COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/085-2013.—Puntarenas, on the twenty-second day of February, two thousand thirteen.
I.That by means of Agreement AJDIP/004-2013, the Board of Directors reviewed a restructuring proposal for the Comisión Nacional de Veda (National Closed Season Commission), submitted by Mr. Marvin Mora Hernández, Director of Fisheries and Aquaculture Organizations, under official communication number DOPA-001-01-2013.
2.—That the Directors consider it viable to modify Article 2 of Agreement AJDIP/036-2009, given the practical need to restructure the Comisión Nacional de Veda, basically in the sense of clearly establishing the participatory mechanism in making momentous decisions such as the establishment of closed season periods for the various fisheries.
AGREES:
1º—Modify Article 2 of Agreement AJDIP/036-2009, so that it reads as follows:
"Article 2º—Said Commission shall be composed of:
The representatives indicated in subsections e), f), and g) shall be chosen from the respective lists of three nominees that the interested groups propose before the Executive Presidency.
2.1.—In the event that it is required to carry out closed seasons in the Caribbean fishing sector, or on the Pacific Coast outside the Golfo de Nicoya, or closed seasons on specific resources, the representatives of the public institutional sector represented on the Comisión Nacional de Vedas shall receive the involved sectors in a hearing, for the final definition of said closed season and its subsequent recommendation before the Board of Directors of INCOPESCA." 2º—The other conditions established in Agreement AJDIP/036-2009 remain in force, unless they are contrary to those established by means of this provision.
3º—Final agreement.
4º—Effective as of its adoption.
5º—Let it be published.
Considering:
en la totalidad del texto - Texto Completo Norma 085 Reforma Acuerdo AJDIP/036-2009 "Reintegra la Comisión Asesora Permanente denominada Comisión Nacional para Vedas" Texto Completo acta: ED88C INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/085-2013.-Puntarenas, a los veintidós días del mes de febrero de dos mil trece.
I.Que por medio de Acuerdo AJDIP/004-2013, conoció la Junta Directiva una propuesta de reestructuración de la Comisión Nacional de Veda, presentada por el Lic. Marvin Mora Hernández, Director de Organizaciones Pesqueras y Acuícolas, bajo oficio número DOPA-001-01-2013.
2.-Que consideran los señores Directores viable modificar el artículo 2°, del Acuerdo AJDIP/036-2009, dada la necesidad práctica de reestructurar la Comisión Nacional de Veda, básicamente en el sentido de establecer con claridad el mecanismo participativo en la toma de decisiones trascendentales como son el establecimiento de períodos de veda de las diversas pesquerías.
ACUERDA:
1º-modifíquese el artículo 2° del acuerdo AJDIP/036-2009, para que se lea de la siguiente manera:
"Artículo 2º-Dicha Comisión estará conformada por:
Los representantes señalados en los incisos e) f) y g), serán elegidos de las respectivas ternas que los grupos interesados propongan ante la Presidencia Ejecutiva.
2.1.- En el eventual caso de que se requiera realizar vedas en el sector pesquero del Caribe, ó bien en el Litoral Pacífico fuera del Golfo de Nicoya, ó vedas sobre recursos específicos, los representantes del sector público institucional representados en la Comisión Nacional de Vedas, recibirán en audiencia a los sectores involucrados, para la definición final de dicha veda y su posterior recomendación ante la Junta Directiva del INCOPESCA." 2º-Las demás condiciones establecidas en el Acuerdo AJDIP/036-2009 mantienen su vigencia, salvo que las mismas sean contrarias a los establecidos mediante la presente disposición.
3º-Acuerdo firme.
4º-Rige a partir de su adopción.
5º-Publíquese.
