1. 1That on the ninth day of May, two thousand eleven, Executive Decree No. 36499-S-MINAET, “Reglamento para la elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica,” was published in La Gaceta Number 88, the purpose of which is to establish the guidelines so that all institutions of the Public Administration (Administración Pública) may formulate, update, and implement an Institutional Environmental Management Program (Programa de Gestión Ambiental Institucional, “PGAI”).
2. 2That article 4 of the aforementioned regulation states that a Technical Evaluation Commission (Comisión Técnica Evaluadora, “CTE”) shall be formed, responsible for the review and monitoring of the PGAI.
3. 3That articles 9 and 13 of the regulation cited above state that the MINAET, via administrative resolution, shall define through the CTE of the PGAI the guidelines, manuals, guides, and other instruments based on which the institutions of the Public Administration shall prepare their PGAI and their progress reports.
4. 4That in Regular Meeting (Reunión Ordinaria) Number One-Record 01-2011 of the CTE of the PGAI, its formation was validated, and it was agreed to proceed with the approval and officialization of the Guide and the instruments necessary for the preparation of Environmental Management Programs in the Public Sector of Costa Rica. Therefore,

THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS

1º-To officialize the Guide and the instruments necessary for the preparation of Environmental Management Programs in the Public Sector of Costa Rica, in accordance with what is set forth in articles 9 and 13 of Executive Decree No. 36499-S-MINAET, “Reglamento para la elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica.” 2º-The aforementioned guide shall be published on the site www.digeca.go.cr (Note from Sinalevi: The Guide and the Instruments necessary for the preparation of Environmental Management Programs in the Public Sector of Costa Rica must be consulted in the system independently) 3º-Let this resolution be communicated and published in the Official Journal La Gaceta.

1. 1Que el día nueve de mayo de dos mil once, se publicó en La Gaceta Número 88 el Decreto Ejecutivo Nº 36499-S-MINAET "Reglamento para la elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica", cuyo objeto es establecer los lineamientos para que todas las instituciones de la Administración Pública logren formular, actualizar e implementar un Programa de Gestión Ambiental Institucional "PGAI".
2. 2Que en el artículo 4 del reglamento citado supra señala que se conformará una Comisión Técnica Evaluadora "CTE", encargada de la revisión y seguimiento de los PGAI.
3. 3Que los artículos 9 y 13 del reglamento citado anteriormente, señalan que el MINAET, vía resolución administrativa, definirá a través de la CTE de los PGAI los lineamientos, manuales, guías y otros instrumentos con base en los cuales las instituciones de la Administración Pública elaborarán sus PGAI y sus informes de avance.
4. 4Que en la Reunión Ordinaria Número Uno-Acta 01-2011 de la CTE de los PGAI, se validó la conformación de ésta, y se acordó a proceder con la aprobación y oficialización de la Guía y los instrumentos necesarios para la elaboración de Programas de Gestión Ambiental en el Sector Público de Costa Rica. Por tanto,

El MINISTRO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES

1º-Oficializar la Guía y los instrumentos necesarios para la elaboración de los Programas de Gestión Ambiental en el Sector Público de Costa Rica, de acuerdo a lo consignado en los artículos 9 y 13 del Decreto Ejecutivo Nº 36499-S-MINAET "Reglamento para la elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica".

2º-La anterior guía estará publicada en el sitio www.digeca.go.cr (Nota de Sinalevi: La Guía y los Instrumentos necesarios para la elaboración de los Programas de Gestión Ambiental en el Sector Públicó de Costa Rica, debe consultarse en el sistema en forma independiente) 3º-Comuníquese y publíquese esta resolución en el Diario Oficial La Gaceta.
