throughout the entire text - Full Text of Regulation 169 Creation of the Isla Caballo Responsible Fishing Marine Area and its Management Plan Full Text of Act: E7CF0 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA A.J.D.I.P/169-2012.-Puntarenas, on the thirteenth day of the month of April, 2012.

I.-Mr. Antonio Porras Porras, by means of official communication DGT-A-026-2012 of March 19, 2012, submits a Proposal for a Fisheries Management Plan for the establishment of the Isla Caballo Responsible Fishing Marine Area, Puntarenas.

II.-According to Article 50 of the Political Constitution, it is the obligation of the State to procure the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most adequate distribution of wealth. Likewise, it incorporates the right of every person to a healthy and ecologically balanced environment.

III.-It is incumbent upon INCOPESCA, as the Governing Institution of the fisheries and aquaculture sector of our country, to establish management measures for the sustainable use of hydrobiological resources, which allow for the protection of reproduction, recruitment, and feeding areas, that favor the increase of species and the growth of their biomass, in such a way as to guarantee their sustainability for the benefit of the ecosystems and the fishers.

IV.-In accordance with the Code of Conduct for Responsible Fisheries, Executive Decree No. 27919-MAG recognizes in its Article 6, the important contribution of artisanal, small-scale fishing to the generation of employment, income, and food security. Hence the need for the State to appropriately guarantee the right of male and female fishers, by adopting regulatory measures that favor the use of fishery resources in the waters of national jurisdiction.

V.-Since 1995, the board of directors of INCOPESCA issued an agreement where they embraced the project of the community of Palito de Chira, supported by scientific foundations from academics of different institutions to reserve a marine reef area where high levels of fish reproduction occur, prohibiting all types of fishing gear (arte de pesca) except handline fishing.

VI.-Isla Caballo has a territorial extension of 3.7 square kilometers, and is located in the Golfo de Nicoya. Inhabited by local residents who have occupied the public zone. 80% (concessionable zone) was sold by the locals to Mr. James Zeller. The ICT developed a partial regulatory plan; it promotes hotel development on 42% of the island. Isla Caballo is located in the Golfo de Nicoya, covers approximately 150 hectares, and is inhabited by some 30 families made up of more than 200 people, of whom many live in simple houses. It is reached by boat, which takes approximately 30 minutes from Puntarenas.

VII.-The I. Caballo fishing area is located in zone 202 of the Golfo de Nicoya, and this is the first proposal for a Responsible Fishing Marine Area (Área Marina de Pesca Responsable, AMPR) in that zone, which is precisely the intermediate part of that Gulf. The AMPRs created to date are in zone 203 (Tárcoles) and in 201 (Palito-Montero), in addition to the existence of several more proposals such as Níspero and I. Venado). To understand the commercial classes and the species that are caught in that fishing area, 132 biological samplings carried out in 2006 by the Research and Development Department were analyzed, for a total of 676 kilograms of sampled fishery products, which was the most accessible biological information available. The most important commercial class caught at I. Caballo was the first small (tabla 1), which comprises 67.9% of them, but other classes were also fished, such as first large, class, scrap (chatarra), and others. The first small and the first large are the commercial classes that comprise the species of greatest commercial interest, such as croakers (corvinas) and snooks (róbalos).

VIII.-With the establishment of this Marine Area, the following are intended among its purposes and objectives; to determine and develop:

- Support artisanal fishers so that their activity is sustainable, economically relevant, and contributes to food security.

- Establish and regulate the fishing gear and methods (artes y métodos de pesca) to be used in the area.

- Protect and sustainably use the marine resources of the area.

- Consolidate the contribution to the conservation of marine biodiversity made by the artisanal fishers who belong to the association of Fishers of the island.

- Develop a Control and surveillance Program jointly with the government institutions related to the functioning of the management of the Responsible Fishing Marine Area.

- Ensure that the fishery product caught in the Isla Caballo Responsible Fishing Marine Area has a differentiated price and market, based on its better quality and that it is a sustainable product.

- Seek additional financial and technical support for the different needs required for the adequate management of the responsible fishing marine area.

- Develop and implement sustainable productive projects.

IX.-Whereas for the Board of Directors it is of vital importance the strengthening and implementation of this type of fisheries governance models, the board of directors. Therefore, AGREES:

1º-To approve the Creation of the Isla Caballo Responsible Fishing Marine Area and its Management Plan (Plan de Ordenación), in accordance with the description presented by Mr. Antonio Porras Porras, by means of official communication DGT-A-026-2012, in which the terms and conditions, geographic coordinates are detailed, as well as the technical proposal for management measures and zoning of the Isla Caballo Responsible Fishing Marine Area, which is composed of seven thematic axes.

Total Area: 1.48 square kilometers, equivalent to 148 hectares, calculated with the Gepath program (Berny Marín) The participatory zoning is accompanied by 8 Programs that will be reflected in the following thematic axes:

AXIS 1: Evaluation and monitoring of fishery resources of the Area: Biology and fisheries management.

AXIS 2: Identification of permitted fishing gear and methods: Biology and fisheries management.

AXIS 3: Community outreach and knowledge building: training and extension:

AXIS 4: Strengthening of Local Organizational Structures: training and extension AXIS 5: Generation of productive alternatives.

AXIS 6: Establishment and implementation of marketing strategies for fishery products.

AXIS 7: Application and compliance with the current fisheries regulations. Surveillance and Control.

Considering:

I.-Presenta el licenciado Antonio Porras Porras, mediante oficio DGT-A-026-2012 del 19 de marzo de 2012, Propuesta de Plan de Ordenamiento Pesquero para el establecimiento del Área Marina de Pesca Responsable de Isla Caballo, Puntarenas.

II.-Según el artículo 50 de la Constitución Política dispone que es obligación del Estado procurar el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Asimismo, incorpora el derecho de toda persona a un ambiente sano y ecológicamente equilibrado.

III.-Que corresponde al INCOPESCA como Institución Rectora del sector pesquero y acuícola de nuestro país, establecer medidas de ordenamiento para el aprovechamiento sostenible de los recursos hidrobiológicos, que permitan proteger áreas de reproducción, reclutamiento y de alimentación, que favorezcan el incremento de las especies y el aumento de su biomasa, de manera que se garantice su sostenibilidad en provecho de los ecosistemas y de los pescadores.

IV.-Que de acuerdo al Código de Conducta para la Pesca Responsable, Decreto Ejecutivo Nº 27919-MAG reconoce en su Artículo 6, la importante contribución de la pesca artesanal en pequeña escala a la generación de empleo, ingresos y seguridad alimentaria. De ahí la necesidad de que el Estado garantice apropiadamente el derecho de los pescadores y pescadoras, adoptando medidas de regulación que favorezcan el aprovechamiento de los recursos pesqueros en las aguas de jurisdicción nacional.

V.-Que desde el año 1995, la junta directiva del INCOPESCA emitió un acuerdo donde acogieron el proyecto de la comunidad de Palito de Chira, apoyados en fundamentos científicos de académicos de diferentes instituciones para reservar un área marina de arrecifes y donde se dan altos niveles de reproducción de peces prohibiéndose todo tipo de arte de pesca salvo la pesca con cuerda de mano.

VI.-Que la Isla Caballo tiene una extensión territorial de 3.7 kilómetros cuadrados, se encuentra localizada en el Golfo de Nicoya. Habitada por pobladores locales quienes han ocupado la zona pública. El 80% (zona concesionable) fue vendida por los lugareños al señor James Zeller. El ICT elaboró un plan regulador parcial, éste promueve el desarrollo hotelero en el 42% de la isla. Isla Caballo se encuentra ubicada en el Golfo de Nicoya, abarca aproximadamente 150 hectáreas y habitan en ella unas 30 familias integradas por más de 200 personas, de las cuales muchas viven en casas sencillas. Se llega por medio de botes que tardan aproximadamente 30 minutos desde Puntarenas.

VII.-Que el área de pesca I. Caballo está ubicada en la zona 202 del Golfo de Nicoya y esta es la primera propuesta de Área Marina de Pesca Responsable que se tiene en esa zona, que es precisamente la parte intermedia de ese Golfo. Las AMPR creadas hasta el momento están en la zona 203 (Tárcoles) y en la 201 (Palito-Montero, además de que existen varias propuestas más como Níspero e I. Venado). Para conocer las clases comerciales y las especies que se capturan en esa área de pesca, se analizaron 132 muestreos biológicos realizados en el año 2006 por el Dpto. de Investigación y Desarrollo, para un total de 676 kilogramos de productos pesqueros muestreados, la cual fue la información biológica más accesible que se tuvo. La clase comercial más importante capturada en I. Caballo fue la primera pequeña (tabla 1), la cual comprende 67.9% de las mismas, pero también se pescaron otras clases como la Primera grande, clase, chatarra y otros. La primera pequeña y la primera grande son las clases comerciales que comprenden las especies de mayor interés comercial como las corvinas y róbalos.

VIII.-Que con el establecimiento de ésta Área Marina, se pretende dentro de los fines y objetivos; determinar y desarrollar:

- Apoyar a los pescadores artesanales para que su actividad sea sostenible, económicamente relevante y que contribuya a la seguridad alimentaria.

- Establecer y regular las artes y métodos de pesca a utilizar en el área.

- Proteger y aprovechar de una manera sostenible los recursos marinos del área.

- Consolidar el aporte a la conservación de la biodiversidad marina que realizan los pescadores artesanales que pertenecen a la asociación de Pescadores de la isla.

- Desarrollar un Programa de control y vigilancia en conjunto con las instituciones gubernamentales que tenga que ver con el funcionamiento del manejo del Área Marina de Pesca Responsable.

- Procurar que el producto pesquero capturado en el Área Marina de Pesca Responsable de Isla Caballo tenga un precio y mercado diferenciado, con base en su mejor calidad y que es un producto sostenible.

- Gestionar apoyo adicional financiero y técnico para las diferentes necesidades que se requiera en el manejo adecuado del área marina de pesca responsable.

- Elaborar y desarrollar proyectos productivos sostenibles.

IX.-Que siendo para la Junta Directiva de vital importancia el fortalecimiento e implementación de éste tipo de modelos de gobernanza pesquera, la junta directiva. Por tanto, ACUERDA:

1º-Aprobar la Creación del Área Marina de Pesca Responsable de Isla Caballo y su Plan de Ordenación, de conformidad con la descripción presentada por el licenciado Antonio Porras Porras, mediante oficio DGT-A-026-2012, en el cual se detallan los términos y condiciones, coordenadas geográficas, así como la propuesta técnica de medidas de manejo y zonificación Área Marina de Pesca Responsable de Isla Caballo, el cual está compuesto por siete ejes temáticos.

Área Total: 1.48 kilómetros cuadrados equivalente a 148 hectáreas, calculado con el programa Gepath (Berny Marín) La zonificación participativa se hace acompañar de 8 Programas que estarán reflejados en los siguientes ejes temáticos:

EJE 1: Evaluación y monitoreo de recursos pesqueros del Área: Biología y manejo pesquero.

EJE 2: Identificación de las artes y métodos de pesca permitidas: Biología y manejo pesquero.

EJE 3: Proyección a la comunidad y construcción del conocimiento: capacitación y extensión:

EJE 4: Fortalecimiento de Estructuras Locales de Organización: capacitación y extensión EJE 5: Generación de alternativas productivas.

EJE 6: Establecimiento e implementación de estrategias de comercialización para los productos pesqueros.

EJE 7: Aplicación y cumplimiento de la normativa pesquera vigente. Vigilancia y Control.
