THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In use of the powers conferred in Articles 140, subsections 3) and 18), 50 and 146 of the Political Constitution; the Organic Environmental Law No. 7554, of October 4, 1995; the General Public Administration Law No. 6227 of May 2, 1978; the United Nations Framework Convention on Climate Change of May 9, 1992, Approval Law No. 7414 of June 13, 1994; the Kyoto Protocol to the United Nations Framework Convention on Climate Change, Approval Law No. 8219 of March 8, 2002 and Executive Decree No. 35669-MINAET of December 4, 2009, Organic Regulation of the Ministry of Environment, Energy and Telecommunications.
Considering:
56 of August 1, 2007, in force to date, requests all public institutions, and urges local governments and autonomous institutions, to develop and implement a short, medium and long-term Action Plan with clear goals that contemplates the five axes of the National Climate Change Strategy (Estrategia Nacional de Cambio Climático), assigning the Ministry of Environment, Energy and Telecommunications the role of coordinating and monitoring entity for all efforts.

The verification of GHG emissions inventories must be carried out by verification bodies accredited by the Costa Rican Accreditation Body (Ente Costarricense de Acreditación, ECA). The level of assurance in the inventory verification processes must be reasonable, with a materiality threshold of 5%.
The only standard recognized by the Government of Costa Rica to demonstrate carbon neutrality is INTE 12-01-06 "Management system to demonstrate carbon neutrality". Organizations will be recognized as carbon neutral with the certification of a management system according to this standard, and with the verification of carbon neutrality. MINAET is responsible for granting the C- Neutral mark, which is registered with the Industrial Property Registry of the National Registry. Therefore, as part of the considerations for granting the C-Neutral mark for a productive process, are:
The validity period of the C-Neutral mark is directly related to the validity period of the Carbon Neutrality Verification under the national standard INTE 12-01-06. So it will be updated each time the organization proves continuity in the verification of its carbon neutrality. Para la participación en el Programa País en el nivel de carbono neutralidad, la organización deberá cumplir con:
Los inventarios de emisiones de GEI que serán realizados por las organizaciones participantes dentro del Programa País, deberán cumplir para su elaboración con lo indicado en los siguientes estándares, en orden de prioridad:
Los gases de efecto invernadero que deberán ser reportados son los siguientes, según aplique:
La verificación de los inventarios de emisiones de GEI deberán ser realizados por organismos verificadores acreditados por el Ente Costarricense de Acreditación (ECA). El nivel de aseguramiento en los procesos de verificación de inventarios debe ser razonable, con un umbral de significancia de un 5%.
La única norma reconocida por el Gobierno de Costa Rica para demostrar carbono neutralidad es la INTE 12-01-06 "Sistema de gestión para demostrar la carbono neutralidad". Las organizaciones serán reconocidas como carbono neutrales con la certificación de un sistema de gestión según ésta norma, y con la verificación de carbono neutralidad. Además deberán cumplir con la realización de las auditorias para mantenimiento de la certificación una vez al año.

El MINAET es el encargado de otorgar la marca C- Neutral, la cual se encuentra registrada ante el Registro de la Propiedad Industrial del Registro Nacional. Por lo tanto, como parte de las consideraciones para otorgar la marca C-Neutral para proceso productivo, se encuentran:
El período de vigencia de la marca C-Neutral está directamente relacionado con el período de vigencia de la Verificación de Carbono Neutralidad bajo la norma nacional INTE 12-01-06. De modo que se actualizará cada vez que la organización compruebe continuidad en la verificación de su carbono neutralidad. Las organizaciones con la marca C-Neutral vigente, serán publicadas en la página web oficial del MINAET.
Toda organización que haga uso de la Marca C-Neutral otorgada por el MINAET debe cumplir con la utilización restringida a proceso productivo/organización carbono neutral.
