in the entirety of the text - Full Text of Norm 36574 Declares of public interest the activities aimed at the investigation, conservation and dissemination of the Santa Elena Peninsula in Guanacaste Full Text record: DC750 N° 36574-MINAET THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS In accordance with the provisions of Articles 50, 140, subsections 3), 18) and 146 of the Political Constitution, Articles 4, 11, 25, 27 paragraph 1, 28 paragraph 2 subsection b) of the General Law of Public Administration and the Convention for the Protection of the World Cultural and Natural Heritage, ratified by Law 5980 of November 16, 1976.

Considering:

60/192 of February 20, 2006 adopted by the General Assembly of the United Nations System, which declares the triennium 2007-2009, and specifically 2008 as the International Year of Planet Earth, recognize the importance for humanity of education and knowledge of Earth Sciences as a tool for the sustainable use of natural resources and to build an essential infrastructure for sustainable development.

Furthermore, it constitutes a parameter that must be included in the evaluation and management of natural areas.

10.-That these geological terrains are exposed on the surface of the Santa Elena Peninsula, along the coastline that covers the bays of Cuajiniquil, Santa Elena, Playa Blanca, Potrero Grande, Nancite, and Naranjo, as well as the Murciélago Islands Archipelago. These terrains cover the sector bounded by the coordinates 10°45' and 10°57' North latitude, and 85°40' and 86°00' West longitude.

11.-That these are exceptional facts that must be recognized as natural, scientific, and historical heritage of the Nation.

12.-That it is highly of national convenience and public interest to promote the observation of and to deepen the understanding and study of these facts and features, as well as to highlight the geological beauty, its value as natural heritage, and its potential for tourism and landscape enjoyment. In the same manner, it serves an educational purpose, by highlighting this knowledge related to the geological history of the country and disseminating it at the community, national, and world levels.

13.-The preservation of this heritage does not entail the implementation of additional measures or prohibitions to those already existing, nor will it restrict the development of the zone from a tourist and economic point of view.

14.-That Article 50 of the Political Constitution establishes the State's obligation to defend and guarantee a healthy and ecologically balanced environment; therefore, there exists a public interest and a commitment by the State to issue the legal measures that help to preserve and conserve that heritage, which becomes a common good of humanity. Therefore, They decree:

It shall take effect from its publication in the Official Gazette La Gaceta.

Considerando:

10.-Que estos terrenos geológicos se encuentran expuestos en la superficie de la Península de Santa Elena, a lo largo del litoral que cubre las bahías de Cuajiniquil, Santa Elena, Playa Blanca, Potrero Grande, Nancite y Naranjo, así como el Archipiélago de las Islas Murciélago. Estos terrenos cubren el sector delimitado por las coordenadas 10°45' y 10°57' latitud Norte, y 85°40' y 86°00' longitud Oeste.

11.-Que estos son hechos de carácter excepcional que deben ser reconocidos como patrimonio natural, científico e histórico de la Nación.

12.-Que resulta altamente de conveniencia nacional y de interés público, promover la observación y profundizar en el entendimiento y estudio de estos hechos y rasgos, así como resaltar la belleza geológica, su valor como patrimonio natural y su potencial turístico y de deleite paisajístico. De la misma manera, tiene un fin educativo, al destacar estos conocimientos relacionados con la historia geológica del país y divulgarlos a nivel comunal, nacional y del mundo.

13.-La preservación de este patrimonio no conlleva la implementación de medidas o prohibiciones adicionales a las ya existentes, ni restringirá el desarrollo de la zona desde el punto de vista turístico y económico.

14.-Que el artículo 50 de la Constitución Política establece la obligación del Estado de defender y garantizar un ambiente sano y ecológicamente equilibrado, existiendo por lo tanto un interés público y un compromiso del Estado de emitir las medidas jurídicas que ayuden a preservar y conservar ese patrimonio, que pasa a ser un bien común de la humanidad. Por tanto,

DECLARATORIA DE INTERÉS PÚBLICO DE LAS ACTIVIDADES TENDIENTES A LA INVESTIGACIÓN, CONSERVACIÓN Y DIVULGACIÓN DE LA PENÍNSULA DE SANTA ELENA, GUANACASTE

Decretan:

Rige a partir de su publicación en el Diario Oficial La Gaceta.

Dado en la Presidencia de la República.-San José, a los treinta y un días del mes de marzo del dos mil once.

Artículo 1 — That the Science and Environment Agenda for the 21st Century, adopted by the United Nations Conference on Environment and Development (UNCED, Rio de Janeiro, 1992) and ratified at the World Summit on Sustainable Development in Johannesburg, 2002, and Resolution No.

Artículo 2 — That geodiversity, understood as geological and geomorphological diversity, is an essential factor that conditions biological, cultural, and landscape diversity.

Artículo 3 — That geological heritage constitutes a natural heritage with cultural, aesthetic, landscape, economic, and/or intrinsic values that must be preserved and transmitted to future generations.

Artículo 4 — That in development planning, the intrinsic values, both material and intangible, of geodiversity, geological heritage, and the geological processes present in natural areas are underestimated and even ignored.

Artículo 6 — That the Santa Elena Peninsula, Guanacaste, is one of the few sites in the world where rocks from the Earth's mantle, which displaced more than 50 kilometers from the depths of planet Earth and whose age exceeds 150 million years, can be observed.

Artículo 7 — That the Santa Elena Peninsula is circumscribed within the Guanacaste Conservation Area, a site declared World Heritage by UNESCO in the year 1999.

Artículo 8 — That scientific advancement has made it possible to deeply study the surface and coastline of the Santa Elena Peninsula, Guanacaste, together with a thick and complete sequence of sedimentary rocks that overlie it.

Artículo 9 — That the fossil reefs exposed on the Santa Elena Peninsula are one of the few remnants of the Tethys Sea, an ancient sea from the Age of Dinosaurs, whose fauna has provided the keys to understanding the origins of Costa Rica and its tectonic context and evolution.

Artículo 3 — Effectiveness.

Artículo 2 — Que la geodiversidad, entendida como la diversidad geológica y geomorfológica, es un factor esencial que condiciona la diversidad biológica, cultural y del paisaje.

Artículo 3 — Que el patrimonio geológico constituye un patrimonio natural con valores culturales, estéticos, de paisaje, económicos y/o intrínsecos que es necesario preservar y transmitir a las futuras generaciones.

Artículo 4 — Que en la planificación del desarrollo se subestiman e incluso se ignoran los valores intrínsecos, tanto materiales como intangibles, de la geodiversidad, el patrimonio geológico y los procesos geológicos presentes en las áreas naturales.

Artículo 6 — Que la Península de Santa Elena, Guanacaste, es uno de los pocos sitios en el mundo donde se pueden observar rocas del manto terrestre, que desplazaron más de 50 kilómetros desde las profundidades del planeta Tierra y cuya edad supera los 150 millones de años.

Artículo 7 — Que la Península de Santa Elena está circunscrita al Área de Conservación Guanacaste, sitio declarado Patrimonio de la Humanidad declarado por la UNESCO en el año 1999.

Artículo 8 — Que el avance científico ha permitido estudiar a fondo la superficie y litoral de la Península de Santa Elena, Guanacaste, junto con una espesa y completa secuencia de rocas sedimentarias que lo sobreyacen.

Artículo 9 — Que los arrecifes fósiles expuestos en la Península de Santa Elena, son uno de los pocos remanentes de mar Tethys, antiguo mar de la Era de los Dinosaurios, cuya fauna ha dado las claves para conocer los orígenes de Costa Rica y su contexto y evolución tectónica.
