Agreement on the Agricultural Sector in the Sixaola BasinAcuerdo sobre el Sector Agropecuario en la Cuenca del Sixaola

Enrique Castillo Barrantes, Minister of Foreign Affairs and Worship, and the diplomatic note dated August 27, 2012, signed by His Excellency Mr. Rómulo Roux, Minister of Foreign Affairs of the Republic of Panama, for the strengthening of the actions of the Agricultural Sector in the binational basin of the Sixaola River under the modality of Exchange of Notes, whose texts are as follows:

The Minister of Foreign Affairs and Worship San José, July 23, 2012 DM-DGPE/458-12 Mr. Minister:

Encouraged by the desire to strengthen bilateral cooperation on border issues and under the coverage of the Agreement on Cooperation for Border Development and its Annex, signed in Sixaola, on May 3, 1992, and the Association Agreement, done in Panama City on October 29, 2009, the Government of the Republic of Costa Rica proposes to the Honorable Government of the Republic of Panama, the following Agreement for the strengthening of the actions of the Agricultural Sector in the binational basin of the Sixaola River, under the modality of Exchange of Notes, which shall be governed by the following terms:

1. This Agreement has the following objectives:

• a)To strengthen the cooperation ties between the Ministries of Agriculture and Livestock of Costa Rica and of Agricultural Development of Panama to promote actions that contribute to improving the living conditions and reducing the environmental vulnerability of the populations in the binational basin of the Sixaola River.

To His Excellency Francisco Álvarez de Soto Minister of Foreign Affairs in Charge of the Republic of Panama b) To optimize the use of existing resources in the programs and projects under execution in the binational basin, to achieve synergies in the use and destination of project funds and achieve with them effective improvements in the quality of life of both countries.

• c)To promote collaboration with the business sector of both countries to achieve alliances that contribute to local development and provide economic, social, and environmental benefits, thereby enhancing the opportunities offered by the region to achieve a diversified economy consistent with the environmental norms of both countries.
• d)To develop a program of joint priority activities aimed at improving the investment climate and the economic diversification of the region, strengthening the capacity of the communities and their organizations to achieve more equitable participation in the markets for products and for environmental goods and services.
• e)To convey to higher instances of the Executive Branch and their dependencies, in their respective countries, the urgent need to address other demands that fall outside the sectoral mandate of the Ministers of Agriculture, such as road infrastructure for safe movement, health, and the impact of flooding.

2. The Ministers of the Agricultural Sector, through their respective Administrative Units and Institutions associated with their sector, have arranged to support the following actions:

• a)To promote the projects that fall within the purview of the agricultural sector, as part of the actions to put into operation the binational inter-institutional network to address cross-border poverty and the environmental, social, economic, and cultural sustainability, agreed upon between the Presidents of Panama and Costa Rica in the agreements and conventions between both countries.
• b)To support micro, small, and medium producers of the cross-border region by facilitating the implementation of the actions of national projects under execution, in a manner that promotes a diversified culture and provides new opportunities to generate income for the region's own inhabitants.
• c)To support national and regional initiatives aimed at forming alliances between the public and private sectors for the development of productive and conservation projects that contribute to combating poverty, inequality, and social exclusion, and that provide conditions for mitigating climate impacts.
• d)To intensify actions so that regional production complies with cleaner production policies and responds to the environmental norms of both countries, strengthening productive development that is environmentally friendly and that contributes to improving health and the living standards of the populations.
• e)To reorient the institutional management of both Ministries so that the employment and income generation needs of the cross-border area are urgently addressed, through the provision of technical assistance, investment resources, and facilitation for small businesses.
• f)To intercede before other institutions, mainly those for health, public works, and emergency prevention, for them to intensify their actions, so that they have an effective impact on solving these problems in the region.

3. Alliances for the execution of actions:

• a)To request support from international cooperation for the implementation of cross-border initiatives that provide the necessary economic means and assistance.
• b)To strengthen cooperation with the business sector for the financing and execution of actions within the framework of corporate social responsibility, facilitating the replication of the experiences that are already being developed in the region.
• c)To recognize the importance of local authorities and organizations and their capacities for the development of the area, so that, in coordination with the competent regional entities, they are collaborators in the implementation of the activities promoted by said institutions.
• d)To instruct the regional offices regarding these agreements so that they assist in their implementation and provide periodic progress reports to their Ministers.

4. This Agreement supersedes the Collaboration Agreement between the Minister of Agriculture and Livestock of Costa Rica and the Ministry of Agricultural Development of Panama with the objective of strengthening the cross-border development of the Binational basin of the Sixaola River, signed in the city of Changuinola on August 27, 2010.

5. This Agreement shall have an indefinite term and shall enter into force on the date of the second of the notes in which the Parties communicate the fulfillment of the formalities of their legal systems for its entry into force.

6. This Agreement may be denounced at any time, by either of the Parties, via written notification to the Other Party through the diplomatic channel. Said denunciation shall take effect one year after the date of receipt of its notification, and the projects that are under execution shall not be affected.

If Your Excellency has the kindness to confirm on behalf of the Government of the Republic of Panama the foregoing, this note and Your Excellency's note of response shall constitute an Agreement between both Governments, which shall enter into force in accordance with its numeral 5.

I take this opportunity to reiterate to Your Excellency the assurances of my highest and most distinguished consideration.

I have the honor to address Your Excellency on the occasion of acknowledging receipt of your attentive note No. DM-DGPE/458-12 dated July 23, 2012, which reads as follows:

In this regard, I have the honor to inform Your Excellency that the foregoing proposal is acceptable to the Government of the Republic of Panama and that Your Excellency's Note and this one constitute an Agreement between our two Governments that shall enter into force on the date of receipt of this Note.

El Ministro de Relaciones Exteriores y Culto San José, 23 de julio de 2012 DM-DGPE/458-12 Señor Ministro:

Animado por el deseo de fortalecer la cooperación bilateral en temas fronterizos y al amparo del Convenio sobre Cooperación para el Desarrollo Fronterizo y su Anexo, firmado en Sixaola, el 3 de mayo de 1992 y el Acuerdo de Asociación, hecho en la Ciudad de Panamá el 29 de octubre de 2009, el Gobierno de la República de Costa Rica propone al Honorable Gobierno de la República de Panamá, el siguiente Acuerdo para el fortalecimiento de las acciones del Sector Agropecuario en la cuenca binacional del Río Sixaola, bajo la modalidad de Canje de Notas, el cual se regirá por los siguientes términos:

1. El presente Acuerdo tienen los siguientes objetivos:

• a)Afianzar los lazos de cooperación entre los Ministerios de Agricultura y Ganadería de Costa Rica y de Desarrollo Agropecuario de Panamá para impulsar acciones que contribuyan a mejorar las condiciones de vida y reduzcan la vulnerabilidad ambiental de las poblaciones en la cuenca binacional del río Sixaola.

Excelentísimo Señor Francisco Álvarez de Soto Ministro de Relaciones Exteriores Encargado de la República de Panamá b) Optimizar el uso de los recursos existentes en los programas y proyectos en ejecución en la cuenca binacional, para lograr sinergias en el uso y destino de los fondos de los proyectos y lograr con estos mejoras efectivas en la calidad de vida de ambos países.

• c)Impulsar la colaboración con el sector empresarial de ambos países para lograr alianzas que contribuyan al desarrollo local y provean beneficios económicos, sociales y ambientales potenciando con estos las oportunidades que ofrece la región para lograr una economía diversificada consistente con las normas ambientales de ambos países.
• d)Desarrollar un programa de actividades prioritarias conjuntas dirigidas a mejorar el clima de inversión y la diversificación económica de la región, fortaleciendo la capacidad de las comunidades y sus organizaciones para lograr una participación más equitativa en los mercados de productos y de bienes y servicios ambientales.
• e)Transmitir a instancias superiores del Poder Ejecutivo y sus dependencias, en sus respectivos países, la necesidad urgente de atender otras demandas que escapan al mandato sectorial de los Ministros de Agricultura, como son, infraestructura vial para una movilización segura, salud e impacto de las inundaciones.

2. Los Ministros del Sector Agropecuario, a través de sus respectivas Unidades Administrativas e Instituciones asociadas a su sector, han dispuesto apoyar las siguientes acciones:

• a)Impulsar los proyectos que competen al sector agropecuario, como parte de las acciones para poner en funcionamiento la red interinstitucional binacional para enfrentar la pobreza transfronteriza y la sostenibilidad ambiental, social, económica y cultural, acordada entre los Presidentes de Panamá y Costa Rica en los acuerdos y convenios entre ambos países.
• b)Apoyar a los micro, pequeños y medianos productores de la región transfronteriza facilitando la implementación de las acciones de los proyectos nacionales en ejecución, de forma que se promueva una cultura diversificada, y aporten nuevas oportunidades de generar ingresos por los propios moradores de la región.
• c)Apoyar las iniciativas nacionales y regionales dirigidas a la formación de alianzas entre el sector público y el privado para el desarrollo de proyectos productivos y de conservación, que contribuyan a combatir la pobreza, la desigualdad y la exclusión social, y que provean condiciones para mitigar los impactos del clima.
• d)Intensificar las acciones para que la producción regional cumpla con las políticas de producción más limpia y que responda a las normas ambientales de ambos países, fortaleciendo un desarrollo productivo amigable con el ambiente y que contribuya a mejorar la salud y el nivel de vida de las poblaciones.
• e)Reorientar la gestión institucional de ambos Ministerios de forma que se atienda con urgencia las necesidades de generación de empleos e ingresos del área transfronteriza, por medio de la provisión de asistencia técnica, recursos de inversión y facilitación a los pequeños negocios.
• f)Interceder ante otras instituciones, principalmente en las de salud, obras públicas y prevención de emergencias para que intensifiquen sus acciones, de forma que las mismas tengan una incidencia efectiva en la solución de estos problemas en la región.

3. Alianzas para la ejecución de las acciones:

• a)Solicitar a la cooperación internacional el apoyo para la implementación de iniciativas transfronterizas que faciliten los medios económicos y de asistencia necesarios.
• b)Fortalecer la cooperación con el sector empresarial para la financiación y ejecución de acciones dentro del marco de la responsabilidad social empresarial, facilitando replicar las experiencias que ya se vienen desarrollando en la región.
• c)Reconocer la importancia de las autoridades y organizaciones locales y sus capacidades para el desarrollo de la zona, para que en coordinación con las entidades regionales competentes sean colaboradores en la implementación de las actividades que promueven dichas instituciones.
• d)Instruir a las oficinas regionales de estos acuerdos para que coadyuven en su implementación y provean informes periódicos de avance a sus Ministros.

4. Este Acuerdo sustituye el Acuerdo de Colaboración entre la Ministra de Agricultura y Ganadería de Costa Rica y el Ministerio de Desarrollo Agropecuario de Panamá con el objetivo de fortalecer el desarrollo transfronterizo de la cuenca Binacional de río Sixaola, suscrito en la ciudad de Changuinola el 27 de agosto de 2010.

5. El presente Acuerdo tendrá un plazo indefinido y entrará en vigor en la fecha de la segunda de las notas en que las Partes se comuniquen del cumplimiento de las formalidades de sus ordenamientos jurídicos para su entrada en vigencia.

6. Este Acuerdo podrá ser denunciado en cualquier momento, por cualquiera de las Partes, mediante notificación escrita a la Otra Parte por medio de la vía diplomática. Dicha denuncia surtirá efecto transcurrido un año de la fecha de la recepción de su notificación, y no se verán afectados los proyectos que estuviesen en ejecución.

Si Vuestra Excelencia tiene a bien confirmar en nombre del Gobierno de la República de Panamá lo expuesto anteriormente, la presente nota y la de respuesta de Vuestra Excelencia, constituirán un Acuerdo entre ambos Gobierno, que entrará en vigor de acuerdo con su numeral 5.

Tengo el honor de dirigirme a Vuestra Excelencia en ocasión de avisar recibo de su atenta nota N° DM-DGPE/458-12 fechada 23 de julio de 2012, que dice lo siguiente:

"Señor Ministro:

Animado por el deseo de fortalecer la cooperación bilateral en temas fronterizos y al amparo del Convenio sobre Cooperación para el Desarrollo Fronterizo y su Anexo, firmado en Sixaola, el 3 de mayo de 1992 y el Acuerdo de Asociación, hecho en la Ciudad de Panamá el 29 de octubre de 2009, el Gobierno de la República de Costa Rica propone al Honorable Gobierno de la República de Panamá, el siguiente Acuerdo para el fortalecimiento de las acciones del Sector Agropecuario en la cuenca binacional del Río Sixaola, bajo la modalidad de Canje de Notas, el cual se regirá por los siguientes términos:

1. El presente Acuerdo tienen los siguientes objetivos:

• a)Afianzar los lazos de cooperación entre los Ministerios de Agricultura y Ganadería de Costa Rica y de Desarrollo Agropecuario de Panamá para impulsar acciones que contribuyan a mejorar las condiciones de vida y reduzcan la vulnerabilidad ambiental de las poblaciones en la cuenca binacional del río Sixaola.

• c)Impulsar la colaboración con el sector empresarial de ambos países para lograr alianzas que contribuyan al desarrollo local y provean beneficios económicos, sociales y ambientales potenciando con estos las oportunidades que ofrece la región para lograr una economía diversificada consistente con las normas ambientales de ambos países.

Excelentísimo Señor Enrique Castillo Barrantes Ministro de Relaciones Exteriores y Culto San José d) Desarrollar un programa de actividades prioritarias conjuntas dirigidas a mejorar el clima de inversión y la diversificación económica de la región, fortaleciendo la capacidad de las comunidades y sus organizaciones para lograr una participación más equitativa en los mercados de productos y de bienes y servicios ambientales.

• e)Transmitir a instancias superiores del Poder Ejecutivo y sus dependencias, en sus respectivos países, la necesidad urgente de atender otras demandas que escapan al mandato sectorial de los Ministros de Agricultura, como son, infraestructura vial para una movilización segura, salud e impacto de las inundaciones.

2. Los Ministros del Sector Agropecuario, a través de sus respectivas Unidades Administrativas e Instituciones asociadas a su sector, han dispuesto apoyar las siguientes acciones:

• a)Impulsar los proyectos que competen al sector agropecuario, como parte de las acciones para poner en funcionamiento la red interinstitucional binacional para enfrentar la pobreza transfronteriza y la sostenibilidad ambiental, social, económica y cultural, acordada entre los Presidentes de Panamá y Costa Rica en los acuerdos y convenios entre ambos países.
• b)Apoyar a los micro, pequeños y medianos productores de la región transfronteriza facilitando la implementación de las acciones de los proyectos nacionales en ejecución, de forma que se promueva una cultura diversificada, y aporten nuevas oportunidades de generar ingresos por los propios moradores de la región.
• c)Apoyar las iniciativas nacionales y regionales dirigidas a la formación de alianzas entre el sector público y el privado para el desarrollo de proyectos productivos y de conservación, que contribuyan a combatir la pobreza, la desigualdad y la exclusión social, y que provean condiciones para mitigar los impactos del clima.
• d)Intensificar las acciones para que la producción regional cumpla con las políticas de producción más limpia y que responda a las normas ambientales de ambos países, fortaleciendo un desarrollo productivo amigable con el ambiente y que contribuya a mejorar la salud y el nivel de vida de las poblaciones.
• e)Reorientar la gestión institucional de ambos Ministerios de forma que se atienda con urgencia las necesidades de generación de empleos e ingresos del área transfronteriza, por medio de la provisión de asistencia técnica, recursos de inversión y facilitación a los pequeños negocios.
• f)Interceder ante otras instituciones, principalmente en las de salud, obras públicas y prevención de emergencias para que intensifiquen sus acciones, de forma que las mismas tengan una incidencia efectiva en la solución de estos problemas en la región.

3. Alianzas para la ejecución de las acciones:

• a)Solicitar a la cooperación internacional el apoyo para la implementación de iniciativas transfronterizas que faciliten los medios económicos y de asistencia necesarios.

4. Este Acuerdo sustituye el Acuerdo de Colaboración entre la Ministra de Agricultura y Ganadería de Costa Rica y el Ministerio de Desarrollo Agropecuario de Panamá con el objetivo de fortalecer el desarrollo transfronterizo de la cuenca Binacional de río Sixaola, suscrito en la ciudad de Changuinola el 27 de agosto de 2010.

5. El presente Acuerdo tendrá un plazo indefinido y entrará en vigor en la fecha de la segunda de las notas en que las Partes se comuniquen del cumplimiento de las formalidades de sus ordenamientos jurídicos para su entrada en vigencia.

6. Este Acuerdo podrá ser denunciado en cualquier momento, por cualquiera de las Partes, mediante notificación escrita a la Otra Parte por medio de la vía diplomática. Sobre el particular, tengo el honor de informar a Vuestra Excelencia que la propuesta anterior es aceptable al Gobierno de la República de Panamá y que la Nota de Vuestra Excelencia y la presente constituyen un Acuerdo entre nuestros dos Gobiernos que entrará en vigencia en la fecha de la recepción de la presente Nota.
