1That the Cartagena Protocol on Biosafety, ratified and approved by Law 8537, published in La Gaceta No. 227 of November 27, 2006, has the objective of contributing to ensuring an adequate level of protection in the field of the safe transfer, handling, and use of living modified organisms resulting from modern biotechnology that may have adverse effects on the conservation and sustainable use of biological diversity, also taking into account risks to human health, and specifically focusing on transboundary movements.
2That the General Law of the Animal Health Service, No. 8495 of April 6, 2006, in its Article 5, establishes the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA) as the competent body responsible for regulating, planning, administering, coordinating, executing, and applying activities of a national, regional, and international nature, relating to animal population health, veterinary control of zoonoses, protection and safety of food of animal origin, animal feed, animal genetic material, products and by-products, and the production, use, release, or commercialization of Genetically Modified Organisms (GMOs).
3That, in addition, subsection h) of Article 6 of Law No. 8495 establishes among the competencies of SENASA to establish and execute the necessary measures regarding the production or commercialization of GMOs that are animals, their products and by-products of animal origin, biological control agents, or others that may represent any type of unacceptable risk to the environment, human health, animal health, or the surrounding biological environment.
4That to develop the competencies attributed to SENASA in relation to GMOs, it is necessary to create an internal body to oversee the matter and thereby advise the Office of the Director General (Dirección General) for the purpose of complying with the legal mandate established in the aforementioned Law No. 8495. Therefore,

THE DIRECTOR GENERAL OF THE NATIONAL ANIMAL HEALTH SERVICE OF THE MINISTRY OF AGRICULTURE AND LIVESTOCK Issues the following Directive:

Considering:

a)Two officials representing the Office of the Director General.
b)Three officials representing the National Laboratory of Veterinary Services (Laboratorio Nacional de Servicios Veterinarios, LANASEVE).
c)One representative of the National Aquatic Health Program.
d)One representative of the Animal Quarantine Directorate.

The Office of the Director General shall appoint the Coordinator of the Internal Biosafety Commission (Comisión Interna de Bioseguridad, CIBio).

1Que el Protocolo de Cartagena sobre Seguridad de la Biotecnología, ratificado y aprobado mediante la Ley N° 8537, publicada en La Gaceta N° 227 del 27 de noviembre del 2006, tiene como objetivo contribuir a garantizar un nivel adecuado de protección en la esfera de la transferencia, manipulación y utilización seguras de los organismos vivos modificados resultantes de la biotecnología moderna que puedan tener efectos adversos para la conservación y la utilización sostenible de la diversidad biológica, teniendo también en cuenta los riesgos para la salud humana, y centrándose concretamente en los movimientos transfronterizos.
2Que la Ley General del Servicio de Salud Animal, N° 8495 de 6 de abril 2006, en su artículo 5 establece al Servicio Nacional de Salud Animal (SENASA) como el órgano competente encargado de reglamentar, planificar, administrar, coordinar, ejecutar y aplicar actividades de carácter nacional, regional e internacional, relativas a la salud de la población animal, control veterinario de zoonosis, la protección y la seguridad de los alimentos de origen animal, los alimentos para los animales, el material genético animal, los productos y subproductos, la producción, el uso, la liberación o la comercialización de los Organismos Genéticamente Modificados (OGM).
3Que además el inciso h) del artículo 6 de la Ley N° 8495, establece entre las competencias del SENASA establecer y ejecutar las medidas necesarias sobre la producción o la comercialización de OGM que sean animales, sus productos y subproductos de origen animal, los agentes de control biológico u otros que puedan representar cualquier tipo de riesgo no aceptable en el ambiente, la salud humana, animal o biológica del entorno.
4Que para desarrollar las competencias que se le atribuyen al SENASA con relación a los OGM, se requiere crear un órgano interno que vele por el tema y con ello oriente a la Dirección General a los efectos de dar cumplimiento al mandato legal establecido en la Ley N° 8495 antes citada. Por tanto,

EL DIRECTOR GENERAL DEL SERVICIO NACIONAL DE SALUD ANIMAL DEL MINISTERIO DE AGRICULTURA Y GANADERIA Emite la siguiente Directriz:

Considerando:

a)Dos funcionarios (as) en representación de la Dirección General.
b)Tres funcionarios (as) en representación del Laboratorio Nacional de Servicios Veterinarios (LANASEVE).
c)Un (a) representante del Programa Nacional de Salud Acuícola.
d)Un (a) representante de la Dirección de Cuarentena Animal.

La Dirección General nombrará al Coordinador(a) de la Comisión Interna de Bioseguridad (CIBio).
