in the entirety of the text - Full Text of Norm 36803 Transfers from the “Fund for the Financing of Credit for Banana Rehabilitation due to damages caused by Natural Phenomena” regulated by DE-34984-H-MAG to the “Banana Contingency Fund,” regulated by DE-17890-H-MAG Full Text of Record: 13203F No. 36803-H-MAG (This Executive Decree was repealed by Article 3, subparagraph m) of Executive Decree No. 42037 of November 8, 2019, "Creation of the Fund for the prevention, exclusion, and combat against Fusarium oxysporum f.sp cubense Tropical Race 4 and other pests and diseases affecting banana cultivation and repeal of the banana contingency fund") THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF FINANCE, AND AGRICULTURE AND LIVESTOCK Using the powers established in articles 140, subsections 3) and 18) and 146 of the Political Constitution, Law No. 6227 of May 2, 1978, Law No. 5515 of April 19, 1974, and Law No. 4895 of November 16, 1971, and their amendments.
1°.- That Law 5515, which establishes a tax of one United States dollar ($1.00) on each box or container of bananas of 40 net pounds that is exported, provides that part of the proceeds of this tax may be allocated to the banana producer.
2°.- That by Executive Decree No. 17890-H-MAG of September 29, 1987, the Banana Contingency Fund was established, which was formed "with US$0.01 that, in accordance with Article 11 of Executive Decree No. 16563-MAG, of September 24, 1985, amended by Article 8 of Executive Decree No. 18995-P-MAG-MEC-H-MOPT, of May 8, 1989, banana producers will donate for each box of bananas exported; with the sum corresponding to 50% of the tax paid on the number of boxes of bananas exported beyond the goals set by Article 5 of Executive Decree No. 16.564-P-H-MEC, of September 24, 1985; and with any other resources, internal or external, that the Executive Branch decides to allocate to increase this Fund." (underlining not in the original) 3°.- That by Executive Decree No. 29594-MAG-H of May 31, 2001, an amendment to Executive Decree No. 17890-H-MAG of September 29, 1987, was ordered, so that with the resources of the Banana Contingency Fund, "financial support could be provided to farms owned by cooperatives that are held in trust by a subsidiary of Corbana or banana farms foreclosed or in the process of foreclosure by banks that are members of the National Banking System and that are administered by a subsidiary of Corbana. The resources made available to the subsidiary of this public entity may be used for the normal operation required by a banana farm (payment of wages, social security contributions, employment benefits, suppliers, etc.), until June 30, 2001. These resources will not be reimbursable. Corbana's subsidiary will be responsible for channeling the resources in a technical manner according to the needs of the farms. Likewise, due to the purposes for which these resources are allocated, the provisions of Article 9 of Executive Decree No. 19705-MAG-H of March 30, 1990, and its amendments, shall not apply, nor shall any of the provisions of the latter, particularly those regarding credit that are incompatible with the provisions of this subsection. It is authorized that these resources be used to pay Corbana the sums it transferred to FIBASUR in order to keep the farms in operation as of April 1, 2001." (underlining not in the original) 4°.- That at that time, everything corresponding to the normal operation of the farms was paid, but the debts accumulated with the Caja Costarricense de Seguro Social were not paid, because the Fund's money was insufficient for that; considering that the obligations of said Fund had to be met according to its purposes.
5°.- That to date, according to a certification issued by the Caja Costarricense de Seguro Social, the employer FIDUCIARIA BANANERA DEL SUR S.A. is inactive, and with payrolls registered in its name from July 1995 to June 2011, and pending payment for employer contributions and interest, contributions of the Worker Protection Law and interest, judicial collection costs, and fees, under the following employer numbers and names: 2-03101122833-180-001 FIDUCIARIA BANANERA DEL SUR S.A.; 2-03101122833-180-002 FIBASUR COOPEADELANTE R.L.; 2-03101122833-180-003 FIBASUR S.A. 1°.- Que la ley 5515, que establece un impuesto de un dólar de los Estados Unidos de América ($ 1.00) sobre cada caja o envase de banano de 40 libras netas que se exporte, dispone que parte del producto de este impuesto podrá destinarse al productor de banano.
2°.- Que mediante Decreto Ejecutivo N° 17890-H-MAG de 29 de septiembre de 1987, se estableció el Fondo de Contingencias Bananeras, que se conformó "con USS 0,01 que de conformidad con el artículo 11 del decreto ejecutivo N° 16563-MAG, del 24 de setiembre de 1985, reformado por el artículo 8° del decreto ejecutivo N° 18995-P-MAG-MEC-H-MOPT, del 8 de mayo de 1989, donarán los productores de banano por cada caja de banano exportada; con la suma que corresponda al 50% del impuesto que se pagare por el número de cajas de banano que se llegaran a exportar más allá de las metas fijadas por el artículo 5° del decreto ejecutivo N° 16.564-P-H-MEC, del 24 de setiembre de 1985; y con cualesquiera otros recursos, internos o externos, que el Poder Ejecutivo decida destinar a engrosar este Fondo." (subrayado no es del original) 3°.- Que mediante el Decreto Ejecutivo N° 29594-MAG-H de 31 de mayo del 2001, se dispuso una modificación al Decreto Ejecutivo N° 17890-H-MAG de 29 de septiembre de 1987, a efecto de que con los recursos del Fondo de Contingencias Bananeras, se pudiera "brindar apoyo financiero a las fincas propiedad de cooperativas que se encuentran entregadas en fideicomiso a una subsidiaria de Corbana o las fincas bananeras rematadas o en proceso de remate por parte de bancos integrantes del Sistema Bancario Nacional y que se encuentren administradas por una subsidiaria de Corbana. Los recursos puestos a disposición de la subsidiaria de este último ente público podrán ser utilizados para la operación normal que demande una finca bananera (pagos salarios, cargas sociales, prestaciones laborales, proveedores, etc), hasta el 30 de junio del año 2001. Estos recursos no serán reembolsables. La subsidiaria de Corbana será la encargada de canalizar los recursos en forma técnica conforme a las necesidades de las fincas. Asimismo, por los fines a los que se destinan estos recursos no se aplicará lo dispuesto en el artículo 9 del Decreto Ejecutivo Nº 19705-MAG-H del 30 de marzo de 1990 y sus reformas, así como ninguna de las disposiciones de este último, particularmente las de crédito que sean incompatibles con lo dispuesto en este inciso. Se autoriza para que con estos recursos se cancele a Corbana, las sumas que traspasó a FIBASUR con el fin de mantener las fincas en operación a partir del 1º de abril del año 2001." (subrayado no es del original) 4°.- Que en aquel momento se pagó todo lo correspondiente a la operación normal de las fincas, más no se pagaron las deudas acumuladas con la Caja Costarricense de Seguro Social, porque el dinero del Fondo era insuficiente para ello; tomando en cuenta que se tenían que atender las obligaciones de dicho Fondo de acuerdo con sus cometidos.
5°.- Que a la fecha, según certificación emitida por la Caja Costarricense de Seguro Social, el patrono FIDUCIARIA BANANERA DEL SUR S.A., se encuentra inactivo, y con planillas registradas a su nombre de julio de 1995 a junio de 2011, y pendientes de pago por concepto de cuotas patronales e intereses, cuotas de la Ley de Protección al Trabajador e intereses, gastos de cobro judicial y honorarios, bajo los siguientes números y nombres patronales: 2-03101122833-180-001 FIDUCIARIA BANANERA DEL SUR S.A.; 2- 03101122833-180-002 FIBASUR COOPEADELANTE R.L.; 2 03101122833-180-003 FIBASUR S.A.
