article 38 of the Regulation to the Forestry Law, Executive Decree No. 25721-MINAE and its amendments, the Executive Branch shall establish, by Executive Decree, the priority areas in which environmental services must be paid, the number of hectares to be contracted, and the amount to be paid per hectare.

25721-MINAE of October 17, 1996, establishes the procedure to be followed by those interested in entering the Program for Payment of Environmental Services. Therefore, They Decree:

"PAYMENT OF ENVIRONMENTAL SERVICES FOR THE YEAR 2012"

However, in the event of having a greater allocation of resources according to article 5º of the "Law on Tax Simplification and Efficiency" No. 8114 published on July 9, 2001, and other financial resources that FONAFIFO captures for the payment of environmental services, they will be distributed according to the criteria of the funders and FONAFIFO. In any case, the resources used for these purposes must be incorporated into the institutional budget and approved by the Comptroller General of the Republic.

The contracts that FONAFIFO formalizes for this purpose shall establish both the conditions and the terms, form of payment, and other requirements to comply with what is stipulated in this article.

• a)Nine hundred and eighty exact dollars ($980) per hectare, for the payment of environmental services for Reforestation, disbursed over a period of five years.
• b)One thousand four hundred and seventy exact dollars ($1,470) per hectare, for the payment of environmental services for Reforestation strictly with native species contained in Decrees No. 25663-MINAE of October 8, 1996 and No. 25700-MINAE of October 15, 1996, disbursed over a period of five years.
• c)Six hundred and forty exact dollars ($640) per hectare, for the payment of environmental services for the recovery of areas through Natural Regeneration in pastures and grasslands, that were deforested before December 31, 1989. These projects may only be carried out in defined areas, as priority lands for an afforestation project under the Kyoto Protocol-Clean Development Mechanism (CDM) regime or another, that recognizes an additional payment for the carbon credits that FONAFIFO can commercialize, disbursed over a period of ten years.
• d)Four hundred and ten exact dollars ($410) per hectare, for the payment of environmental services for Natural Regeneration in grasslands and also areas with productive potential in sites with at least one year of abandonment and free of grazing outside Kyoto areas, disbursed over a period of ten years.
• e)Six hundred and forty exact dollars ($640) per hectare, for the payment of environmental services for Forest Protection, disbursed over a period of ten years.
• f)Seven hundred and fifty exact dollars ($750) per hectare, for the payment of environmental services for Forest Protection in Conservation Gaps, in the zones identified by SINAC and FONAFIFO, disbursed over a period of ten years.
• g)Eight hundred exact dollars ($800) per hectare, for the payment of environmental services for Protection of Water Resource (Protección de Recurso Hídrico) in areas of water importance identified by the Water Directorate of MINAET and by FONAFIFO, disbursed over a period of ten years.
• h)Five hundred exact dollars ($500) per hectare, for the payment of environmental services in Forest Management contracts, in which harvesting was carried out in accordance with the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decrees No. 27388-MINAE published on November 2, 1998, Decree No. 30763-MINAE published on October 9, 2002 effective until June 16, 2008 and Decree No. 34559-MINAE published in La Gaceta No. 115 of June 16, 2008, disbursed over a period of ten years.
• i)One dollar and thirty cents ($1.30) per tree, for the payment of environmental services for Reforestation integrated into Agroforestry Systems and small blocks of less than five hectares, disbursed over a period of three years.
• j)One dollar and ninety-five cents ($1.95) per tree, for the payment of environmental services for Reforestation integrated into Agroforestry Systems, strictly with native species contained in Decrees No. 25663 MINAE of October 8, 1996 and No. 25700 MINAE of November 15, 1996, disbursed over a period of three years.

The amounts pending payment for contracts from previous years shall be governed by what is established in the respective Executive Decrees for each year.

• a)For reforestation projects with species contained in the decrees of closed seasons and threatened or endangered species (Decree No. 25663-MINAE of October 8, 1996 and Decree No. 25700-MINAE) of November 15, 1996, the entire country is established as a priority.
• b)For reforestation projects established in protection areas according to article 33 of the Forestry Law No. 7575, the entire country shall be considered a priority.
• c)Sites where there is a high potential for plantation blocks, giving special priority to projects that use improved genetic material and to projects that use seed certified by the National Seed Office (ONS).
• d)Areas where reforestation projects financed through incentives or environmental services that have complied with both the approved management plans and their period of validity may be included.
• e)Reforestation projects with forest-industry integration.

The validity of the new contracts will begin the day after the located in districts with a Social Development Index (SDI) less than 40% according to the determination made by MIDEPLAN (2007). | 10 additional points | | III | Forests in any of the above priorities, with an application for entry to the PPSA in areas less than 50 hectares. In case of equal qualifications, processing will be done according to the order of presentation of the pre-applications.

• a)Lands with land-use capacity I, II, III, IV, V, VI, according to the provisions of the Methodology for the Determination of Land Use Capacity in Costa Rica, (Executive Decree No. 23214-MAG-MIRENEM, published in La Gaceta No. 107 of June 6, 1994).
• b)Areas for the establishment of trees in specific agreements with FONAFIFO.
• c)Priority will be given to projects processed by organizations that have a current agreement with FONAFIFO.

• a)Natural regeneration projects in pastures and grasslands, according to the provisions of subsections b and c, in areas defined as Kyoto lands or others where an additional payment is recognized for the carbon credits that FONAFIFO can commercialize and that were deforested before December 31, 1989.
• b)Natural regeneration projects in pastures and grasslands that can be carried out outside areas defined as Kyoto lands, with at least one year of abandonment and free of grazing.
• c)Natural regeneration projects with productive potential in sites with at least one year of abandonment and free of grazing.
• d)For natural regeneration in the protection areas according to article 33 of the Forestry Law No. 7575, the entire country shall be considered a priority.

• a)Properties that have management plans approved by the State Forestry Administration and in which harvesting was carried out in accordance with the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decrees No. 27388-MINAE published on November 2, 1998, Decree No. 30763-MINAE published on October 9, 2002 effective until June 16, 2008, and Executive Decree No. 34559-MINAE published in La Gaceta No. 115 of June 16, 2008. SINAC or the forestry regent shall certify compliance with the provisions of the Management Plan.

In each of the Subregional Offices of SINAC and in the Regional Offices of FONAFIFO, an updated map will be maintained in physical and digital "shape file" format, with the priority areas for locating the farms that apply to the Program for Payment of Environmental Services in the Forest Protection modality.

7575 shall be the following:

• a)In Reforestation contracts that incorporate various forest species and with different harvest cycles, the validity of the contract shall be equal to that of the species with the longest harvest cycle and that this does not exceed fifteen years, in which case this would be the maximum period of validity. In all cases, the validity of reforestation contracts may not be less than ten years.
• b)For Forest Protection contracts, the validity of the contract shall be ten years from its signing.
• c)For Forest Management contracts in which harvesting was carried out in accordance with the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decrees No. 27388-MINAE published on November 2, 1998, Decree No. 30763-MINAE published on October 9, 2002 effective until June 16, 2008, and Executive Decree No. 34559-MINAE published in La Gaceta No. 115 of June 16, 2008, the validity of the contract shall be ten years from its signing.
• d)For Natural Regeneration contracts in grasslands and sites with productive potential outside areas defined as Kyoto lands, the validity of the contract shall be ten years from its signing.
• e)For Natural Regeneration contracts in which carbon credits are commercialized under a specific agreement or project, the validity of the contract shall be ten years from its signing.
• f)For contracts in which Agroforestry Systems are developed, the validity of the contract shall be five years from its signing. In this modality, the registration of the encumbrance of the property before the Property Registry shall not be carried out.

The Regional Offices of FONAFIFO shall be responsible for processing and verifying compliance with the legal and regulatory requirements of the applications for payment for environmental services, once these are fulfilled, they will prepare an approval resolution and will submit the contract for its respective signature to the Director of the National Forestry Financing Fund.

• a)Reforestation projects with areas less than or equal to fifty hectares may receive the first payment in advance, whether processed through organizations or individually. For these projects, the first payment of 50% will be made once the contract with the State is formalized, provided that the payment amount is guaranteed as established in the Procedures Manual for the Payment of Environmental Services. In the following years, the payment will be distributed as follows: 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year. These payments are made from the average date of planting. Reforestation projects that do not receive advance payment will receive the first payment of 50% once the contract with the State is formalized and it is certified by the forestry regent that the plantation is established and its average date of establishment. In the following years the payment will be distributed as follows: 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year. Likewise, payments will be made from the average date of planting.
• b)Payments for environmental services for Forest Protection projects shall be 10% once the contract with the State is signed and the requirements established in the Manual of Procedures for the Payment of Environmental Services are met. Subsequent payments will be 10% each year until the tenth year, which must be requested annually from the date of signing the contract, except for contracts with payments for the year elapsed, maintaining, in this last case, the validity of the contract until the year of the last payment.
• c)In Forest Management contracts in which harvesting was carried out in accordance with the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decrees No. 27388-MINAE published on November 2, 1998, Decree No. 30763-MINAE published on October 9, 2002 effective until June 16, 2008, and Executive Decree No. 34559-MINAE, published in La Gaceta No. 115 of June 16, 2008; the first payment of 10% will be made once the contract with the State is signed and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. Subsequent payments will be 10% each year until the tenth year, which must be requested annually from the date of the signing of the contract.
• d)For Natural Regeneration projects, the first payment of 10% will be made once the contract with the State is signed and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. Subsequent payments will be 10% each year until the tenth year, which must be requested annually from the date of the signing of the contract.
• e)The payment of environmental services for projects in which Agroforestry Systems are developed will be made once the contract with the State is signed and the establishment of the trees and their average date of planting is certified by the forestry regent. The first payment will be 65% of the established amount, 20% in the second year, and 15% in the third year, which must be requested annually from the average date of establishment of the trees.
• f)These payment percentages may vary in accordance with agreements, covenants, or contracts with financing entities or partners that recognize differentiated amounts.

The conditions of such payments shall be established by the agreements and contracts formalized for this purpose.

Energía y Telecomunicaciones (MINAET), por medio del Fondo Nacional de Financiamiento Forestal (FONAFIFO) y el Sistema Nacional de Áreas de Conservación (SINAC), Instituciones que tienen dentro de sus competencias, la de fomentar el sector forestal, entre otros a través del Programa de Pago por Servicios Ambientales (PPSA).

Así como, permitir que se desarrollen e institucionalicen otros mecanismos de financiamiento, tal es el caso de la venta de servicios ambientales de mitigación de gases con efecto invernadero y el mecanismo de cobro del servicio ambiental de conservación del recurso hídrico en Costa Rica.

las Oficinas Regionales del FONAFIFO, deben dar prioridad a las presolicitudes cuya finca (s) se ubican dentro de las prioridades establecidas por el SINAC.

10.-Que según el artículo 38 del Reglamento de la Ley Forestal, Decreto Ejecutivo N° 25721-MINAET y sus reformas, el Poder Ejecutivo establecerá mediante Decreto Ejecutivo, las áreas prioritarias en las que se deben pagar servicios ambientales, la cantidad de hectáreas a contratar y el monto a pagar por hectárea.

11.-Que el artículo 39 del Reglamento a la Ley Forestal, Decreto Ejecutivo N° 25721-MINAET del 17 de octubre de 1996, establece el procedimiento que deberán seguir los interesados en ingresar al Programa de Pago de Servicios Ambientales. Por tanto,

"PAGO DE SERVICIOS AMBIENTALES PARA EL AÑO 2012"

Pero, en caso de disponer de una mayor asignación de recursos según el artículo 5º de la "Ley de Simplificación y Eficiencia Tributarias" N° 8114 publicada el 9 de julio del 2001, y otros recursos financieros que capte el FONAFIFO para el pago de servicios ambientales, se distribuirán según criterio de los financiadores y de FONAFIFO. En todo caso, los recursos utilizados para éstos fines deberán ser incorporados en el presupuesto institucional y ser aprobados por la Contraloría General de la República.

Los contratos que al efecto formalice el FONAFIFO, establecerán tanto las condiciones como los plazos, forma de pago y otros requisitos para cumplir con lo estipulado en este artículo.

• a)Novecientos ochenta dólares exactos ($980) por hectárea, para el pago de servicios ambientales por Reforestación, desembolsados durante un período de cinco años.
• b)Mil cuatrocientos setenta dólares exactos ($1.470) por hectárea, para el pago de servicios ambientales por Reforestación estrictamente con especies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de octubre de 1996, desembolsados durante un período de cinco años.
• c)Seiscientos cuarenta dólares exactos ($640) por hectárea, para el pago de servicios ambientales por la recuperación de áreas mediante Regeneración Natural en pastos y potreros, que hayan sido deforestadas antes del 31 de diciembre de 1989. Estos proyectos se podrán realizar sólo en áreas definidas, como tierras prioritarias para un proyecto de aforestación bajo el régimen del Protocolo de Kyoto-Mecanismo de Desarrollo Limpio (MDL) u otro, que reconozca un pago adicional por los créditos de carbono que el FONAFIFO pueda comercializar, desembolsados durante un período de diez años.
• d)Cuatrocientos diez dólares exactos ($410) por hectárea, para el pago de servicios ambientales por Regeneración Natural en potreros y también áreas con potencial productivo en sitios con al menos un año de abandono y libres de pastoreo fuera de áreas Kyoto, desembolsados durante un período de diez años e) Seiscientos cuarenta dólares exactos ($640) por hectárea, para el pago de servicios ambientales por Protección de Bosque, desembolsados durante un período de diez años.
• f)Setecientos cincuenta dólares exactos ($750) por hectárea, para el pago de servicios ambientales por Protección de Bosque en Vacíos de Conservación, en las zonas identificadas por el SINAC y FONAFIFO, desembolsados durante un período de diez años.
• g)Ochocientos dólares exactos ($800) por hectárea, para el pago de servicios ambientales por Protección de Recurso Hídrico en las zonas de importancia hídrica identificadas por la Dirección de Aguas del MINAET y por el FONAFIFO, desembolsados durante un período de diez años.
• h)Quinientos dólares exactos ($500) por hectárea, para el pago de servicios ambientales en contratos de Manejo de Bosque, en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Practicas y Manual de Procedimientos, Decretos Ejecutivos N° 27388-MINAE publicado el 2 de noviembre de 1998. el Decreto N° 30763-MINAE publicado el 9 octubre del 2002 vigente hasta el 16 de junio del 2008 y el Decreto N° 34559-MINAE publicado en La Gaceta N° 115 del 16 de junio del 2008, desembolsados durante un período de diez años.
• i)Un dólar con treinta centavos ($1,30) por árbol, para el pago de servicios ambientales por Reforestación integrados a Sistemas Agroforestales y bloques pequeños de menos de cinco hectáreas, desembolsados durante un período de tres años.
• j)Un dólar con noventa y cinco centavos ($1,95) por árbol, para el pago de servicios ambientales por Reforestación integrados a Sistemas Agroforestales. estrictamente con especies nativas contenidas en los Decretos N° 25663 MINAE del 8 de octubre de 1996 y N° 25700 MINAE del 15 de noviembre de 1996, desembolsados durante un período de tres años.

Los montos pendientes por pagar por contratos de años anteriores, se regirán según lo establecido en los Decretos Ejecutivos respectivos para cada año.

1. Proyectos de Reforestación: Se establecen como zonas prioritarias para la ejecución de proyectos de reforestación las áreas sin bosque en los sitios que presenten un alto potencial productivo para el desarrollo de plantaciones forestales.

• a)Para los proyectos de reforestación con especies contenidas en los decretos de vedas y especies amenazadas o en peligro de extinción (Decreto N° 25663-MINAE del 8 de octubre de 1996 y Decreto N° 25700-MINAE) del 15 de noviembre de 1996, se establece como prioritario todo el país.
• b)Para proyectos de reforestación establecidos en las áreas de protección según el artículo 33 de la Ley Forestal N° 7575, se considerará como prioritario todo el país.
• c)Sitios donde existe un alto potencial de bloques de plantación dando especial prioridad a los proyectos que utilicen material genético mejorado y a los proyectos que utilicen semilla certificada por la Oficina Nacional de Semillas (ONS).
• d)Se podrán incluir áreas en donde se ejecutaron proyectos de reforestación financiados por medio de incentivos o servicios ambientales que hayan cumplido tanto con los planes de manejo aprobados como con su período de vigencia.
• e)Proyectos de reforestación con integración bosque industria.

2. Proyectos de Protección de Bosque: Se establecen como prioridad para la contratación de proyectos de protección de bosque las áreas que cumplan con los criterios que se establecen a continuación y cuya calificación se realizará aplicando la siguiente Matriz de Valoración.

En caso de calificaciones iguales se tramitará según el orden de presentación de las presolicitudes.

3. Proyectos de establecimiento de árboles forestales en Sistemas Agroforestales (SAF): Se establecen como prioritarias para la contratación de proyectos de establecimiento de árboles en SAF las áreas sin bosque con los siguientes criterios:

• a)Tierras con capacidad de uso I, II, III, IV, V, VI, según dispone la Metodología para la Determinación de la Capacidad de Uso de las Tierras en Costa Rica, (Decreto Ejecutivo N° 23214-MAG-MIRENEM. publicado en La Gaceta N° 107 del 6 de junio de 1994).
• b)Áreas para el establecimiento de árboles en convenios específicos con FONAFIFO.
• c)Se dará prioridad a proyectos tramitados por organizaciones que tengan convenio vigente con el FONAFIFO.

4. Proyectos de Regeneración Natural: Se establecen como prioritarias para la contratación de proyectos de regeneración natural las áreas sin bosque con los siguientes criterios:

• a)Proyectos de regeneración natural en pastos y potreros, según lo establecido en los incisos b y c. en áreas definidas como tierras Kyoto u otras que se reconozca un pago adicional por los créditos de carbono que el FONAFIFO pueda comercializar y que hayan sido deforestadas antes del 31 de diciembre de 1989.
• b)Proyectos de regeneración natural en pastos y potreros que se puedan realizar fuera de áreas definidas como tierras Kyoto, con al menos un año de abandono y libres de pastoreo.
• c)Proyectos de regeneración natural con potencial productivo en sitios con al menos un año de abandono y libres de pastoreo.
• d)Para la regeneración natural en las áreas de protección según el artículo 33 de la Ley Forestal N° 7575, se considerará como prioritario todo el país.

5. Proyectos de Manejo de Bosque: Se establecen como prioridades para la contratación de proyectos de manejo de bosque las áreas con el siguiente criterio:

• a)Inmuebles que tienen planes de manejo aprobados por la Administración Forestal del Estado y en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de Procedimientos, Decretos Ejecutivos N° 27388-MINAE publicado el 2 de noviembre de 1998, Decreto N° 30763-MINAE publicado el 9 octubre del 2002 vigente hasta el 16 de junio del 2008 y Decreto Ejecutivo N° 34559-MINAE publicado en La Gaceta N° 115 del 16 de junio del 2008. El SINAC o el regente forestal certificará el cumplimiento de lo establecido en el Plan de Manejo.

En cada una de las Oficinas Subregionales del SINAC y en las Oficinas Regionales del FONAFIFO, se mantendrá un mapa actualizado en físico y en formato digital "shape file", con las áreas prioritarias para ubicar las fincas que apliquen al Programa de Pago por Servicios Ambientales en la modalidad de Protección de Bosque.

para la presentación de sus presolicitudes.

• a)En contratos de Reforestación que incorporen varias especies forestales y con diferentes turnos de cosecha, la vigencia del contrato será igual al de la especie que tenga el turno más largo de cosecha y que éste no exceda de quince años, en cuyo caso este sería el lapso máximo de tiempo de la vigencia. En todos los casos, la vigencia de los contratos de reforestación no puede ser menor a diez x años.
• b)Para contratos de Protección de Bosque la vigencia del contrato será de diez años a partir de su firma.
• c)Para contratos de Manejo de Bosque y en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios. Criterios e Indicadores, Código de Practicas y Manual de Procedimientos, Decretos Ejecutivos N° 27388-MINAE publicado el 2 de noviembre de 1998, Decreto N° 30763-MINAE publicado el 9 octubre del 2002 vigente hasta el 16 de junio del 2008 y el Decreto Ejecutivo N° 34559-MINAE publicado en La Gaceta N° 115 del 16 de junio del 2008. la vigencia del contrato será de diez años a partir de su firma.
• d)Para contratos de Regeneración Natural en potreros y sitios con potencial productivo fuera de áreas definidas como tierras Kyoto, la vigencia del contrato será de diez años a partir de su firma.
• e)Para contratos de Regeneración Natural en los que se comercialice créditos de carbono bajo convenio o proyecto específico, la vigencia del contrato será de diez años a partir de su firma.
• f)Para los contratos en los que se desarrollan Sistemas Agroforestales, la vigencia f del contrato será de cinco años a partir de su firma. En esta modalidad no se realizará la inscripción de la afectación del inmueble ante el Registro de la Propiedad.

Las Oficinas Regionales del FONAFIFO, serán las encargadas de tramitar y verificar el cumplimiento de los requisitos legales y reglamentarios de las solicitudes de pago por servicios ambientales, una vez cumplidos los mismos, elaborarán una resolución de aprobación y remitirán el contrato para su respectiva firma al Director del Fondo Nacional de Financiamiento Forestal.

• a)Los proyectos de Reforestación con áreas menores o iguales a cincuenta hectáreas, podrán recibir el primer pago por adelantado, ya sea tramitado a través de organizaciones o en forma individual. Para estos proyectos, el primer pago del 50% se hará una vez formalizado el contrato con el Estado, siempre y cuando el monto pago esté garantizado según se establezca en el Manual de Procedimientos para el Pago de Servicios Ambientales. En los siguientes años, el pago se distribuirá así: 20% en el segundo año, 15% en el tercer año. 10% en el cuarto año y 5% en el quinto año. Estos pagos se realizan a partir de la fecha promedio de plantación. Los proyectos de reforestación que no reciben pago por adelantado, recibirán el primer pago del 50% una vez formalizado el contrato con el Estado y se certifique por parte del regente forestal el establecimiento de la plantación y su fecha promedio de establecimiento. En los siguientes años el pago se distribuirá así: 20% en el segundo año, 15% en el tercer año, 10% en el cuarto año y 5% en el quinto año. Igualmente los pagos se realizarán a partir de la fecha promedio de plantación.
• b)Los pagos por servicios ambientales para los proyectos de Protección de Bosque, será de un 10% una vez firmado el contrato con el Estado y que se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los pagos subsiguientes serán de un 10% cada año hasta el décimo año, los mismos deberán solicitarse anualmente a partir de la fecha de la firma del contrato, exceptuando los contratos con pagos por año vencido, manteniendo en este último caso, la vigencia del contrato hasta el año del último pago.
• c)En contratos de Manejo de Bosque en los cuales se realizó la cosecha de acuerdo a los Estándares de Sostenibilidad para Manejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de Prácticas y Manual de Procedimientos, Decretos Ejecutivos N° 27388-MINAE publicado el 2 de noviembre de 1998. Decreto N° 30763-MINAE publicado el 9 octubre del 2002 vigente hasta el 16 de junio del 2008 y el Decreto Ejecutivo N° 34559-MINAE, publicado en La Gaceta N° 115 del 16 de junio del 2008;el primer pago del 10% se hará una vez firmado el contrato con el Estado y que se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los pagos subsiguientes serán de un 10% cada año hasta el décimo año, los mismos deberán solicitarse anualmente a partir de la fecha de la firma del contrato.
• d)Para los proyectos de Regeneración Natural, el primer pago del 10% se hará una vez firmado el contrato con el Estado y que se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los pagos subsiguientes serán de un 10% cada año hasta el décimo año, los mismos deberán solicitarse anualmente a partir de la fecha de la firma del contrato.
• e)El pago de servicios ambientales para los proyectos en los que se desarrollen Sistemas Agroforestales se hará una vez firmado el contrato con el Estado y se certifique por parte del regente forestal el establecimiento de los árboles y su fecha promedio de plantación. El primer pago será de un 65% del monto establecido, 20% para en el segundo año y un 15% para en el tercer año, los mismos deberán solicitarse anualmente a partir de la fecha promedio de establecimiento de los árboles.
• f)Estos porcentajes de pago pueden variar de conformidad con acuerdos, convenios o contratos con entidades financiadoras o socios que reconozcan montos diferenciados.

Las condiciones de tales pagos; serán establecidas por los convenios y contratos formalizados para tal efecto.
