273-2011 (COMIECO-LXI) of the Council of Ministers of Economic Integration, dated December 2, 2011, and its Annex: "Central American Technical Regulation RTCA 65.03.57:10 Pesticides. Pesticides for Domestic Use and Professional Use. Labeling Requirements", which are transcribed below:

RESOLUTION No. 273-2011 (COMIECO-LXI) THE COUNCIL OF MINISTERS OF ECONOMIC INTEGRATION

That in accordance with articles 38, 39 and 55 of the Protocol to the General Treaty on Central American Economic Integration -Protocol of Guatemala-, modified by the Amendment of February 27, 2002, the Council of Ministers of Economic Integration has under its competence the matters of Central American Economic Integration and, as such, it is responsible for approving the administrative acts of the Economic Subsystem; That according to article 15 of that same regional legal instrument, the State Parties have the commitment to constitute a Customs Union among their territories, which will be achieved gradually and progressively, based on programs established for that purpose, approved by consensus; That within the framework of the process of forming the Customs Union, the State Parties have reached important agreements regarding Labeling Requirements for Pesticides for Domestic Use and Professional Use, which require the approval of the Council; That the State Parties, in their capacity as Members of the World Trade Organization (WTO), notified the Committee on Technical Barriers to Trade, in accordance with what is established in the Agreement on Technical Barriers to Trade, of the Draft Central American Technical Regulation RTCA 65.03.57:10 Pesticides. Pesticides for Domestic Use and Professional Use. Labeling Requirements; That the State Parties granted a reasonable period of time to the Member States of the WTO to make observations on the notified draft Regulation as required by numeral 4), paragraph 9 of article 2 of the Agreement on Technical Barriers to Trade, observations that were duly analyzed and addressed as pertinent; That in accordance with the Agreement on Technical Barriers to Trade, Members shall provide a reasonable period of time between the approval of technical regulations and their entry into force, in order to give time for producers to adapt their products or their production methods to what is established in the regulations; That in accordance with numeral 3 of article 55 of the Protocol of Guatemala, the opinion of the Consultative Committee on Economic Integration was obtained,

Based on the provisions of articles 1, 3, 5, 7, 15, 26, 30, 36, 37, 38, 39, 46, 52 and 55 of the Protocol to the General Treaty on Central American Economic Integration - Protocol of Guatemala -,

To approve the Central American Technical Regulation RTCA 65.03.57:10 PESTICIDES. PESTICIDES FOR DOMESTIC USE AND PROFESSIONAL USE. LABELING REQUIREMENTS, in the form that appears as an Annex to this Resolution and forms an integral part thereof.

This Resolution shall enter into force on June 2, 2012, and shall be published by the State Parties.

The officialization of this technical regulation entails ratification by the Council of Ministers of Economic Integration of Central America (COMIECO).

SCOPE OF APPLICATION Applies to the labels of pesticides for domestic use and professional use in their different formulations and presentations.

Does not apply to pesticides of botanical and microbiological origin.

SYMBOLS AND ABBREVIATIONS IUPAC: International Union of Pure and Applied Chemistry.

OMS: World Health Organization (WHO) FAO: Food and Agriculture Organization of the United Nations.

4. DEFINITIONS 4.1 Pest control company (Empresa controladora de plagas): that natural or legal entity dedicated to using pesticides subject to this regulation to prevent, control, or destroy any pest that may affect human health, in interior areas or spaces, exteriors of homes, buildings, public and private facilities, industries, businesses, public and private vehicles, large extensions in gardening and recreation, and places where people circulate, remain, or gather.

4.2 Formulation additives (Aditivos de formulación): any emulsifying substance, solvent, dispersant, propellant, components of the pesticide formulation, or their mixtures.

4.3 Primary packaging or container (Envase primario o envase): any receptacle that has direct contact with the product, with the specific mission of protecting it from deterioration, contamination, or adulteration and facilitating its handling. Also simply designated as "container".

4.4 Secondary packaging or package (Envase secundario o empaque): any receptacle that has contact with one or more primary containers, with the purpose of protecting them and facilitating their commercialization until reaching the final consumer. Secondary packaging is generally used to group one or more primary containers into a single sales unit.

4.5 Tertiary packaging or packing (Envase terciario o embalaje): any receptacle used to facilitate handling and protect the primary container and/or secondary packaging against physical damage and external agents during storage and transport; these receptacles are used during product distribution and normally do not reach the final user.

4.6 Label (Etiqueta): set of written, printed, or graphic information elements relating to a product, chosen for their relevance to the sector or sectors concerned, which are adhered to or printed on the receptacle containing the product or on its exterior packing/container, or which are affixed to them.

4.7 Supplementary label (Etiqueta complementaria): one that replaces the original label when it is written in a language other than Spanish/Castilian; or, that supplements the information not included on the original label presented in Spanish/Castilian.

4.8 Manufacturer (Fabricante): legal entity dedicated to the synthesis of technical-grade active ingredients used in the formulation of pesticides subject to this regulation.

4.9 Formulation (Formulación): process by which pesticides containing one or more active ingredients uniformly distributed in one or more additives are produced, with or without the aid of formulation conditioners.

4.10 Formulator (Formulador): natural or legal person dedicated to the formulation of pesticides subject to this regulation.

4.11 Active ingredient (Ingrediente activo): component of a formulation responsible for direct or indirect biological activity against pests and vectors. A single active ingredient may consist of one or more chemical entities that may differ in relative activity. A formulation may contain one or more active ingredients.

4.12 Trademark (Marca comercial): any denominative, figurative, three-dimensional, or mixed sign, visually perceptible, that is suitable for distinguishing the products or services of one individual or legal entity from those of others.

4.13 Trade name (Nombre comercial): denominative or mixed sign by which a company, a commercial establishment, or an entity is identified and distinguished.

4.14 Common name (Nombre común): name of the active ingredient, approved by the International Organization for Standardization (ISO).

4.15 Pest (Plaga): any type of organism that, due to its population density, damages crops, health, production assets, and the human environment.

4.16 Pesticide (Plaguicida): any substance or mixture of chemical substances intended to prevent, destroy, or control any pest, including vectors of human diseases or undesirable species of plants and animals that cause damage or otherwise interfere with the production, processing, storage, transport, or marketing of consumer goods.

4.17 Pesticide for domestic use (Plaguicida de uso doméstico): formulation containing one or more active ingredients, which through scientific studies have recognition for use in environments where people live, circulate, remain, or gather (homes, buildings, public and private facilities, industries, businesses, public and private vehicles, interior and exterior gardens). Spaces where agricultural activities or large-scale gardening are carried out are not included. These pesticides must be category IV according to the WHO toxicological classification. They must be ready-to-use formulations without any modification, as sold.

4.18 Pesticide for professional use (Plaguicida de uso profesional): formulation containing one or more active ingredients. They can only be applied by authorized and trained personnel. These pesticides must be categories II, III, or IV according to the WHO toxicological classification, and at the time of their application, the final dilution must be classified as category IV. These pesticides must have recognition for application in environments where people live, circulate, remain, or gather (homes, buildings, public and private facilities, industries, businesses, public and private vehicles, interior and exterior gardens, large extensions of gardening and recreation).

NOTE: This category includes pesticides for public health use and pesticides for use by pest control companies (empresas controladoras de plagas).

4.19 Pamphlet or instruction leaflet (Panfleto o instructivo): document containing the technical-scientific information attached to the finished product, which must contain at least the necessary data for the safe and effective use of the pesticide for domestic use and professional use it accompanies.

4.20 Central panel of the label (Panel central de la etiqueta): it is the part of the label where the trade name and common name, the type of formulation, the product's trademark, or the registered trademark, if applicable, are inscribed.

5. GENERAL CONDITIONS AND RESTRICTIONS OF LABELING 5.1 General principles of labeling for pesticides for domestic and professional use.

5.1.1 Labels placed on pesticides must be applied in such a way that they do not separate from the container or package under normal conditions of use.

5.1.2 The printing materials used must be of such quality that they resist the action of atmospheric agents and normal conditions of use, transport, and storage.

5.1.3 Language must be clear, brief, simple, and free of ideas that tend to amplify or exaggerate the real qualities or capabilities of the pesticide. Words must be commonly used, avoiding technicalities that confuse the user and using words that accurately define the idea.

5.1.4 The use of indications such as "non-toxic (no tóxico)", "not harmful (no nocivo)", or any other analogous indication is not permitted, nor the use of extensive terms such as: "etc. (etc.)", "and others (y otros)", "widely (ampliamente)", "the most diverse (los más diversos)", "certain (ciertos)", "almost all (casi todos)", "the majority (la mayoría)", or any other analogous indication.

5.1.5 The graphic representations, figures, pictograms, or necessary designs of the labeling must appear clearly visible and easily legible, avoiding the use of drawings that confuse or induce misuse of the product.

5.1.6 The texts and legends on the labeling of pesticide containers or packages intended for the Central American market must be written in Spanish. When the language in which the label is written is not Spanish, a supplementary label (etiqueta complementaria) in Spanish must be placed, containing the mandatory information included in this regulation.

5.1.7 When a supplementary label (etiqueta complementaria) is used to replace the original label or supplement it, the information contained therein must conform to what is established in this regulation, and it must be adhered to the container or package.

5.1.8 Labels written in more than one language will be accepted, provided that the information is also in Spanish/Castilian.

5.1.9 Information that, due to the size of the container or package, cannot be part of the pesticide labeling (both for domestic and professional use) must be presented in a pamphlet (panfleto) accompanying each container or package, and must include the legend, in uppercase and bold letters, stating: "READ THE PAMPHLET OR INSTRUCTION LEAFLET BEFORE USING THIS PRODUCT".

5.2 Dimensions of the label 5.2.1 Pesticides for domestic use The label dimension must adjust to the size of the container and package. The font size and pictograms must comply with what is established in points 5.3.1 to 5.3.3.

5.2.2 Pesticides for professional use For pesticides for professional use, the label size must be in accordance with the following proportions:

a. On containers or packages with a capacity up to 4 L or 5 kg, the label must cover at least 75% of its total surface, excluding the top and bottom of the container or package.

b. On containers or packages larger than 4 L or 5 kg up to 18 L or 25 kg, the label must cover at least 25% of its total surface, excluding the top and bottom of the container or package. Under no circumstances may the size be smaller than that defined for labels in subsection a.) of this article.

c. On containers or packages with a capacity greater than 18 L or 25 kg, the label size must be at least equal to the size defined in subsection b.) of this numeral.

5.3 Font size and pictograms for pesticides for domestic use and professional use.

5.3.1 Font size The warning legends required in this regulation must be in uppercase and bold, with a size of at least 2 mm, and all other texts at least 1.25 mm, 5.3.2 Printing styles 5.3.2.1 Printing on the label must be in the same direction and must never overlap, even when different colors are used.

5.3.2.2 Condensed printing must never be used.

5.3.2.3 Italic printing must only be used for scientific or Latin names.

5.3.2.4 Highlighted printing must only be used for emphasis.

5.3.3 Size of pictograms The pictograms required in this regulation must be of dimensions that allow the user to identify and understand the message. The minimum permitted size is 7 x 7 mm. For pesticides for professional use, the placement of pictograms is established in point 7.4.3.

5.4 Legends required on the label.

5.4.1 The telephone numbers of the Toxicological Information Centers of each State Party must be declared.

5.4.2 On each label for domestic and professional use, as applicable, the following warning legends must be placed:

a. For both types of pesticides: "CAUTION; READ THE LABEL AND THE PERTINENT INSTRUCTIONS BEFORE USING THIS PRODUCT".

b. In the case of pesticides for professional use, the legend must state: "CAUTION, READ THE LABEL, THE PAMPHLET, AND THE INSTRUCTIONS BEFORE USING THIS PRODUCT".

c. For both types of pesticides: "DO NOT APPLY DIRECTLY OR INDIRECTLY ON FOOD OR KITCHEN UTENSILS"; "DO NOT APPLY IN THE PRESENCE OF PERSONS AND DOMESTIC ANIMALS"; "DO NOT TRANSPORT OR STORE NEXT TO FOOD PRODUCTS AND CLOTHING"; "KEEP OUT OF REACH OF CHILDREN AND DOMESTIC ANIMALS"; "NEVER REUSE THIS CONTAINER".

d. In addition, they must include a legend indicating: "DO NOT EAT, DRINK, OR SMOKE WHEN USING THIS PRODUCT. WASH HANDS CAREFULLY WITH SOAP AND WATER AFTER HANDLING THIS PRODUCT".

5.4.3 In the case of pesticides for professional use, the corresponding pictograms must be included, in accordance with Annexes 1 and 2.

a. On both types of pesticides, the re-entry period to the area or environment that has been treated must be indicated. In addition, the pest controlled by the product must be declared using the common name and the scientific name.

b. Legend in uppercase and bold letters stating: "IN CASE OF DISCOMFORT OR INTOXICATION, TAKE THE PATIENT TO A DOCTOR AND PROVIDE THIS LABEL, PAMPHLET, OR INSTRUCTION LEAFLET".

6. LABEL FORMAT FOR PESTICIDES FOR DOMESTIC USE.

6.1 Central panel or Main section of the label.

The following requirements must appear on the central panel or main section of the label:

a. The trade name and the trademark of the product.

b. The legend "PLAGUICIDA DE USO DOMESTICO".

c. The biocidal action of the pesticide, indicating its physical form or the term that best defines its physical state.

d. The net content in International System units, and it will not require any additional phrase to identify it.

6.2 Other mandatory information on the label.

The following requirements must be distributed on the rest of the label in the order decided by the manufacturer:

a. The Common name (Nombre común) and the chemical name of the active ingredient(s) (in accordance with the chemical nomenclature recognized by IUPAC), the concentration of this and other ingredients of toxicological importance, expressed in percentage form. The quantity in grams of the active ingredient(s) contained per liter or kilogram of formulated product must be indicated.

b. Under the title "PHRASES AND WARNINGS OF USE (FRASES Y ADVERTENCIAS DE USO)", the legends established in numeral 5.4 must be included.

c. Under the title "SAFETY PRECAUTIONS (PRECAUCIONES DE SEGURIDAD)", the specific warnings for the product must be indicated (if they exist), good application practice, precautions to consider before and after application.

d. Under the title "SYMPTOMS AND SIGNS OF INTOXICATION (SINTOMAS Y SIGNOS DE INTOXICACION)", the symptoms and effects of acute intoxication in humans must be indicated, by ingestion, inhalation, dermal and ocular contact, or any other. Use common terms.

e. Under the title "FIRST AID (PRIMEROS AUXILIOS)", indicate the immediate measures to be taken in case of acute overexposure to the product:

- In case of ingestion, the manufacturer or formulator must indicate the measures to take, which will depend on the type of formulation and the active ingredient(s) it contains.

- Must bear the legend: "NEVER GIVE TO DRINK OR INDUCE VOMITING IN AN UNCONSCIOUS PERSON." - IN CASE OF CONTACT WITH SKIN, WASH USING PLENTIFUL SOAP AND WATER.

- IN CASE OF CONTACT WITH EYES, WASH WITH WATER FOR SEVERAL MINUTES. IF OCULAR IRRITATION PERSISTS, VISIT A DOCTOR. WASH HANDS AFTER HANDLING.

f. Under the title "RECOMMENDATIONS TO THE PHYSICIAN (RECOMENDACIONES AL MEDICO)", indicate the antidotes and specific treatment, as well as the measures to confirm the diagnosis, if known. If there is no antidote, indicate "HAS NO ANTIDOTE (NO TIENE ANTÍDOTO)".

g. Under the title "INSTRUCTIONS FOR USE (INSTRUCCIONES DE USO)", indicate the method of application, dosages, target pests of the product, and any other information the manufacturer or formulator deems necessary for the use of the product.

h. Under the title "PRECAUTIONS AND WARNINGS OF USE (PRECAUCIONES Y ADVERTENCIAS DE USO)", the physical and chemical risks of the pesticide must be indicated, and any other the manufacturer or formulator deems necessary.

i. If the product is an aerosol, a liquid, or a flammable or combustible solid, it must bear the flammability or combustibility pictogram established in Annex 1, and the following warnings:

- Pressurized container. Do not perforate or burn, even after use.

- Do not spray on an open flame or on incandescent material.

- Keep away from heat sources, sparks, and open flames.

- Do not smoke when using the product.

- Protect from sunlight and do not expose this product to a temperature above 50°C.

j. Under the title "MEASURES FOR ENVIRONMENTAL PROTECTION (MEDIDAS PARA PROTECCION AL AMBIENTE)", indicate the appropriate destruction of containers, protection of domestic animal species and fauna in general, and to prevent contamination of soil, air, water tables, and receiving water bodies.

The indications must comply with what is established in the legislations of each country.

k. The product label must indicate the country of formulation with the legend "FORMULATED IN (FORMULADO EN)".

l. The official registration number issued by the competent authority of the State Party. In addition, the batch number, date of formulation, and expiration date (indicating month and year) must be included; these may appear outside the label, forming part of the primary container (envase primario), and must be provided by the manufacturer or formulator.

m. The name, address, and telephone number of the manufacturer, formulator, importer, distributor, or packer.

7. LABEL FORMAT FOR PESTICIDES FOR PROFESSIONAL USE 7.1 Pesticides for professional use must contain the following requirements on the central panel or main section of the label:

a. The trade name and the trademark of the product.

b. The legend "PLAGUICIDA DE USO PROFESIONAL PARA SALUD PUBLICA" or "PLAGUICIDA DE USO PROFESIONAL PARA EMPRESAS CONTROLADORAS DE PLAGAS", as the case may be.

c. The common name (nombre común) and the chemical name of the active ingredient (according to the chemical nomenclature recognized by IUPAC), the concentration of this and other ingredients of toxicological importance, expressed in percentage form. The quantity in grams of the active ingredient(s) contained per liter or kilogram of formulated product must be indicated.

d. The biocidal action of the pesticide, indicating its physical form or the term that best defines its physical state.

For the purposes of this Regulation, the WHO toxicological classification criteria will be used, according to the following table:

7.2 Other mandatory information on the label.

The requirements included in this section must be distributed on the rest of the label according to the design presented in numeral 7.4 of this regulation:

a. Under the title "PHRASES AND WARNINGS OF USE (FRASES Y ADVERTENCIAS DE USO)", the legends established in numeral 5.4 must be included.

b. Under the title "SAFETY PRECAUTIONS (PRECAUCIONES DE SEGURIDAD)", the specific warnings for the product must be indicated (if they exist), good application practice, precautions when handling concentrates (if applicable), precautions to consider before and after application, care with application equipment (if there is a risk), among others.

c. Under the title "SYMPTOMS AND SIGNS OF INTOXICATION (SINTOMAS Y SIGNOS DE INTOXICACION)", the symptoms and effects of acute intoxication in humans must be indicated, by ingestion, inhalation, dermal and ocular contact, or any other. Use common terms.

d. Under the title "FIRST AID (PRIMEROS AUXILIOS)", indicate the immediate measures that must be taken in case of acute overexposure to the product:

- In case of ingestion, the manufacturer or formulator must indicate the measures to take, which will depend on the type of formulation and the active ingredient(s) it contains.

- Must bear the legend: "NEVER GIVE TO DRINK OR INDUCE VOMITING IN AN UNCONSCIOUS PERSON." - IN CASE OF CONTACT WITH SKIN, IMMEDIATELY REMOVE ALL CONTAMINATED CLOTHING. WASH THE SKIN AREAS IN CONTACT WITH THE PESTICIDE, USING PLENTIFUL SOAP AND WATER.

- IN CASE OF CONTACT WITH EYES, WASH WITH WATER FOR SEVERAL MINUTES. IF OCULAR IRRITATION PERSISTS, VISIT A DOCTOR. Under the title "RECOMMENDATIONS TO THE PHYSICIAN (RECOMENDACIONES AL MEDICO)", indicate the antidotes and specific treatment, as well as the measures to confirm the diagnosis, if known. If there is no antidote, indicate "HAS NO ANTIDOTE (NO TIENE ANTÍDOTO)".

e. Under the heading "INSTRUCTIONS FOR USE", indicate the method of application, dosages, pests for which the product is intended, and any other information the manufacturer or formulator deems necessary for the use of the product.

f. Under the heading "PRECAUTIONS AND WARNINGS FOR USE", the physical and chemical risks of the pesticide must be indicated, along with any other the manufacturer or formulator deems necessary.

If the product is a flammable or combustible aerosol, liquid, or solid, it must bear the corresponding flammability or combustibility pictogram from Annex 1 (Anexo 1), and the following warnings:

- Pressurized container, do not puncture or burn, even after use. - Do not spray on an open flame or incandescent material. - Keep away from heat, sparks, and open flames. - Do not smoke when using the product. - Protect from sunlight and do not expose the product to temperatures exceeding 50°C.

g. Under the heading "MEASURES FOR ENVIRONMENTAL PROTECTION", indicate the proper final disposal of containers after use, protection of domestic animal species and fauna in general, and measures to prevent contamination of soil, air, water tables (mantos), and receiving water bodies. The indications must comply with the provisions of the legislation of each country.

h. Pesticides for professional use must include the toxicological classification of the pesticide on the label in a visual manner using a specific color, as established in Table 1 (Tabla 1). The color identification shall be in the form of a band along the base of the label, whose width shall be equal to 15% of the height of said label. At the center of the band, the text indicating the toxicological category of the product must be printed in black or a contrasting color: "MODERATELY HAZARDOUS" ("MODERADAMENTE PELIGROSO") for Category II, "SLIGHTLY HAZARDOUS" ("LIGERAMENTE PELIGROSO") for Category III, and "PRECAUTION" ("PRECAUCION") for products in Category IV, as applicable, in a size no smaller than one-third of the width of the band.

i. The shades of the colors and the signal words corresponding to the toxicological category of the pesticides must be as indicated in Table 1 (Tabla 1).

j. The batch number, date of formulation, and expiration date (indicating month and year) may appear outside the label as part of the primary packaging. The product label must indicate the country of formulation with the legend "FORMULATED IN".

k. The official registration number, issued by the competent authority of the State Party. Additionally, the batch number, date of formulation, and expiration date (indicating month and year) must be included; these may appear outside the label as part of the primary packaging, and must be provided by the manufacturer or formulator.

l. The name, address, and telephone number of the manufacturer, formulator, importer, distributor, or packer.

7.3 Leaflet (Panfleto) 7.3.1 Pesticides for professional use must include a leaflet (panfleto) that, in addition to reproducing the information on the label, contains information regarding application equipment, personal protective equipment, method of application, dosage, mode of action, mechanism of action, re-entry period to treated areas, and other specific measures for the prevention of harm to health and the protection of the user, domestic animals, and the environment.

7.3.2 The leaflet (panfleto) must bear the legend in uppercase and bold letters stating: "DO NOT EAT, SMOKE, OR DRINK DURING THE HANDLING AND APPLICATION OF THIS PRODUCT. BATHE AFTER HANDLING IT AND PUT ON CLEAN CLOTHES." 7.4 AUTHORIZED LABEL FORMATS 7.4.1 In the case of a single-panel label, it must contain the following information:

a. The legend "PROFESSIONAL-USE PESTICIDE FOR PUBLIC HEALTH" ("PLAGUICIDA DE USO PROFESIONAL PARA SALUD PÚBLICA") or "PROFESSIONAL-USE PESTICIDE FOR PEST CONTROL COMPANIES" ("PLAGUICIDA DE USO PROFESIONAL PARA EMPRESAS CONTROLADORAS DE PLAGAS").

b. Trade name and brand name of the product.

c. Chemical name, common name, and concentration in percentages of the active ingredient(s) and other additives of toxicological importance.

d. Pesticides for professional use must indicate the quantity in grams of the active ingredient(s) contained per liter or kilogram of formulated product.

e. Type of formulation and biocidal action.

f. The official registration number, issued by the competent authority of the State Party. Additionally, the batch number, date of formulation, and expiration date (indicating month and year) must be included; these may appear outside the label as part of the primary packaging.

g. Instructions for use.

h. Entry periods to areas where the pesticide has been applied.

i. Safety precautions and warning phrases. The necessary pictograms in accordance with Annex 2 (Anexo 2).

j. Precautions and warnings for physical and chemical risk, and any other the manufacturer or formulator deems necessary, including the respective pictograms in accordance with Annex 1 (Anexo 1).

k. First aid and recommendations to the physician.

l. The net content in International System units and it shall not require any additional phrase to identify it.

m. Name, address, and telephone number of the manufacturer, formulator, importer, distributor, or packer.

n. Warning phrases from numeral 5.4.

o. Environmental protection measures (including the pictograms from Annex 2 (Anexo 2)).

p. Legal responsibility, transport, storage, incompatibility with other products warnings, and any other information the manufacturer or formulator deems necessary.

q. Color corresponding to the toxicological category and its name (as per the provisions in Table 1 (Tabla 1)).

7.4.2 In the case of a two-panel label:

7.4.2.1 The first panel or central panel must contain the following information:

a. The legend "PROFESSIONAL-USE PESTICIDE FOR PUBLIC HEALTH" ("PLAGUICIDA DE USO PROFESIONAL PARA SALUD PÚBLICA") or "PROFESSIONAL-USE PESTICIDE FOR PEST CONTROL COMPANIES" ("PLAGUICIDA DE USO PROFESIONAL PARA EMPRESAS CONTROLADORAS DE PLAGAS"), as applicable.

b. Trade name and brand name of the product.

c. Chemical name, common name, and concentration in percentages of the active ingredient(s) and other additives of toxicological importance.

d. Pesticides for professional use must indicate the quantity in grams of the active ingredient(s) contained per liter or kilogram of formulated product.

e. Type of formulation and biocidal action.

f. The net content in International System units and it shall not require any additional phrase to identify it.

7.4.2.2 The second panel, which may be located to the left or right of the central panel, must contain:

a. Instructions for use.

b. The entry periods to areas where the pesticide has been applied.

c. Safety precautions and warning phrases (established in numeral 5.4). Furthermore, the necessary pictograms must be included in accordance with Annex 2 (Anexo 2).

d. Precautions and warnings for physical and chemical risk, and any other the manufacturer or formulator deems necessary, including the respective pictograms in accordance with Annex 1 (Anexo 1).

e. First aid and recommendations to the physician.

f. Environmental protection measures (including the necessary pictograms from Annex 2 (Anexo 2)).

g. Name and address of the manufacturer or formulator, distributor, and registrant.

h. Legal responsibility, transport, storage, and incompatibility with other products warnings.

i. The official registration number issued by the competent authority of the State Party. It must also include the batch number, date of formulation, and expiration date (indicating month and year); these may appear outside the label as part of the primary packaging.

j. Name, address, and telephone number of the manufacturer, formulator, importer, distributor, or packer.

k. Environmental protection measures (including the pictograms from Annex 2 (Anexo 2)).

l. Legal responsibility, transport, storage, incompatibility with other products warnings, and any other information the manufacturer or formulator deems necessary.

m. Color corresponding to the toxicological category and its name (as per the provisions in Table 1 (Tabla 1)).

7.4.3 In the case of a three-panel label, the information shall be distributed as indicated below:

Given at the Presidency of the Republic, on the twentieth day of the month of February of the year two thousand twelve.

RESOLUCION No. 273-2011 (COMIECO-LXI) EL CONSEJO DE MINISTROS DE INTEGRACIÓN ECONÓMICA

Que de conformidad con los articulas 38, 39 Y 55 del Protocolo al Tratado General de Integración Económica Centroamericana -Protocolo de Guatemala-, modificado por la Enmienda del 27 de febrero de 2002, el Consejo de Ministros de Integración Económica tiene bajo su competencia los asuntos de la Integración Económica Centroamericana y, como tal, le corresponde aprobar los actos administrativos del Subsistema Económico; Que de acuerdo con el articulo 15 de ese mismo instrumento jurídico regional, los Estados Parte tienen el compromiso de constituir una Unión Aduanera entre sus territorios, la que se alcanzará de manera gradual y progresiva, sobre la base de programas que se establezcan al efecto, aprobados por consenso; Que en el marco del proceso de conformación de la Unión Aduanera, los Estados Parte han alcanzado importantes acuerdos en materia de Requisitos de Etiquetado de Plaguicidas de Uso Doméstico y de Uso Profesional, que requieren la aprobación del Consejo; Que los Estados Parte, en su calidad de Miembros de la Organización Mundial del Comercio (OMC), notificaron al Comité de Obstáculos Técnicos al Comercio, de conformidad con lo establecido en el Acuerdo sobre Obstáculos Técnicos al Comercio, el Proyecto de Reglamento Técnico Centroamericano RTCA 65.03.57:10 Plaguicidas. Plaguicidas de Uso Doméstico y de Uso Profesional. Requisitos de Etiquetado; Que los Estados Parte, concedieron un plazo prudencial a los Estados Miembros de la OMC para hacer observaciones al proyecto de Reglamento notificado tal y como lo exige el numeral 4), párrafo 9 del artículo 2 del Acuerdo sobre Obstáculos Técnicos al Comercio, observaciones que fueron debidamente analizadas y atendidas en lo pertinente; Que de conformidad con el Acuerdo sobre Obstáculos Técnicos al Comercio, los Miembros preverán un plazo prudencial entre la aprobación de los reglamentos técnicos y su entrada en vigor, con el fin de dar tiempo a -Ios productores para adaptar sus productos o sus métodos de producción a lo establecido en los reglamentos; Que de conformidad con el numeral 3 del artículo 55 del Protocolo de Guatemala, se recabó la opinión del Comité Consultivo de Integración Económica,

ÁMBITO DE APLICACIÓN Aplica a las etiquetas de los plaguicidas para uso doméstico y uso profesional en sus diferentes formulaciones y presentaciones.

No aplica a los plaguicidas de origen botánico y microbiológico.

SIMBOLOS Y ABREVIATURAS IUPAC: International Union of Pure and Applied Chemistry (Unión Internacional de Química Pura y Aplicada).

OMS: Organización Mundial de la Salud FAO: Food and Agriculture Organization of the United Nations (Organización de las Naciones Unidas para la Agricultura y la Alimentación).

4. DEFINICIONES 4.1 Empresa controladora de plagas: aquella empresa natural o jurídica que se dedica a utilizar plaguicidas objeto de este reglamento para prevenir, controlar o destruir cualquier plaga que pueda afectar la salud humana, en áreas o espacios interiores, exteriores de viviendas, edificios, instalaciones públicas y privadas, industrias, comercios, vehículos públicos y privados, grandes extensiones en jardinería y recreación y lugares donde circulan, permanecen o concurren personas.

4.2 Aditivos de formulación: cualquier sustancia emulsificante, disolvente, dispersante, propelente, componentes de la formulación del plaguicida o sus mezclas.

4.3 Envase primario o envase: todo recipiente que tiene contacto directo con el producto, con la misión específica de protegerlo de su deterioro, contaminación o adulteración y facilitar su manipulación. También se designa simplemente como "envase".

4.4 Envase secundario o empaque: todo recipiente que tiene contacto con uno o más envases primarios, con el objeto de protegerlos y facilitar su comercialización hasta llegar al consumidor final. El envase secundario generalmente es usado para agrupar en una sola unidad de expendio, uno o varios envases primarios.

4.5 Envase terciario o embalaje: todo recipiente utilizado para facilitar la manipulación y proteger el envase primario y/o envase secundario, contra los daños físicos y agentes exteriores durante su almacenamiento y transporte; estos recipientes se utilizan durante la distribución del producto y normalmente no llegan al usuario final.

4.6 Etiqueta: conjunto de elementos de información escritos, impresos o gráficos relativos a un producto, elegidos en razón de su pertinencia para el sector o los sectores de que se trate, que se adhieren o se imprimen en el recipiente que contiene el producto o en su embalaje/envase exterior, o que se fijan en ellos.

4.7 Etiqueta complementaria: aquella que sustituye a la etiqueta de origen, cuando ésta se declara en idioma diferente al español/castellano; o bien, complementa la información no incluida en la etiqueta de origen presentada en idioma español/castellano.

4.8 Fabricante: persona jurídica, que se dedica a la síntesis de ingredientes activos grado técnico que se utilizan en la formulación de plaguicidas objeto de este reglamento.

4.9 Formulación: proceso mediante el cual se elaboran plaguicidas que contengan uno o más ingredientes activos uniformemente distribuidos en uno o más aditivos, con o sin ayuda de acondicionadores de fórmula.

4.10 Formulador: persona natural o jurídica que se dedica a la formulación de plaguicidas objeto de este reglamento.

4.11 Ingrediente activo: componente de una formulación responsable de la actividad biológica directa o indirecta contra plagas y vectores. Un único íngrediente activo puede estar conformado por una o más entidades químicas que pueden diferir en la actividad relativa. Una formulación puede contener uno o más ingredientes activos.

4.12 Marca comercial: cualquier signo denominativo, figurativo, tridimensional o mixto, perceptible visualmente, que sea apto para distinguir los productos o servicios de una persona individual o jurídica de las de otros.

4.13 Nombre comercial: signo denominativo o mixto, con el que se identifica y distingue a una empresa, a un establecimiento mercantil o a una entidad.

4.14 Nombre común: nombre del ingrediente activo, aprobado por la Organización Internacional de Normalización (ISO).

4.15 Plaga: cualquier tipo de organismo que por su densidad de población perjudica los cultivos, la salud, los bienes de producción y el ambiente del hombre.

4.16 Plaguicida: cualquier sustancia o mezcla de sustancias químicas destinada a prevenir, destruir o controlar cualquier plaga, incluyendo los vectores de enfermedades humanas o las especies de plantas y animales indeseables que causan perjuicio o que interfieren de cualquier otra forma en la producción, elaboración, almacenamiento, transporte o comercialización de bienes de consumo.

4.17 Plaguicida de uso doméstico: formulación que contiene uno o varios ingredientes activos, que por estudios científicos cuentan con reconocimiento para uso en ambientes donde vivan, circulen, permanezcan o concurran personas(viviendas, edificios, instalaciones públicas y privadas, industrias, comercios, vehículos públicos y privados, jardines interiores y exteriores). No se incluyen los espacios donde se realizan actividades agrícolas o de jardinería a gran escala, estos plaguicidas deben de ser de categoría IV según la clasificación toxicológica de la OMS. Deberán ser formulaciones listas para uso sin modificación alguna, tal como se expenden.

4.18 Plaguicida de uso profesional: formulación que contienen uno o varios ingredientes activos. Solo pueden ser aplicados por personal autorizado y capacitado. Estos plaguicidas deben ser de las categorías Il, III o IV según clasificación toxicológica de la OMS y que al momento de su aplicación, la dilución final se clasifique en la categoría IV. Estos plaguicidas deben contar con reconocimiento para ser aplicados en ambientes donde vivan, circulen, permanezcan o concurran personas (viviendas, edificios, instalaciones públicas y privadas, industrias, comercios, vehículos públicos y privados, jardines interiores y exteriores, grandes extensiones de jardinería y recreación).

NOTA: Esta categoría contempla a los plaguicidas de uso en salud pública y los plaguicidas de uso por empresas controladoras de plagas.

4.19 Panfleto o instructivo: documento que contiene la información técnico-científica que se adjunta al producto terminado, el cual debe contener al menos los datos necesarios para el uso seguro y eficaz del plaguicida de uso doméstico y de uso profesional que lo contiene.

4.20 Panel central de la etiqueta: es la parte de la etiqueta donde está inscrito el nombre comercial y nombre común, el tipo de formulación, la marca comercial del producto o la marca registrada si éste es el caso.

5. CONDICIONES Y RESTRICCIONES GENERALES DEL ETIQUETADO 5.1 Principios generales del etiquetado de plaguicidas de uso doméstico y profesional.

5.1.1 Las etiquetas que se coloquen en los plaguicidas deben aplicarse de manera que no se separen del envase o empaque bajo condiciones normales de uso.

5.1.2 Los materiales de impresión empleados deben ser de una calidad tal, que resistan la acción de los agentes atmosféricos y las condiciones normales de uso, transporte y almacenamiento.

5.1.3 El lenguaje debe ser claro, breve, sencillo y exento de ideas que tiendan a la ampliación o exageración de las cualidades o capacidades reales del plaguicida. Las palabras deben ser de uso común evitando tecnicismos que confundan al usuario y empleando palabras que definan certeramente la idea.

5.1.4 No se permite el uso de indicaciones tales como "no tóxico", "no nocivo" o cualquier otra indicación análoga, ni el uso de términos extensivos tales como: "etc.", "y otros", "ampliamente" "los más diversos", "ciertos", "casi todos", "la mayoría" o cualquier otra indicación análoga.

5.1.5 Las representaciones gráficas, figuras, pictogramas o diseños necesarios del etiquetado, deben aparecer claramente visibles y fácilmente legibles, evitando el uso de dibujos que confundan o induzcan al mal uso del producto.

5.1.6 Los textos y leyendas del etiquetado de los envases o empaques de plaguicidas, destinados al mercado centroamericano, deben estar redactados en español. Cuando el idioma en que está redactada la etiqueta no sea éste, debe colocarse una etiqueta complementaria en idioma español, que contenga la información obligatoria incluida en este reglamento.

5.1.7 Cuando se utilice una etiqueta complementaria que sustituya a la etiqueta de origen o la complemente, la información contenida en ella debe estar conforme con lo establecido en este reglamento, y la misma debe estar adherida al envase o empaque.

5.1.8 Se aceptarán etiquetas redactadas en más de un idioma, siempre y cuando la información esté también en español/castellano.

5.1.9 La información que por el tamaño del envase o empaque no pueda formar parte del etiquetado del plaguicida (tanto de uso doméstico como profesional) se debe presentar en un panfleto que acompañe a cada envase o empaque y debe incluirse la leyenda, en letra mayúscula y en negrita que diga: "LEA EL PANFLETO O INSTRUCTIVO ANTES DE USAR ESTE PRODUCTO".

5.2 Dimensiones de la etiqueta 5.2.1 Plaguicidas de uso doméstico La dimensión de la etiqueta se debe ajustar al tamaño del envase y empaque. El tamaño de letra y pictogramas debe cumplir con 10 establecido en los puntos 5.3.1 al 5.3.3.

5.2.2 Plaguicidas de uso profesional Para los plaguicidas de uso profesional, el tamaño de la etiqueta debe estar de acuerdo con las siguientes proporciones:

a. En envases o empaques cuya capacidad sea hasta de 4 L o 5 kg, la etiqueta debe abarcar por lo menos el 75% de la superficie total del mismo, excluyendo la parte superior e inferior del envase o empaque.

b. En envases o empaques mayores de 4 L o 5 kg hasta 18 L o 25 kg, la etiqueta debe abarcar por lo menos el 25% de la superficie total del mismo, excluyendo la parte superior e inferior del envase o empaque. En ningún caso el tamaño puede ser menor al definido para etiquetas en el inciso a.) de este articulo.

c. En envases o empaques de capacidad superior a 18 Lo 25 kg, el tamaño de la etiqueta debe ser al menos igual al tamaño definido en el inciso b.) de este numeral.

5.3 Tamaño de letras y pictogramas para los plaguicidas de uso doméstico y uso profesional.

5.3.1 Tamaño de la letra Las leyendas de advertencias solicitadas en este reglamento deben estar en mayúscula y en negrita, con un tamaño de al menos 2 mm y todos los demás textos de al menos 1,25 mm, 5.3.2 Estilos de impresión 5.3.2.1 La impresión sobre la etiqueta debe ir en la misma dirección y nunca debe sobreponerse, aún cuando se utilicen colores diferentes.

5.3.2.2 La impresión condensada nunca debe utilizarse.

5.3.2.3 La impresión en itálica solo debe utilizarse para nombres científicos o latinos.

5.3.2.4 La impresión en resaltado solo debe utilizarse para enfatizar.

5.3.3 Tamaño de los pictogramas Los pictogramas exigidos en este reglamento deben ser de dimensiones tales que permita al usuario identificar y comprender el mensaje. El tamaño mínimo permitido es de 7 x 7 mm. Para plaguicidas de uso profesional la ubicación de los pictogramas se establece en el punto 7.4.3.

5.4 Leyendas solicitadas en la etiqueta.

5.4.1 Se deben declarar los números telefónicos de los Centros de Información Toxicológica de cada Estado Parte.

5.4.2 En cada etiqueta de uso doméstico y profesional según corresponda, deben colocarse las siguientes leyendas de advertencias:

a. Para ambos tipos de plaguicidas "PRECAUCIÓN; LEA LA ETIQUETA Y LAS INSTRUCCIONES PERTINENTES ANTES DE USAR ESTE PRODUCTO".

b. En el caso de plaguicidas de uso profesional, la leyenda debe decir: "PRECAUCION, LEA LA ETIQUETA, EL PANFLETO Y LAS INSTRUCCIONES ANTES DE USAR ESTE PRODUCTO".

c. Para ambos tipos de plaguicidas: ''NO APLICAR DIRECTAMENTE, NI INDIRECTAMENTE SOBRE ALIMENTOS O UTENSILIOS DE COCINA"; ''NO SE APLIQUE EN PRESENCIA DE PERSONAS Y ANIMALES DOMESTICOS"; ''NO SE TRANSPORTE NI ALMACENE JUNTO A PRODUCTOS ALIMENTICIOS Y ROPA"; "MANTÉNGASE FUERA DEL ALCANCE DE LOS NIÑOS Y ANIMALES DOMÉSTICOS"; "NUNCA REUTILICE ESTE ENVASE".

d. Además deben incluir una leyenda que indique: ''NO COMER, BEBER O FUMAR CUANDO SE UTILICE ESTE PRODUCTO. LAVARSE CUIDADOSAMENTE LAS MANOS CON AGUA Y JABON DESPUES DE LA MANIPULACIÓN DE ESTE PRODUCTO".

5.4.3 En el caso de los plaguicidas de uso profesional, deben incluirse los pictogramas correspondientes, de conformidad con los anexos 1 y 2.

a. En ambos tipos de plaguicidas, se debe indicar el período de reingreso - al área o ambiente que ha sido tratado. Además se debe declarar la plaga que controla el producto utilizando el nombre común y el nombre científico.

b. Leyenda en letra mayúscula y en negrita que diga: "EN CASO DE MALESTAR O INTOXICACION, LLEVE EL PACIENTE AL MEDICO Y ENTREGUE ESTA ETIQUETA, PANFLETO O INSTRUCTIVO".

6. FORMATO DE ETIQUETA PARA PLAGUICIDAS DE USO DOMESTICO.

6.1 Panel central o Sección principal de la etiqueta.

Los siguientes requisitos deben aparecer en el panel central o sección principal de la etiqueta:

a. El nombre comercial y la marca comercial del producto.

b. La leyenda "PLAGUICIDA DE USO DOMESTICO".

c. La acción biocida del plaguicida, señalando la forma física del mismo o bien aquel término que defina mejor su estado físico.

d. El contenido neto en unidades del Sistema Internacional y no requerirá de ninguna frase adicional que lo identifique, 6.2 Otra información obligatoria en la etiqueta.

Los siguientes requisitos deben distribuirse en el resto de la etiqueta en el orden que lo decida el fabricante:

a. El Nombre común y el nombre químico del o de los ingredientes activos (de conformidad con la nomenclatura química reconocida por IUPAC), la concentración de este y de otros ingredientes de importancia toxicológica, expresado en forma porcentual. Se debe indicar la cantidad en gramos del o de los ingredientes activos contenidos por litro o kilogramo de producto formulado.

b. Bajo el título de "FRASES Y ADVERTENCIAS DE USO", debe incluirse las leyendas establecidas en el numeral 5.4.

c. Bajo el título de "PRECAUCIONES DE SEGURIDAD", debe indicarse las advertencias específicas al producto (si existen), la buena práctica de aplicación, precauciones a tener en cuenta antes y después de la aplicación.

d. Bajo el título de "SINTOMAS y SIGNOS DE lNTOXICACION" debe. indicarse los síntomas y efectos de la intoxicación aguda en el ser humano, por ingestión, inhalación, contacto dérmico y ocular o cualquier otro. Usar términos comunes.

e. Bajo el título de "PRIMEROS AUXILIOS", señalar las medidas inmediatas que deben tomarse en el caso de sobre exposición aguda al producto:

- En caso de ingestión el fabricante o formulador debe indicar las medidas a tomar, las cuales dependerán del tipo de formulación y del o los ingredientes activos que contenga - Debe llevar la leyenda: ''NUNCA DÉ A BEBER NI INDUZCA EL VOMITO EN UNA PERSONA INCONSCIENTE." - EN CASO DE CONTACTO CON LA PIEL LAVAR USANDO AGUA Y JABÓN ABUNDANTE.

- EN CASO DE CONTACTO CON LOS OJOS LAVAR CON AGUA DURANTE VARIOS MINUTOS. SI LA IRRITACIÓN OCULAR PERSISTE VISITAR A UN MÉDICO. LAVARSE LAS MANOS DESPUÉS DE LA MANIPULACIÓN.

f. Bajo el título de "RECOMENDACIONES AL MEDICO" indicar los antídotos y el tratamiento específico, así como las medidas para confirmar el diagnóstico, si se conocen. En caso de no tener antídoto indicar "NO TIENE ANTÍDOTO".

g. Bajo el título de "INSTRUCCIONES DE USO", indicar el modo de aplicación, dosificaciones, plagas a las que se destina el producto y cualquier otra información que el fabricante o formulador considere necesaria para la utilización del producto.

h. Bajo el título "PRECAUCIONES y ADVERTENCIAS DE USO" deben indicarse los riesgos físicos y químicos del plaguicida, y cualquier otro que el fabricante o formulador considere necesario.

i. Si el producto es un aerosol, un liquido o un sólido inflamable o combustible, debe llevar el pictograma de inflamabilidad o combustibilidad establecidos en el Anexo 1, y las siguientes advertencias:

- Recipiente a presión. No perforar ni quemar, incluso después de su uso.

- No rociar sobre llama al descubierto o sobre material incandescente.

- Mantener alejado de fuentes de calor, chispas y llamas al descubierto.

- No fumar cuando utiliza el producto.

- Proteger de la luz solar y no exponer este producto a una temperatura superior de 50°C.

j. Bajo el título "MEDIDAS PARA PROTECCION AL AMBIENTE" señalar la adecuada destrucción de los envases, protección de las especies de animales domésticos y de la fauna en general y para prevenir la contaminación del suelo, aire, mantos y cuerpos receptores de agua.

Las indicaciones deben cumplir con lo establecido en las legislaciones de cada país.

k. La etiqueta del producto debe indicar el país de formulación con la leyenda "FORMULADO EN".

l. El número del registro oficial extendido por la autoridad competente del Estado Parte. Además debe incluirse el número de lote, fecha de formulación y fecha de caducidad (indicando mes y año); estos pueden aparecer fuera de la etiqueta formando parte del envase primario, los cuáles deben ser proporcionados por el fabricante o formulador.

m. El nombre, dirección y número de teléfono del fabricante, formulador, importador, distribuidor o envasador.

7. FORMATO DE ETIQUETA PARA PLAGUICIDAS DE USO PROFESIONAL 7.1 Los plaguicidas de uso profesional deberán contener en el panel central o sección principal de la etiqueta los siguientes requisitos:

a. El nombre comercial y la marca comercial del producto.

b. La leyenda ''PLAGUICIDA DE USO PROFESIONAL PARA SALUD PUBLICA" o ''PLAGUICIDA DE USO PROFESIONAL PARA EMPRESAS CONTROLADORAS DE PLAGAS", según sea el caso.

c. El nombre común y el nombre químico del ingrediente activo (según la nomenclatura química reconocida por IUPAC), la concentración de este y de otros ingredientes de importancia toxicológica expresado en forma porcentual. Se debe indicar la cantidad en gramos del o los ingredientes activos contenidos por litro o kilogramo de producto formulado.

d. La acción biocida del plaguicida, señalando la forma física del mismo o bien aquel término que defina mejor su estado fisico.

Para fines de este Reglamento se utilizará los criterios de clasificación toxicológica de la OMS, según la tabla siguiente:

e. El contenido neto en unidades del Sistema Internacional de Unidades y no requerirá de ninguna frase adicional que lo identifique.

7.2 Otra información obligatoria en la etiqueta.

Los requisitos incluidos en este apartado deberán ser distribuidos en el resto de la etiqueta de acuerdo al diseño presentado en el numeral 7.4 de este reglamento:

a. Bajo el título de ''FRASES Y ADVERTENCIAS DE USO", debe incluirse las leyendas establecidas en el numeral 5.4.

b, Bajo el título de "PRECAUCIONES DE SEGURIDAD", deben indicarse las advertencias específicas al producto (si existen), la buena práctica de aplicación, las precauciones cuando se manipulan concentrados (si procede), precauciones a tener en cuenta antes y después de la aplicación, cuidados con el equipo de aplicación (si existe riesgo), entre otros.

c. Bajo el título de "SINTOMAS y SIGNOS DE INTOXICACION", deberá indicarse los síntomas y efectos de la intoxicación aguda en el ser humano, por ingestión, inhalación, contacto dérmico y ocular o cualquier otro. Usar términos comunes.

d. Bajo el título de "PRIMEROS AUXILIOS" señalar las medidas inmediatas que deben tomarse en el caso de sobre exposición aguda al producto:

- En caso de ingestión, el fabricante o formulador debe indicar las medidas a tomar, las cuales dependerán del tipo de formulación y del o los ingredientes activos que contenga - Debe llevar la leyenda: "NUNCA DÉ A BEBER O INDUZCA EL VOMITO EN UNA PERSONA INCONSCIENTE." - EN CASO DE CONTACTO CON LA PIEL QUITAR INMEDIATAMENTE TODA LA ROPA CONTAMINADA. LAVAR LAS ZONAS DE PIEL EN CONTACTO CON EL PLAGUICIDA, USANDO AGUA Y JABÓN ABUNDANTES.

- EN CASO DE CONTACTO CON LOS OJOS LAVAR CON AGUA DURANTE VARIOS MINUTOS. SI LA IRRITACIÓN OCULAR PERSISTE VISITAR A UN MÉDICO. Bajo el título de "RECOMENDACIONES AL MEDICO" indicar los antídotos y el tratamiento específico, así como las medidas para confirmar el diagnóstico, si se conocen. En caso de no tener antídoto indicar "NO TIENE ANTÍDOTO".

e. Bajo el título de "INSTRUCCIONES DE USO", indicar el modo de aplicación, dosificaciones, plagas a las que se destina el producto y cualquier otra información que el fabricante o formulador considere necesaria para la utilización del producto.

f. Bajo el título "PRECAUCIONES Y ADVERTENCIAS DE USO'', deberá indicarse los riesgos físicos y químicos del plaguicida, y cualquier otro que el fabricante o formulador considere necesario.

Si el producto es un aerosol, un liquido o un sólido inflamable o combustible, debe llevar el pictograma de inflamabilidad o combustibilidad correspondiente del Anexo 1, y las siguientes advertencias:

- Recipiente a presión, no perforar ni quemar, incluso después de su uso.

- No rociar sobre llama al descubierto o sobre material incandescente.

- Mantener alejado de calor, chispas y llamas al descubierto.

- No fumar cuando utiliza el producto.

- Proteger de la luz solar y no exponer el producto a una temperatura superior de 50°C, g. Bajo el título "MEDIDAS PARA PROTECCION AL AMBIENTE" señalar la adecuada disposición final de los envases luego de su uso, protección de las especies de animales domésticos y de la fauna en general y para prevenir la contaminación del suelo, aire, mantos y cuerpos receptores de agua Las indicaciones deberán estar conformes con lo establecido en las legislaciones de cada país.

h. Los plaguicidas de uso profesional, deberán incluir la clasificación toxicológica del plaguicida en la etiqueta de manera visual mediante un color específico, según lo establecido en la Tabla 1. La identificación del color se hará en forma de una banda a lo largo de la base de la etiqueta, cuyo ancho será igual al 15% de la altura de dicha etiqueta. Al centro de la banda debe imprimirse en color negro o en un color contrastante el texto que señala la categoría toxicológica del producto "MODERADAMENTE PELIGROSO" para categoría II, "LIGERAMENTE PELIGROSO" para categoría III y "PRECAUCION" para los de categoría IV según corresponda, en un tamaño no menor de la tercera parte del ancho de la banda.

i. Las tonalidades de los colores y las palabras de advertencia correspondientes a la categoría toxicológica de los plaguicidas, deben ser según se indica en la Tabla 1.

j. El número de lote, fecha de formulación y fecha de caducidad (indicando mes y año) puede aparecer fuera de la etiqueta formando parte del envase primario. La etiqueta del producto deberá indicar el país de formulación con la leyenda "FORMULADO EN".

k. El número del registro oficial, extendido por la autoridad competente del Estado Parte. Además debe incluirse el número de lote, fecha de formulación y fecha de caducidad (indicando mes y año); estos pueden aparecer fuera de la etiqueta formando parte del envase primario, los cuáles deben ser proporcionados por el fabricante o formulador.

l. El nombre, dirección y número de teléfono del fabricante, formulador, importador, distribuidor o envasador.

7.3 Panfleto 7.3.1 Los plaguicidas de uso profesional deben incluir un panfleto que además de reproducir la información de la etiqueta, contenga información referente a equipos de aplicación, equipos de protección personal, forma de aplicación, dosificación, modo de acción, mecanismo de acción, período de reingreso a áreas tratadas y otras medidas específicas para la prevención de daños a la salud y protección del usuario, animales domésticos y al ambiente.

7.3.2 El panfleto debe llevar la leyenda en letra mayúscula y negrita que diga: ''NO COMER, FUMAR O BEBER DURANTE EL MANEJO Y APLICACIÓN DE ESTE PRODUCTO. BÁÑESE DESPUÉS DE MANIPULARLO Y PÓNGASE ROPA LIMPIA" 7.4 FORMATOS AUTORIZADOS DE ETIQUETAS 7.4.1 En el caso de que la etiqueta sea de un panel, la misma debe contener la siguiente información:

a. Leyenda "PLAGUICIDA DE USO PROFESIONAL PARA SALUD PÚBLICA" o "PLAGUICIDA DE USO PROFESIONAL PARA EMPRESAS CONTROLADORAS DE PLAGAS".

b. Nombre comercial y la marca comercial del producto.

c. Nombre químico, nombre común y concentración en porcentajes del ingrediente(s) activo(s) y de otros aditivos de importancia toxicológica, d. Los plaguicidas de uso profesional, deben indicar la cantidad en gramos del ingrediente(s) activo(s) contenidos por litro o kilogramo de producto formulado; e. Tipo de formulación y acción biocida.

f. El número del registro oficial, extendido por la autoridad competente del Estado Parte. Además debe incluirse el número de lote, fecha de formulación y fecha de caducidad (indicando mes y año); los cuales pueden aparecer fuera de la etiqueta, formando parte del envase primario.

g. Instrucciones de uso.

h. Periodos de ingreso en áreas donde se ha aplicado el plaguicida.

i. Precauciones de seguridad y frases de advertencia. Los pictogramas necesarios de conformidad con el anexo 2.

j. Precauciones y advertencias de riesgo físico, químico y. otro que considere necesario el fabricante o formulador, incluyendo los pictogramas respectivos de conformidad con el anexo 1.

k. Primeros auxilios y recomendaciones al médico.

l. El contenido neto en unidades del Sistema Internacional y no requerirá de ninguna frase adicional que lo identifique.

m. Nombre, dirección y número de teléfono del fabricante, formulador, importador, distribuidor o envasador.

n. Frases de advertencia del numeral 5.4.

o. Medidas de protección ambiental (incluyendo los pictogramas del anexo 2).

p. Advertencias de responsabilidad legal, transporte, almacenamiento, incompatibilidad con otros productos y cualquier otra información que el fabricante o formulador considere necesaria.

q. Color correspondiente a la categoría toxicológica y nombre de la misma (según lo dispuesto en la Tabla 1) 7.4.2 En el caso de una etiqueta de dos paneles:

7.4.2.1 El primer panel o panel central debe contener la siguiente información:

a. La leyenda ''PLAGUICIDA DE USO PROFESIONAL PARA SALUD PÚBLICA" o ''PLAGUICIDA DE USO PROFESIONAL PARA EMPRESAS CONTROLADORAS DE PLAGAS", según sea el caso.

b. Nombre comercial y la marca comercial del producto.

c. Nombre químico, nombre común y concentración en porcentajes del ingrediente(s) activo(s) y de otros aditivos de importancia toxicológica.

d. Los plaguicidas de uso profesional, deben indicar la cantidad en gramos del ingrediente(s) activo(s) contenidos por litro o kilogramo de producto formulado.

e. Tipo de formulación y acción biocida.

f. El contenido neto en unidades del Sistema Internacional y no requerirá de ninguna frase adicional que lo identifique.

7.4.2.2 El segundo panel, que puede estar ubicado a la izquierda o derecha del panel central, debe contener:

a. Instrucciones de uso.

b. Los periodos de ingreso en áreas donde se ha aplicado el plaguicida.

c. Precauciones de seguridad y frases de advertencia (establecidas en el numeral 5.4).Además se deben incluir los pictogramas necesarios de conformidad con el Anexo 2.

d. Precauciones y advertencias de riesgo físico, químico y otro que el fabricante o formulador considere necesario, incluyendo los pictogramas respectivos de conformidad con el Anexo 1.

e. Primero auxilios y recomendaciones al médico.

f. Medidas de protección ambiental (incluyendo los pictogramas necesarios del Anexo 2).

g, Nombre y dirección del fabricante o formulador, distribuidor y registrante.

h. Advertencias de responsabilidad legal, transporte, almacenamiento e incompatibilidad con otros productos.

i. El número del registro oficial extendido por la autoridad competente del Estado Parte. Además debe incluir el número de lote, fecha de formulación y fecha de caducidad (indicando mes y año); los cuales pueden aparecer fuera de la etiqueta formando parte del envase primario.

j. Nombre dirección y número de teléfono del fabricante, formulador, importador, distribuidor o envasador.

k. Medidas de protección ambiental (incluyendo los pictogramas del Anexo 2).

I.Advertencias de responsabilidad legal, transporte, almacenamiento, incompatibilidad con otros productos y cualquier otra información que el fabricante o formulador considere necesaria.

m. Color correspondiente a la categoría toxicológica y nombre de la misma (según lo dispuesto en la Tabla 1).

7.4.3 En el caso de una etiqueta de tres paneles, la distribución de la información se hará como se indica a continuación:

Indicar la cantidad en gramos del ingrediente( s) activo( s) contenidos por litro o kilogramo de producto formulado.

VERIFICACIÓN Y VIGILANCIA La vigilancia y verificación de este Reglamento Técnico Centroamericano le corresponde a la Autoridad Nacional Competente de cada uno de los Estados Parte.
