…in the entirety of the text - Full Text of Regulation 0 Provisions for the use of the official Carbon Neutral symbol of the Ministry of Environment and Energy Full Text of record: EE1DC ENVIRONMENT AND ENERGY CLIMATE CHANGE DIRECTORATE Based on Articles 28, 102 and 103 of the General Public Administration Law, No. 6227 of May 2, 1978; the United Nations Framework Convention on Climate Change, Law No. 7414 of June 13, 1994; the Central American Convention on Climate Change, Law No. 7513 of June 9, 1995; the Law Approving the Kyoto Protocol to the United Nations Framework Convention on Climate Change, Law No. 8219 of March 8, 2002; and the Organic Regulation of the Ministry of Environment, Energy and Telecommunications, Executive Decree No. 35669-MINAET, of December 4, 2009, and its amendments.
PROVISIONS FOR THE USE OF THE OFFICIAL SYMBOL CARBON NEUTRAL OF THE MINISTRY OF ENVIRONMENT AND ENERGY 1º—Any organization receiving Carbon Neutrality certification or its equivalent authorized by the Ministry of Environment and Energy, through the Climate Change Directorate, must make use of the Carbon Neutral brand symbol as a result of the activities included in the scope of the Carbon Neutrality Declaration.
To do so, it must follow the following stages:
1. The organization that meets the requirements set forth in the Application for Participation in the Country Program, published on the website of the Climate Change Directorate, and to which the Climate Change Directorate has indicated, via email, the corresponding expediente number, may use the Carbon Neutral brand symbol on stationery, posters, and other external symbols of the organization, as indicated in this provision and as expressly authorized individually for each use.
2. The period of validity for the use of the “Carbon Neutral” brand shall be 1 calendar year, starting from the date indicated in the certification declaration issued by the verification/validation body accredited by the Costa Rican Accreditation Body, in compliance with what is indicated in Agreement 36-MINAET published in La Gaceta of June 19, 2012. The organizations to which [the “Carbon Neutral” brand is granted will be published on the page of the Climate Change Directorate, in the Carbon Neutrality 2021 section. When the organization renews its carbon neutrality declaration, it must inform the Climate Change Directorate in order to update the date. Otherwise, it will be indicated by appropriate means that the organization does not hold the “Carbon Neutral” brand recognized by the Government of Costa Rica, and therefore, it may not make use of the same, in which case, if it does so without official permission, the corresponding legal actions will be taken.
3. The organization to which the “Carbon Neutral” brand authorized by MINAE has been granted must request approval for the use of the symbol or brand from the Climate Change Directorate each time it is to be used on a document or medium different from the one approved on previous occasions.
4. The organization may request the use of the “Carbon Neutral” symbol on:
. Advertising or promotional documents, brochures, advertisements relating to the scope of the carbon neutrality declaration, the organization's website.
Quotations relating to activities duly authorized within the scope of the carbon neutrality declaration.
2º—Restrictions on the use of the symbol. The “Carbon Neutral” symbol or brand granted by MINAE may not be used in the following cases:
a. If the organization is in the process of evaluation by a third-party body, if it has an expired, withdrawn, or suspended carbon neutrality declaration.
b. In reports or documents of the organization related to activities that fall outside the scope indicated in the carbon neutrality declaration.
c. In documents issued by the organization as a result of activities other than those included in the scope of the carbon neutrality declaration.
d. On the organization’s headers, corporate stationery, or invoices, on personal business cards, uniforms, badges, or identification cards.
e. In any situation that may give rise to an incorrect interpretation of the organization’s status (Example: that may lead to considering activities not covered by the scope of the carbon neutrality declaration and that is abusive in the judgment of MINAE).
f. The “Carbon Neutral” symbol associated with the national standard INTE 12-01-06:2011 must not be used on the organization’s products.
g. Organizations authorized to use the “Carbon Neutral” symbol or brand shall not authorize their clients to use the symbol, under any circumstance.
h. The use of the “Carbon Neutral” symbol is not permitted on any document that has not been previously approved by MINAE.
i. The “Carbon Neutral” symbol may not be used on certificates and reports in which all the results of registered activities fall outside the scope of the organization’s carbon neutrality declaration.
j. The organization’s reports may include scopes indicated for the carbon neutrality declaration, as well as scopes not included within the carbon neutrality declaration. This may be done by means of a footnote, referencing the expediente number and official publication on the page of the Climate Change Directorate.
k. The organization may not transfer its right to use the “Carbon Neutral” symbol to subcontractors or third parties. The same applies to the use of the “Carbon Neutral” symbol on documents derived from subcontractors, specification compliance reports, opinion reports, and interpretations.
l. The “Carbon Neutral” symbol may not be placed on products (according to the carbon neutrality declaration under the standard INTE 12-01-06:2011) m. The use of the “Carbon Neutral” symbol does not imply that MINAE approves a specific product or article, or an opinion issued by the organization.
n. The “Carbon Neutral” symbol must not be used in such a way as to give the impression that MINAE is accepting responsibility for the processes associated with the organization.
o. It is prohibited to include any element within the “Carbon Neutral” logo or symbol. It is prohibited to place the “Carbon Neutral” logo or symbol as a background on sheets, as well as to render it with elements, images, or textures that cause distortion or alter its perception.
p. The “Carbon Neutral” symbol granted to one organization may not be placed alongside the symbol or logo of another organization that does not hold the granted “Carbon Neutral” symbol.
q. Being in default of its tax obligations.
r. Having a final judicial sanction for crimes or infractions of environmental legislation, or a final administrative sanction for violation of environmental regulations, or a conviction for environmental damage.
3º—Form and color of the logo. The following “Carbon Neutral” logo is the officially registered one, which may be used by authorized organizations.
a. “Carbon Neutral,” “Carbon Neutral” logo.
b. Font of “Carbon Neutral”: Insaniburger / Regular c. Font of “Recognized by the Government of Costa Rica”: ClementePDaa-Hairline / Hairline d. The logo may be used in English, with the same format and text style, which is included below.
e. Colors:
a. green and light blue used in the official MINAE logo b. Gray: C:0% / M:0% / K: 80%.
4º—It becomes effective upon its publication.

Texto Completo acta: EE1DC AMBIENTE Y ENERGÍA DIRECCIÓN DE CAMBIO CLIMÁTICO Con fundamento en los artículos 28, 102 y 103 de la Ley General de la Administración Pública, N° 6227 del 2 de mayo de 1978; la Convención Marco de la Naciones Unidas sobre el Cambio Climático, Ley N° 7414 del 13 de junio de 1994; el Convenio Centroamericano sobre Cambios Climáticos, Ley N° 7513 del 9 de junio de 1995; la Ley de Aprobación del Protocolo de Kioto de la Convención Marco de las Naciones Unidas sobre el Cambio Climático, Ley No 8219 del 8 de marzo del 2002 y el Reglamento Orgánico del Ministerio de Ambiente, Energía y Telecomunicaciones, Decreto Ejecutivo N° 35669-MINAET, del 4 de diciembre de 2009 y sus reformas.
CARBONO NEUTRAL DEL MINISTERIO DE AMBIENTE Y ENERGÍA 1º-Toda organización que reciba la certificación Carbono Neutralidad o su similar autorizado por el Ministerio de Ambiente y Energía, a través de la Dirección de Cambio Climático, debe hacer uso del símbolo de la marca Carbono Neutral como resultado de las actividades incluidas en el alcance de la Declaración de Carbono Neutralidad.
Para ello debe seguir las siguientes etapas:
l. La organización que cuente con los requisitos indicados en la Solicitud de Participación en Programa País, publicada en la página web de la Dirección de Cambio Climático, y a la cual la Dirección de Cambio Climático, haya indicado vía correo electrónico, el número de expediente correspondiente, podrá utilizar el símbolo de la marca Carbono Neutral en la papelería, afiches y demás símbolos externos de la organización, que se indican en esta disposición y que sean autorizados expresamente en forma individual para cada uso.
2. El tiempo de vigencia de uso de la marca "Carbono Neutral" será de 1 año calendario, a partir de la fecha indicada en la declaración de certificación emitida por el organismo verificador/validador acreditado ante el Ente Costarricense de Acreditación, en cumplimiento con lo indicado en el Acuerdo 36-MINAET publicado en La Gaceta del 19 de junio 2012. Las organizaciones a las cuales se [es entregue la marca "Carbono Neutral" serán publicadas en la página de la Dirección de Cambio Climático, en la sección de Carbono Neutralidad 2021. Cuando la organización realice la renovación de su declaración de carbono neutralidad, deberá informarlo a la Dirección de Cambio Climático, con el fin de actualizar la fecha. De no ser así, se indicará por los medios apropiados que la organización no cuenta con la marca "Carbono Neutral" reconocida por el Gobierno de Costa Rica, y por tanto, no podrá hacer uso de la misma, en cuyo caso de hacerlo Sin permiso oficial, se establecerán las acciones legales correspondientes.
3. La organización a la cual se le ha otorgado la marca "Carbono Neutral" autorizada por el MINAE, debe solicitar a la Dirección de Cambio Climático la aprobación de uso de símbolo o marca, cada vez que lo va a emplear en un documento o medio diferente, al que le fue aprobado en ocasiones anteriores.
4. La organización puede solicitar el uso de del símbolo "Carbono Neutral" en:
. Documentos de tipo publicitario o de promoción, folletos, anuncios referentes al alcance de la declaración de carbono neutralidad, sitio web de la organización.
Cotizaciones relativas a las actividades debidamente autorizadas en el alcance de la declaración de carbono neutralidad.
2º-Restricciones de uso de símbolo. El símbolo o marca de "Carbono Neutral" otorgado por el MINAE no puede utilizarse en los siguientes casos:
a. Si la organización está en proceso de evaluación por un organismo de tercera parte, si cuenta con la declaración de carbono neutralidad vencida, retirada o suspendida.
b. En informes o documentos de la organización relacionados con actividades que se encuentran fuera del alcance indicado en la declaración de carbono neutralidad.
c. En documentos emitidos por la organización como resultado de actividades distintas de aquellas incluidas en el alcance de la declaración de carbono neutralidad.
d. En encabezados, papelería corporativa, o facturas por parte de la organización, en tarjetas de presentación personal, uniformes, gafetes o identificaciones.
e. En cualquier situación que pueda dar lugar a una interpretación incorrecta de la condición de la organización (Ejemplo: que pueda inducir a considerar actividades no cubiertas por el alcance de la declaración de carbono neutralidad y que resulte abusiva ajuicio del MINAE).
f. El símbolo "Carbono Neutral" asociado a la norma nacional INTE 12-01-06:2011 no deberá ser utilizada en productos de la organización.
g. Las organizaciones con autorización para uso de símbolo o marca "Carbono Neutral" no autorizarán a sus clientes que utilicen el símbolo, bajo ninguna circunstancia.
h. No se permite el uso del símbolo "Carbono Neutral" en cualquier documento que no haya sido aprobado con anterioridad por el MINAE.
i. No se puede utilizar el símbolo "Carbono Neutral" en certificados e informes, en los cuales todos los resultados de actividades que se registren, estén fuera del alcance de la declaración de carbono neutralidad de la organización.
j. En los informes de la organización se permite que incluyan alcances indicados para la declaración de carbono neutralidad, así como los alcances no incluidos dentro de la declaración de carbono neutralidad. Esto se puede realizar por medio de una nota al pie, y dónde se haga referencia al número de expediente y publicación oficial en la página de la Dirección de Cambio Climático.
k. La organización no puede transferir su derecho de uso del símbolo de "Carbono Neutral" a subcontratistas o a terceros. Así como, el uso del símbolo "Carbono Neutral" en documentos derivados de subcontratistas, reportes de cumplimiento de especificaciones, reportes de opinión e interpretaciones.
l. El símbolo "Carbono Neutral" no puede ser colocado en productos (según la declaración de carbono neutralidad bajo la norma INTE 12-01-06:2011) m. El uso del símbolo "Carbono Neutral", no implica que el MINAE apruebe un determinado producto o artículo, o una opinión emitida por la organización.
n. El símbolo "Carbono Neutral" no debe ser utilizado de tal forma que pueda dar la impresión de que el MINAE está aceptando responsabilidad por los procesos asociados con la organización.
o. Queda prohibido incluir cualquier elemento dentro del logotipo o símbolo "Carbono Neutra Queda prohibido colocar el logotipo o símbolo "Carbono Neutral" como fondo en las hojas, así como plasmarlo con elementos, imágenes o texturizados que provoquen la distorsión o alteren su percepción.
p. No se puede colocar el símbolo "Carbono Neutral" otorgado a una organización junto al símbolo o logotipo de otra organización que no cuente con el símbolo "Carbono Neutral" otorgado.
q. Encontrarse moroso en sus obligaciones tributarias.
r. Tener una sanción judicial firme por delitos o infracciones a la legislación ambiental, o sanción administrativa firme por violación a la normativa ambiental o condena por daño ambiental.
3º-Forma y color del logotipo. El siguiente logotipo "Carbono Neutral", es el oficialmente registrado, que podrá ser utilizado por las organizaciones autorizadas.
a. Logotipo "Carbono Neutral", "Carbón Neutral".
b. Tipo de letra de "Carbono Neutral": Insaniburger / Regular c. Tipo de letra de "Reconocido por el Gobierno de Costa Rica": ClementePDaa-Hairline / Hairline d. El logo podrá ser utilizado en inglés, con el mismo formato y tipo de texto el cual se incluye abajo e. Colores:
a. verde y celeste utilizados en logotipo oficial del MINAE b Gris: C:0% / M:0% / K: 80%.
4º-Rige a partir de su publicación.
