Amendment to the Institutional Environmental Management Commission of the Ministry of Public SecurityReforma a la Comisión Institucional de Gestión Ambiental del Ministerio de Seguridad Pública

in the entirety of the text - Complete Text of Norm 382 Reform Creation of the institutional commission for the development of environmental management programs of the Ministry of Public Security Complete Text of record: 10BFB4 Nº 382-2012 MSP (This norm was repealed by Article 12 of Agreement N° 24 of March 2, 2016, "Creation of the Institutional Commission for the Development of Environmental Management Programs of the Ministry of Public Security") THE MINISTER OF PUBLIC SECURITY Based on the powers conferred by subsections 28, paragraph 2), subparagraph a) of the General Law of Public Administration.
I.-That Article 28, paragraph 2), subparagraph a) of the General Law of Public Administration, establishes that the Minister is the highest hierarchical body of the respective Ministry, and is exclusively responsible for directing and coordinating all services of the Ministry.
II.-That through Agreement Nº 007-2012-MSP, published in La Gaceta Nº 55 of March 16, 2012, the Creation of the Institutional Commission for the development of Environmental Management Programs of the Ministry of Public Security was ordered.
III.-That Law N° 8839 Comprehensive Waste Management published in La Gaceta N° 135 of July 13, 2010, establishes powers for the Administration to acquire environmentally friendly goods and services, including percentages in the qualification methodologies to assess compliance with these characteristics, also referring to the offices responsible for preparing bidding documents or direct purchase documents, to establish environmental criteria and product life-cycle criteria to evaluate tenders, in accordance with the criteria established in the Regulation of the cited Law.
IV.-That the Ministry of Finance through the General Directorate of Goods Administration and Administrative Procurement adopted the Capacity Building Program for Sustainable Public Procurement, promoted by the United Nations Environment Programme of which our country is a pilot plan, and is coordinated by the Environmental Quality Management Directorate of MINAET as one of the most relevant topics in the Strategic Plan for the Modernization of Public Procurement.
V.-That in order to comply with the preceding recitals, it is necessary to include the Institutional Procurement Directorate in the Institutional Commission for the development of Environmental Management Programs of the Ministry of Public Security. Therefore, IT IS AGREED:

I.-Que el artículo 28 inciso 2) aparte a) de la Ley General de la Administración Pública, establece que el Ministro es el órgano jerárquico superior del respectivo Ministerio, y le corresponde de manera exclusiva, dirigir y coordinar todos los servicios del Ministerio.
II.-Que mediante Acuerdo Nº 007-2012-MSP, publicado en La Gaceta Nº 55 del 16 de marzo del 2012, se dispuso la Creación de la Comisión Institucional para la elaboración de Programas de Gestión Ambiental del Ministerio de Seguridad Pública.
III.-Que la Ley N° 8839 Gestión Integral de Residuos publicada en La Gaceta N° 135 del 13 de julio del 2010, establece potestades a la Administración para adquirir bienes y servicios amigables con el ambiente, incluyendo porcentajes en las metodologías de calificación para valorar el cumplimiento de estas características, refiriéndose además a las dependencias a las que les compete elaborar los carteles de licitación o de compra directa, establecer criterios ambientales y de ciclo de vida de los productos para evaluar las licitaciones, de conformidad con los criterios establecidos en el Reglamento de la Ley de cita.
IV.-Que el Ministerio de Hacienda a través de la Dirección General de Administración de Bienes y Contratación Administrativa adoptó el Programa de Fortalecimiento de Capacidades para las compras Públicas Sustentables, promovido por el Programa de las Naciones Unidas sobre el Medioambiente del cual nuestro país es plan piloto, y es coordinado por la Dirección de Gestión de la Calidad Ambiental del MINAET como uno de los temas de mayor relevancia en el Plan Estratégico de Modernización de las Compras Públicas.
V.-Que con el fin de cumplir con los anteriores considerandos se hace necesario incluir a la Dirección de la Proveeduría Institucional en la Comisión Institucional para la elaboración de Programas de Gestión Ambiental del Ministerio de Seguridad Pública. Por tanto, ACUERDA:
