General Provisions

CHAPTER I

Maintenance: all those technical and artisanal activities, as well as the financial cost incurred by the Municipality, through its various departments, for the upkeep of the parks located in the districts of its jurisdiction where the service is provided.

Municipality: Municipality of Osa.

Park or green zone: all those publicly owned real estate assets that serve as a recreation and leisure area for the citizenry and that have or are subject to having public services and urban facilities, such as telephone service, potable water (drinking fountains), benches, children's playground equipment, among others. These sites are freely accessible to all inhabitants of the country, who, when using them, have the obligation to keep them in the best possible condition. Within these sites, one shall not:

a)Destroy the lawns, shrubs, or trees planted in them.
b)Destroy the ornamental works placed in them.

Its calculation is governed in accordance with the model established in article 74 of the Municipal Code.

In accordance with what is indicated in article 2 of this Regulation.

CAPÍTULO I

Disposiciones generales

Mantenimiento: toda aquella actividad técnica y artesanal, así como el costo financiero que realiza la Municipalidad, a través de sus distintas dependencias para la atención de los parques ubicados en los distritos de su jurisdicción en donde se preste el servicio.

Municipalidad: Municipalidad de Osa.

Parque o zona verde: todo aquel bien inmueble de dominio público que sirva como área de recreo y esparcimiento para la ciudadanía y que cuenta o es sujeto de tener servicios públicos y facilidades urbanísticas, tales como telefonía, agua potable (bebederos), bancas, juegos infantiles, entre otros. Estos sitios, son de libre acceso a todos los habitantes del país, los que al usarlos tienen la obligación de conservarlos en el mejor estado posible. Dentro de estos sitios no se deberá:

a)Destruir los prados, arbustos o árboles que están en ellos plantados.
b)Destruir las obras de ornato que en estos estén colocadas.

Su cálculo se rige de conformidad con el modelo establecido en el artículo 74 del Código Municipal.

CAPÍTULO II

De conformidad con lo indicado en el artículo 2º de este Reglamento.

Artículo 1 — —For the purposes of this regulation, the following terms are defined:

Artículo 2 — —The park maintenance service considers the effective cost of what is invested by the Municipality, which is distributed according to the number of taxpayers in the districts of the canton of Osa.

Artículo 3 — —The liable party for this rate is every taxpayer in the districts of the canton of Osa, even if they do not demonstrate an interest in the service.

Artículo 5 — —When public events are authorized in said places for reasons of general interest, the necessary precautionary measures must be taken so that the greater influx of people to them does not cause detriment to the trees, plants, or urban furniture.

Artículo 6 — —The Municipality shall collect a rate for the concept of park and green zone maintenance from all taxpayers in the districts of the canton of Osa.

Artículo 7 — —The amount of this rate is determined by taking into consideration the effective cost of what is invested by the Municipality for its maintenance, increased by ten percent profit for its development.

Artículo 8 — —This rate must be paid by the liable party referred to in article 20 of this Regulation.

Artículo 9 — —The Municipality shall collect this rate from the liable parties, quarterly and by means of a single receipt that will be issued for this purpose.

Artículo 10 — —Delay in the payment of this rate shall generate interest that will be calculated as established in the Tax Code of Norms and Procedures.

Artículo 11 — —In accordance with article 70 of the Municipal Code, debts for municipal taxes shall constitute a preferential legal mortgage over the respective properties.

Artículo 12 — —This rate comes into effect 30 business days after its publication in the Official Gazette La Gaceta.

Artículo 13 — —This regulation is approved unanimously and definitively by the Municipal Council of Osa, in the acta of extraordinary session No.

Artículo 1 — Para efectos del presente reglamento se definen los siguientes términos:

Artículo 2 — El servicio de mantenimiento de parques considera el costo efectivo de lo invertido por la Municipalidad, el cuál se distribuye de acuerdo al número de contribuyentes de los distritos del cantón de Osa.

Artículo 3 — Es sujeto pasivo de esta tasa es todo contribuyente de los distritos del cantón de Osa, aunque éste no demuestre interés en el servicio.

Artículo 5 — Cuando por motivos de interés general se autoricen en dichos lugares actos públicos, se deberán tomar las medidas previsoras necesarias para que la mayor afluencia de personas a los mismos no cause detrimento en los árboles, plantas o mobiliario urbano.

Artículo 6 — La Municipalidad, cobrará una tasa por concepto de mantenimiento de parques y zonas verdes a todos los contribuyentes de los distritos del cantón de Osa.

Artículo 7 — El monto de esta tasa se determina tomando en consideración el costo efectivo de lo invertido por la Municipalidad para su mantenimiento, incrementándose en un diez por ciento de utilidad para su desarrollo.

Artículo 8 — Esta tasa deberá pagarla el sujeto pasivo a que se refiere este Reglamento en su artículo 20.

Artículo 9 — El cobro de esta tasa lo hará la Municipalidad a los sujetos pasivos, por trimestre y mediante un único recibo que se emitirá para tal efecto.

Artículo 10 — El atraso en el pago de esta tasa generará intereses que se calcularan según lo establecido en el Código de Normas y Procedimientos Tributarios.

Artículo 11 — De conformidad con el artículo 70 del Código Municipal, las deudas por tributos municipales constituirán hipoteca legal preferente sobre los respectivos inmuebles.

Artículo 12 — Esta tasa rige 30 días hábiles después de su publicación en el Diario Oficial La Gaceta.
