throughout the entire text - Complete Text of Norm 055 Extends the deadline for submission of the corresponding requirements for the issuance and granting of licenses and/or authorizations by interested parties seeking a commercial underwater fishing license, established in point 3 of agreement AJDIP/166-2011 Complete Text of record: E276C COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE A.J.D.I.P./055-2012.-Puntarenas, on the tenth day of the month of February, 2012.

I.-That by means of Agreement AJDIP/166-2011, the Board of Directors authorized and approved the issuance and granting of commercial underwater fishing licenses and authorizations, for the fishery resource, for divers in the Guanacaste zone.

II.-That said Agreement was published, in accordance with the law, in the Official Gazette La Gaceta No. 145 of July 28, 2011.

III.-That likewise, to date and despite the complementary Agreements adopted by the Board of Directors, along the same lines, specifying permitted fishing gear, it has not been feasible to issue these licenses, which is clearly not consistent with the spirit that motivated this Collegiate Body to adopt the aforementioned agreement.

IV.-That in today's session, at the express request of the Board of Directors, the following persons have appeared regarding this matter: MSc. Ricardo Gutiérrez Vargas, Regional Director of Guanacaste, Lic. Antonio Porras Porras, Technical Director General, and Ing. Roger López Chavarría, Head of the Information Technology Unit, with the purpose of finalizing the requirements that remain pertinent and necessary to, once and for all, proceed to issue the underwater fishing licenses, by reason of the unrestricted compliance with the regulatory provisions that the Board of Directors has issued in the exercise of its powers and authority; besides the harm that its delay has caused to the affected fishermen.

V.-That as noted by the Regional Director of Guanacaste, in the operative clause (por tanto) 3, of agreement AJDIP/166-2011, a strict period of 2 months was established counted from its publication, which occurred on July 28, and consequently the expiration of the document reception period closed on September 28, 2011, which caused many potential beneficiaries to have been left without the possibility of fulfilling this legal requirement.

VI.-By reason of the arguments expressed by the Regional Director of Guanacaste, the Board of Directors. Therefore:

1.-To extend, for one time only, the deadline for submission of the corresponding requirements for the issuance and granting of licenses and/or authorizations by interested parties seeking a commercial underwater fishing license, until February 29, 2012.

2.-Effective from its adoption, let it be published.

Considering:

RESOLVES:

1. 1Que por medio del Acuerdo AJDIP/166-2011, la Junta Directiva autorizó y aprobó la emisión y otorgamiento de licencias y autorizaciones de pesca comercial subacuática, del recurso pesquero, para buzos en la zona de Guanacaste.
2. 2Que dicho Acuerdo fue publicado, conforme a derecho en el Diario Oficial La Gaceta N° 145 del 28 de julio de 2011.
3. 3Que asimismo, a la fecha y pese a los Acuerdos complementarios adoptados por la Junta Directiva, en esa misma línea, con especificación de artes de pesca permitidos, no ha sido factible la emisión de éstas licencias, lo cual no resulta a todas luces coincidente con el espíritu que motivó a éste Órgano Colegiado para la adopción del acuerdo supra.
4. 4Que en la sesión del día de hoy, han comparecido, a solicitud expresa de la. Junta Directiva, en este tema, el MSc. Ricardo Gutiérrez Vargas, Director Regional de Guanacaste, el Lic. Antonio Porras Porras, Director General Técnico y el Ing. Roger López Chavarría, Jefe Unidad de Informática, con el propósito de finiquitar los requisitos que restaren pertinentes y necesarios para de una vez por todas, proceder a emitir las licencias de pesca subacuática, en razón del cumplimiento irrestricto que las disposiciones normativas que en el ejercicio de sus facultades y atribuciones ha dictado la Junta Directiva; amén del perjuicio que su dilatación ha significado a los pescadores afectados.
5. 5Que según lo ha señalado el Director Regional de Guanacaste, en el por tanto 3°, del acuerdo AJDIP/166-2011, se estableció un período taxativo de 2 meses contados a partir de su publicación, la cual acaeció el 28 de julio, por lo que en consecuencia el vencimiento del período de recepción de documentación se cerró el pasado 28 de setiembre de 2011, lo cual ocasionó que muchos posibles beneficiarios se hayan quedado sin la posibilidad de cumplir con este requisito legal.

6º-En razón de las argumentaciones vertidas por el Director Regional de Guanacaste, la Junta Directiva. Por tanto:

ACUERDA:

1º-Extender por una única vez, el plazo de presentación los requisitos correspondientes para la emisión y otorgamiento de las licencias y/o autorizaciones por parte de los interesados en contar con una licencia de pesca comercial subacuática, hasta el próximo 29 de febrero de 2012.

2º-Rige a partir de su adopción, publíquese.
