within the entirety of the text - Complete Text of Regulation 07 Establishes the delimitation of the Public Zone in the Canton of Carrillo Complete Text of record: E50D7 NATIONAL GEOGRAPHIC INSTITUTE NOTICE N9 2012-07 MARITIME TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE CANTON OF CARRILLO Based on the powers conferred by Article 140 and Article 240 subsection 1 of Law No. 6227 General Law of Public Administration, and the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, and Law No. 8154 establishing the Cadastre and Registry Regularization Program.

1. 1That by means of Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry and that the Administrative Board of the National Registry will administer the Institute’s budget, and will sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute will be the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or works and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature that are related to said works, with the purpose of supporting the processes of planning.
2. 2That the Law Creating the National Geographic Institute, No. 59, constitutes it permanently and in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order that originate from the works entrusted to its charge.
3. 3That the Loan Agreement No. 1284/OC-CR “Cadastre and Registry Regularization Program,” signed with the Inter-American Development Bank, under the mixed Financing modality, between the cited Bank and the State of the Republic of Costa Rica, whose Executing Unit is a decentralized body of the Ministry of Finance, has as its objective: to form the cadastre of the totality of the existing properties in the country, duly georeferenced, and to make this information compatible with the Real Property Registry.
4. 4That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, and Article 62 of the Regulation to Law No. 6043, the competence of the National Geographic Institute is recognized for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation indicates that “The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.”
5. 5That in the Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone,” it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to the two execution methodologies indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through digital georeferenced delimitation, this with the purpose of streamlining delimitations and providing greater technical certainty to interested parties.
6. 6That in the Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: “The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05, will constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed within the National Territory by any public dependency, person, or national or foreign private entity must be referenced...”; while Article 7 indicates that “As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute will publish by adequate means that information which has been officialized...”
7. 7That the Ministry of Public Works and Transport and the Cadastre and Registry Regularization Program (Law No. 8154, published in “La Gaceta,” number 237 of December 10, 2001, Loan Agreement No 1284/OC-CR), signed an Agreement effective December 18, 2009, whose main objective was to formalize the support provided by the Executing Unit (UE) of the Cadastre and Registry Regularization Program (PRCR) to the National Geographic Institute to determine and georeference to the national coordinate system the position of: a) the ordinary high-tide line (línea de pleamar ordinaria) and consequently the line delimiting the public zone of the Maritime Terrestrial Zone (ZMT), and b) the boundary markers (mojones) demarcating the public zone of the ZMT on the Pacific coast of our country.
8. 8That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of elaborating regulatory plans, approving surveying plans, granting concessions in the Restricted Zone, and other aspects of coastal land-use planning.
9. 9That the georeferenced digital information on delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
10. 10That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841 -P “Regulation to Law No. 6043 on the Maritime Terrestrial Zone,” b) Executive Decree No. 33797-MJ-MOPT declaring as official the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, and c) Executive Decree No. 36642-MP-MOPT-MINAET “Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone.”
11. 11That Article 140 of Law No. 6227 General Law of Public Administration indicates that “the administrative act will produce its effect after being communicated to the administered party, except if it grants only rights, in which case it will produce it from when it is adopted,” a provision that must necessarily be related to subsection 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: “General acts will be communicated by publication and specific ones, by notification.”

COMMUNICATES:

First.-The National Geographic Institute used, in canton 05 Carrillo - province of Guanacaste, the ‘Digital Georeferenced Delimitation’ methodology to delimit the public zone of the Maritime Terrestrial Zone in specific coastal sectors, where, as of the date of signing of this Notice, there exists no delimitation of the public zone through the placement of boundary markers (mojones) officialized via the respective publication in the Official Gazette La Gaceta.

Second.- The public zone of the Maritime Terrestrial Zone of canton 05 Carrillo - province of Guanacaste, determined by the National Geographic Institute with digital georeferenced delimitation, was carried out in 2010 and corresponds to the coastal sectors whose extreme point coordinates are indicated below, both in the official cartographic projection system of Costa Rica CRTM05, as well as by reference, in the Lambert projection of the MBCR-1/50,000 Map Sheets: Punta Gorda and Carrillo Norte, namely:

Third.-The coastal sectors of canton 05 Carrillo - province of Guanacaste, which as of the date of signing of this Notice have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official demarcation status.

Fourth.-The official technical data of the digital georeferenced delimitation of the public zone of the Maritime Terrestrial Zone, corresponding to canton 05 Carrillo - province of Guanacaste, have been recorded in the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in a file with shape vector format, under the code: RN/IGN GDG-IGN-ZMT 505/Geolinea Version 01 11/05/2012.

en la totalidad del texto - Usted está en la última versión de la norma - Texto Completo Norma 07 Establece la delimitación de Zona Pública en el Cantón de Carrillo Texto Completo acta: E50D7 INSTITUTO GEOGRÁFICO NACIONAL AVISO N9 2012-07 ZONA MARÍTIMA TERRESTRE DELIMITACIÓN DE ZONA PUBLICA CANTÓN DE CARRILLO Con fundamento en las facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley No. 6227 General de la Administración Pública, y en lo dispuesto en la Ley No. 59 de creación del Instituto Geográfico Nacional, la Ley No. 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la Ley No. 6043 sobre la Zona Marítimo Terrestre, y la Ley No.8154 del Programa de Regularización del Catastro y Registro.

1. 1Que mediante Ley No. 8905, se establece el Instituto Geográfico Nacional, como una dependencia del Registro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto del Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de ía República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley de Creación del Instituto Geográfico Nacional, No. 59, lo constituye de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que el Convenio de Préstamo No. 1284/OC-CR "Programa de Regularización de Catastro y Registro", suscrito con el Banco Interamericano de Desarrollo, bajo la modalidad de Financiamiento mixto, entre el citado Banco y El Estado de la República de Costa Rica, cuya Unidad Ejecutora es un órgano desconcentrado del Ministerio de Hacienda, tiene como objetivo: formar el catastro de la totalidad de los predios existentes en el país, debidamente georreferenciados, y compatibilizar esta información con el Registro de la Propiedad Inmueble.
4. 4Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), No. 59, y el artículo 62 del Reglamento a la Ley No. 6043, se reconoce la competencia del Instituto Geográfico Nacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en ei Diario Oficial, de cada porción de la zona marttimo-terrestre en que haya demarcado la zona pública".
5. 5Que en el Decreto Ejecutivo No. 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre", se establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a las dos metodologías de ejecución que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georeferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
6. 6Que en el Decreto Ejecutivo No. 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera..."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado..."
7. 7Que el Ministerio de Obras Públicas y Transportes y el Programa de Regularización del Catastro y Registro (Ley No. 8154, publicada en "La Gaceta", número 237 del 10 de diciembre de 2001, Contrato de Préstamo No 1284/OC-CR), suscribieron un Convenio con fecha de rige 18 de diciembre de 2009, cuyo objetivo principal fue formalizar el apoyo que brindó la Unidad Ejecutora (UE) del Programa de Reguiarización del Catastro y Registro (PRCR) al Instituto Geográfico Nacional para determinar y georeferenciar al sistema nacional de coordenadas la posición de: a) línea de pleamar ordinaria y consecuentemente la línea que delimita la zona pública de la Zona Marítimo Terrestre (ZMT), y b) los mojones que demarcan la zona pública de la ZMT en el litoral Pacífico de nuestro país.
8. 8Que la georeferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
9. 9Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
10. 10Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo No. 7841 -P "Reglamento a la Ley No. 6043 sobre la Zona Marítimo Terrestre", b) el Decreto Ejecutivo No. 33797-MJ-MOPT declara como oficial la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, y c) el Decreto Ejecutivo No. 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".
11. 11Que el artículo 140 de la Ley No. 6227 General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que; "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

Primero.-El Instituto Geográfico Nacional, utilizó en el cantón 05 Carrillo - provincia de Guanacaste, ía metodología de "Delimitación Digital Georreferenciada1' para delimitar la zona pública de la Zona Marítimo Terrestre en sectores costeros específicos, donde no existe a la fecha de firma del presente Aviso, delimitación de la zona pública a través de la colocación de mojones oficializados vía respectiva publicación en el Diario Oficial La Gaceta.

Segundo.- La zona pública de la Zona Marítimo Terrestre del cantón 05 Carrillo - provincia de Guanacaste, determinada por el Instituto Geográfico Nacional con delimitación digital georreferenciada, fue realizada en el 2010 y corresponde a los sectores costeros cuyas coordenadas de puntos extremos se indican a continuación, tanto en el sistema de proyección cartográfico oficial de Costa Rica CRTM05, así como por referencia, en la proyección Lambert del Mapa MBCR-1/50.000 Hojas: Punta Gorda y Carrillo Norte, a saber:

Tercero.-Los sectores costeros del cantón 05 Carrillo - provincia de Guanacaste, que cuentan a la fecha de firma del presente Aviso, con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición de demarcación oficial.

Cuarto.-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre, correspondiente al cantón de Carrillo 05 - provincia de Guanacaste, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: RN/IGN GDG-IGN-ZMT 505/Geolinea Versión 01 11/05/2012.
