in the entirety of the text - Complete Text of Regulation 36750 Reform of the Transitory Procedure for the Technical Vehicle Inspection of Small and Medium Agricultural Producers Complete Text of acta: DD534 Nº 36750-MOPT-MAG THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF AGRICULTURE AND LIVESTOCK AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT Exercising the powers established in articles 140, subsections 3) and 18) and 146 of the Political Constitution, Law Nº 6227 of May 2, 1978, General Law of Public Administration, Law Nº 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and based on the provisions of Law Nº 7331, Law of Transit on Public Land Routes and its reforms.

1. 1That according to the Land Service of the Directorate of Land and Water Development (AGLL) of the FAO, on carbon sequestration within the framework of its program for integrated planning and management of land resources for sustainable rural development, "agricultural soils are among the largest carbon sinks on the planet with the potential to extend carbon sequestration (CS) and thus provide the possibility of mitigating the ever-increasing atmospheric concentration of CO2. Within the Kyoto Protocol and the subsequent discussions of the Committee of the Parties, there are a number of elements that make carbon sequestration in agricultural and forest lands a valid strategy to mitigate the increase in the atmospheric concentration of greenhouse gases. Article 3.4 of the Kyoto Protocol may allow the expansion of human-induced activities of carbon sinks. The recent post-Kyoto agreements consider sinks in soils in countries, recognizing the substantial potential of agriculture, grazing lands, and forests to sequester carbon and the need to generate national credit possibilities to develop agricultural carbon sinks in the soil."
2. 2That according to the same Food and Agriculture Organization of the United Nations, in its book Agricultural Production Systems and Poverty, "Small farmers produce much of the food in the developing world; however, they tend to be much poorer than the rest of the population in those countries, and have less food security even than the urban poor."
3. 3That since the entry into force of the Technical Vehicle Inspection, this Agricultural Sector has been affected, regarding its work vehicles, since these have lacked investment, maintenance, and renewal for many years, due to the difficult economic and physical conditions of the environment in which they carry out their activities; however, they have acquired vehicles of more recent models to adapt to their needs, so it is necessary to modify the transitory procedure to exclude the vehicle emissions test in the Technical Vehicle Inspection for vehicles belonging to small and medium agricultural producers.
4. 4That on the other hand, this Sector has a very slight impact on the environmental pollution generated by vehicles, given that, rather, agricultural soils are among the largest carbon sinks on the planet with the potential to extend carbon sequestration (CS) and thus provide the possibility of mitigating the ever-increasing atmospheric concentration of CO2. Therefore,

Considering:

en la totalidad del texto - Texto Completo Norma 36750 Reforma Procedimiento Transitorio para la Revisión Técnica Vehicular de los Pequeños y Medianos productores agropecuarios Texto Completo acta: DD534 Nº 36750-MOPT-MAG LA PRESIDENTA DE LA REPÚBLICA, LA MINISTRA DE AGRICULTURA Y GANADERÍA Y EL MINISTRO DE OBRAS PÚBLICAS Y TRANSPORTES En ejercicio de las facultades establecidas en los artículos 140, incisos 3) y 18) y 146 de la Constitución Política, la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, la Ley Nº 7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, y con fundamento en los dispuesto en la Ley Nº 7331, Ley de Tránsito por Vías Públicas Terrestres y sus reformas.

1. 1Que según el Servicio de Tierras de la Dirección de Desarrollo de Tierras y Aguas (AGLL) de la FAO, sobre el secuestro de carbono dentro del marco de su programa de planificación y manejo integrado de los recursos de la tierra para el desarrollo rural sostenible, "los suelos agrícolas están entre los sumideros de carbono más grande del planeta con potencial para extender el secuestro de carbono (SC) y proporcionar así la posibilidad de mitigar la concentración atmosférica de CO2 en incesante crecimiento. Dentro del Protocolo de Kyoto y en las discusiones subsiguientes del Comité de las Partes, hay un cierto número de elementos que hacen que el secuestro de carbono en las tierras agrícolas y forestales constituya una estrategia válida para mitigar el incremento de la concentración atmosférica de los gases de invernadero. El artículo 3.4 del Protocolo de Kyoto puede permitir la expansión de actividades inducidas por el hombre de los sumideros de carbono. Los recientes acuerdos post-Kyoto consideran los sumideros en los suelos en los países, reconociendo el potencial sustancial de la agricultura, las tierras de pastoreo y los bosques para, secuestrar carbono y la necesidad de generar posibilidades de créditos nacionales para desarrollar los sumideros de agrícolas de carbono en el suelo."
2. 2Que según la misma Organización de las Naciones Unidas para la Agricultura y la Alimentación, en su libro Sistemas de Producción Agropecuaria y Pobreza, "Los pequeños agricultores producen gran parte de los alimentos del mundo en desarrollo, sin embargo, suelen ser mucho más pobres que el resto de la población de esos países, y tienen menos seguridad alimentaria incluso que los sectores urbanos pobres."
3. 3Que desde la entrada en vigencia de la Revisión Técnica Vehicular, se ha afectado a este Sector Agrícola, en cuanto sus vehículos de trabajo, ya que éstos han carecido de inversión, mantenimiento y renovación por muchos años, lo anterior dadas las difíciles condiciones económicas y físicas del medio en el cual se desempeñan sus actividades, sin embargo, éstos han adquirido vehículos de modelos más recientes para que se adapten a sus necesidades, por lo que se requiere modificar el procedimiento transitorio para excluir de la prueba de emisiones de gases en la Revisión Técnica Vehicular los vehículos pertenecientes a los pequeños y medianos productores agropecuarios.
4. 4Que por otra parte, este Sector tiene un impacto muy leve en la contaminación ambiental generada por los vehículos, dado que más bien los suelos agrícolas están entre los sumideros de carbono más grandes del planeta con potencial para extender el secuestro de carbono (SC) y proporcionar así la posibilidad de mitigar la concentración atmosférica de CO2 en incesante crecimiento. Por tanto,
