1That it is the duty of the State to ensure the protection and conservation of natural resources, and to establish preventive measures to avoid their deterioration.
2That forest fires cause the country, year after year, substantial losses and irreparable damage to forest resources, agriculture, soil, air, water, scenic beauty, and the quality of life of the inhabitants.
3That in accordance with article 6 subsection k) of the Forestry Law No. 7575, the State Forest Administration has competence for the prevention and control of forest fires on lands of the State's natural heritage and to collaborate in the prevention of fires on private plantations and forests.
4That article 35 of the Forestry Law No. 7575 declares all actions undertaken to prevent and extinguish forest fires to be of public interest; these measures being binding for all authorities of the country.
5That article 35 of the Forestry Law No. 7575 provides that it is the responsibility of the State Forest Administration (AFE), through the National System of Conservation Areas (SINAC), to order and direct the actions aimed at preventing forest fires.

6º—The actions for prevention and control of forest fires require close coordination and joint support among the different public institutions, non-governmental organizations, and private companies, together with the support of society.

7That through Executive Decree N° 26399-MINAE of October 27, 1997, and repealed by article 13 of Executive Decree N° 29149 of November 13, 2000, the National Commission on Forest Fires (CONIFOR) was created, an inter-institutional coordination body attached to the National System of Conservation Areas (SINAC) of the Ministry of Environment, Energy and Telecommunications (MINAET).
8That since 1997, our country has had Fire Management Strategies, in which the guidelines and policies that have allowed the State to comprehensively address the problem of forest fires in the country have been established, articulating actions and strengthening management for integrated fire management (manejo integral del fuego) in the institutions that make up CONIFOR. Therefore,

They decree:

"Declare the National Strategy for Integrated Management of Fire in Costa Rica 2012-2021 and its National Action Plan as the official instruments for planning, control, monitoring, and evaluation in this matter; ratify the National Commission on Forest Fires (CONIFOR), and create the National Program for Integrated Fire Management, the National Technical Committee on Forest Fires (COTENA), and the National Center for Integrated Fire Management (CENMIF) of the National System of Conservation Areas"

Considering:

a. National System of Conservation Areas, the permanent representative being the Coordinator of said Commission, who shall be recognized as the National Coordinator of CONIFOR.

b. Benemérito Cuerpo de Bomberos de Costa Rica, who shall hold the Secretariat of the Commission.

c. Ministry of Agriculture and Livestock.

d. Ministry of Public Education.

e. Ministry of Public Security.

f. National Commission for Risk Prevention and Emergency Response.

g. Instituto Costarricense de Electricidad.

h. Instituto de Desarrollo Rural.

i. Instituto Costarricense de Acueductos y Alcantarillados.

j. Instituto Meteorológico Nacional.

k. Benemérita Cruz Roja Costarricense.

l. Asociación de Voluntarios para el Servicio en las Áreas Silvestres Protegidas.

Those designated must have field experience and have received training in fire management (manejo del fuego).

a. Hold ordinary and extraordinary meetings, convened by the National Coordinator or the Secretariat of the Commission, and shall meet once a month or whenever warranted, according to the current operating regulations.

b. Represent the country in the various activities of fire management (manejo del fuego) carried out at the national and international level.

c. Establish coordination and contact mechanisms at the national and international level to combine efforts and strengthen integrated fire management (manejo integral del fuego) actions.

d. Strengthen actions that allow the incorporation and participation of society, community organizations, governmental and non-governmental organizations.

e. Implement, at the level of each institution, an Annual Work Plan based on the strategic lines described in the National Strategy for Integrated Fire Management in Costa Rica.

f. Implement and support joint actions for the fulfillment of the activities described in the National Action Plan for Integrated Fire Management.

g. Establish inter-institutional coordination actions to improve the various integrated fire management (manejo integral del fuego) activities carried out at the national level.

h. Provide human, technical, logistical, and economic support to carry out prevention activities, appropriate use of fire, emergency response to forest fires, and research at the national level, as well as what is required by the Regional Commissions for Integrated Fire Management.

i. Support technically, logistically, economically, and with personnel the National Center for Integrated Fire Management (CENMIF).

j. Carry out coordination with the respective entities in case technical assistance or attention to forest fires is requested in other countries.

k. Approve the Annual Work and Contingency Plan of CONIFOR.

l. Comply with the internal operating regulations of CONIFOR.

a. The actions established to address the problem of forest fires and agricultural burning (quemas agrícolas) shall be developed within the context of integrated fire management (manejo integral del fuego) under the protection of the right to life, the established national structure, and sustainable development.

b. Participation shall be based on the commitment of governmental and non-governmental institutions at the national and international level, private companies, local governments, and community organizations, through the recognition of the role and integration of society in integrated fire management (manejo integral del fuego).

c. Decision-making in integrated fire management (manejo integral del fuego) shall be based on inter-institutional coordination, through knowledge and accumulated experience in relation to institutional and social management, mitigation, research, and transfer of knowledge and operations.

d. Promote actions of support, exchange, advice, and accompaniment to the Inter-institutional Commission on Agricultural Burning, in accordance with what is established in the current executive decree for that purpose.

e. Technical advice to the Emergency Operations Center (COE) in cases of forest fires that occur at the national level, warranting the convening of CONIFOR before this national coordination body.

. Manage the execution and monitoring of the National Strategy for Integrated Fire Management in Costa Rica and the National Action Plan.

. Establish methodological guidelines for the preparation and supervision of the Annual Work Plans of the institutions that make up CONIFOR in matters of integrated fire management (manejo integral del fuego).

. Support, strengthen, and advise the technical management and decision-making of CONIFOR, the Executive Directorate of SINAC, or any other entity or Head of the Public Administration that requires technical advice in matters of integrated fire management (manejo integral del fuego).

. Provide support, follow-up, and supervision to the actions carried out by the Conservation Areas of SINAC on this topic.

. Support, supervise, assume and transfer command, as well as decision-making in the response to forest fires, the criteria of which during the emergency shall be binding for the respective authorities.

. Promote the development of institutional programs on integrated fire management (manejo integral del fuego) among the institutions that make up CONIFOR.

. Provide technical support and give criteria during the process of seeking resources required from the international sphere for integrated fire management (manejo integral del fuego).

. Define and support the actions that allow the strengthening and participation of society in integrated fire management actions.

. Evaluate and propose guidelines for the creation and organization of volunteer forest firefighter brigades.

. Coordinate the development and operation of the National Center for Integrated Fire Management (CENMIF).

. Promote inter-institutional and national campaigns on integrated fire management (manejo integral del fuego).

. Represent the country in national and international commissions or committees on integrated fire management (manejo integral del fuego).

. Supervise the dissemination of the inter-institutional actions carried out in compliance with the National Integrated Fire Management Plan.

The CENMIF shall have a physical space, with personnel, equipment, and technology provided by SINAC, which shall integrate, manage, and provide the information on what is developed at the country level in matters of Integrated Fire Management.

1Que es deber del Estado velar por la protección y conservación de los recursos naturales; así como establecer las medidas preventivas para evitar el deterioro de los mismos.
2Que los incendios forestales provocan al país año a año, cuantiosas pérdidas e irreparables daños en los recursos forestales, agrícolas, suelo, aire, agua, belleza escénica y la calidad de vida de los habitantes.
3Que de conformidad con el artículo 6 inciso k) de la Ley Forestal Nº 7575, es competencia de la Administración Forestal del Estado la prevención y control de incendios forestales en los terrenos del patrimonio natural del Estado y colaborar en la prevención de incendios en plantaciones y bosques privados.
4Que el artículo 35 de la Ley Forestal Nº 7575, declara de interés público todas las acciones que se emprendan, a fin de prevenir y extinguir incendios forestales; siendo éstas medidas vinculantes para todas las autoridades del país.
5Que el artículo 35 de la Ley Forestal Nº 7575 dispone que corresponde a la Administración Forestal del Estado (AFE), por medio del Sistema Nacional de Áreas de Conservación (SINAC) ordenar y encauzar las acciones tendientes a prevenir los incendios forestales.

6º-Las acciones de prevención y control de incendios forestales requieren una estrecha coordinación y apoyo conjunto entre las diferentes instituciones públicas, organizaciones no gubernamentales y empresas privadas, junto al apoyo de la sociedad.

7Que mediante Decreto Ejecutivo N° 26399-MINAE del 27 de octubre de 1007 y derogado mediante el artículo 13 del Decreto Ejecutivo N° 29149 del 13 de noviembre del 2000, se creó la Comisión Nacional sobre Incendios Forestales (CONIFOR), ente de coordinación interinstitucional adscrito al Sistema Nacional de Áreas de Conservación (SINAC) del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET).
8Que desde el año 1997, nuestro país ha contado con Estrategias de Manejo del Fuego; en las cuales se han establecido los lineamientos y políticas que han permitido al Estado; atender de forma integral la problemática de los incendios forestales en el país; articulando acciones y fortaleciendo la gestión para el manejo integral del fuego en las instituciones que conforman la CONIFOR. Por tanto,

"Declárese la Estrategia Nacional de Manejo Integral del Fuego en Costa Rica 2012-2021 y su Plan Nacional de Acción como los instrumentos oficiales para la planificación, control, seguimiento y evaluación en esta materia; se ratifica a la Comisión Nacional sobre Incendios Forestales (CONIFOR) y se crea el Programa Nacional de Manejo Integral del Fuego, el Comité Técnico Nacional de Incendios Forestales (COTENA) y el Centro Nacional de Manejo Integral del Fuego (CENMIF) del Sistema Nacional de Áreas de Conservación"

Considerando:

Decretan:

a. Sistema Nacional de Áreas de Conservación, siendo el representante titular el Coordinador de dicha Comisión; al que se le reconocerá como Coordinador Nacional de la CONIFOR.

b. Benemérito Cuerpo de Bomberos de Costa Rica, quien desempeñará la Secretaría de la Comisión.

c. Ministerio de Agricultura y Ganadería.

d. Ministerio de Educación Pública.

e. Ministerio de Seguridad Pública.

f. Comisión Nacional de Prevención de Riesgos y Atención de Emergencias.

g. Instituto Costarricense de Electricidad.

h. Instituto de Desarrollo Rural.

i. Instituto Costarricense de Acueductos y Alcantarillados.

j. Instituto Meteorológico Nacional.

k. Benemérita Cruz Roja Costarricense.

l. Asociación de Voluntarios para el Servicio en las Áreas Silvestres Protegidas.

Los designados deberán tener experiencia de campo y haber recibido capacitación en manejo del fuego.

a. Realizar reuniones ordinarias y extraordinarias, convocadas por el Coordinador Nacional o la Secretaría de la Comisión, debiendo sesionar una vez al mes o bien cuando se amerite, de acuerdo al reglamento de funcionamiento vigente.

b. Representar al país en las diversas actividades de manejo del fuego que se llevan a cabo a nivel nacional e internacional.

c. Establecer mecanismos de coordinación y contacto en el ámbito nacional e internacional, para aunar esfuerzos y fortalecer las acciones de manejo integral del fuego.

d. Fortalecer acciones que permitan la incorporación y participación de la sociedad, organizaciones comunales, organizaciones gubernamentales y no gubernamentales.

e. Implementar a nivel de cada institución un Plan Anual de Trabajo, con base en las líneas estratégicas descritas en la Estrategia Nacional de Manejo Integral del Fuego en Costa Rica.

f. Implementar y apoyar acciones conjuntas para el cumplimiento de las actividades descritas en el Plan Nacional de Acción de Manejo Integral del Fuego.

g. Establecer acciones de coordinación interinstitucional para mejorar las diversas actividades de manejo integral del fuego que se lleven a cabo a nivel nacional.

h. Brindar apoyo humano, técnico, logístico y económico para llevar a cabo actividades de prevención, uso adecuado del fuego, atención de emergencias por incendios forestales e investigación a nivel nacional; así como lo requerido por las Comisiones Regionales de Manejo Integral del Fuego.

i. Apoyar técnica, logística, económicamente y con personal al Centro Nacional de Manejo Integral del Fuego (CENMIF).

j. Realizar las coordinaciones con los entes respectivos, en caso de solicitarse asistencia técnica o atención de incendios forestales en otros países.

k. Aprobar el Plan Anual de Trabajo y de Contingencia de la CONIFOR.

l. Dar cumplimiento al reglamento interno de funcionamiento de la CONIFOR.

a. Las acciones que se establezcan para atender la problemática de los incendios forestales y quemas agrícolas, se desarrollaran dentro del contexto de manejo integral del fuego al amparo del derecho a la vida, estructura nacional establecida y el desarrollo sustentable.

b. La participación estará basada en el compromiso de las instituciones gubernamentales y no gubernamentales a nivel nacional e internacional, empresas privadas, gobiernos locales y organizaciones comunales mediante el reconocimiento del rol e integración de la sociedad en el manejo integral del fuego.

c. La toma de decisiones en el manejo integral del fuego se fundamentara en la coordinación interinstitucional, mediante el conocimiento y la experiencia acumulada con relación a la gestión institucional, social, mitigación, investigación y transferencia de conocimientos y operaciones.

d. Promover acciones de apoyo, intercambio, asesoría y acompañamiento a la Comisión Interinstitucional de Quemas Agrícolas, de acuerdo a lo establecido en el decreto ejecutivo vigente para tal fin.

e. Asesoramiento técnico al Centro de Operaciones de Emergencias (COE) ante casos de incendios forestales que se presenten a nivel nacional, que amerite la convocatoria de la CONIFOR, ante este ente de coordinación nacional.

. Gestionar la ejecución y seguimiento de la Estrategia Nacional de Manejo Integral del Fuego en Costa Rica y el Plan Nacional de Acción.

. Establecer lineamientos metodológicos para la elaboración y supervisión de los Planes Anuales de Trabajo de las instituciones que conforman la CONIFOR, en materia de manejo integral del fuego.

. Apoyar, fortalecer y asesorar la gestión técnica y toma de decisiones de la CONIFOR, la Dirección Ejecutiva del SINAC u otro ente o Jerarca de la Administración Pública que requiera del asesoramiento técnico en materia de manejo integral del fuego.

. Brindar apoyo, seguimiento y supervisión a las acciones que realicen las Áreas de Conservación del SINAC en esta temática.

. Apoyar, supervisar, relevar y transferir el mando, así como la toma de decisiones en la atención de incendios forestales, cuyo criterio durante la emergencia será vinculante para las respectivas autoridades.

. Fomentar el desarrollo de programas institucionales sobre manejo integral del fuego entre las instituciones que conforman la CONIFOR.

. Apoyar técnicamente y dar criterio durante la gestión de búsqueda de recursos que se requieran del ámbito internacional, para el manejo integral del fuego.

. Definir y apoyar las acciones que permitan el fortalecimiento y participación de la sociedad en las acciones de manejo integral del fuego.

. Evaluar y proponer lineamientos para la creación y organización de las brigadas de bomberos (as) forestales voluntarios.

. Coordinar el desarrollo y operación del Centro Nacional para el Manejo Integral del Fuego (CENMIF).

. Promover campañas interinstitucionales y nacionales sobre manejo integral del fuego.

. Representar al país en las comisiones o comités, nacionales e internacionales sobre manejo integral del fuego.

. Supervisar la difusión de las acciones interinstitucionales que se ejecutan en cumplimiento del Plan Nacional de Manejo Integral del Fuego.

El CENMIF, tendrá un espacio físico, con personal, equipo y tecnología, aportado por el SINAC; el cual integrará, manejará y brindará la información de lo que se desarrolle a nivel de país en materia de Manejo Integral del Fuego.

Artículo 3 — —The National Commission on Forest Fires (CONIFOR) shall be comprised of one permanent representative and one alternate delegate from the highest authority of each of the following institutions:

Artículo 6 — —The functions of CONIFOR shall be the following:

Artículo 7 — —For the fulfillment of the functions of CONIFOR, the following shall be the main policies:

Artículo 9 — —The Executive Directorate of the National System of Conservation Areas (SINAC) shall appoint the institution's representative to the National Commission on Forest Fires (CONIFOR), who shall be in charge of the following actions:

Artículo 10 — —The headquarters of the Coordination of the National Commission on Forest Fires (CONIFOR) shall be located at the offices of the Executive Secretariat of SINAC.

Artículo 14 — —The National Program for Integrated Fire Management is created as the internal coordination and technical advisory body for the Executive Directorate of SINAC in integrated fire management (manejo integral del fuego) actions carried out at the national level by SINAC.

Artículo 17 — —Create the National Center for Integrated Fire Management (CENMIF), which shall be located at the offices of the Executive Secretariat of SINAC.

Artículo 18 — —Repeal Executive Decree Nº 31397-MINAE, published in La Gaceta Nº 198 of October 15, 2003, and Executive Decree Nº 33108-MINAE, published in La Gaceta Nº 124 of June 28, 2006.

Artículo 19 — —Shall become effective upon its publication in the Official Newspaper La Gaceta.

Artículo 3 — La Comisión Nacional sobre Incendios Forestales (CONIFOR) estará integrada por un representante titular y un suplente, delegados por la máxima autoridad de cada una de las siguientes instituciones:

Artículo 6 — Las funciones de la CONIFOR serán las siguientes:

Artículo 7 — Para el cumplimiento de las funciones de la CONIFOR, se tendrán como políticas principales las siguientes:

Artículo 9 — La Dirección Ejecutiva del Sistema Nacional de Áreas de Conservación (SINAC) nombrará al representante de la institución, ante la Comisión Nacional sobre Incendios Forestales (CONIFOR), el cual tendrá a cargo las siguientes acciones:

Artículo 10 — La sede de la Coordinación de la Comisión Nacional sobre Incendios Forestales (CONIFOR) se ubicará en las oficinas de la Secretaría Ejecutiva del SINAC.

Artículo 14 — Se crea el Programa Nacional de Manejo Integral del Fuego como la instancia interna de coordinación y asesoramiento técnico de la Dirección Ejecutiva del SINAC, en acciones de manejo integral del fuego que se realicen a nivel nacional por parte del SINAC.

Artículo 17 — Créase el Centro Nacional de Manejo Integral del Fuego (CENMIF), el cual se ubicará en las oficinas de la Secretaría Ejecutiva del SINAC.

Artículo 18 — Deróguese el Decreto Ejecutivo Nº 31397-MINAE, publicado en La Gaceta Nº 198 del 15 de octubre del 2003 y el Decreto Ejecutivo Nº 33108-MINAE, publicado en La Gaceta Nº 124 del 28 de junio del 2006.

Artículo 19 — Rige a partir de su publicación en el Diario Oficial La Gaceta.
