1. 1That Agreement No. 3 is received, adopted by the National Commission for Sport-Tourism Fishing in a session held on January 10, 2013, by means of which they recommend to the Board of Directors the approval for the celebration of the International Sport Fishing Tournament, called "Presidential Challange", which would be held in the area of the bay of Puerto Carrillo to Punta Guiones, in the province of Guanacaste, on the days from the 28th of February to the 3rd of March, 2013.
2. 2That this activity will have as its modality billfish fishing, for which the directors consider it opportune and appropriate, within the framework of the powers and attributions that the Fisheries and Aquaculture Law confers upon INCOPESCA in its capacity as the governing body of fisheries and aquaculture, to guarantee the ideal conditions for achieving the aims pursued in this type of activities.

3- In that vein, and since it clearly corresponds to INCOPESCA, not only the promotion of this type of fishing activity, but also its regulation, given the scope and social and economic importance that the celebration of this type of international events represents, in accordance with numerals 34 and 35 of the aforementioned Law, in order to guarantee the best conditions, regarding the fishery resource, it is appropriate to establish and declare a temporary closure (veda) for commercial fishing in those areas where this sport fishing tournament takes place, in accordance with compliance with the legal norm, in conformity with the express request made by the Organizing Committee when requesting authorization from INCOPESCA.

1. 4That in accordance with the foregoing and clearly framed within the

activities, of the Board of Directors. Therefore, Agrees 1- To approve the holding of the Sport Fishing Tournament called "Presidential Challange" which will be held from February 28 to March 3, 2013, which will be based in the Bay of Puerto Carrillo in the province of Guanacaste.

1. 2That for purposes of guaranteeing the success of the activity, it is determined as a temporary exclusive zone for sport billfish fishing solely during the days of February 28 to March 3, 2013, the zone determined by a geometric figure formed by the following Cartesian coordinates and reference points: From Punta Guiones as point one determined with the following coordinates 85 degrees 41 minutes west longitude, with 9 degrees 55 minutes north latitude, from there a straight imaginary line is drawn with a course of approximately 270 degrees until reaching a distance of forty nautical miles to the west, arriving at point two, determined with the following coordinates: 86 degrees 20 minutes west longitude with 9 degrees 55 minutes north latitude, from there a straight imaginary line is drawn to point three determined with the following coordinates: 85 degrees 30 minutes west longitude with 9 degrees 10 minutes north latitude, and finally from there with an approximate course north to the bay of Puerto Carrillo determined with the following coordinates 85 degrees 31 minutes west longitude with 9 degrees 52 minutes north latitude.

3- In the area comprised by the zone previously described, commercial fishing with surface longline, where the main line is placed at a depth less than 9.10 meters depth (5 fathoms) and billfish fishing for the time here determined is prohibited. Only and for that time will billfish fishing be permitted for sport and tourism fishing in this zone under the "catch and release" modality.

4- This authorization is conditional upon faithful compliance with the legal requirements, as well as those that guarantee the safety and physical integrity, not only of the participants, but also of the general public that the holding of this type of events entails, before the Authorities of INCOPESCA, the Costa Rican Tourism Institute, the Municipality of the locality, the National Coast Guard Service, the National Directorate of Maritime Transport, the National Insurance Institute, the Costa Rican Red Cross, etc.

5- Let it be published, it is effective from its publication.

1. 1Que se recibe Acuerdo N° 3, adoptado por la Comisión Nacional de Pesca Deportiva- Turística en sesión celebrada el 10 de enero de 2013, por medio del cual recomiendan a la Junta Directiva la aprobación para la celebración del Torneo de Pesca Deportiva Internacional, denominado "Presidential Challange", el cual se estaría celebrando en la zona de la bahía de Puerto Carrillo hasta Punta Guiones, en la provincia de Guanacaste, los días del 28 de febrero al 3 de marzo de 2013.
2. 2Que esta actividad tendrá como modalidad la pesca de picudos, por lo cual consideran oportuno y procedente los señores directores, en el marco de las facultades y atribuciones que la Ley de Pesca y Acuicultura le confiere al INCOPESCA en su condición de ente rector de la pesca y la acuicultura, que garantizar las condiciones idóneas para la consecución de los fines perseguidos en este tipo de actividades.

3- En ese giro, y siendo que claramente corresponde al INCOPESCA, no solo el fomento de este tipo de actividad pesquera; sino que asimismo su regulación, por la envergadura e importancia social y económica que representa la celebración de este tipo de eventos de carácter internacional, al tenor de los numerales 34 y 35 de la Ley supra, a fin de garantizar las mejores condiciones, respecto al recurso pesquero, resulta procedente el establecimiento y declaratoria una veda temporal para la pesca comercial en aquellas zonas donde se realice este torneo de pesca deportiva en concordancia con el cumplimiento de la norma legal, de conformidad con la solicitud expresa planteada por el Comité Organizador al momento de requerir la autorización al INCOPESCA.

1. 4Que en concordancia con lo anterior y claramente enmarcado dentro del mandato legal expreso establecido por Ley al INCOPESCA de fomentar este tipo de actividades, la Junta Directiva. Por tanto,

Acuerda 1- Aprobar la realización del Torneo de Pesca Deportiva denominado "Presidential Challange" que se estará celebrando del 28 de febrero al 3 de marzo del 2013, el cual tendrá como sede en la Bahía de Puerto Carrillo en la provincia de Guanacaste.

1. 2Que para efectos de garantizar el éxito de la actividad, se determina como zona temporal exclusiva para la pesca deportiva de picudos únicamente durante los días 28 de febrero al 3 de marzo del 2013, la zona que se determina mediante una figura geométrica conformada con las siguientes coordenadas cartesianas y puntos de referencia: Desde Punta Guiones como punto uno determinado con las siguientes coordenadas 85 grados 41 minutos longitud oeste, con 9 grados 55 minutos latitud norte, de ahí se traza una línea recta imaginaria con rumbo de 270 grados aproximadamente hasta llegar a una distancia de cuarenta millas náuticas hacia el oeste, llegando al punto dos, determinado con las siguientes coordenadas: 86 grados 20 minutos longitud oeste con 9 grados 55 minutos latitud norte, de ahí se traza una línea recta imaginaria hasta el punto tres determinado con las siguiente coordenadas: 85 grados 30 minutos longitud oeste con 9 grados 10 minutos latitud norte, y finalmente desde ahí con rumbo norte aproximadamente hasta la bahía de Puerto Carrillo determinado con las siguientes coordenadas 85 grados 31 minutos longitud oeste con 9 grados 52 minutos latitud norte.

3- Queda prohibido en el área comprendida de la zona anteriormente descrita, la pesca comercial con palangre de superficie, donde la línea madre esté colocada a una profundidad menor de los 9.10 metros de profundidad (5 brazadas) y la pesca de picudos por el tiempo aquí determinado. Solamente y por ese tiempo se permitirá la pesca de picudos a la pesca deportiva y turística en esta zona bajo la modalidad de "capture y libere".

4- Queda condicionada esta autorización al fiel cumplimiento de los requisitos legales, así como aquellos que garanticen la seguridad e integridad física, no solo de los participantes; sino del público en general que conllevan la realización de este tipo de eventos, ante las Autoridades del INCOPESCA, Instituto Costarricense de Turismo, la Municipalidad de la localidad, Servicio Nacional de Guardacostas, Dirección Nacional de Transporte Marítimo, el Instituto Nacional de Seguros, la Cruz Roja Costarricense, etc.

5- Publíquese, rige a partir de su publicación.

6- Acuerdo Firme.

Considerando:
