Subsequently, by agreement AJDIP/026-2018 of January 12, 2018, "Establishes the legal minimum capture sizes (TLPC) responding to the sizes at first sexual maturity (TPMS)", this norm is repealed once again.)

AJDIP/105-2013.-Puntarenas, on the eighth day of March, two thousand thirteen.

1. 1That in accordance with the schedule prepared by the Board of Directors, regarding the establishment of sizes at first maturity (tallas de primera madurez) for the main species of commercial interest; for which the General Technical Directorate carried out a series of consultations with the Costa Rican fishing sector, in the zones of Guanacaste, Puntarenas, Limón, and the Southern Zone, so that they could express their positions on this particular matter.
2. 2That the Board of Directors received in this session Lic. Antonio Porras Porras, General Technical Director, as well as the biologists Hubert Araya Umaña, Head of the Development and Research Department, and Berny Marín Alpízar, who presented the proposal for sizes at first maturity.
3. 3That in this same line of thought, Lic. Porras Porras presents the aforementioned proposal, under official communication DGT-015-03-2013, indicating that this proposal includes the changes generated in relation to the initial proposal and that are supported by the consultation process carried out with the Fishing Sector, as well as a product of the review of the initial proposal regarding the proposed entry into force on a progressive basis of this management measure, with the purpose of preventing the collapse of the fishery for the species included in this proposal.
4. 4That due to the selectivity of the fishing gear and the variability in sizes and weights of the specimens targeted for capture, there is a deviation in the sizes of the captured species with respect to the size at first maturity, a deviation whose distribution range will be determined by the type of fishing gear and by the population distribution of the target species, a situation that, for the purposes of rational compliance with the management measure, requires defining tolerance ranges regarding the landings of specimens that are below the size at first maturity.
5. 5That this proposal does not include other species of fishing and commercial interest due to the lack of current studies that would allow for the generation of the respective technical recommendation, but these studies will be scheduled in the relevant annual operational plans, depending on the available capacity, based on the economic and human resources available and the defined strategic lines of action.
6. 6That for tuna, dolphinfish, as well as for the group of sharks, it is taken into account that these species are subject to management by the Inter-American Tropical Tuna Commission - CIAT - and the Organization for the Fishing and Aquaculture Sector of the Central American Isthmus - OSPESCA.
7. 7That the Board Members equally consider the need to establish a management framework on the issue of sizes at first maturity that allows for both the conservation and utilization of the resource, and the sustainability of the national fishing sector.

8- In that same line of thought, compliance with the provisions issued by the Comptroller General of the Republic on this particular topic is also necessary.

1. 9That having analyzed and discussed the issue and the proposal on sizes at first maturity, the Board of Directors, Therefore;

AGREES:

1.-To establish the Sizes at First Maturity for marine species of commercial interest in the fishing activities of the commercial fleet for capture, utilization, landing, and commercialization by national or foreign vessels.

. For the purposes of landing and commercialization of the species whose sizes at first maturity are defined herein, the established tolerance percentages for each of the species shall be applied to the defined measurement per specimen, thus establishing that the landing, transport, stockpiling, processing, or commercialization of species whose measurement is below that resulting after applying the permitted tolerance percentage with respect to the size at first maturity shall not be permitted.

. The defined sizes at first maturity shall be subject to changes that may arise from scientific and technical investigations carried out by INCOPESCA, in relation to the biological behavior of the species.

. Within the maximum periods to reach the Sizes at First Maturity established in this management framework, INCOPESCA, through the Development and Research Department or through investigation systems that may be feasible and suitable, must conduct analyses, biological monitoring, and studies or investigations that allow for the validation, review, and/or adjustment of the established Sizes at First Maturity, for which purpose priority shall be given to the study of the species of the sardine, corvina, pargo, dolphinfish, and shark resources.

. It is expressly established that regarding the sizes defined for the species of yellowfin tuna, dolphinfish, and sharks, they must be applied in accordance with the management measures that the Inter-American Tropical Tuna Commission -CIAT- has established or may establish in relation to the capture and utilization of said species.

Sole Temporary Provision. The management measures established for the Sizes at First Maturity shall come into force three calendar months after their publication in the Official Gazette La Gaceta, for the purpose of ensuring that they are duly disseminated and known by the commercial fishing sector.

(Its original text re-established by agreement AJDIP/132 of March 13, 2015. Previously, this temporary provision had been amended by agreement No. AJDIP/235-2013 of June 21, 2013, but the same was repealed by agreement AJDIP/132 of March 13, 2015, therefore ratifying the entry into force with its original wording by which the sizes at first sexual maturity of the main species of commercial interest were established.)

Considering:

AJDIP/105-2013.-Puntarenas, a los ocho días del mes de marzo de dos mil trece.

1. 1Que de conformidad con la programación realizada por la Junta Directiva, respecto al establecimiento de las tallas de primera madurez de las principales especies de interés comercial; para lo cual se desarrollo por parte de la Dirección General Técnica una serie de consultas al sector pesquero costarricense, en las zonas de Guanacaste, Puntarenas, Limón y Zona Sur, a fin de que estos manifestaran sus posiciones sobre éste particular.
2. 2Que la Junta Directiva recibió en esta sesión al Lic. Antonio Porras Porras, Director General Técnico, así como los biólogos Hubert Araya Umaña, Jefe del Departamento de Desarrollo e Investigación, y Berny Marín Alpízar quienes presentaron la propuesta de tallas de primera

madurez.

1. 3Que en ese mismo orden de ideas, presenta el Lic. Porras Porras, la propuesta señalada, bajo oficio DGT-015-03-2013, indica que esta propuesta incluye los cambios generados en relación a la propuesta inicial y que se sustentan en el proceso de consulta realizado con el Sector Pesquero, así como producto de la revisión de la propuesta inicial en cuanto a la propuesta de entrada en vigencia de forma progresiva de esta medida de regulación, con las finalidad de evitar el colapso de la pesquería de las especies incluidas en esta propuesta.
2. 4Que debido a la selectividad de los artes de pesca y a la variabilidad en tallas y pesos de los especímenes objeto de captura, se presenta una desviación en las tallas de las especies capturadas con respecto a la talla de primera madurez., misma cuyo ámbito de distribución va a estar determinado por el tipo de arte de pesca y por la distribución poblacional de la especie objeto de pesca, situación que para efectos de cumplimiento racional de la medida de regulación requiere definir rangos de tolerancia en cuanto a los desembarques de especímenes que estén por debajo de la talla de primera madurez.
3. 5Que esta propuesta no contempla otras especies de interés pesquero y comercial debido a la falta de estudios actuales que permitan generar la respectiva recomendación técnica, pero se programaran estos estudios en los planes anuales operativos pertinentes, dependiendo de la capacidad con que se cuente, con base en los recursos económicos y humanos de los que se disponen y las líneas de acción estratégicas definidas.
4. 6Que tanto para el atún, dorado como para el grupo de los tiburones se toma en cuenta que estas especies son objeto de ordenamiento de la Comisión Interamericana de Atún Tropical - CIAT- y de la Organización del Sector Pesquero y Acuícola del Istmo Centroamericano - OSPESCA-.
5. 7Que igualmente consideran los Sres. Directores la necesidad de establecer un ordenamiento sobre el tema de las tallas de primera madurez que permita tanto, la conservación y aprovechamiento del recurso, como la sustentabilidad del sector pesquero nacional.

8- En ese mismo orden de ideas, resulta también necesario el cumplimiento de las disposiciones emanadas por la Contraloría General de la República en este tema en particular.

1. 9Que habiendo analizado y discutido el tema y la propuesta sobre tallas de primera madurez, la Junta Directiva, Por tanto;

ACUERDA:

1.-Establecer las Tallas de Primera Madurez de especies marinas de interés comercial en las actividades de pesca de la flota comercial para la captura, aprovechamiento, descarga y comercialización por parte de embarcaciones nacionales o extranjeras.

. Para efectos de la descarga y comercialización de las especies cuyas tallas de primera madurez se definen en el presente, se deberán aplicar los porcentajes de tolerancia establecidos respecto de cada una de las especies sobre la medida definida por ejemplar, estableciéndose entonces que no se permitirá la descarga, el transporte, acopio, procesamiento o comercialización de especies cuya medida esté por debajo del que resulte, después de aplicar el porcentaje de tolerancia permitido respecto a la talla de primera madurez.

. Las tallas definidas de primera madurez, estarán sujetas a los cambios que pudieran resultar producto de las investigaciones científicas y técnicas que sean realizadas por el INCOPESCA, en relación con el comportamiento biológico de las especies.

. Dentro de los plazos máximos para alcanzar las Tallas de Primera Madurez establecidos en el presente ordenamiento, el INCOPESCA a través del Departamento de Desarrollo e Investigación o de los sistemas de investigación que pueden resultar factibles e idóneos deberá realizar análisis, monitoreo biológico y estudios o investigaciones que permitan validar, revisar y/o ajustar, las Tallas de Primera Madurez que se han establecido, para efectos de los cual se dará prioridad al estudio de las especies del recurso sardina, corvina, pargo, dorado y tiburón.

. Se establece expresamente que en cuanto a las tallas definidas para las especies de atún aleta amarilla, dorado y tiburones, las mismas deben de aplicarse en concordancia con las medidas de ordenación que para estos efectos haya establecido o establezca la Comisión Interamericana de Atún Tropical -CIAT- en lo relativo a la captura y aprovechamiento de dichas especies.

Transitorio Único. Las medidas de ordenamiento establecidas de las Tallas de Primera Madurez, empezarán a regir tres meses calendario después de su publicación en el Diario Oficial La Gaceta, a los efectos de que las mismas sean debidamente divulgadas y conocidas por el sector pesquero comercial.

(Restablecido su texto original por acuerdo AJDIP/132 del 13 de marzo de 2015. Anteriormente este transitorio había sido reformado por acuerdo N° AJDIP/235-2013 del 21 de junio del 2013, pero el mismo fue derogado por acuerdo AJDIP/132 del 13 de marzo de 2015, por lo se que ratifica la entrada en vigencia con su redacción original mediante el cual se establecieron las tallas de primera madurez sexual de las principales especies de interés comercial ) 3.-Acuerdo Firme.
