throughout the entire text - Complete Text of Standard 067 Establishes the possibility of delegating or authorizing a third party to carry out small-scale artisanal commercial fishing when the permit holder is unable to do so for exceptional reasons Complete Text of minutes: ED824 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/067-2013.-Puntarenas, on the fifteenth day of February, two thousand thirteen.
I.-Whereas Mr. Luis Gerardo Dobles Ramírez, Executive President, states that difficulties and problems have been arising for elderly permit holders (Ciudadanos de Oro), as well as those who, due to health problems, are unable to carry out fishing operations, in accordance with the authorization granted to them by said small-scale commercial fishing license.
II.-Whereas the current regulatory provisions are silent regarding the guarantee for those permit holders who fall under the circumstances indicated in the first whereas clause, of the possibility of delegating or authorizing a third party to carry out the commercial fishing activity; since said activity constitutes their means of supporting their family, and being unable to do so due to the aforementioned conditions undoubtedly leads to a serious violation of the right to access to work enshrined in our Magna Carta.
III.-Whereas in this regard, the Board of Directors points out the need to positively regulate this aspect, for which reason they consider it viable and appropriate to establish the possibility that when a permit holder is unable, whether due to age or illness, to carry out fishing operations, they may authorize a third party to carry out commercial fishing in their name and on their behalf, reason for which the Board of Directors. Therefore:
1°-When a permit holder is unable to carry out small-scale artisanal commercial fishing operations, due to reasons of advanced age as senior citizens (Ciudadanos de Oro), illness, pregnancy, or those persons with disability problems, they shall exceptionally be allowed to authorize relatives up to the second degree of consanguinity to carry out the small-scale artisanal fishing activities in their name and on their behalf.
2°-For the perfecting of the authorization to a third party, the license permit holder must demonstrate the condition motivating their request, accrediting it with the respective medical opinion, disability status, or golden citizen card (carné de oro).
3°-Likewise, they must accredit by the corresponding legal means the link of the degree of consanguinity with the third party intended to be authorized, as well as said party's compliance with having passed the zafarrancho course taught by the INA, for which a peremptory period of six months is granted.
4°-Final resolution.

I.-Que manifiesta el licenciado Luis Gerardo Dobles Ramírez, Presidente Ejecutivo, que se han venido presentando inconvenientes y problemas para permisionarios de la tercera edad (Ciudadanos de Oro), así como aquellos que en razón de problemas de salud, se ven imposibilitados de realizar faenas de pesca, de conformidad con la autorización que en ese sentido le otorga dicha licencia de pesca comercial en pequeña escala.
II.-Que las disposiciones reglamentarias vigentes, son omisas en cuanto a garantizar a aquellos permisionarios que se encuentren en los supuestos señalados en el considerando primero, la posibilidad de delegar o autorizar en un tercero el ejercicio de la actividad de pesca comercial; toda vez que la misma constituye el modo de llevar sustento a su familia y el no poder hacerlo por las condiciones dichas, acarrea indudablemente una seria violación al derecho de acceso al trabajo consagrado en nuestra Carta Magna.
III.-Que en ese sentido, señalan los Sres. Directores la necesidad de normar positivamente éste aspecto, razón por la cual consideran viable y procedente establecer la posibilidad para que cuando un permisionario se vea imposibilitado, sea por razones de edad o enfermedad de realizar faenas de pesca, pueda autorizar a un tercero para que en su nombre y representación lleve a cabo la pesca comercial, razón por lo que la Junta Directiva. Por tanto:
ACUERDA:
1º-Cuando un permisionario se vea imposibilitado para realizar las faenas de pesca comercial artesanal en pequeña escala, por motivos de su edad adultos mayores (Ciudadanos de Oro), enfermedad, embarazo o aquellas personas con problemas de discapacidad, se permitirá excepcionalmente autoricen a familiares hasta segundo grado de consanguinidad para que realicen en su nombre y representación las actividades de pesca artesanal en pequeña escala.
2º-Para el perfeccionamiento de la autorización a un tercero, deberá el permisionario de la licencia demostrar la condición que motiva su solicitud, acreditándose con el respectivo dictamen médico, condición de discapacidad o carné de oro.
3º-Igualmente deberá acreditar por los medios legales correspondientes el vínculo de grado de consanguinidad con el tercero que se pretende autorizar, así como el cumplimiento por parte de éste, de la aprobación del curso de zafarrancho impartido por el INA, para lo cual se le otorga un plazo taxativo de seis meses.
