1. 1That Director Jeannette Pérez Blanco presents the report of the National Commission for Tourist Sport Fishing, which in Agreement 3°, of the session held on March 7, recommends the approval of the International Sport Fishing Tournament, called "Presidential Papagayo," which will be held from May 16 to 19, 2013, in the Golfo de Papagayo, province of Guanacaste.
2. 2That said tournament is of an international nature, which is why it has the endorsement of the Costa Rican Tourism Institute, given the importance it holds for our country from a socioeconomic point of view, due to the inflow of foreign currency and the charitable purposes encompassed by this tournament.

3º-Said tournament is being organized by The President Challenge Foundation, represented in Costa Rica by Mrs. Joan Vernon, for which the representative qualifications of said Foundation are provided, as well as the regulations that will govern it.

4º-The organizers request that the endorsement for holding this activity be accompanied by the establishment of a closed area during the days on which the activity will take place, in order to guarantee the normal development of the activity, as well as thereby avoiding inconveniences and/or possible accidents with the commercial fleet, for which they provide the coordinates for the establishment of said closed area, which are located in an area comprised within a rectangle formed by the following coordinates: Point 1) 10°20'00" North Latitude with 85°53'00" West Longitude. Point 2) 10°20'00" North Latitude with 86°43'00" West Longitude. Point 3) 10°40'00" North Latitude with 86°43'00" West Longitude, and Point 4) 10°40ʹ00" North Latitude with 85°53'00" West Longitude.

5º-The request of Mrs. Vernon on behalf of The President Challenge Foundation having been duly analyzed, by virtue of the implications that the development of this activity represents for our country at a worldwide level, and having the positive recommendation of the National Commission for Tourist Sport Fishing, the Board of Directors. Therefore; AGREES:

1º-To authorize the holding of the International Sport Fishing Tournament, called "Presidential Papagayo," which will be held from May 16 to 19, 2013, for which an exclusive closed area is established with restrictions for all types of commercial fishing during the days of the Tournament's celebration, in the area comprised within a rectangle formed by the following coordinates: Point 1) 10°20'00" North Latitude with 85°53'00" West Longitude. Point 2) 10°20'00" North Latitude with 86°43'00" West Longitude. Point 3) 10°40'00" North Latitude with 86°43'00" West Longitude, and Point 4) 10°40'00" North Latitude with 85°53'00" West Longitude. The reserved area may not include any part of the Santa Rosa National Park, nor shall it imply any violation of Article 9 of the Fisheries and Aquaculture Law.

2º-The Regional Directorate of Guanacaste is instructed to issue the pertinent communication to the artisanal fishing sector, and to request its collaboration in the scheduling of normal fishing activities, in such a way that they do not interfere with the activities of this tournament.

3º-This authorization is conditioned upon the faithful compliance, by the organizers, with the legal requirements, as well as those that guarantee the safety and physical integrity, not only of the participants, but also of the general public, involved in holding this type of event, before the Authorities of INCOPESCA, the Costa Rican Tourism Institute, the local Municipality, the National Coast Guard Service, the National Directorate of Maritime Transport, the National Insurance Institute, the Costa Rican Red Cross, etc.

4º-Firm Agreement.

5º-Let it be published, it is effective as of its publication.

1. 1Que presenta la Directora Jeannette Pérez Blanco, informe de la Comisión Nacional de Pesca Deportiva Turística, la cual en el Acuerdo 3°, de la sesión celebrada el día 7 de marzo, recomienda la aprobación del Torneo Internacional de Pesca Deportiva, denominado "Presidential Papagayo", que se estará llevando a cabo del 16 al 19 de mayo de 2013, en el Golfo de Papagayo, provincia de Guanacaste.
2. 2Que dicho torneo reviste carácter internacional, razón por la cual cuenta con el aval del Instituto Costarricense de Turismo, toda vez de la importancia que reviste para nuestro país desde el punto de vista socioeconómico, en razón del ingreso de divisas y los fines de beneficencia que engloba este torneo.

3º-Dicho torneo está siendo organizado por The President Challenge Foundation, representada en Costa Rica por la señora Joan Vernon, para lo cual se aportan las calidades de representación de dicha Fundación, así como la reglamentación que regirá el mismo.

4º-Solicitan los organizadores que el aval para la celebración de esta actividad, esté acompañado del establecimiento de un área de veda durante los días en los cuales se llevara a cabo la actividad, a fin de garantizar el desarrollo normal de la actividad, así como evitando con ello inconvenientes y/o posibles accidentes con la flota comercial, para lo cual aportan las coordenadas para el establecimiento de dicha área de veda, mismas que se ubican en un área comprendida en un rectángulo conformado por las siguientes coordenadas: Punto 1) 10°20'00" Latitud Norte con 85°53'00" Longitud Oeste. Punto 2) 10°20'00" Latitud Norte con 86°43'00" Longitud Oeste. Punto 3) 10°40'00" Latitud Norte con 86°43'00" Longitud Oeste, y Punto 4) 10°40ʹ00" Latitud Norte con 85°53'00" Longitud Oeste.

5º-Debidamente analizada la solicitud de la señora Vernon en representación de The President Challenge Foundation, en virtud de las implicaciones que el desarrollo de ésta actividad representa para nuestro país a nivel Mundial, y por contarse con la recomendación positiva de la Comisión Nacional de Pesca Deportiva Turística, la Junta Directiva. Por tanto; ACUERDA:

1º-Autorizar la celebración del Torneo de Pesca Deportiva Internacional, denominado "Presidential Papagayo", que se estará llevando a cabo del 16 al 19 de mayo de 2013, para lo cual se establece un área de veda exclusiva con restricción para todo tipo de pesca comercial durante los días de celebración del Torneo, en el área comprendida en un rectángulo conformado por las siguientes coordenadas: Punto 1) 10°20'00" Latitud Norte con 85°53'00" Longitud Oeste. Punto 2) 10°20'00" Latitud Norte con 86°43'00" Longitud Oeste. Punto 3) 10°40'00" Latitud Norte con 86°43'00" Longitud Oeste, y Punto 4) 10°40'00" Latitud Norte con 85°53'00" Longitud Oeste. El área reservada no podrá comprender ninguna parte del Parque Nacional de Santa Rosa, así como tampoco implicará violación alguna del artículo 9 de la Ley de Pesca y Acuicultura.

2º-Se instruye a la Dirección Regional de Guanacaste, para que realice el comunicado pertinente al sector pesquero artesanal, y le solicite su colaboración en la programación de las actividades normales de pesca, de manera tal que no interfiera con las actividades de éste torneo.

3º-Queda condicionada ésta autorización al fiel cumplimiento, por parte de los organizadores, de los requisitos legales, así como aquellos que garanticen la seguridad e integridad física, no solo de los participantes; sino del público en general que conllevan la realización de este tipo de eventos, ante las Autoridades del INCOPESCA, Instituto Costarricense de Turismo, la Municipalidad de la localidad, Servicio Nacional de Guardacostas, Dirección Nacional de Transporte Marítimo, Instituto Nacional de Seguros, la Cruz Roja Costarricense, etc.

4º-Acuerdo Firme.
