Considering:
Hubert Araya Umaña presents a proposal for a Fisheries Management Plan for the establishment of the Responsible Fishing Marine Area of Puerto Níspero, at the mouth of the Tempisque River, which is supported by official communication DDI/0028-2012 of March 26, 2012.
- Determining and regulating the fishing gear and methods to be used in the area.
- Conserving and sustainably using the marine resources of the area.
- Contributing to the conservation of marine biodiversity carried out by the artisanal fishers belonging to the Association.
- Exercising control and surveillance jointly with the governmental institutions involved in the operation and management of the Marine Area for Responsible Fishing.
- Certifying the product caught under the AMRP modality as a product of higher quality than that caught with other fishing gear.
- Securing additional financial and technical support for the various needs required for the proper management of the Responsible Fishing Marine Area.
- Developing prototype projects related to mariculture.
- Developing tourism projects in harmony with nature.
Hubert Araya states that within the proposal for the establishment of the Responsible Fishing Marine Area of Puerto Níspero, other expected outcomes are:
- That the Responsible Fishing Marine Area to be established be evaluated and supported as a model for the management and regulation of the use of marine-coastal resources, supporting their conservation and long-term sustainable use.
- Supporting the strengthening of an Information System (database), development of technological capacity, training, and control, for the proper monitoring of this initiative and its responsible fishing code.
- Supporting the collection, processing, and commercialization of fishery products, improving handling, safety, value added, and income generation.
AGREES:
1- To approve the establishment and the Creation of the Responsible Fishing Marine Area of Puerto Níspero and the Fisheries Management Plan for the establishment of this Marine Area in accordance with the eight thematic axes, as well as the conditions indicated in official communication DDI/0028-2012, dated March 26, sent by Lic. Hubert Araya Umaña, Head of the Development and Research Department.
2- The total area encompassed by this Marine Area for Responsible Fishing (AMPR) corresponds to 2.6 km², running from Vuelta de Los Perros toward La Tigra, from the Puerto Níspero landing site toward the southern tip of Isla del Toro, and from this same point toward Punta Panamá (Figure 1); the geographical points are detailed in Table No. 3. This area borders exactly on the established boundaries of the Cipancí Wildlife Refuge.

On the other hand, the Association considers that the areas within the Cipancí Wildlife Refuge, located around Isla Toro in the northern part (0.4 km²) and at Vuelta El Flor (0.18 km²), are important zones for the reproduction and breeding of commercial species (Figure 1). For this reason, the Association commits from now on to care for and protect the area defined in Figure 1, since fishing is currently carried out with gear not permitted within the refuge, particularly within those zones, as well as at Isla Verde, El Reventado, La Necesidad, and El Venado.

In this zone, fishing takes place along the rocky margins, a detail observed in Figure 2, but not in the center of the area; however, it has been proposed to include the center to protect the species that move from one area to another and thus reduce habitat fragmentation.
Commercial fishing is intended, it is agreed, as the only permitted fishing gear, although small-scale aquaculture activities are proposed in the medium term. On the other hand, as the area is a transit zone, there will be free passage for fishers from other areas.

Considerando:
Hubert Araya Umaña, propuesta de Plan de Ordenamiento Pesquero para el establecimiento del Área Marina de Pesca Responsable de Puerto Níspero, en la desembocadura del río Tempisque, misma que se sustenta en el oficio DDI/0028-2012 del 26 de marzo del 2012.
- Determinar y regular las artes y métodos de pesca a utilizar en el área.
- Conservar y aprovechar de una manera sostenible los recursos marinos del área.
- Aportar a la conservación de la biodiversidad marina que realizaran los pescadores artesanales que pertenecen a la Asociación.
- Ejercer un control y vigilancia en conjunto con las instituciones gubernamentales que tenga que ver con el funcionamiento del manejo del Área Marina para la Pesca Responsable.
- Certificar el producto capturado bajo la modalidad de AMPR como un producto de mejor calidad que el capturado con otras artes de pesca.
- Gestionar apoyo adicional financiero y técnico para las diferentes necesidades que se requiera en el manejo adecuado del Área Marina de Pesca Responsable.
- Desarrollar proyectos prototipos relacionados con la maricultura.
- Desarrollo de proyectos turísticos en armonía con la naturaleza.
Hubert Araya que dentro de la propuesta de establecimiento de Área Marina de Pesca Responsable de Puerto Níspero, otros productos esperados son:
- Que el Área Marina de Pesca Responsable a establecer, sea evaluada y apoyada como un modelo de gestión y regulación del aprovechamiento de los recursos marino-costeros, que apoye su conservación y utilización de manera sostenible a largo plazo.
- Apoyar el fortalecimiento de un Sistema de Información (base de datos), desarrollo de capacidad tecnológica, capacitaciones y control, para el adecuado seguimiento a esta iniciativa y a su código de pesca responsable.
- Apoyar el acopio, proceso y comercialización de productos pesqueros, que mejore la manipulación, inocuidad, valor agregado y generación de ingresos.
ACUERDA:

Por otro lado, la Asociación considera, que las áreas que se encuentran dentro del Refugio de Vida Silvestre Cipancí, que están alrededor de la Isla Toro en la parte norte (0.4 Km2) y en la Vuelta El Flor (0.18 Km2), son zonas importantes para la reproducción y cría de especies comerciales (Figura 1). Por este motivo la Asociación se compromete desde ya a cuidar y proteger el área definida en la figura 1, ya que en la actualidad se da la pesca con artes no permitidos dentro del refugio, en partículas dentro de esas zonas, así como en Isla Verde, El Reventado, La Necesidad y El Venado.

En esta zona la pesca se realiza en los márgenes rocosos, detalle que se observa en la figura 2, no así en el centro del área, sin embargo se ha propuesto incluir el centro para proteger las especies que se mueven de un área a otra y así reducir la fragmentación del hábitat.
