Carlos A. Roverssi Rojas, Acting Minister of Foreign Affairs and Worship, and the diplomatic note dated November 19, 2012, signed by His Excellency Mr. Ernst Martens, Ambassador of the Federal Republic of Germany, whose texts are as follows:
Dr. Ernst Martens Ambassador of the Federal Republic of Germany His Excellency José Enrique Castillo Barrantes Minister of Foreign Affairs and Worship of the Republic of Costa Rica Present San José, November 19, 2012 Mr. Minister:
Pursuant to the Convention on Technical Cooperation concluded between our two Governments on July 23, 1965, as well as the Amending Protocols of March 13, 1986, and December 18, 2006, I have the honor to propose to you, on behalf of the Government of the Federal Republic of Germany, the following Agreement:
1. The Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica shall jointly promote the following project:
Promotion of Costa Rica's climate neutrality strategy as a low-carbon development model (Low Carbon Development).
2. The objective of the project is to contribute to climate protection and sustainable development in Costa Rica through the promotion of a low-climate-impact economy and the reduction of greenhouse gas emissions.
3. The Government of the Federal Republic of Germany shall provide, at its contributions for the project mentioned in paragraph 1 for the following total value:
a maximum of 3,500,000 euros.
The Government of the Federal Republic of Germany shall entrust the execution of the project mentioned in paragraph 1 to the following organization:
Deutsche Gesellschaft für Internationale Zusammenarbeit GmbH (GIZ).
4. On behalf of the Government of the Republic of Costa Rica, the execution of the project shall be the responsibility of the Ministry of Environment, Energy and Telecommunications.
5. The details of the project specified in paragraph 1 and of the respective contributions and obligations shall be established in individual execution and/or financing contracts, which shall be concluded between the executing agency mentioned in paragraph 3 and the institutions to which the Government of the Republic of Costa Rica entrusts the execution of the project. Such execution and/or financing contracts shall be subject to the legal provisions in force in the Federal Republic of Germany.
6. The measures included in the commitment must be fully implemented within a period of eight years from the year of said commitment. Unused funds shall definitively expire. For the commitments of the current year, the implementation period shall conclude on December 31, 2019.
7. The Government of the Republic of Costa Rica shall exempt the materials, vehicles, goods and equipment, as well as the respective spare parts, supplied for the project specified in paragraph 1 from all import and export duties and other public charges, including port fees.
8. Furthermore, the provisions of the above-mentioned Convention of July 23, 1965, as well as the Amending Protocols of March 13, 1986, and December 18, 2006, shall also apply to this Agreement.
9. This Agreement is concluded in German and Spanish, both texts being equally authentic.
If the Government of the Republic of Costa Rica declares itself in agreement with the proposals contained in paragraphs 1 to 9, this Note and Your Excellency's Note in reply stating the agreement of your Government shall constitute an Agreement between our Governments which shall enter into force on the day the Government of the Republic of Costa Rica has notified the Government of the Federal Republic of Germany through diplomatic channels of the fulfillment of the internal requirements necessary for the entry into force of the Exchange of Notes. For such purposes, the date of receipt of the communication in question shall be determinative.

In this regard, I have the honor to inform Your Excellency that the above proposal is acceptable to the Government of the Republic of Costa Rica and that Your Excellency's Note and this Note constitute an Agreement between our two Governments which shall enter into force on the day the Government of the Republic of Costa Rica has notified the Government of the Federal Republic of Germany, through diplomatic channels, of the fulfillment of the internal requirements necessary for the entry into force of this Exchange of Notes.
