Now, having no objections, no observations, as established in Article No. 43 of the Municipal Code, the approval of the original text as published is communicated." Therefore, according to what is transcribed, the text of the referred regulation is the following:

REGULATION FOR THE APPLICATION OF THE TARIFF FOR THE GARBAGE COLLECTION SERVICE The Municipal Council of Montes de Oro, by means of Subsection No. 18, Chapter IV, of ordinary session No. 08-2012, approved the "Regulation for the Application of the Tariff for the Garbage Collection Service", in the following manner:

The Municipality of Montes de Oro, using the powers conferred upon it by the Municipal Code, the Political Constitution, and the Laws of the Republic of Costa Rica, establishes the following regulation for the application of the tariff for the traditional solid waste collection service.

Definitions

CHAPTER I

a. Traditional Garbage: Solid waste traditionally generated, including paper, cardboard, plastic, organic food, which are the result of the daily activities of the different housing units, private patent holders, and state entities.

b. Category: Placement of a taxpayer according to the estimation of garbage they generate per week, the building area of the dwelling, the commercial activity they carry out, the nature of the institution, and others established by this regulation.

c. Municipality: Municipality of Montes de Oro.

d. Collection Service: Service of collecting, transporting, and managing solid waste (traditional garbage).

e. Fee for services: Amount to be charged to the taxpayer for the collection service, according to their category, subject to prior approval by the respective entities and publication in La Gaceta.

f. Residential Tariff: This is the designation assigned to dwellings and is classified into 4 categories according to the amount of waste they produce and/or their square meters of construction.

g. Commercial Tariff: This is the designation assigned to commerce and is classified into 9 categories according to the amount of waste they produce and/or the commercial activity carried out.

h. Government Tariff: This is the designation assigned to government institutions, NGOs, and non-commercial institutions, and is classified into 5 categories according to the amount of waste they produce and/or their user population.

Complaints

CHAPTER V

a. A note presenting the complaint.

b. A photocopy of the legal representative's ID card in the case of a legal person, or a photocopy of the identity card in the case of a natural person.

c. A photocopy of the Certification of Legal Status or the patent registered in the case of a natural person.

d. A certification of the number of employees issued by the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social). e. A certification from the ICT for hotels, cabins, or other activities of tourist interest.

Garbage Collection

CHAPTER VI

Sharp-edged objects must first be wrapped in a resistant material such as cardboard and then placed in the plastic bag or the receptacle used to store the garbage.

Receptacles that, due to their poor condition, represent a danger to municipal workers, the interested party shall be notified to remove the receptacle from use; otherwise, they will be removed by the municipal workers.

Sanctions

CHAPTER VII

a. Placing dead animals in bags or receptacles that will later be collected.

b. Separating, removing, or extracting components of the garbage that are in receptacles at the point of collection.

c. Washing or cleaning objects on public roads that may generate garbage.

d. Depositing garbage such as branches, grass clippings (zacate), and other objects in bags for the normal garbage collection, which may cause serious damage to the collection truck and which is not subject to charge.

Por lo tanto, de acuerdo a lo trascrito el texto del referido reglamento es el siguiente:

REGLAMENTO PARA LA APLICACIÓN DE LA TARIFA DEL SERVICIO DE RECOLECCIÓN DE BASURA El Concejo Municipal de Montes de Oro, mediante Inciso Nº 18 Capítulo IV, de la sesión ordinaria Nº 08-2012. Aprobó el "Reglamento para la Aplicación de la Tarifa del Servicio de Recolección de Basura", de la siguiente manera:

La Municipalidad de Montes de Oro en uso de las facultades que le confiere el Código Municipal, la Constitución Política y las Leyes de la República de Costa Rica, establece el siguiente reglamento, para la aplicación de la tarifa del servicio de recolección de desechos sólidos tradicionales.

Definiciones

CAPÍTULO I

a. Basura tradicional: Desechos sólidos generados tradicionalmente dentro de los que se encuentran el papel, cartón, plástico, alimentos orgánicos, que son el resultado de las actividades cotidianas de las distintas unidades habitacionales, patentados privados y entes de carácter estatal.

b. Categoría: Ubicación de un contribuyente de acuerdo a la estimación de basura que genera por semana, área de construcción de la vivienda, actividad comercial que desarrolla, naturaleza de la institución y otros que establezca el presente reglamento.

c. Municipalidad: Municipalidad de Montes de Oro.

d. Servicio de recolección: Servicio de recolectar, transportar y manejar los desechos sólidos (basura tradicional).

e. Tasa por los servicios: Monto a cobrar al contribuyente por el servicio de recolección, de acuerdo a su categoría, previa aprobación de los entes respectivos y publicación en La Gaceta.

f. Tarifa Residencial: Es la denominación asignada a las viviendas y se clasifica en 4 categorías de acuerdo a la cantidad de desechos que producen y/o a sus metros cuadrados de construcción.

g. Tarifa Comercial: Es la denominación asignada al comercio y se clasifica en 9 categorías de acuerdo a la cantidad de desechos que producen y/o a la actividad comercial que se desarrolle.

h. Tarifa de Gobierno: Es la denominación asignada a las instituciones gubernamentales ONG, e instituciones no comerciales, y se clasifica en 5 categorías de acuerdo a la cantidad de desechos que producen y/o a su población usuaria.

Reclamos

CAPÍTULO V

a. Nota presentado el reclamo.

b. Fotocopia de la cédula del representante legal en caso de la persona jurídica o fotocopia de la cédula de identidad en caso de la persona física.

c. Fotocopia de la Certificación Personería Jurídica o el patentado registrado en caso de la persona física.

d. Certificación de la cantidad de empleados emitido por la Caja Costarricense de Seguro Social. e. Certificación del ICT para hoteles, cabinas u otras actividades de interés turísticos.

Recolección de basura

CAPÍTULO VI

Los objetos punzo cortantes primero deben envolverse en un material resistente como el cartón para luego depositarlo en la bolsa plástica o el recipiente que se utiliza para almacenar la basura.

Los recipientes que por su mal estado representen un peligro para los funcionarios municipales, se avisará al interesado para que saque fuera de uso el recipiente, de lo contrario serán retirados por los funcionarios municipales.

Sanciones

CAPÍTULO VII

a. Colocar animales muertos en bolsas o recipientes que luego van a ser recolectados.

b. Separar, remover o extraer componentes de la basura que estén en recipientes en el sitio de recolección.

c. Lavar o limpiar objetos en la vía pública que puedan generar basura.

d. Depositar basuras como ramas, zacate y otros objetos en bolsas, para la recolección normal de basura, que pueden ocasionar graves daños al camión recolector y que no sea objeto de cobro.

Regulation for the Application of the Garbage Collection Service RateReglamento para la Aplicación de la Tarifa del Servicio de Recolección de Basura

Artículo 1 — —For the purposes of this regulation, the following shall be understood:

Artículo 2 — —Every housing unit, private patent holder, public or private non-commercial state entity, located within the coverage area of the traditional waste collection service, must pay the respective tariff and comply with this regulation.

Artículo 3 — — The Municipality shall charge for the traditional garbage collection service by categories for all users within the coverage area, a service that must be provided regularly and guaranteed to be of good quality.

Artículo 5 — —For charging for the garbage collection service, for the different types of users, they shall be classified into the following categories:

Artículo 6 — —Residential Tariff 1 is defined as: Any dwelling that produces a maximum of 15 Kg.

Artículo 7 — —Residential Tariff 2 is defined as: Any dwelling that produces more than 15 Kg.

Artículo 8 — —Residential Tariff 3 is defined as: Any dwelling that produces more than 30 Kg.

Artículo 9 — —Residential Tariff 4 is defined as: Any dwelling that produces more than 45 kg of ordinary waste per week.

Artículo 10 — —Commercial Tariff 1 is defined as: Any business that produces between 0 and 15 Kg.

Artículo 11 — —Commercial Tariff 2 is defined as: Any business that produces more than 15 Kg.

Artículo 12 — —Commercial Tariff 3 is defined as: Any business that produces more than 40 and up to 64 Kg.

Artículo 13 — —Commercial Tariff 4 is defined as: Any business that produces more than 64 and up to 99 Kg.

Artículo 14 — —Commercial Tariff 5 is defined as: Any business that produces more than 99 and up to 199 Kg.

Artículo 15 — —Commercial Tariff 6 is defined as: Any business that produces more than 199 kg.

Artículo 16 — —Commercial Tariff 7 is defined as: Any business that produces more than 499 kg and up to 1000 kg of ordinary waste per week.

Artículo 17 — —Commercial Tariff 8 is defined as: Any business that produces more than 1000 and up to 2000 kg of ordinary waste per week.

Artículo 18 — —Commercial Tariff 9 is defined as: Any business that produces more than 2000 kg of ordinary waste per week.

Artículo 19 — —Institutional or Government Tariff 1 is defined as: Any government institution, NGO, or non-commercial institution that produces between 0 and up to 15 kgs of ordinary waste per week.

Artículo 20 — —Institutional or Government Tariff 2 is defined as: Any government institution, NGO, or non-commercial institution that produces more than 15 and up to 45 kg of ordinary waste per week and that is located within the coverage area of the collection service.

Artículo 21 — —Institutional or Government Tariff 3 is defined as: Any government institution, NGO, or non-commercial institution that produces between 45 to 79 kg of ordinary waste per week.

Artículo 22 — —Institutional or Government Tariff 4 is defined as: Any government institution, NGO, or non-commercial institution that produces more than 79 kg and up to 149 kg of ordinary waste per week.

Artículo 23 — —Institutional or Government Tariff 5 is defined as: Any government institution, NGO, or non-commercial institution that produces more than 149 kg of ordinary waste per week and that is located within the coverage area of the collection service.

Artículo 24 — —Any natural or legal person may file their respective complaint if they consider that the assigned category is not in accordance with the average weekly garbage generation or another factor used for the classification of their category.

Artículo 25 — —For the filing of a complaint of this type, the property and the complaining person where the activity is carried out must be up to date on all their municipal commitments, such as fees, taxes, and contributions.

Artículo 26 — —For the filing of a complaint of this type, the interested party must submit:

Artículo 27 — —Once the complaint is received in the manner indicated in the previous article, the municipal administration shall have a period no longer than one calendar month to resolve the respective complaint, which will have the appeal remedies, as set forth in law.

Artículo 28 — —The garbage must be contained in the receptacle used, be it sealed plastic bags, plastic containers, or metal drums in good condition for use, and must not exceed the top.

Artículo 30 — — The Municipality is responsible for the collection of garbage that is in bags and receptacles, but not for cleaning the area from which it was collected.

Artículo 32 — —Prohibitions: For users and the general public.

Artículo 1 — Para los efectos de este reglamento entiéndase por:

Artículo 2 — Toda unidad habitacional, patentado privado, ente de carácter estatal público o privado no comercial, que se encuentre dentro del área de cobertura del servicio de recolección de desechos tradicionales, deberá de cancelar la tarifa respectiva y cumplir el presente reglamento.

Artículo 3 — La Municipalidad realizará el cobro del servicio de recolección de basura tradicional por categorías, para todos los usuarios se encuentren dentro del área de cobertura, servicio que deberá ser de manera regular y garantizando que el mismo de buena calidad.

Artículo 5 — Para el cobro del servicio de recolección de basura, para los distintos tipos de usuarios, se clasificaran en las siguientes categorías:

Artículo 6 — Se toma como tarifa Residencial 1: Toda vivienda que produzca como máximo 15 Kg.

Artículo 7 — Se toma como tarifa Residencial 2: Toda vivienda que produzca más de 15 Kg.

Artículo 8 — Se toma como tarifa Residencial 3: Toda vivienda que produzca más de 30 Kg.

Artículo 9 — Se toma como tarifa Residencial 4: Toda vivienda que produzca más de 45 kgr de desechos ordinarios por semana.

Artículo 10 — Se toma como tarifa Comercial 1: Todo comercio que produzca entre 0 y 15 Kg.

Artículo 11 — Se toma como tarifa Comercial 2: Todo comercio que produzca más de 15 Kg.

Artículo 12 — Se toma como tarifa Comercial 3: Todo comercio que produzca más de 40 y hasta 64 Kg.

Artículo 13 — Se toma como tarifa Comercial 4: Todo comercio que produzca mas de 64 y hasta 99 Kg.

Artículo 14 — Se toma como tarifa Comercial 5: Toda comercio que produzca más de 99 y hasta 199 Kg.

Artículo 15 — Se toma como tarifa Comercial 6: Todo comercio que produzca mas de 199 kg.

Artículo 16 — Se toma como tarifa Comercial 7: Todo comercio que produzca más de 499 kg y hasta 1000 kgr de desechos ordinarios por semana.

Artículo 17 — Se toma como tarifa Comercial 8: Todo comercio que produzca más de 1000 y hasta 2000 kgr de desechos ordinarios por semana.

Artículo 18 — Se toma como tarifa Comercial 9: Todo comercio que produzca más de 2000 kg desechos ordinarios por semana.

Artículo 19 — Se toma como tarifa Institucional o Gobierno 1: Toda institución gubernamental, ONG o institución no comercial, que produzca entre 0 y hasta 15 kgrs de desechos ordinarios por semana.

Artículo 20 — Se toma como tarifa Institucional o Gobierno 2: Toda institución gubernamental, ONG o institución no comercial, que produzca más de 15 y hasta 45 kgr de desechos ordinarios por semana y que se ubiquen dentro del área de cobertura del servicio de recolección.

Artículo 21 — Se toma como tarifa Institucional o Gobierno 3: Toda institución gubernamental, ONG o institución no comercial, que produzca entre 45 a 79 kgr de desechos ordinarios por semana.

Artículo 22 — Se toma como tarifa Institucional o Gobierno 4: Toda institución gubernamental, ONG o institución no comercial, que produzca mas de 79 kg y hasta 149 kgr de desechos ordinarios por semana.

Artículo 23 — Se toma como tarifa Institucional o Gobierno 5: Toda institución gubernamental, ONG o institución no comercial, que produzca más de 149 kgr de desechos ordinarios por semana y que se ubiquen dentro del área de cobertura del servicio de recolección.

Artículo 24 — Toda persona física o jurídica podrá presentar su respectivo reclamo si considera que la categoría asignada no está acorde con el promedio de generación de basura semanal u otro factor utilizado para la clasificación de su categoría.

Artículo 25 — Para la presentación de un reclamo de este tipo, la propiedad y la persona reclamante donde se desarrolle la actividad, debe estar al día en todos sus compromisos municipales, tales como tasas, impuestos y contribuciones.

Artículo 26 — Para la presentación de un reclamo de este tipo, el interesado deberá presentar:

Artículo 27 — Recibido el reclamo en la forma señalada en el artículo anterior, la administración municipal contará con un plazo no mayor a un mes calendario, para resolver el reclamo respectivo, el cual tendrá los recursos de alzada, señalados en la ley.

Artículo 28 — La basura debe estar confinada en el recipiente utilizado ya sea este, bolsas plásticas selladas, recipientes plásticos o estañones de metal en buen estado de uso y no deben rebasar la parte superior.

Artículo 30 — La Municipalidad es la responsable de la recolección de la basura que está en bolsas y recipientes, pero no de la limpieza del área de donde se recolectó.

Artículo 32 — Prohibiciones: Para los usuarios, público en general.
