General Provisions

CHAPTER I

50 of the Municipal Code, which grants the authority to regulate this matter.

49 of the current Municipal Code, the appointment of the Permanent Commission on Environmental Affairs of the Municipal Council of Siquirres is established, which shall be governed by these regulations.

Nature

Purpose

a)To function as an advisory body to the Municipal Council on environmental matters.
b)To promote guidelines in environmental management (Gestión Ambiental) policies and to advance the projects required in this field for the canton of Siquirres.

Composition

CHAPTER III

The Permanent Commission on Environmental Affairs shall be composed of proprietary and alternate council members (regidores propietarios y suplentes), proprietary and alternate district council members (síndicos propietarios y suplentes); taking into account the nominations, always ensuring that all political parties represented on the Council participate in it, with a maximum of five members.

The Commission may also request the advice it requires from officials of other state or private institutions.

If any considers that there is an impossibility to participate in it, they shall request their exclusion in writing to the Presidency of the Council, giving the reasons for the case. The Presidency shall make the determination on whether the Council Member shall remain in the Commission or be excluded.

On the obligations of the members of the Commission

CHAPTER IV

If any of the members misses a session, they must justify it before the Presidency of the Commission, and if they incur three consecutive absences without justification, the President of the Municipal Council must replace this member.

Powers of the Permanent Commission on Environmental Affairs

CHAPTER V

It shall propose the corresponding solutions and corrective measures to the Municipal Environmental Management Office, the governing unit of the canton.

Functions

CHAPTER VI

1)To advise the Municipal Council.
2)To hear and issue opinions on the matters delegated to it by the Council.
3)To prepare an annual work plan, which includes a budget, that must be approved by the Municipal Council.
4)To propose to the Municipal Council the regulations of the Commission and other Environmental topics that require regulation.
5)To propose to the Municipal Council a budget for projects regarding the Environment.
6)To coordinate with the different Technical and Administrative Units of the Municipality. This coordination must be permanent in the case of the Municipal Environmental Management Office or its equivalent.
7)To coordinate work with interested civil society groups as well as with other public or private institutions with functions in the Environmental field.
8)To promote the participation of civil society, municipal officials, and officials from other institutions as advisors to the commission.
9)To promote Education and Dissemination processes in Environmental matters.
10)To plan, propose, follow up, and evaluate specific projects on Environmental matters for the Municipal Council.
11)To propose to the Municipal Council to prioritize the most important Environmental topics in the Canton with an integral vision.
12)To establish a space in the Council sessions for the citizen to present procedures and complaints regarding Environmental Impact.
13)To study and propose possible solutions to the Environmental Affairs of the Canton to the Municipal Environmental Management Office.
14)To keep updated regarding Environmental Legal Information.
15)To ensure compliance with the Municipal Plan for solid waste collection in all neighborhoods of the canton.

Procedure

CHAPTER VII

The document must contain:

a. Day, start and end time, place, attendees, and absentees at the meeting.

b. Each aspect referred to its knowledge and recommendation must be independent of one another, differentiated by a number. Apart from the foregoing, it must contain a description of what was analyzed and the recommendation directed to the Municipal Council.

c. When unanimous agreement on a report does not exist, the members of the Commission who do not approve it have the duty to justify their negative vote, explain their reasons, and also draft a minority report. If a majority and minority report exist, the majority report shall be heard first.

d. The Secretariat of the Council shall keep custody of all paperwork, as well as the original report(s) in its official files.

Shall be effective as of its publication. Let it be published.

CAPÍTULO I

Disposiciones Generales

Naturaleza

Las cuales cuentan con un fin establecido y son permanentes en el tiempo.

b)Promover las directrices en políticas de Gestión Ambiental e impulsar los proyectos que en este campo se requieran para el cantón de Siquirres.

Conformación

CAPÍTULO III

La Comisión Permanente de Asuntos Ambientales estará conformada por regidores propietarios y suplentes, síndicos propietarios y suplentes; tomando en cuenta las postulaciones, procurando siempre que participen en ella todos los partidos políticos representados en el Concejo, con máximo de cinco integrantes.

Podrá además la Comisión solicitar la asesoría que requiera a funcionarios de otras instituciones estatales o privadas.

Si alguno considera que existe alguna imposibilidad para participar en la misma, solicitará por escrito su exclusión, a la Presidencia del Concejo, dando las razones del caso. La Presidencia tomará la determinación sobre si el Regidor deberá permanecer en la Comisión o si se excluye.

De las obligaciones de las integrantes de la Comisión

CAPÍTULO IV

Si alguno de los miembros faltare a una sesión, debe justificarla ante la Presidencia de la Comisión y si incurriere en tres ausencias consecutivas sin justificación, el o la Presidente(a) del Concejo Municipal deberá sustituir a este integrante.

Competencia de la Comisión Permanente de Asuntos Ambientales

CAPÍTULO V

Propondrá las soluciones y medidas correctivas correspondientes a la Oficina de Gestión Ambiental Municipal, unidad rectora del cantón.

Funciones

CAPÍTULO VI

1)Asesorar al Concejo Municipal.
2)Conocer y dictaminar sobre los asuntos que el Concejo le delegue.
3)Elaborar un plan de trabajo anual, que incluya un presupuesto, que deberá ser aprobado por el Concejo Municipal.
4)Proponer al Concejo Municipal la reglamentación de la Comisión y de otros temas Ambientales que se requiera reglamentar.
5)Proponer al Concejo Municipal un presupuesto para proyectos en materia de Medio Ambiente.
6)Coordinar con las diferentes Unidades Técnicas y Administrativas de la Municipalidad. Esta coordinación debe ser permanente en el caso de la Oficina de Gestión Ambiental Municipal o su equivalente.
7)Coordinar labores con los grupos interesados de la sociedad civil así como con otras instituciones públicas o privadas con funciones en el campo Ambiental.
8)Promover la participación de la sociedad civil, funcionarios municipales y funcionarios de otras instituciones como asesores de la comisión.
9)Promover procesos de Educación y Divulgación en materia Ambiental.
10)Planear, proponer, dar seguimiento y evaluar proyectos específicos en materia Ambiental para el Concejo Municipal.
11)Proponer al Concejo Municipal priorizar sobre los temas Ambientales de más importancia en el Cantón con una visión integral.
12)Abrir un espacio en las sesiones del Concejo al ciudadano para gestiones y denuncias de Impacto Ambiental.
13)Estudiar y proponer las posibles soluciones a los Asuntos Ambientales del Cantón a la Oficina de Gestión Ambiental Municipal.
14)Mantenerse actualizados en cuanto a la Información Legal Ambiental.
15)Velar por el cumplimiento del Plan Municipal de recolección de desechos sólidos por todos los barrios del cantón.

Procedimiento

CAPÍTULO VII

El documento debe contener:

a. Día, hora de inicio y final, lugar, presentes y ausentes a la reunión.

b. Cada aspecto trasladado a su conocimiento y recomendado, deberá ser independiente uno del otro, diferenciándose con un número. Aparte de lo anterior debe contener una descripción de lo analizado y la recomendación dirigida al Concejo Municipal.

c. Cuando no existiere acuerdo unánime sobre un informe, los miembros de la Comisión que no lo aprueben, tienen el deber de justificar su negativa, exponer sus razones y además redactar un informe de minoría. De existir uno de mayoría y de minoría, se conocerá primero el de mayoría.

d. La Secretaría del Concejo, custodiará toda la papelería, así como el o los informes originales en sus archivos oficiales.

Regulation for the Permanent Environmental Affairs CommissionReglamento para la Comisión Permanente de Asuntos Ambientales

Artículo 1 — These Regulations are based on the provisions of Article No.

Artículo 2 — In accordance with Article No.

Artículo 3 — The Permanent Commissions shall be those described in Article No.

Artículo 4 — It is mandatory for the Municipality of Siquirres to have a Permanent Commission on Environmental Affairs.

Artículo 5 — The purpose of the Permanent Commission on Environmental Affairs of the Municipal Council is:

Artículo 6 — In the Municipal Council session immediately following the installation of its members, the Municipal President shall appoint the members of the Permanent Commission on Environmental Affairs.

Artículo 7 — The President shall proceed to appoint the members.

Artículo 8 — The term of the appointment shall be two years, and each of the members may be re-elected.

Artículo 9 — The Commission may request technical advice from the officials of the Municipal Environmental Management Office (Oficina de Gestión Ambiental Municipal), who must appear when so required.

Artículo 10 — The Commission shall propose the mechanisms to incorporate, as advisors, persons whose professional profile or leadership in the community allows for strengthening its capacity to perform its functions.

Artículo 11 — The Environmental Management Office of the Municipality and the Permanent Commission on Environmental Affairs must regularly coordinate their actions for the well-being of its citizens.

Artículo 12 — All Proprietary Council Members appointed by the Presidency of the Council are obligated to participate in the Commission.

Artículo 13 — To attend punctually the sessions convened.

Artículo 14 — Non-compliance with any of these regulated articles by the members of the Commission may be cause for their permanent removal from it.

Artículo 15 — To study, analyze, and investigate the reported problems related to the Environment and Sustainable Development.

Artículo 16 — It is within the powers of the Permanent Commission on Environmental Affairs to fulfill the functions assigned to it by the Municipal Council by virtue of Article No.

Artículo 17 — To propose two members of the Permanent Commission on Environmental Affairs to the Municipal Environmental Management Commission (Comisión de Gestión Ambiental Municipal).

Artículo 18

Artículo 20 — The quorum shall be half plus one of the members of the Commission, and its meetings shall be public; the foregoing does not mean that the open participation of those attending is enabled, requiring an agreement to grant an audience for a special situation or for them to speak.

Artículo 22 — The Commission must, on an obligatory basis, submit to the Municipal Council, every three calendar months, a complete report of the work carried out, as well as those pending resolution.

Artículo 23 — The report of the Commission must be submitted within a maximum period of fifteen (15) days after receiving the matter; the Commission may request from the Municipal Council the extensions it deems necessary when duly justified.

Artículo 24 — The reports must be submitted in writing and signed by all members of the Commission who drafted it.

Artículo 25 — Once the report is known in the Municipal Council, those recommendations that involve a decision-making action by it shall be submitted to a vote by the Municipal President.

Artículo 1 — El presente Reglamento, se fundamenta en lo dispuesto en el artículo N° 50 del Código Municipal el cual otorga la potestad de reglamentar esta materia.

Artículo 2 — De conformidad con el Artículo N° 49, del Código Municipal vigente, se establece el nombramiento de la Comisión Permanente de Asuntos Ambientales del Concejo Municipal de Siquirres, la cual se regirá por el presente reglamento.

Artículo 3 — Las Comisiones Permanentes serán aquellas que describe el artículo N° 49 del Código Municipal.

Artículo 4 — Es obligatorio para la Municipalidad de Siquirres contar con una Comisión Permanente de Asuntos Ambientales.

Artículo 5 — La finalidad de la Comisión Permanente de Asuntos Ambientales del Concejo Municipal es:

Artículo 6 — En la sesión del Concejo Municipal posterior inmediata a la instalación de sus miembros, el o la Presidente (a) Municipal nombrará a los integrantes de la Comisión Permanente de Asuntos Ambientales.

Artículo 7 — El o la presidente(a) procederá a nombrar los integrantes.

Artículo 8 — El plazo del nombramiento será de dos años y cada uno de los miembros, puede ser reelecto.

Artículo 9 — La Comisión podrá solicitar asesoría técnica a los funcionarios de la Oficina de Gestión Ambiental Municipal, estos deben comparecer cuando así les sea requerido.

Artículo 10 — La Comisión propondrá los mecanismos para incorporar en carácter de asesores a personas cuyo perfil profesional o liderazgo en la comunidad permita fortalecer su capacidad de desempeño de sus funciones.

Artículo 11 — La Oficina de Gestión Ambiental de la Municipalidad y la Comisión Permanente de Asuntos Ambientales deberán coordinar con regularidad sus acciones para el bienestar de sus ciudadanos.

Artículo 12 — Todos los Regidores Propietarios nombrados por la Presidencia del Concejo están obligados a participar en la Comisión.

Artículo 13 — Asistir puntualmente a las sesiones que le convoquen.

Artículo 14 — El incumplimiento, de algunos de estos artículos reglamentados por parte de los integrantes de la Comisión, puede ser causa de su separación en forma permanente de la misma.

Artículo 15 — Estudiar, analizar e investigar los problemas denunciados relacionados con el Medio Ambiente y el Desarrollo Sostenible.

Artículo 16 — Es competencia de la Comisión Permanente de Asuntos Ambientales cumplir con las funciones que le asigne el Concejo Municipal en virtud del artículo N° 13 inciso m) del Código Municipal.

Artículo 17 — Proponer a dos miembros de la Comisión Permanente de Asuntos Ambientales a la Comisión de Gestión Ambiental Municipal.

Artículo 18

Artículo 22 — La Comisión deberá, en forma obligatoria, presentar ante el Concejo Municipal, cada tres meses calendario un informe completo de las labores realizadas; como de aquellas pendientes para resolver.

Artículo 23 — El informe de la Comisión deberán presentarse en un plazo máximo de quince días (15) después de recibido el asunto, la Comisión podrá solicitar al Concejo Municipal las prórrogas que considere necesarios cuando sea bien justificada.

Artículo 24 — Los informes deberán presentarse por escrito y firmados por todos los miembros de la Comisión que lo redacten.

Artículo 25 — Una vez conocido el informe en el Concejo Municipal, aquellas recomendaciones que involucren la toma de una decisión por parte de éste, serán sometidas a votación por parte del señor(a) Presidente(a) Municipal.
