Regulation for Awarding the Legislative Environmental PrizeReglamento para otorgar el Galardón Ambiental Legislativo

Each year, in the month of February, the Office of Popular Initiative shall present to the Legislative Directive Board the proposal to hold the Legislative Environmental Distinction competition, as well as a shortlist with the names of experts in environmental matters to form the deliberating jury and decide on the dedication of that year's competition, which must be closely related to the Costa Rican environment or geography. The jury must be appointed during this same month.

The members of the jury must act in observance of the principles of impartiality, ethics, and discretion; for this reason, the members of the jury must maintain professional secrecy regarding their actions inherent to the position of jury member.

Being a promoter or active participant in a competing proposal is incompatible with the position of jury member.

Any blood relationship or affinity up to the third degree, inclusive, of a jury member with respect to any of the nominated projects shall be grounds for excuse or recusal.

The Directive Board shall convene the members designated as the jury for their respective swearing-in and installation, as well as to provide them with copies of the legislative decree and its regulations, and instruct them on the methodology to be followed regarding the work they must perform.

Once the jury has been formed, it must appoint from among its members a coordinator who will be responsible for maintaining communication with the Office of Popular Initiative, as this entity is responsible for the coordination and execution of the competition on behalf of the Legislative Assembly.

The Legislative Directive Board, during the month of March of each year, shall announce the call for entries for the competition in at least one nationally circulated print medium, as well as in other media outlets.

The country's public and private educational centers that offer the I, II, and III cycles of basic general education and diversified education may participate. The announcement to be disseminated must contain:

The name of the environmental distinction, in accordance with Article 1 of these regulations.

The rationale for the call for entries for the Legislative Environmental Distinction competition.

The requirements that must be met by the participating educational centers.

The amount of the financial benefit of the Legislative Environmental Distinction.

• e)The dates for admission of projects, the declaration, and the awarding of the distinction.
• f)The format of the projects.
• g)The participating themes.
• h)Any other elements that the Directive Board considers pertinent.

The projects must be related to environmental education programs, or promote the conservation and protection of the environment; likewise, they must meet the following requirements:

• a)Presentation in writing, in Arial 12-point font, with one-and-a-half line spacing, with margins of three centimeters on the bottom, top, and right, and three and a half centimeters on the left edge.
• b)Maximum length of 60 pages (cuartillas).
• c)Specification of the project name, background, justification, problem, general and specific objectives, methodology, budgeting, implementation deadline, and mode of execution.
• d)In the event that the prize amount is not sufficient to carry out the project, the manner in which they will obtain the resources to achieve the remaining financing must be indicated.

Projects shall be received from the first business day of the month of April of each year until the last business day of the month of June of that same year.

The jury may begin deliberations regarding the awarding of the distinction as of the first session held.

The powers corresponding to the jury are:

• a)Coordinating actions with the Office of Popular Initiative.
• b)Drafting the rationale for the call for entries for the Legislative Environmental Distinction.
• c)Establishing the requirements that educational centers participating in the competition must meet.
• d)Selecting the participating themes.
• e)Defining the evaluation, as well as the scores to be applied to each aspect to be assessed.
• f)Proposing any other element it deems appropriate to the Legislative Directive Board.
• g)Choosing the winning project.
• h)Declaring the competition void, in accordance with Article 12 of these regulations.

The jury may resort to specialized technical advice from public or private universities, specialized institutes, or professional associations.

To determine the winner of the competition, the jury, in accordance with the previously determined methodology, shall weigh the scores; the project obtaining the highest score shall be the one awarded the Legislative Environmental Distinction. The jury's decision is final and unappealable.

The jury, by a qualified majority vote, may declare the competition void, in which case it shall present its technical opinion to the Legislative Directive Board. Said technical opinion or an excerpt thereof shall be published in at least one nationally circulated print medium and may be announced in other media outlets.

The jury must deliver, no later than July 16 of each year, to the Legislative Directive Board, a sealed envelope containing the name of the educational center that won the Legislative Environmental Distinction competition, or, failing that, it shall indicate if the competition must be declared void. In both cases, a reasoned basis must be provided.

The Office of Popular Initiative shall announce the winning project, no later than within the period of thirty days prior to the award ceremony. This announcement shall be published in at least one nationally circulated print medium, without prejudice to being announced in other media outlets.

The jury may not grant hearings or interviews to the contestants; likewise, it is barred from providing information regarding the deliberations that arise within it, which are considered confidential.

The distinction shall be awarded by the Legislative Directive Board, in a ceremony that will also be attended by the jury, on August 24 of each year, the date on which National Parks Day is celebrated, at the time and place agreed upon by this legislative body. In years when the indicated date is a non-business day, the awarding of the distinction shall take place on the following business day.

The Office of Popular Initiative shall budget an item each year, destined to finance the prize to be awarded to the educational center that wins the Legislative Environmental Distinction.

To define the amount to be budgeted, at least five times the base salary of an Office Clerk 1, as defined in Article 2 of Law No. 7337, must be considered. Likewise, this same Office must include the necessary items for the publications and the execution of the activities generated by the procedure to be followed for the awarding of the Legislative Environmental Distinction.

It is the responsibility of the Office of Popular Initiative to ensure compliance with the rules and procedures established throughout the entire process for awarding the Legislative Environmental Distinction, as well as in the implementation of the winning project.

For this purpose, said Office may request reports from the winner on the progress of the project. Furthermore, within a period of one year from the awarding of the prize, the Office of Popular Initiative must conduct at least two visits to verify the project's development. To fulfill this purpose, it may be accompanied by one or more of the members who formed the jury that awarded the distinction or, failing that, by a specialist professional in the field who can advise on an ad honorem basis.

Once the reports on progress have been requested and/or the visits carried out, the Office of Popular Initiative must draft a report referring to the degree of execution of the project.

In the event that there is no significant progress or that it has not been initiated, the Legislative Directive Board shall be informed, so that this legislative body may issue the corresponding compliance warning (prevención de cumplimiento).

If three months after the warning the problem persists, the Directive Board may issue a second warning, following a report from the Office of Popular Initiative.

If non-compliance in the development of the project continues after a period of one year, the Legislative Directive Board shall declare contempt (desacato) and, consequently, the distinguished educational center must return the prize that was awarded to it.

It takes effect upon its publication in the Official Gazette La Gaceta.

San José, on the nineteenth day of the month of April of two thousand thirteen.

Cada año, en el mes de febrero, la Oficina de Iniciativa Popular presentará ante el Directorio Legislativo la propuesta de realización del concurso Galardón Ambiental Legislativo, así como una terna con los nombres de personas expertas en materia ambiental para que integren el jurado deliberador y decidan acerca de la dedicación del concurso de ese año, la cual deberá guardar estrecha relación con el ambiente o la geografía costarricense. El jurado deberá quedar nombrado durante este mismo mes.

Los miembros del jurado deberán actuar bajo la observancia de los principios de imparcialidad, ética y discrecionalidad, por ese motivo, los miembros del jurado deberán guardar secreto profesional sobre sus actuaciones propias del cargo de integrante del jurado.

Es incompatible con el puesto el hecho de ser promotor o participante activo de una oferta concursante con la de miembro del jurado.

Será causal de excusa o recusación, cualquier vínculo de consanguinidad o afinidad hasta tercer inclusive, de algún miembro del jurado respecto a alguno de los proyectos postulados.

El Directorio convocará a los miembros que fueron designados como jurado para su respectiva juramentación e instalación, así como para entregarles copias del decreto legislativo y su reglamento, e instruirlos acerca de la metodología que se debe seguir respecto de la labor que deben realizar.

Una vez que se haya integrado el jurado, este debe nombrar de su seno a un coordinador que será el encargado de mantener la comunicación con la Oficina de Iniciativa Popular, por ser esta instancia la responsable de la coordinación y la ejecución del concurso por parte de la Asamblea Legislativa.

El Directorio Legislativo, durante el mes de marzo de cada año, anunciará la convocatoria del concurso, en al menos un medio de comunicación escrita de circulación nacional, así como en otros medios informativos.

Podrán participar los centros educativos del país, públicos y privados, que impartan el I, II y III ciclos de la educación general básica y la educación diversificada. El anuncio que se divulgará debe contener:

El nombre del galardón ambiental, de acuerdo con el artículo 1 este reglamento.

La motivación de la convocatoria al concurso Galardón Ambiental Legislativo.

Los requisitos que se deben cumplir por parte de los centros educativos participantes.

El monto del beneficio económico del Galardón Ambiental Legislativo.

• e)Las fechas de admisión de los proyectos, la declaratoria y la entrega del galardón.
• f)El formato de los proyectos.
• g)Los temas participantes.
• h)Cualesquiera otros elementos que el Directorio considere pertinente.

Los proyectos deberán estar relacionados con los programas de educación ambiental, o bien, promover la conservación y la protección del medio ambiente; asimismo, deben cumplir con los siguientes requisitos:

• a)Presentación por escrito, en letra arial 12, con interlineado de espacio y medio, con márgenes de tres centímetros en su parte inferior, superior y derecha, y de tres y medio centímetros en el extremo izquierdo.
• b)Extensión máxima de 60 cuartillas.
• c)Especificación del nombre del proyecto, antecedentes, justificación, problema, objetivo general y específicos, metodología, presupuestación, plazo de implementación y modo de ejecución.
• d)En caso de que el monto del premio no sea suficiente para llevar a cabo el proyecto, debe indicarse la forma en que obtendrán los recursos para lograr el financiamiento restante.

Los proyectos se recibirán a partir del primer día hábil del mes de abril de cada año y hasta el último día hábil del mes de junio de ese mismo año.

El jurado puede iniciar las deliberaciones acerca de la adjudicación del galardón, a partir de la primera sesión que se celebre.

Las atribuciones correspondientes al jurado son:

• a)Coordinar acciones con la Oficina de Iniciativa Popular.
• b)Redactar la motivación de la convocatoria al Galardón Ambiental Legislativo.
• c)Establecer los requisitos que deben cumplir los centros educativos participantes en el concurso.
• d)Seleccionar los temas participantes.
• e)Definir la evaluación, así como los puntajes que se le aplicarán a cada aspecto que se valorará.
• f)Proponer al Directorio legislativo cualquier otro elemento que considere oportuno.
• g)Escoger el proyecto ganador.
• h)Declarar desierto el concurso, de acuerdo con el artículo 12 de este reglamento.

El jurado podrá recurrir al asesoramiento técnico especializado de las universidades públicas o privadas, institutos especializados o colegios profesionales.

Para definir al ganador del concurso, el jurado, de acuerdo con la metodología previamente determinada, ponderará los puntajes; el proyecto que obtenga el mayor puntaje será al que se le otorgue el Galardón Ambiental Legislativo. El fallo del jurado es inapelable.

El jurado, por voto de la mayoría calificada, podrá declarar desierto el concurso, en cuyo caso presentará su criterio técnico al Directorio legislativo. Dicho criterio técnico o un extracto de él se publicará al menos en un medio escrito de circulación nacional y podrá anunciarse en otros medios informativos.

El jurado deberá entregar a más tardar el 16 de julio de cada año, al Directorio Legislativo, un sobre cerrado que contendrá el nombre del centro educativo ganador del concurso Galardón Ambiental Legislativo, o en su defecto, indicará si el concurso debe ser declarado desierto. En ambos casos deberá mediar razonamiento fundado.

La Oficina de Iniciativa Popular anunciará el proyecto ganador, a más tardar, dentro del periodo de los treinta días anteriores a la premiación. Este anuncio se publicará al menos en un medio escrito de circulación nacional, sin perjuicio de ser anunciado en otros medios informativos.

El jurado no podrá conceder audiencias, ni entrevistas a los concursantes; asimismo, está imposibilitado para informar en relación con las deliberaciones que surjan de su seno, las cuales son consideradas confidenciales.

El galardón será entregado por el Directorio Legislativo, en una ceremonia que también contará con la presencia del jurado, el 24 de agosto de cada año, fecha en que se celebra el Día de los Parques Nacionales, a la hora y en el lugar que acuerde este órgano legislativo. Los años en que la fecha indicada sea un día inhábil, la entrega del galardón se realizará el día hábil siguiente.

La Oficina de Iniciativa Popular presupuestará cada año una partida, destinada a financiar el premio que se entregará al centro educativo que resulte ganador del Galardón Ambiental Legislativo.

Para definir la cantidad que se va a presupuestar, se deberá considerar al menos cinco veces el salario base de un oficinista 1, definido en el artículo 2 de la Ley Nº 7337. Asimismo, esta misma Oficina debe incluir las partidas necesarias para las publicaciones y la ejecución de las actividades que genere el procedimiento a seguir para la premiación del Galardón Ambiental Legislativo.

Corresponde a la Oficina de Iniciativa Popular velar por el cumplimiento de las normas y los procedimientos establecidos durante todo el proceso para el otorgamiento del Galardón Ambiental Legislativo, así como en la aplicación del proyecto ganador.

Para tal fin, dicha Oficina podrá solicitar informes al ganador sobre los avances del proyecto. Además, en el plazo de un año contado a partir de que se otorgue el premio, la Oficina de Iniciativa Popular deberá realizar al menos dos visitas para corroborar el desarrollo del proyecto. Para cumplir tal propósito, podrá hacerse acompañar de uno o varios de los miembros que integraron el jurado que otorgó el galardón o, en su defecto, de un profesional especialista en la materia que pueda asesorar de forma ad honórem.

Una vez solicitados los informes sobre los avances y/o efectuadas las visitas, la Oficina de Iniciativa Popular deberá redactar un informe en el que haga referencia al grado de ejecución del proyecto.

En caso de que no existan avances significativos o que no se haya iniciado, se le informará al Directorio legislativo, con el fin de que este órgano legislativo haga la prevención de cumplimiento correspondiente.

Si transcurridos tres meses a partir de la prevención el problema subsiste, el Directorio podrá realizar una segunda prevención, previo informe de la Oficina de Iniciativa Popular.

Si transcurrido el plazo de un año se mantiene el incumplimiento del desarrollo del proyecto, el Directorio legislativo declarará el desacato y, en consecuencia, el centro educativo galardonado deberá realizar la devolución del premio que le fue otorgado.
