in the full text - Full Text of Regulation 37126 Declares a sanitary emergency in the community of Limón 2000 due to the surfacing and poor disposal of black water Full Text record: E4922 No. 37126 - S THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF HEALTH In use of the powers conferred upon them by Articles 140, subsections 3, 18, and 146 of the Political Constitution, Article 28 of Law No. 6227 of May 2, 1978, "Ley General de Administración Pública," and Articles 1, 2, 4, 7, 264, 265, 266, 267, and subsequent and concordant articles of Law No. 5395 of October 30, 1973, "Ley General de Salud."
1. That in accordance with Article 1 of the Ley General de Salud, the health of the population is a public-interest good protected by the State.
2. That Article 2 of the Ley General de Salud grants the Ministry of Health, acting on behalf of the State, the essential function of safeguarding the health of the population.
3. That the authorities of the Ministry of Health have detected in the community of Limón 2000 three determinants that considerably affect the health of the population living in said community: a) Biological, b) Environmental, c) Social.
4. That the deficiencies detected in said community include: a) Problems of black water (aguas negras) surfacing throughout the community, b) Poor disposal of black water, causing contamination of water sources, c) The community of Limón 2000 is a social welfare project, and therefore does not have the means to undertake the necessary improvements and thus adequately dispose of the water generated by their properties.
5. That it is the competence of this Ministry to address the aforementioned situation, since it represents a risk situation for the health of the inhabitants of the community of Limón 2000, due to the proliferation of waterborne diseases such as hepatitis, diarrhea, dermatitis, and meningitis, among others.
6. That the right to health of individuals is an immediately applicable fundamental right, and its protection by the State is an unavoidable duty.
7. That the legal norms establishing the competence of the Ministry of Health in health matters enshrine implicit sovereign powers so that it may issue all legal measures necessary to confront and resolve sanitary emergency (emergencia sanitaria) situations.
8. That public authorities are obliged to apply the precautionary principle in health matters, meaning they must take the preventive measures necessary to avoid serious or irreparable harm to the health of the inhabitants.
9. That technical and administrative agility must be provided to seek solutions to the problems faced by the community of Limón 2000.
10. That the foregoing facts constitute an emergency situation in health matters.

"Ley General de Salud".
1.Que de conformidad con el artículo 1 de la Ley General de Salud, la salud de la población es un bien de interés público tutelado por el Estado.
2.Que el artículo 2 de la Ley General de Salud le otorga al Ministerio de Salud, actuando a nombre del Estado, la función esencial de velar por la salud de la población.
3. Que las autoridades del Ministerio de Salud, han detectado en la comunidad de Limón 2000, tres determinantes que afectan considerablemente la salud de la población que habita en dicha comunidad, a) Biológico, b) Ambiental, c) Social.
4. Que de las deficiencias detectadas en dicha comunidad se encuentran: a) Problemas de afloramiento de aguas negras de manera general en toda la comunidad, b) Mala disposición de aguas negras, causando la contaminación de fuentes de agua, c) La comunidad de Limón 2000 es un proyecto de bien social, por lo que no cuentan con los medios para realizar las mejoras necesarias y así disponer de manera adecuada las aguas que generan sus propiedades.
5. Que es competencia de este Ministerio, abordar la situación mencionada, ya que representa una situación de riesgo para la salud de los habitantes de la comunidad de Limón 2000, por la proliferación de enfermedades hídricas tales como hepatitis, diarreas, dermatitis y meningitis entre otras.
6. Que el derecho a la salud de las personas es un derecho fundamental de aplicación inmediata y su tutela obligada por parte del Estado, un deber ineludible.
7. Que las normas legales que establecen la competencia del Ministerio de Salud en materia de salud, consagran potestades de imperio implícitas para que aquel pueda dictar todas las medidas legales que fueren necesarias para enfrentar y resolver los estados de emergencia sanitarios.
8. Que las autoridades públicas están obligadas a aplicar el principio precautorio en materia sanitaria en el sentido de que deben tomar las medidas preventivas que fueren necesarias para evitar daños graves o irreparables a la salud de los habitantes.
9. Que se debe brindar agilidad técnica y administrativa para buscar soluciones a la problemática que tiene la comunidad de Limón 2000.
10. Que los hechos anteriores configuran una situación de emergencia en materia de salud.
