in the entirety of the text - Complete Text of Regulation 36828 Creation of the national mixed forum and of the regional mixed forums of organizations of small and medium-scale producers and of the public agricultural sector Complete Text record: 10B3B2 N° 36828-MAG (This executive decree was repealed by Article 27 of Executive Decree N° 39483 of December 2, 2015, "Creates the National Mixed Forum of the Regional Mixed Forums of Organizations of small and medium-scale producers and of the Public Agricultural Sector") THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Based on the powers granted to them by Articles 140 subsections 3) and 18) and 146 of the Political Constitution; Articles 25 and 27 subsection 1) and 28 subsection 2, item b) of Law No. 6227, General Law of the Public Administration of May 2, 1978, Law No. 7064, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, of April 29, 1987, and;
I.-That the Government of the Republic has established in its policy the principle of inclusion with ethnic and gender equity for broad access by individuals and groups to resources and services and to the possibility of expressing themselves politically, with citizen freedom in decision-making as a guiding principle of agricultural policy.
II.-That the State Policy for the Agri-food Sector and Costa Rican Rural Development 2010-2021 constitutes the framework for action for this sector.
III.-That there is a need to promote dialogue and the search for consensus in decision-making processes on strategic topics of interest to organizations of small and medium-scale producers and rural youth, in order to obtain the greatest social benefit and economic growth.
IV.-That it is necessary to have a body for work, dialogue, and consensus-building for decision-making at the national and regional levels, which facilitates joint negotiation on the demands of organized small and medium-scale producers and guides the supply of services from public institutions, to jointly construct relevant solutions. Therefore, THEY DECREE:
CREATION OF THE NATIONAL MIXED FORUM AND OF THE REGIONAL MIXED FORUMS OF ORGANIZATIONS OF SMALL AND MEDIUM-SCALE PRODUCERS AND OF THE PUBLIC AGRICULTURAL SECTOR
Considering:

SEPSA: Executive Secretariat for Agricultural Sector Planning (Secretaría Ejecutiva de Planificación Sectorial Agropecuaria).

d)To analyze and propose a solution, through a national agenda, for all those matters in the regional scope of the Agri-food Sector that are not resolved in that scope.

A quorum shall exist whenever a majority of its members are present and, among these members, the representatives of at least four regions are present.

Its functions include the following activities:
a)Preparing the respective agendas and issuing the notice of meeting to all the Forum members.
b)Preparing the minutes of the ordinary and extraordinary sessions of the National Mixed Forum.
c)Monitoring the agreements reached in the ordinary and extraordinary sessions.
d)Preparing periodic monitoring and compliance reports on the agreements reached in the National Mixed Forum.
e)Coordinating with any other public or private body the requests or agreements reached by the National Mixed Forum for their fulfillment.
f)Submitting to the National Agricultural Sector Council (Consejo Nacional Sectorial Agropecuario, CAN) the agreements of a national nature for the issuance of the corresponding directives to each institution according to its competence.

a)To constitute a regional space for work, dialogue, and consensus-building to inform, analyze, and propose actions for the development of the Agri-food Sector.

II.-Que la Política de Estado del Sector Agroalimentario y el Desarrollo Rural Costarricense 2010-2021, constituye el marco de acción para este sector.
III.-Que existe la necesidad de impulsar el diálogo y la búsqueda del consenso en los procesos de toma de decisiones sobre temas estratégicos de interés para las organizaciones de pequeños y medianos productores, productoras y juventud rural, para así obtener el mayor beneficio social y el crecimiento económico.
IV.-Que es necesario contar con una instancia de trabajo, diálogo y concertación para la toma de decisiones en los ámbitos nacional y regional, que facilite la negociación conjunta sobre las demandas de los pequeños y medianos productores organizados y oriente la oferta de servicios de las instituciones públicas, para construir en forma las soluciones pertinentes. b)Gestionar soluciones conjuntas público-privadas a los diversos problemas de índole nacional que afectan el desarrollo agro productivo nacional, para mejorar la calidad de vida de los pequeños y medianos productores.
c)Impulsar programas y proyectos de inversión que mejoren el desempeño de las economías rurales en los territorios.
d)Analizar y proponer solución mediante una agenda nacional a todos aquellos asuntos del ámbito regional del Sector Agroalimentario, que no sean resueltos en dicho ámbito.

Existirá quórum siempre que se encuentren presentes la mitad más uno de sus miembros y dentro de estos miembros estén presentes los representantes de al menos cuatro regiones.

Dentro de sus funciones están las siguientes actividades:
a)Elaborar las respectivas agendas y hacer la convocatoria a todos los integrantes del Foro.
b)Elaborar las actas de las sesiones ordinarias y extraordinarias del Foro Nacional Mixto.
c)Dar seguimiento a los acuerdos tomados en las sesiones ordinarias y extraordinarias.
d)Preparar informes periódicos de seguimiento y cumplimiento de los acuerdos tomados en el Foro Nacional Mixto.
e)Coordinar con cualquier otra instancia pública o privada las peticiones o acuerdos tomados por el Foro Nacional Mixto para su cumplimiento.
f)Elevar a instancia del Consejo Nacional Sectorial Agropecuario (CAN), los acuerdos de índole nacional para la emisión de las directrices que correspondan a cada institución según su competencia.

a)Constituir un espacio regional de trabajo, diálogo y concertación para informar, analizar y proponer acciones para el desarrollo del Sector Agroalimentario.
b)Construir soluciones conjuntas a los diversos problemas de índole regional que afectan la gestión del desarrollo agro productivo y de las economías en los territorios rurales.
c)Fortalecer el crecimiento de la organización social en la región, que permita aumentar los niveles de competitividad para aprovechar las oportunidades que ofrece la apertura de mercados.
d)Impulsar programas y proyectos de desarrollo que aseguren el crecimiento económico y social de los territorios rurales.

El período del nombramiento del representante regional será de dos años.

a)Elaborar conjuntamente con el representante del Foro Regional Mixto las respectivas agendas y apoyar en el proceso de convocatoria a todos los integrantes del Foro.
b)Elaborar las actas de las sesiones ordinarias y extraordinarias del Foro Regional Mixto.
c)Dar seguimiento a los acuerdos tomados en las sesiones ordinarias y extraordinarias.
d)Preparar informes periódicos de seguimiento y cumplimiento de los acuerdos tomados en el Foro Regional Mixto.
e)Coordinar con cualquier otra instancia pública o privada las peticiones o acuerdos tomados por el Foro Regional Mixto para su cumplimiento.
f)Elevar al Comité Sectorial Regional Agropecuario los acuerdos para la emisión de las directrices que correspondan a cada Institución según su competencia.
