Use permits (permisos de uso) will be granted directly to applicants, who must process the matter personally or through an authorized representative and express their interest to the Municipality in obtaining said permit, for which they must submit the application in clear writing on the use permit application form that the Maritime Terrestrial Zone Department of the Municipality, or the Services Platform, will provide, where they will indicate the purposes they have for the plot they are requesting. Said forms must bear a strict sequential number, and if necessary due to deterioration, or because they were incorrectly completed by the applicant, they must be voided and kept in the department's files in strict order.
The completed form and the respective documentation must be submitted to the Maritime Terrestrial Zone Department. When submitting the application, the applicant will identify themselves by presenting their identity card if doing so in person. If they cannot appear in person or if it involves a legal entity, the signature of the applicant or of the legal representative appearing on the application must be authenticated by a lawyer.
For the processing of the application for the use permit (permiso de uso), as well as during its validity if it is approved, the applicant will be obligated to keep an updated place for receiving notifications, whether a designated fax number or an email, and when other places are involved, applying subsidiarily for such purposes, as provided in the Law on Notifications and Other Judicial Citations.
The applicant must provide the following documents:
- a)Original and photocopy of the physical identity card or legal certification (Personería jurídica) issued no more than one month prior.
- b)Original and photocopy of a cadastral plan of the requested area or a sketch prepared by a professional in the field, of the area for which the use permit is requested.
- c)Certification of the legal status (personería jurídica), of the Share Capital (Capital Accionario), and its distribution, in the case of entities.
- d)Inspection request and duly carried out inspection.
- e)Sworn statement (Declaración jurada) indicating that the applicant is not subject to any prohibition based on Article 4 of this Regulation.
- f)Request for verification of Natural Heritage of the State (Patrimonio Natural del Estado).
- g)Specific appraisal carried out by Direct Taxation.
Once the documentation is complete, the Maritime Terrestrial Zone Department will form the respective file (expediente), duly foliated and numbered, and will attach the respective technical and legal report on the use permit application. Said Department will refer it to the Environment - Maritime Terrestrial Zone Commission, for its analysis and recommendation, which will have a period of two calendar months to render a discretionary criterion on the opportunity and convenience of granting or rejecting the permit, a period that may be extended for an equal period by prior considered resolution. This Environment - Maritime Terrestrial Zone Commission will refer the file with its commission opinion to the full Council so that it may definitively decide whether to approve or disapprove the granting of the use permit.
Once approved by the Municipal Council and the Mayor's Office notified thereof, the latter must proceed to the preparation of the administrative resolution and the signing of the respective agreement, and subsequently communicate what was agreed to the applicant, by the designated fax or to the indicated place. The proof of notification will be attached to the formed file, which will be kept in the Maritime Terrestrial Zone Department, so that it is responsible for its custody together with the administrative file.
Any breach or non-observance of the provisions of this procedure or The Law, when the seriousness of the matter so warrants, will be coordinated by the Maritime Terrestrial Zone Department for the performance of the necessary inspections to verify said breach or non-observance of the provisions of this regulation or The Law.
