Registration Requirements** **Full Text of Act: DFA82** **No. 36844-MAG-MEIC-COMEX** **THE PRESIDENT OF THE REPUBLIC,** **THE MINISTER OF AGRICULTURE AND LIVESTOCK,** **THE MINISTER OF ECONOMY, INDUSTRY AND TRADE,** **AND THE MINISTER OF FOREIGN TRADE** In accordance with the powers and attributions granted to them by Articles 50, 140 subsections 3), 8), 10), 18), and 20); and 146 of the Political Constitution; Articles 4, 25, 27 paragraph 1, 28 paragraph 2 subsection b) of the General Law on Public Administration, Law No. 6227 of May 2, 1978; Articles 1, 3, 5, 7, 15, 26, 30, 36, 37, 38, 39, 46, 52, and 55 of the Protocol to the General Treaty on Central American Economic Integration, Approval Law No. 7629 of September 26, 1996; and **Whereas:** I.—That the Council of Ministers for Economic Integration (COMIECO), through Resolution No. 265-2011 (COMIECO-LX) dated July 27, 2011, within the framework of the process of forming a Central American Customs Union, approved the "Central American Technical Regulation RTCA 65.05.34:06 Registration of Commercial Varieties. Registration Requirements", in the form that appears as an Annex to the aforementioned resolution.

II.—That in compliance with what is indicated in said resolution, its publication is hereby ordered. Therefore, **They Decree:** **Publication of Resolution No. 265-2011 (COMIECO-LX)** **dated July 27, 2011, and its Annex: Central American Technical** **Regulation RTCA 65.05.34:06 Registration of Commercial Varieties.** **Registration Requirements** **Article 1**—Publish Resolution No. 265-2011 (COMIECO-LX) of the Council of Ministers for Economic Integration dated July 27, 2011, and its Annex: "Central American Technical Regulation RTCA 65.05.34:06 Registration of Commercial Varieties. Registration Requirements", which are transcribed below:

**RESOLUTION No. 265-2011 (COMIECO-LX)** **THE COUNCIL OF MINISTERS FOR ECONOMIC INTEGRATION** **WHEREAS:** That in accordance with Articles 38, 39, and 55 of the Protocol to the General Treaty on Central American Economic Integration—Guatemala Protocol—amended by the Amendment of February 27, 2002, the Council of Ministers for Economic Integration (COMIECO) has under its competence the matters of Central American Economic Integration and, as such, is responsible for approving the administrative acts of the Economic Subsystem; That according to Article 15 of that same regional legal instrument, the State Parties have the commitment to constitute a customs union among their territories, which shall be achieved gradually and progressively, based on programs established for that purpose, approved by consensus; That within the framework of the process of forming the Customs Union, the State Parties have reached important agreements on registration requirements for the registration of commercial varieties, which require the approval of the Council of Ministers for Economic Integration; That the State Parties, in their capacity as Members of the World Trade Organization (WTO), notified the Committee on Sanitary and Phytosanitary Measures and the Committee on Technical Barriers to Trade, in accordance with the provisions of the Agreement on the Application of Sanitary and Phytosanitary Measures and the Agreement on Technical Barriers to Trade, of the Draft Central American Technical Regulation RTCA 65.05.34:06 Registration of Commercial Varieties. Registration Requirements; That the State Parties granted a reasonable period of time to the Member States of the WTO to make observations on the notified draft Regulation, as required by subparagraph d) of numeral 5 of Annex B on Transparency of Sanitary and Phytosanitary Regulations of the Agreement on the Application of Sanitary and Phytosanitary Measures and numeral 4), paragraph 9 of Article 2 of the Agreement on Technical Barriers to Trade, without any observations having been received on the same; That in accordance with both Agreements, the Members shall provide a reasonable period of time between the approval of the technical regulations and their entry into force, in order to give producers time to adapt their products or their production methods to the provisions of this regulation; That in accordance with paragraph 3 of Article 55 of the Guatemala Protocol, the opinion of the Consultative Committee on Economic Integration was requested, without it having pronounced itself on the matter, **THEREFORE:** Based on the provisions of Articles 1, 3, 5, 7, 15, 26, 30, 36, 37, 38, 39, 52, and 55 of the Guatemala Protocol, **RESOLVES:** 1. Approve the Central American Technical Regulation RTCA 65.05.34:06 REGISTRATION OF COMMERCIAL VARIETIES. REGISTRATION REQUIREMENTS.

2. The approved Central American Technical Regulation appears as an Annex to this Resolution and forms an integral part thereof.

3. This Resolution shall enter into force on January 27, 2012, and shall be published by the State Parties. Comalapa, Republic of El Salvador, July 27, 2011.

I.-Que el Consejo de Ministros de Integración Económica (COMIECO), mediante resolución Nº 265-2011 (COMIECO-LX) de fecha 27 de julio del 2011, en el marco del proceso de conformación de una Unión Aduanera Centroamericana, aprobó el "Reglamento Técnico Centroamericano RTCA 65.05.34:06 Registro de Variedades Comerciales. Requisitos de Inscripción", en la forma en que aparece como Anexo de la resolución en mención.

II.-Que en cumplimiento de lo indicado en dicha resolución, se procede a su publicación. Por tanto,
