in the entirety of the text - Full Text of Norm 36681 Creates the Tapiria National Wildlife Refuge, State category Full Text of record: DD773 No. 36681-MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In exercise of the powers conferred by article 140, subsections 3) and 18) of the Political Constitution; articles 82 and 87 of the Wildlife Conservation Law, No. 7317 of October 30, 1992; articles 35 and 36 of the Organic Law of the Environment, No. 7554 of October 4, 1995; articles 11 and 27 of the General Law of Public Administration, No. 6227 of May 2, 1978; article 22 of the Biodiversity Law, No. 7788 of April 30, 1998, and articles 12, 71, and 72 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE of March 11, 2008.
Considering:
4-213189-000, located in the district of Puerto Viejo, canton of Sarapiquí, province of Heredia, with an area of one million two hundred ninety-five thousand seven hundred seventy-one square meters and twenty-seven square decimeters (129 ha 5771.27 m²) and cadastral map number H-0622239-2000.
10.—That it is the function of the National System of Conservation Areas to carry out the administration of wildlife and the recommendation of measures that ensure the perpetuity of species, in accordance with article 22 of the Biodiversity Law, No. 7788.
11.—That having analyzed the objectives pursued by the declaration of the Tapiria National Wildlife Refuge (Refugio Nacional de Vida Silvestre Tapiria), it has been determined that they are in accordance with the requirements for creating new protected wilderness areas, set forth in article 36 of the Organic Law of the Environment, No. 7554.
12.—That the provisions of articles 71 and 72 of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE, were complied with.
13.—That in accordance with article 12, subsection b) of the Regulation to the Biodiversity Law, Executive Decree No. 34433-MINAE, the National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación, CONAC), in ordinary session No. 03-2010, held on April 19, 2010, through Agreement No. 21, approved the creation of the Tapiria National Wildlife Refuge, of state category. Therefore, They decree:
"CREATION OF THE TAPIRIA NATIONAL WILDLIFE REFUGE, STATE CATEGORY"
3347-1, Lambert projection coordinates 278-280 and 532-534 of the basic map of Costa Rica scale 1:50,000, edition 2 of the National Geographic Institute (IGN), and whose boundary details are described as follows: north, Hilario Peralta Peralta; south, Blas Mendoza Bustos; east, public road and IDA; and to the west, public road and El Toro S. A.
7788 and its Regulation, the Cordillera Volcánica Central Conservation Area may grant concessions or use permits for the provision of non-essential services to be offered in the Tapiria National Wildlife Refuge.

Considerando:
10.-Que es función del Sistema Nacional de Áreas de Conservación la administración de la vida silvestre y la recomendación de las medidas que aseguren la perpetuidad de las especies, de conformidad al artículo 22 de la Ley de Biodiversidad, Nº 7788.
11.-Que analizados los objetivos que persigue la declaratoria del Refugio Nacional de Vida Silvestre Tapiria, se ha determinado que los mismos son acordes a los requisitos para crear nuevas áreas silvestres protegidas, consignados en el artículo 36 de la Ley Orgánica del Ambiente, Nº 7554.
12.-Que se cumplió con lo dispuesto en los artículos 71 y 72 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE.
13.-Que de conformidad al artículo 12, inciso b) del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE, el Consejo Nacional de Áreas de Conservación (CONAC), en sesión ordinaria Nº 03-2010, celebrada el día 19 de abril del 2010, mediante Acuerdo Nº 21 aprobó la creación del Refugio Nacional de Vida Silvestre Tapiria, de categoría estatal. Por tanto,
