This document was approved as a Central American Technical Regulation, RTCA 65.05.34:06 Requirements for the Registration of Commercial Varieties, adopted by the Subgroups on Standardization Measures and Agricultural Inputs, Seed Table. The officialization of this Technical Regulation entails its approval by the Council of Ministers of Economic Integration (COMIECO).

OBJECTIVE To establish the requirements that must be met in order to register a plant variety in the commercial varieties register, thereby authorizing the marketing of its seed. The commercial registration of a variety does not grant any exclusivity in its exploitation to the registrant.

2. SCOPE OF APPLICATION Applies to plant varieties of all crops intended for marketing in these countries.

The State Parties may establish exceptions for plant species, according to their particularities, provided that the exception implies a reduction of requirements, whether in terms of validation (validación), varietal description (descripción varietal), or both.

3. DEFINITIONS 3.1 Varietal description (descripción varietal): detail of the phenotypic and genotypic characteristics that identify a plant variety and allow its distinction from other varieties.

3.2 Validation trial (ensayo de validación): test carried out on a variety, by planting it in the field or greenhouse, in which its characteristics and performance are evaluated under certain environmental conditions and agronomic management.

3.3 Variety (variedad): a set of cultivated plants or individuals that are distinguished by one or more morphological, physiological, cytological, chemical, or other characters of agricultural or industrial significance, and which, when reproduced, maintain their distinctive characteristics of uniformity and stability.

3.4 Registration (registro): administrative technical process through which every application for registration of a commercial variety is evaluated by the competent national authority.

3.5 Commercial varieties register (registro de variedades comerciales): the files of the registered varieties that meet the general requirements of this RTCA for their marketing.

4. COMPETENT NATIONAL ENTITY The surveillance and verification of the application and compliance with this Central American Technical Regulation corresponds to the Phytozoogenetic Area of the Standards and Regulations Unit of the Ministry of Agriculture, Livestock and Food of Guatemala; the Seed Certification Area of the General Directorate of Plant and Animal Health, of the Ministry of Agriculture and Livestock of El Salvador; the Seed Certification Department of the National Agricultural Health Service, Ministry of Agriculture and Livestock of Honduras; the Seed Department of the General Directorate of Agricultural Protection and Health, of the Ministry of Agriculture and Forestry of Nicaragua; and the National Seed Office of Costa Rica, or their successors or entities that in the future are specifically assigned these functions.

5. GENERAL REQUIREMENTS The requirements for registration in the commercial varieties register are:

5.1 Submission of the varietal description (descripción varietal), 5.2 Denomination of the variety. 5.3 Results of at least one cycle of validation trials (ensayos de validación), which may be conducted by recognized regional research programs, by public entities, or private companies authorized by the competent national entity. 5.4 The validation trials (ensayos de validación) must be conducted in at least three locations, in the zones and seasons of greatest commercial production for the crop. The new variety must demonstrate being equal to or superior to the national check in yield, or in any other attribute of agronomic, industrial, nutritional type, or other characteristic of particular interest. 5.5 Varieties must initially be registered in the country where they were developed.

6. GENERAL PROVISIONS 6.1 The varietal description (descripción varietal) will be carried out according to the approved formats (for those species where consensus-based formats exist). For other species, the procedure will be as defined in the corresponding procedures in the Central American countries.

6.2 For registration in the commercial varieties register (registro de variedades comerciales), the formats approved in the Central American countries will be used, which are annexed for this purpose. The validity of the Commercial Variety Registration will be five (5) years for annual and semi-perennial crops and ten (10) years for perennial crops, counted from the date of approval of the application. Once this period has expired, at the request of the interested party, the registration may be renewed for an additional period. Countries will have the authority to remove a variety from the register (registro), in highly qualified cases due to adaptability problems or severe susceptibility to pests of economic importance, for which the corresponding technical support must be presented.

6.3 The application for registration in the register of national commercial varieties or those from third countries may be processed by the owner of the cultivar and/or the breeder, their legal representative in the country where the application is processed, the rights holder, the authorized national distributor, or a public or private research institution.

6.4 Regarding varietal descriptors (descriptores varietales) not included for other species in the annexes, each country will develop the corresponding varietal descriptor, which may be adopted by the other State Parties, after prior consultation.

6.5 The genealogical information related to the progenitors may be of a private nature provided that the company demonstrates the reason why it must be confidential.

7. UPDATING AND REVISION OF THE REGULATION This Technical Regulation will be reviewed and updated upon a duly justified request from any State Party.

8. SURVEILLANCE AND VERIFICATION The surveillance and verification of this technical regulation in the Central American territory corresponds to the competent entities designated in numeral 4.

Este documento fue aprobado como Reglamento Técnico Centroamericano, RTCA 65.05.34:06 Requisitos para el Registro de Variedades Comerciales, adoptado por los Subgrupos de Medidas de Normalización e Insumos Agropecuarios Mesa de Semillas. La oficialización de este Reglamento Técnico, conlleva la aprobación por el Consejo de Ministros de Integración Económica (COMIECO).

OBJETO Establecer los requisitos que deben cumplirse a efectos de inscribir una variedad vegetal en el registro de variedades comerciales, de modo que se faculte la comercialización de su semilla.El registro comercial de una variedad no otorga ninguna exclusividad en la explotación de la misma al registrante.

2. ÁMBITO DE APLICACIÓN Aplica a las variedades vegetales de todos los cultivos que se destinen a la comercialización en estos países.

Los estados partes podrán establecer excepciones para especies vegetales, según sus particularidades, siempre que la excepción implique una disminución de requisitos, ya sea en cuanto a validación, descripción varietal, o ambos.

3. DEFINICIONES 3.1 Descripción varietal: detalle de las características fenotípicas y genotípicas que identifican a una variedad vegetal y que permiten su distinción de otras variedades.

3.2 Ensayo de validación: prueba que se realiza de una variedad, mediante su siembra en campo o invernadero, en el cual se evalúan sus características y comportamiento bajo determinadas condiciones de ambiente y manejo agronómico.

3.3 Variedad: conjunto de plantas o individuos cultivados que se distinguen por uno o más Caracteres morfológicos, fisiológicos, citológicos, químicos u otros de carácter agrícola o industrial y que al ser reproducidos mantienen sus características distintivas de uniformidad y estabilidad.

3.4 Registro: proceso técnico administrativo mediante el cual toda solicitud de registro de una variedad comercial es evaluada por la autoridad nacional competente.

3.5 Registro de variedades comerciales: son los expedientes de las variedades inscritas que cumplen con los requisitos generales de este RTCA para su comercialización.

4. ENTE NACIONAL COMPETENTE Corresponde la vigilancia y verificación de la aplicación y cumplimiento del presente Reglamento Técnico Centroamericano a Área Fitozoogénetica de la Unidad de Normas y Regulaciones del Ministerio de Agricultura, Ganadería y Alimentación de Guatemala; Área de Certificación de Semillas de la Dirección General de Sanidad Vegetal y Animal, del Ministerio de Agricultura y Ganadería de El Salvador; Departamento de Certificación de Semillas del Servicio Nacional de Sanidad Agropecuaria, Ministerio de Agricultura y Ganadería de Honduras; a Departamento de Semillas de la Dirección General de Protección y Sanidad Agropecuaria, del Ministerio Agropecuario y Forestal de Nicaragua y, a la Oficina Nacional de Semillas de Costa Rica, o sus sucesores o entidades que en el futuro se les asigne específicamente estas funciones.

5. REQUISITOS GENERALES Los requisitos para la inscripción en el registro de variedades comerciales son:

5.1 Presentación de la descripción varietal, 5.2 Denominación de la variedad.

5.3 Resultados de al menos un ciclo de ensayos de validación, que podrán ser realizados tanto por programas regionales de investigación reconocidos, por entes públicos o empresa privada autorizada por el ente nacional competente.

5.4 Los ensayos de validación deberán ser realizados en tres localidades como mínimo, en las zonas y épocas de mayor producción comercial del cultivo. La nueva variedad deberá demostrar ser igual o superior al testigo nacional en rendimiento, o bien en cualquier otro atributo de tipo agronómico, industrial, nutricional u otra característica de interés particular.

5.5 Las variedades deberán inscribirse inicialmente en el país donde fueron desarrolladas.

6. DISPOSICIONES GENERALES 6.1 La descripción varietal se realizará de acuerdo a los formatos aprobados (en aquellas especies en que existan formatos consensuados). Para otras especies se procederá según se defina en los procedimientos correspondientes en los países centroamericanos.

6.2 Para la inscripción en el registro de variedades comerciales, se utilizarán los formatos aprobados en los países centroamericanos, los que se anexan para este efecto.La vigencia para el Registro de Variedades Comerciales será de cinco (5) años para cultivos anuales y semiperennes y diez (10) años para cultivos perennes los cuales serán contados a partir de la fecha de aprobación de la solicitud. Vencido este periodo, a solicitud del interesado podrá renovar su registro por un periodo adicional.Los países tendrán la facultad de retirar una variedad del registro, en casos muy calificados por problemas de adaptabilidad, susceptibilidad severa a plagas de importancia económica, para lo cual se deberá presentar el soporte técnico correspondiente, 6.3 La solicitud para la inscripción en el registro de variedades comerciales nacionales o provenientes de terceros países podrá ser tramitada por el propietario del cultivar y/o el obtentor, su representante legal en el país donde se tramite la solicitud, el titular de los derechos, el distribuidor nacional autorizado o institución pública o privada de investigación.

6.4 En cuanto a los Descriptores Varietales no incluidos para otras especies en los anexos cada país elaborará el descriptor varietal correspondiente, el cual podrá ser adoptado por los demás Países Partes, previa consulta.

6.5 La información genealógica relacionada con los progenitores podrá ser de carácter privado siempre y cuando la empresa demuestre la razón por la cual deba de ser confidencial.

7. ACTUALIZACIÓN Y REVISIÓN DEL REGLAMENTO Este Reglamento Técnico será revisado y actualizado a solicitud debidamente justificada de cualquier país parte.

8. VIGILANCIA Y VERIFICACIÓN Corresponde la vigilancia y verificación de este reglamento técnico en el territorio centroamericano, a las entidades competentes designadas en el numeral 4.
