, by reasoned resolution, must publish in the Official Gazette La Gaceta, within a period no greater than 3 months following the entry into force of this Regulation, the verification procedure.

Considerando:

Por tanto,

Decretan:

RTCR 460: 2011" Requisitos para Barnices Sanitarios Utilizados en Conservas de Productos Pesqueros"

(Nota de Sinalevi: Por tener articulado propio el Reglamento Técnico RTCR 460:2011 "Requisitos para barnices sanitarios utilizados en conservas de productos pesqueros", debe consultarse en el sistema de forma independiente)

El costo de la verificación del presente Reglamento deberá cubrirlo el Estado conforme a la Ley General del Servicio Nacional de Salud Animal, Ley Nº 8495 del 6 de abril del 2006. Los costos en que se incurran por solicitud o debido al incumplimiento del administrado, se cobrarán directamente a éste.

El incumplimiento a las disposiciones establecidas en este Reglamento, dará lugar a la aplicación de las sanciones que señalan la Ley General del Servicio Nacional de Salud Animal, Ley Nº 8495 del 6 de abril del 2006; según sea el caso. La responsabilidad penal derivada del incumplimiento del presente Reglamento, será del conocimiento de los Tribunales de Justicia respectivos; para tales efectos se aplicarán las disposiciones y sanciones establecidas en la legislación penal vigente.

Dado en la Presidencia de la República. San José, a los trece días del mes de febrero del año dos mil trece.

Transitorio único.-El Servicio Nacional de Salud Animal (SENASA) del Ministerio de Agricultura y Ganadería mediante resolución razonada deberá publicar en el Diario Oficial La Gaceta, en un plazo no mayor a 3 meses posteriores a la entrada en vigencia del presente Reglamento, el procedimiento de verificación.

Artículo 2 — Que es necesario emitir una serie de regulaciones propias y particulares de los barnices que se utilizan en los envases de acero para productos pesqueros, a fin de cumplir con el cometido de preservar la inocuidad y duración de los mismos.

Artículo 1 — Aprobar el siguiente Reglamento Técnico:

Artículo 4 — Deróguese la Directriz SENASA-DG-D011-2010, publicada en el Diario Oficial La Gaceta N° 243 del 15 de diciembre del 2010.

Artículo 5 — El presente Reglamento empezará a regir 6 meses después de su publicación en el Diario Oficial La Gaceta.
