RTCR 449:2010 Technical Regulation for the Labeling of Fresh, Frozen, and Thawed Fishery Products, Sold in Bulk or Prepackaged at the Point of Sale 1. OBJECT AND SCOPE OF APPLICATION This Technical Regulation aims to establish the basic information requirements on the labeling of fresh, frozen, or thawed fishery products, sold in bulk or prepackaged at the point of sale. The provisions of this Regulation apply to domestic and imported fishery products.
2. REFERENCES This Technical Regulation is complemented by the following current technical regulations:
2.1 Executive Decree Nº 18696-MAG-S, Veterinary Inspection Regulation for Fishery Products, published in La Gaceta Nº 239 of December 16, 1988.
2.2 Executive Decree Nº 26012-MEIC, RTCR 100:1997 Labeling of Prepackaged Foods and its amendments, published in La Gaceta Nº 91 of May 14, 1997.

3. DEFINITIONS AND ABBREVIATIONS:
For the purposes of this Technical Regulation, the following definitions and abbreviations are used:
3.1 aquaculture (acuicultura): Commercial production in captivity of aquatic animals and plants under controlled conditions. Commercial aquaculture implies individual or collective ownership of the cultivated organisms, as well as the processes of transport, industrialization, and commercialization of those organisms.
3.2 label (etiqueta): Any tag, brand, mark, image, or other descriptive or graphic matter, which has been written, printed, stenciled, marked, embossed or engraved, or affixed to the container or package of a food.
3.3 labeling (etiquetado): Any written, printed, or graphic material that contains the label, accompanies the food, or is displayed near the food, including that which is intended to promote its sale or placement.
3.4 maximum microbiological limit (límite máximo microbiológico): The maximum limit permitted by the competent authority, based on the absence, presence, or number of microorganisms, per unit of mass, volume, area, or lot.
3.5 maximum residue limit (límite máximo de residuos): The level of residues of a chemical substance permitted by the competent authority in products intended for human consumption.
3.6 packaging materials (materiales de empaque): All materials such as aluminum sheets, plastic sheets, waxed paper, cardboard boxes, and others used to cover and protect fresh, frozen, or thawed fishery products and that have been approved by the competent authority.
3.7 common name (nombre común): Name by which a species is known and which is not the official scientific name.
3.8 freezing process (proceso de congelación): That which is carried out with equipment intended for such purpose, so that the temperature limits of maximum crystallization are exceeded. The quick freezing process should not be considered finished until the temperature of the product has reached -18 °C in the center after thermal stabilization.
3.9 fishery product (producto pesquero): Product or derivative originating from the capture of marine flora and fauna; or from the harvest of aquaculture.
3.10 aquaculture fishery product (producto pesquero acuícola): Any farmed aquatic animal at all stages of its life except species of mammals, aquatic reptiles, and amphibians intended for human consumption.
3.11 adulterated fishery product (producto pesquero adulterado): Any fishery product to which any substance has been added or subtracted to alter its composition, weight, or volume, for fraudulent purposes or to conceal or correct any defect due to being of inferior quality.
3.12 altered fishery product (producto pesquero alterado): Any fishery product that during its cultivation, handling, processing, transport, storage, or possession, and due to reasons not deliberately caused, has undergone such variations in its sensory characteristics, chemical composition, or nutritional value that its suitability for consumption has been nullified or significantly diminished, even if the product remains safe (inocuo).
3.13 frozen fishery product (producto pesquero congelado): Refers to the fishery product that in its final form exceeds the temperature limits of maximum crystallization. The quick freezing process should not be considered finished until the temperature of the product has reached -18 °C in the center after thermal stabilization.
3.14 contaminated fishery product (producto pesquero contaminado): Any fishery product containing pathogenic microorganisms, physical contaminants, chemical substances, toxins, or parasites capable of harming the consumer's health.
3.15 thawed fishery product (producto pesquero descongelado): Refers to the fishery product and its preparations that, after being frozen, are subjected to temperatures higher than -18 °C.
3.16 fresh fishery product (producto pesquero fresco): Refers to the fishery product that in its final form is stored at a temperature between 0 °C and 4 °C and that has not undergone any freezing process.
3.17 wild fishery product (producto pesquero silvestre): Residual object resulting from fishing activity, directly related to the raw material used, through a process that begins with the extraction of species from their natural environment, in which they live independently of human care.
3.18 prepackaged product (producto preenvasado): Any fishery product wrapped, packaged, or packed in advance, ready to be offered to the consumer or for hospitality purposes.
3.19 residues (residuos): Any foreign substance, including its metabolites, found in fishery products and by-products, as a result of application or accidental exposure, that constitutes a risk to human health.
4. CLASSIFICATION AND DESIGNATION The products covered by this regulation are classified and designated as follows:
4.1 Fresh Aquaculture and Wild Fishery Products.
4.2 Frozen Aquaculture and Wild Fishery Products.
4.3 Thawed Aquaculture and Wild Fishery Products.
5. SPECIFICATIONS 5.1 Veterinary Drug Residues and Chemical Contaminants: The products regulated in this Technical Regulation must comply with the provisions of Executive Decree Nº 34687-MAG, RTCR 409:2008 Regulation of Maximum Microbiological Limits and Residues of Drugs and Contaminants for Fishery and Aquaculture Products and By-products Intended for Human Consumption, published in La Gaceta Nº 160 of August 20, 2008.
5.2 Permitted Food Additives and Microbiological Criteria: The food additives permitted in the foods considered in this Technical Regulation must conform to the provisions of Executive Decree Nº 34687-MAG, RTCR 409:2008 Regulation of Maximum Microbiological Limits and Residues of Drugs and Contaminants for Fishery and Aquaculture Products and By-products Intended for Human Consumption, published in La Gaceta Nº 160 of August 20, 2008, or failing that, the current Central American Technical Regulation on Food Additives shall govern.
For the case of microbiological criteria, the Central American Technical Regulation, RTCA 67.04.50:08 Food. Microbiological Criteria for Food Safety applies.
6. METHODS OF ANALYSIS The methods of analysis for microbiological analyses and residues of veterinary drugs, heavy metals, and pesticides, which will be used to determine whether a fishery product is adulterated, altered, or contaminated, are those established by the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA), in accordance with internationally recognized methods.
7. MARKING AND LABELING For the purposes of this Regulation, the labeling information requirements must be included on the containers or packaging of the products. The labels may be of any material and must be affixed to the product with characters that are clear, visible, indelible, and easy for the consumer to read under normal circumstances of purchase and use. For products sold in bulk, the mandatory information regulated herein must be displayed on the gondola, shelf, or display case of the product.
7.1 For prepackaged fishery products, the provisions established in Executive Decree Nº 26012-MEIC of April 15, 1997, and its amendments, RTCR 100:1997, Technical Regulation for the Labeling of Prepackaged Foods, published in La Gaceta Nº 91 of May 14, 1997, must be complied with. In addition to the above, the following must always be indicated on the label:
- a)Common name of the species.
Note 1: When there is one or more common names of the species for the same fishery product, one of the names that is consistent with the scientific name, according to the list detailed in Annex A. Common Names of Species[1][1], must be used.
Note 2: In addition to the common name of the species, it may be indicated whether the product is wild or farmed.
- b)Storage Instructions: The following phrases, as applicable, must be indicated on the label:
7.1.1 Fresh fishery products:
For the storage of these products, one of the following legends must be indicated:
"Keep refrigerated at a temperature no higher than 4 °C".
"Store at a temperature no higher than 4 °C".
"Refrigerate at a temperature no higher than 4 °C".
Or any other legend that suggests storing the product at a temperature no higher than 4 °C.
7.1.2 Frozen fishery products:
For the storage of these products, one of the following legends must be indicated:
"Keep in refrigeration at a temperature no higher than -18 °C".
"Store at a temperature no higher than -18 °C".
"Keep at a temperature no higher than -18 °C".
Or any other legend indicating a storage temperature no higher than -18 °C that guarantees the recommended shelf life of the product.
7.1.3 Thawed fishery products:
For the storage of these products, one of the following legends must be indicated:
"This product has undergone a thawing process, therefore it is recommended not to refreeze." "This product has been thawed, do not freeze".
"Thawed product, do not refreeze".
Or any other legend that suggests not refreezing a product that has been subjected to a thawing process.
Notwithstanding the foregoing, if the prepackaged fresh, frozen, or thawed fishery product has been treated with carbon monoxide (CO) or another permitted substance, for the purpose of preserving, maintaining, or improving the shelf life of the product, the following legend must be indicated in the information: "Product treated with carbon monoxide", or any other legend that informs about the substance used for such purposes.
7.2 For non-prepackaged fishery products. During the commercialization of non-prepackaged products, the information for the consumer must be visible to them and indicate the following:
7.2.1 Frozen and fresh fishery product: Must indicate the following information:
- a)Country of Origin.
- b)Common name of the species.
Note 1: When there is one or more common names of the species for the same fishery product, one of the names that is consistent with the scientific name, according to the list detailed in Annex A. Common Names of Species.(1), must be used.
(1) The list in this Annex is not intended to be an exhaustive list of all common names for fishery products commercialized in the Costa Rican market; it will be updated by Executive Decree upon recommendation of the Costa Rican Institute of Fisheries and Aquaculture (Instituto Costarricense de Pesca y Acuicultura, INCOPESCA) Note 2: In addition to the common name of the species, it may be indicated whether the product is wild or farmed.
7.2.2 Thawed fishery product: Must indicate the same information as in section 7.2.1, in addition to the following legend:
"Thawed product".
Or in any other way that informs that the product has been subjected to a thawing process.
Notwithstanding the foregoing, if the frozen, fresh, or thawed non-prepackaged fishery product has been treated with carbon monoxide (CO) or another permitted substance, for the purpose of preserving, maintaining, or improving the shelf life of the product, the following legend must be indicated in the information: "Product treated with carbon monoxide", or any other legend that informs about the substance used for such purposes.
7.2.3 The information made available to the consumer must be with clear, visible characters that are easy to read under normal circumstances of purchase and use.
8. PACKAGING AND PACKING The packaging used must be clean, free of defects, and made of materials suitable for direct contact with fishery products, in such a way as to guarantee the product protection during handling, storage, and transport, in addition to a seal that ensures the safety (inocuidad) of the product.
9. VERIFICATION 9.1 The Ministry of Economy, Industry and Commerce will verify the provisions established in numeral 7. Marking and Labeling.
9.2 The National Animal Health Service (Servicio Nacional de Salud Animal, SENASA) of the Ministry of Agriculture and Livestock will verify the provisions established in numeral 4. Classification and Designation, numeral 5. Specifications, numeral 6. Methods of Analysis, and numeral 8. Packaging and Packing.
9.3 Likewise, for the purpose of verifying the aspects indicated in points 9.1 and 9.2 above, it will be the responsibility of the Costa Rican Institute of Fisheries and Aquaculture (Instituto Costarricense de Pesca y Acuicultura, INCOPESCA), within the scope of its competencies, to provide the technical assistance required by the Ministries of Economy, Industry and Commerce and Agriculture and Livestock.
10. CONCORDANCE This technical regulation does not concord with any international standard.
